Supreme Court Strikes Down DOMA

In what is likely to cause a storm of controversy, the Supreme Court ruled against the 17-year-old anti-gay Defense of Marriage Act:

  • *DEFENSE OF MARRIAGE ACT PROVISION STRUCK DOWN BY TOP U.S. COURT
  • *SUPREME COURT VOTES 5-4 ON U.S. DEFENSE OF MARRIAGE ACT
  • *COURT SAYS MARRIAGE LAW VIOLATES EQUAL PROTECTION GUARANTEE

Kennedy: DOMA "humiliates tens of thousands of children now being raised by same-sex couples"

Scalia: "By formally declaring anyone opposed to same-sex marriage an enemy of human decency, the majority arms well every challenger to a state law restricting marriage to its traditional definition,"

"DOMA is unconstitutional as a deprivation of the equal liberty of persons that is protected by the Fifth Amendment."

 

Full Timeline of Gay Marriage (via Global Post):

Following is a timeline of important events in the history of gay marriage in the United States.

1969

- The modern gay liberation movement unofficially kicks off with the Stonewall Riots, demonstrations by gays in response to a police raid in New York City.

1972

- The U.S. Supreme Court lets stand a Minnesota Supreme Court ruling that the law does not allow for same-sex marriage, and that the issue is different from interracial marriage.

1973

- Maryland becomes the first state to pass a statute banning gay marriage.

1977

- Harvey Milk becomes the first openly gay elected official in San Francisco, winning a seat on the Board of Supervisors. He later appeals to gays to come out and run for office, saying "for invisible, we remain in limbo." Milk was shot and killed in 1978.

1986

- The U.S. Supreme Court says "we are quite unwilling" to find a fundamental right to sodomy, even in the privacy of one's home, in Bowers v. Hardwick ruling.

1996

- U.S. Supreme Court Justice Anthony Kennedy writes an opinion striking down a Colorado ban on protections for gays, saying the ban "seems inexplicable by anything but animus."

- President Bill Clinton signs the Defense of Marriage Act, defining marriage as between a man and a woman for federal purposes.

1997

- Comedian Ellen DeGeneres reveals she is gay. Shortly afterward, her TV situation comedy character says "I'm gay" - inadvertently speaking into an airport public address system.

1998

- Debut of television show "Will and Grace" about a gay man and his best friend, a straight woman.

2000

- Vermont becomes the first U.S. state to allow civil unions for same-sex couples.

- Republican vice presidential candidate Dick Cheney, who has a lesbian daughter, indicates he supports gay marriage, saying "freedom means freedom for everybody" and "people should be free to enter into any kind of relationship they want to enter into." He said states should regulate the matter, not the federal government. Cheney serves as vice president for eight years.

2003

- The U.S. Supreme Court, in another decision written by Kennedy, strikes down Texas anti-sodomy law in Lawrence v. Texas case and reverses the 1986 Bowers ruling. Kennedy writes that this does not mean the government must recognize gay relationships. "Do not believe it," Justice Antonin Scalia dissents, saying the logic of the opinion points to allowing same-sex marriage.

- The Massachusetts Supreme Court rules in favor of same-sex marriage, and gay weddings begin in 2004.

2004

- San Francisco Mayor Gavin Newsom directs the county to allow same-sex marriages, arguing the state's voter-approved ban on gay marriage, Proposition 22, is unconstitutional. The state Supreme Court stops the weddings on grounds unrelated to the constitutionality of marriage.

2005

- U.S. northern neighbor Canada allows gay marriage.

2008

- California gay marriages become legal when the California Supreme Court strikes down the Proposition 22 ban. That November, voters add a ban to the state constitution - Proposition 8 - ending a summer of gay marriage.

2009

- Iowa state Supreme Court legalizes same-sex marriage.

- Federal court challenge to Proposition 8 filed, days before California Supreme Court lets Proposition 8 stand as a valid change to the state constitution. Eventually, federal district and appeals courts agree to strike down the ban, which heads to the U.S. Supreme Court.

2010

- The U.S. Congress passes legislation to end a policy put in place in 1993 called "don't ask don't tell" that had barred gays from serving openly in the U.S. military. President Barack Obama signs the measure. The policy officially ends in 2011.

2012

- Obama becomes the first U.S. president to endorse gay marriage, acknowledging that his views on the matter had evolved.

- North Carolina approves a constitutional amendment to ban gay marriage in May. In November, Maine, Maryland and Washington become the first states where voters approve same-sex marriage, and Minnesota rejects a new ban.

2013

- The U.S. Supreme Court in March hears oral arguments on the constitutionality of California's Proposition 8 and the federal Defense of Marriage Act.

- The Boy Scouts of America organization votes in May to lift a century-old ban on openly gay scouts in a victory for gay rights activists. A prohibition on openly gay adult leaders remains in place.

- Minnesota, Rhode Island and Delaware in May become the latest U.S. states to allow same-sex couples to marry, bringing to 12 the number of states permitting it. The other states allowing same sex marriage are: Connecticut, Iowa, Maine, Maryland, Massachusetts, New York, New Hampshire, Vermont and Washington state, as well as the District of Columbia.

It is framed as a states rights case.  Consider that the lack of federal jurisdiction over marriage may also apply to other issues.  If states have the sole jurisdiction to decide what persons may marry, why would states not have sole jurisdiction to decide who is a person for purposes of abortion laws?

The problem is that there are two "marriages" that get conflated in many people's minds:  1. the religious one that is generally between a man woman as witnessed by God and the community; and the legal one that is a state-sanctioned legal contract beween a man and woman in some states, or two people in others, that conveys a whole slew of rights and benefits.

The underlying issue is to what extent we are a religious state.

Correct. If people will devote all their energies to the 1% of laws that appeal to their particular sensibilities, they ignore the 99% of it that is designed to return us to slavery.

Same deal with legalization of pot. The cry is "Non violent offenders are in prison!", the counter argument that is certain "victimless" crimes are indeed caused by substances including crimes against "self" or those around you. If anybody wants to go down that path, take it further and consider that  there are even more non-violentesque (sic) people in prison cause they screwed up a tax form.

The court is smart. They know they reached too far with Citizens United. This ruling will help to mitigate that. Oh the current and next generation of corporate and tax lawyers will still make fortunes fighting the unravelling of their secular world: where corporations are people, with full rights  and maybe even the "soul" of a human.

... but they are going to lose the unnatural bonuses of never dying, paying taxes or having only fiat currency penalties for their actions. Today is a great day, even if living people are personally biased against homosexuality.

There are a couple of things that I find interesting: the first is identity politics applied to an action. There are homosexual acts. Somehow that made someone "gay" and they all of the sudden fall into different realm of being. Some of the more ridiculous people in American society parallel this to the civil rights movement, ignoring the fact that you can't choose to disclose your race or gender. You can choose to disclose your sexual preferences.

The second thing I find interesting is that "rights" and "human decency" as expressed by the ALMIGHTY SupremeCpurt have been equated with asking for permission (a license) to engage in a private arrangement. What liberty! Though I suppose in the The New Welfare state, the single highest honor that can bestowed upon you are "benefits" and a slight tax reprieve. That's where we're at.

This issue could have been easily finessed by declaring all marriage illegal due to seperation of church and state and then replaced with simple civil union desiginations that have pre-determined rights and obligations under the law for any 2 individuals. Leave the religions alone and don't require marriage through an religious insitution as a prerequisite for a civil union license. That doesn't mean people can't get married but it is seperate. This was never about seperation of church and state but to destroy religion and moral values associated with it. That is what Marxists do. It ain't about respect and finding workable solutions. Any good controlled Marxist social system can't have competing moral systems aka religion to undermine them.

All this decision really did was change the balance of how much the state intrudes into the church instead of the other way around. The Evangelicals had their chance to do the right thing and separate it completely. Morality is not dependent on religion. The only difference between Atheists and Evangelicals is flip sides of the coin. Morality is a sideshow used to distract from the real issue anyways. It is my a god is better than yours, the Marxists who see the state itself as the vehicle of God while Evangelicals see the church as the vehicle of God. In the other corner you have those that believe God comes from within and is reflected out onto the world through actions of each individual (but people like that are the most dangerous and therefore marginalized and minimized the most since they represent the least amount of centralized control, you know like real Christians not faux Christians who have been indoctrinated that the church is source of God's power on this earth as opposed to the individual).

My example was the right way since it pisses off the Evangelicals and Rainbow Coalition all at the same time while keeping true to separation of church and state, Constitutional law along respect for individuals and institutions across the board. That is why it will never happen. I don't see anyone or any group having the balls to challenge the existing marriage laws as unconstitutional in violation of the establishment clause under the 1st Amendment just I don't see Congress doing anything to protect journalism against prosecution for working with whistleblowers and upholding the freedom of press portion of the 1st Amendment either. Morality here is not a matter of religion on these issues. It is a matter of freedom and personal choice.

 

For the record I am an agnostic, my personal beliefs in morality are individual based on actions not on herd behavior. I could care less if 2 guys want gobble, nibble. chew, cornhole each other nonstop, private institutions shouldn't have to recognize it aka a church or private golf club, the government laws are a public insitution so different rules apply. But the idea of religion being a personal institution is probably too revolutionary just like it was 2000 years ago when Jesus was preaching such...... We see how that simple idea was co-opted and perverted to preserve institutional aka centralized power after the fact.

Actions are moral or they aren't in terms of a universal set. Religion is just a subset describer of a group of actions. There are different religions also describing different groups of actions. Are they all right in describing all 'moral actions' or limited only to their subset of actions. It is simple mathematical set theory 101 and the relationship between universal sets and subsets.

Correct on the instersection but the unversal set is of actions (simple case of (a or b) as opposed to (a and b), well within the rules of set theory), lack of action is an action so also part of the universal set. You either act or you don't. Morality is just one describer of that act or lack of it same with religion depending what you group in said subset of actions. Religion and morality are sometimes mutually inclusive sometimes not when used strictly as describers of subsets of actions. Morality as religious people see it is a strictly emotional construct not a logical construct.

To Jesus, the Old Testament was the Sacred scripture.

Christians generally follow Jesus in considering the Old Testament as Sacred scripture, although admittedly, the Apostle Paul rejected much of the Old Testament Law, and many Christians follow Paul instead of Jesus.

Refering only to the Gospels and Ignoring the Old Testament condemnation of Homosexual behaviour is also cherry-picking.

According to the Gospels, Jesus said more than only that Love is the greatest commandment; Jesus also said his purpose was not to destroy the Jewish Law, but to fulfill the Jewish Law.

Love of God was first. Love of God is obeying His Laws; implying obeying the Old Testament laws. 

Jesus preached forgiveness for sinners, but he also said to the sinners, Go, and sin no more.

Paul also preached forgiveness, but not absolute freedom from law, only freedom from some of the law,

including perhaps many verses in Leviticus. .
