Obamacare Employer Mandate, "Shared Responsibility Payments" Delayed Until 2015
How do you know the IRS' government's takeover of the US healthcare system will be a smashing success? It, or rather the mandatory reporting and "employer shared responsibility payments", were just delayed by one year. The sheer and utter chaos and vocal protests behind the scenes for the administration to agree to this unprecedented step (back) are palpable.
Just released by the US Treasury's Blog:
Continuing to Implement the ACA in a Careful, Thoughtful Manner
Over the past several months, the Administration has been engaging in a dialogue with businesses - many of which already provide health coverage for their workers - about the new employer and insurer reporting requirements under the Affordable Care Act (ACA). We have heard concerns about the complexity of the requirements and the need for more time to implement them effectively. We recognize that the vast majority of businesses that will need to do this reporting already provide health insurance to their workers, and we want to make sure it is easy for others to do so. We have listened to your feedback. And we are taking action.
The Administration is announcing that it will provide an additional year before the ACA mandatory employer and insurer reporting requirements begin. This is designed to meet two goals. First, it will allow us to consider ways to simplify the new reporting requirements consistent with the law. Second, it will provide time to adapt health coverage and reporting systems while employers are moving toward making health coverage affordable and accessible for their employees. Within the next week, we will publish formal guidance describing this transition. Just like the Administration’s effort to turn the initial 21-page application for health insurance into a three-page application, we are working hard to adapt and to be flexible about reporting requirements as we implement the law.
Here is some additional detail. The ACA includes information reporting (under section 6055) by insurers, self-insuring employers, and other parties that provide health coverage. It also requires information reporting (under section 6056) by certain employers with respect to the health coverage offered to their full-time employees. We expect to publish proposed rules implementing these provisions this summer, after a dialogue with stakeholders - including those responsible employers that already provide their full-time work force with coverage far exceeding the minimum employer shared responsibility requirements - in an effort to minimize the reporting, consistent with effective implementation of the law.
Once these rules have been issued, the Administration will work with employers, insurers, and other reporting entities to strongly encourage them to voluntarily implement this information reporting in 2014, in preparation for the full application of the provisions in 2015. Real-world testing of reporting systems in 2014 will contribute to a smoother transition to full implementation in 2015.
We recognize that this transition relief will make it impractical to determine which employers owe shared responsibility payments (under section 4980H) for 2014. Accordingly, we are extending this transition relief to the employer shared responsibility payments. These payments will not apply for 2014. Any employer shared responsibility payments will not apply until 2015.
During this 2014 transition period, we strongly encourage employers to maintain or expand health coverage. Also, our actions today do not affect employees’ access to the premium tax credits available under the ACA (nor any other provision of the ACA).?

It's always every one's responsibility except the ones that never pay and the gubmint that dumped this load of crap on us.
So...the employer requirement goes away for 2014 yet individuals are still required to have Obamacare insurance or else. Sounds like a gimme to businesses to force people onto those $$$ exchanges...permanantely. Am I missing something here?

Many of you are aware of this but some might not be. The more you look and listen the scarier it gets. It is even worse than we think I am afraid.

As a business owner that has always renewed health insurance Jan 1st of every year (like many businesses) we were going to renew on December 1st this year. The insurance companies were all going to allow this and expected it. That would have allowed us (and the insurance companies) to see how the whole exchange process came together and how to best avoid the increased costs going forward. We already know one thing, that since every person will be able to get affordable insurance on their own (I know it is really subsidized by us all through the Fed govt) our company will be changing to providing "single" only, and no longer "family" insurance in order to comply with the law. As a business, providing insurance to employees (and us a business owners also) is paperwork overhead that is best to be avoided. We have enough trouble just trying to stay in business without having to comply with insurance regulations and all other ridiculous regulations that come with actually placing individuals on the payroll.

Hey, do not blame the messenger when I speak the truth.
Our firm already cannot compete using our employees against 1099 workers who are not being provided insurance (nor all other government tax and burden) from what should be their employer. If we cannot compete now when providing lousy insurance that does not comply with the upcoming rules of what is acceptable insurance, we have no choice but the get rid of and/or minimize anyone that might want to be on our insurance plan. Hence just like the government intended, we will all end up on the government plan in very short order.
It is a cluster mess, and we are all going to be in it together... unfortunately.

Not surprised and we may see more delays. You know I agreed with Gartner on this one with the folks running the show not consulting their tech folks and pulled deadlines out of the sky. The insurance exchanges, well I said "Will it Blend"...dealing with COBOL and trying to fifure out out to make it scale will do that..add delays that is...I have been saying for over a year that "the short order code kitchen burned down a few years ago and there was no fire sale"

I'm not being negative at all, just realistic and wish more tech folks would speak up. What are we going to do, waterboard programmers to get them to write code faster...Intuit almost did that with locking developers in a room for a long period of time until they got the code right, and then yesterday, Quicken Health got sold..so didn't work anyway as folks don't want to sit around and use even more software for their healthcare to pay the bills.
We still don't know the status of the federal data hub being built by United Healthcare either and they just said today no more individual policies in California or no exchange participation and in a way they stuck it to HHS...and this insurance company is too big to fail or jail, which ever term you prefer. They left trying to get more business years ago from HHS and went over to DOD to get their big money there, even sued DOD for the Tri-Care contract...been saying this for years, don't trust them as the do everything with models, math and algorithms and they do it well and know how to move money. They own a bank too, Optum bank with over a billion on despotic from health savings accounts. Scary but these guys are running about 80% of the game and the delays are pretty much just government reactions to the company and industry as they don't model very well or at all.
You would think that the big class action law suit to where they short paid doctors and hsopitals for 15 years would still stroke some memories out there and on top of that they licensed their model and collected royalties from Blue Cross, Humana, Healthnet, Aetna and more so they had it coming both ways with money...again trust them...they do models and know how to get your money one way or another.

Thank Snowden for this change in the ACA now instead of September as originally scheduled. All it will take now for the Obama administration to land in really hot water is if Snowden has any secret papers showing that the NSA worked with narco druglords or Chechen terrorists or similar such international murderers.

Where does it say that Obamacare is delayed? It says the employer "shared responsibilty" mandate is delayed, but people still have to pay into Obamacare starting in 2014.

Anyone who buys insurance on their own (individual or family) is going to get reamed, unless they have a fairly low income. Check you state's insurance commissioner's office for filings of your carrier. That is the best way to find out what is in store.
My premiums are slated to double for the most similar plan to what I have now.
My plan is to go without insurance; if something serious occurs, I'll either live (die) with it or go to Thailand or elsewhere for treatment.

Health insurance companies are fleeing California and those that stay will have to raise rates. There are a couple of million illegals that will not pay a dime so the money must come from the rest. Public employee retirees will not be paying either, no current employees. Wait till all those tech millionaires see the tab they must pick up.
