Obamacare Employer Mandate, "Shared Responsibility Payments" Delayed Until 2015
How do you know the IRS' government's takeover of the US healthcare system will be a smashing success? It, or rather the mandatory reporting and "employer shared responsibility payments", were just delayed by one year. The sheer and utter chaos and vocal protests behind the scenes for the administration to agree to this unprecedented step (back) are palpable.
Just released by the US Treasury's Blog:
Continuing to Implement the ACA in a Careful, Thoughtful Manner
Over the past several months, the Administration has been engaging in a dialogue with businesses - many of which already provide health coverage for their workers - about the new employer and insurer reporting requirements under the Affordable Care Act (ACA). We have heard concerns about the complexity of the requirements and the need for more time to implement them effectively. We recognize that the vast majority of businesses that will need to do this reporting already provide health insurance to their workers, and we want to make sure it is easy for others to do so. We have listened to your feedback. And we are taking action.
The Administration is announcing that it will provide an additional year before the ACA mandatory employer and insurer reporting requirements begin. This is designed to meet two goals. First, it will allow us to consider ways to simplify the new reporting requirements consistent with the law. Second, it will provide time to adapt health coverage and reporting systems while employers are moving toward making health coverage affordable and accessible for their employees. Within the next week, we will publish formal guidance describing this transition. Just like the Administration’s effort to turn the initial 21-page application for health insurance into a three-page application, we are working hard to adapt and to be flexible about reporting requirements as we implement the law.
Here is some additional detail. The ACA includes information reporting (under section 6055) by insurers, self-insuring employers, and other parties that provide health coverage. It also requires information reporting (under section 6056) by certain employers with respect to the health coverage offered to their full-time employees. We expect to publish proposed rules implementing these provisions this summer, after a dialogue with stakeholders - including those responsible employers that already provide their full-time work force with coverage far exceeding the minimum employer shared responsibility requirements - in an effort to minimize the reporting, consistent with effective implementation of the law.
Once these rules have been issued, the Administration will work with employers, insurers, and other reporting entities to strongly encourage them to voluntarily implement this information reporting in 2014, in preparation for the full application of the provisions in 2015. Real-world testing of reporting systems in 2014 will contribute to a smoother transition to full implementation in 2015.
We recognize that this transition relief will make it impractical to determine which employers owe shared responsibility payments (under section 4980H) for 2014. Accordingly, we are extending this transition relief to the employer shared responsibility payments. These payments will not apply for 2014. Any employer shared responsibility payments will not apply until 2015.
During this 2014 transition period, we strongly encourage employers to maintain or expand health coverage. Also, our actions today do not affect employees’ access to the premium tax credits available under the ACA (nor any other provision of the ACA).?

Wait until restaurants are forced to raise their prices 30 or 40% to offset all of these costs. And thats just restaurants. I now work in Health IT and I can tell you its not only the financial part that is WAY behind, the reporting of everyone's health care records is also a complete disaster.(understatement)
I feel so sorry for all the small health care providers out there that HAVE TO spend big bucks in software in order to comply with the obamacare requirements. If there are any software guys out there looking for a job, learn HL7 processing and you WILL find a job, no problem.
Spot on. 3 years ago I was told by my accountant that I had to pony up $65,000 over the next 6 years to pay for EMR in order to qualify for Medicare payments etc.
So after about a year, my rising overhead and various other government induced screwups made me close my private practice of 16 years. Now I am stuck with $1,334.38 monthly payments on this EMR for several more years.
Next Gen software, along with the dozens of other software companies, lobbied Congress to require implementation of EMR which would expedite and facilitate the exchange of medical information, improve care etc etc.
Of course all these software companies have programs that don't communicate with each other's medical records , at least outside the major medical centers. The day to day exchange of health care information is a mess.
In fact ,I am currently being sued because I could not find copies of a guy's shoulder x-ray , neither the report or the actual x-ray , despite numerous notes on the chart that I, after a long and frustrating search, was unable to locate either the x-ray or the report from a neighboring hospital in NC. In th old days, the hard copy films woujl have been brought with the patient, because there would be no "assumption" that x-rays could be assessed electronically.
Of course, if I ordered new repeat x-fays, then I am determined to be wasteful.
In my opinion, still no harm done, because he needed a shoulder replacement for a bad fracture anyway, but that won't stop an ignorant lawyer in the yellow pages from filing a suit.
Meanwhile, like the banks did with their POS home mortage securitization, Nextgen sold my 6 year contract to Key Bank, NY.
So now, if I want any service from Next Gen, I can't even find a number to call...it's not on their website. And they don't care. "Fuck you doctor, we got our money! " Of course, their software in my opinion was a POS. I even asked the trainer, a big fat slob who sat slouched out in my office with a big wad of chewing rolling off his lip while he played with his cell phone 90% of the time, was this a "Beta system" because it was so unwieldly and crude.
Of course, I am hounded by Key Bank for every cent of the money from the contract after having missed payment deadlines in the chaos that ensued from having to close my practice in NC and relocate, now corralled as an employed surgeon by a hospital, but waiting to feel the first cattle prod jolt. Mooo moooo.
This is just another example of the government meddling. I never in a million years would have bought this software unless the govt had not been putting a gun to my head.
These software companies know that they can sell us a POS because we have to buy something, and have lobbied Congress.
Congress doesn't give a shit about my or the middle class's health care problems, because these enjoy cadillac health care coverage.

Get a lawyer to agree to a fixed fee bankruptcy filing fee and file. You can then stop paying these scumbags for the next year or two, and maybe even 3. Use the money that you would be using to pay them to buy PMs. Keep careful track of their "collection" efforts and if they so much as leave a dot off an I, sue them--each and every time. This will also delay things.
You will probably not "WIN" but will grow your stack of PMs which will probably grow in value over the next few years and the odds are good that the TP, I mean dollar, will implode in that time-frame as well.
