Fact Or Fiction: Obama Administration Proposes 2,300-Page "New Constitution"

Tyler Durden's picture

Submitted by Charles Hugh-Smith of OfTwoMinds blog,

The U.S. Constitution leaves too many areas open to interpretation; a New Constituion of 2,300 pages (+ 200 redacted secret pages) is the solution.

The Obama Administration has proposed replacing the current U.S. Constitution (4,543 words, including the signatures with a 2,300-page "new Constitution" that in the words of an administration spokesperson, "clears up the gray areas in the current Constitution."

The proposal was launched after the success of two recent 1,000+ page pieces of legislation, the Affordable Care Act and the Dodd-Frank financial reform act.

An additional 200+ pages of the "new Constitution" are redacted due to the sensitive nature of the National Security-related amendments.

Lobbyists from key industries were invited to contribute amendments to the new Constitution;" constitutional legal experts were also invited to submit improvements to the current law of the land.

Some critics who have reviewed the 2,300 pages of the proposed "new Constitution" have stated that the document is impenetrable even to those with law degrees. Average citizens "will be unable to understand the laws that govern their lives."

Other observers note that the complexity and length of legislation such as the Affordable Care Act and the Dodd-Frank financial reform act are already beyond the comprehension of all but a handful of experts.

An administration spokesperson defended the proposed re-write on the grounds that "the new Constitution will provide the clarity that people want in their Constitution."

That's "all she wrote."

Once in the golden cocoon, it is apparently easy to see absolutely nothing that is happening outside. I now fully expect a violent coup and the execution of most members of the Federal "government."

Jail 'em. Don't bail 'em. Confiscating everything they stole is a just sentence. Execution would be an easy way out for them, and create more problems than it solves.

A 28-year sentence for the former mayor of Detroit for fraud is a start. Double the sentence if his lawyers have the cheek to appeal.

Most of the country can see that CONgress is mostly made up of grifters, scamming the system, and serving foreign money making first, and the USA last.

Agree with your sentiments. In fact, I have suggested that we put them all--nude--in iron cages in town squares around the country; we put porta-potties atop the iron cages and let the public expel themselves...

Many a truth spoken in jest. If there was some personal accountability for these people, some public shame in what they do, then this country would be better off. Instead, they hide behind legalese, and think their debates are blameless - while they personally are responsible for the maiming, killing, financial ruin of entire generations.

They sit fat and happy in their counting houses, calculating how to spend other people's money and lives, and give themselves a get out of jail free card when they fail or assist traitors.

'Crush the bourgeoisie between the millstones of inflation and taxation,' said Lenin. This CONgress is intent on doing the same, no matter what fig leaf they use to cover their actions.

I think you give them far too much credit for conscious thought: they are automatons, prisoners of their psychopathies. And just as We protect Ourselves from other sick minds by limiting their ability to interact with society, We need sequester these, the most dangerous psycopaths to ever exist--given the tools of mass destruction (The Federal Reserve, nuclear bombs) they have access to--to places where they will never emerge, be it dark iron rooms or buried wooden boxes.

How many innocent People should a damaged organism be allowed to affect before...

The Revolution happened in 1913 with the passage of the Federal Reserve Act and the Income Tax.

It was a bloodless coup. Hardly anyone noticed. Most still have not the clue. You can see that by the vote count. It is sad.

Here's a link to the radio audio track where Mr. Obama (before he was President) described the constitution as flawed and imperfect... but "remarkable."  His justification for what he describes as the founding fathers "blind spot" essentially nullifies the entire consitution because slavery was an accepted practice at the time.  No mention is made that the Declaration of Independence, and the fact that the U. S. Constitution and the concept that "All men are created equal" was a driving force behind the eventual abolition of slavery.  He does mention that it "paved the way", but clearly he believes it is time to pave it over with version 2.0.

The existing consitution is perfectly clear - they just don't like what it says.

I think the constitution is being tested in exactly the way it was imagined it would be when it was written, by the government that got beyond its rightful boundries. It uses old fashioned language, but the sentiment is as relevant as ever. This is a major red flag if it turns out to be more than a rumour.

I would like to see more credible links/references though, to me this post just looks like spam at the moment. So, I would say "Fiction" at this point. Still one day it might be "fact", so it is worth the thought experiment.

As we, the prospective contractees, have been abused so thoroughly throughout history, and particularly during my lifetime, I declare that I do not agree, and never agreed, to a social contract.  I am sovereign.  Whatever anyone says to the contrary is irrelevant; I respect other people's personal sovereignty, unless they have willfully ceded it or refuse to respect mine.  Now, if you want to call that a contract, fine; it's really no more than a code of ethics between individuals.

Even SCOTUS has no respect for the Constitution:

| According to Fox News, Supreme Court Justice Ruth Bader Ginsburg advised the people who are writing Egypt's new constitution to not use the U.S. Constitution as a model. It was a curious statement for an American jurist to make.

Ginsberg is a bare faced liar; taking the oath at home, and undermining it abroad. She serves The Internationale.

"The Internationale" is  celebrated by socialists, communists, anarchists, democratic socialists and some social democrats. It is a worldwide collectivist movement which has failed in every country that it ruled, but the inner Party like Ginsberg and her foreign handlers profit most.

'The truth is the enemy of the State,' declared the Nazi (socialists) propagandists, and their numbers were brought into the U.S. under 'Operation Paperclip'.

Ginsberg and her ilk like Valerie Jarrett are infiltrators, here to ruin the Republic, by fair means or foul.

There were rumors in the 80's & 90's of a plan to enact something powerful to further govern the masses. We know it today as the 'Patriot Act.'

Control the masses. Government in the USA is based on consent by the governed, according to the Constitution and Bill of Rights.

Operation Paperclip imported Nazis into the upper echelons, those educated, useful Nazis who had been supported by ALL central banks, particularly the Bank of England and its monarchy.

Prescott Bush was prosecuted for aiding the Nazis. Interesting that his descendants partied on, much like the Democrat hierarchy, majorly funded by old Nazi Soros who robbed ordinary jews in Germany. The Communist Party of the USA disbanded after deciding that the Democrats had adopted their agenda.

Most of this is unknown by most people because Americans were taught to trust their Constitution, and it's a criminal shame that The Internationale duped them.

2,300 pages?  Hahahaha, silly rabbit.  That is the summary sheet outlining, on one hand (the aye vote), true enlightenment, and, on the other hand (the nay vote), armageddon.  The true proposed Constitution is 1,295 volumes composed roughly of 950 thousand amendments which cover everything from search and seizure protections (i.e., protection of the government's ability to search and seize at will) to mandatory teeth brushing habits (at least twice a day!).  I hear Johnson & Johnson (JNJ) is lobbying hard to include a flossing amendment.

Right. The people (Americans) who a few posts ago were described, rightfully so, as scoring below global standards of education want clarity in their constitution?

The constitution is enormously flawed. First thing it should have stated is: the people shall determine their own currency. Second thing: the people shall never be taxed by the Federal government. Third thing: the Federal government shall be restricted to providing a military for the defense of our borders and our national safety. Forth thing: The military will be funded by the people voluntarily.

And that's all the power the federal government should have been given.

Hence the problem.  Anything will be voted on so the freeshit army and sheeple get a say.  The Constitution was a unique document that attempted to reflect certain values, protections and principles that were defined by a few wise men.

Sure, over 200 years TPTB (who truly hated it) have successfully tempered its original intent and meaning so that now it is a meaningless husk of it's former self.

Still it was a good effort otherwise we would not be discussing it.  E.g, who the fuck in Greater Britain talks about the Magna Carta, individual rights and common law anymore?  They gave up the ghost of resistance a millenia ago.   Just sheep wanting for the Slaughter house.

The global banner of National Socialism marches on..... the 3% in America that say they will stand give me a semblance of hope. Let's see what happens when the day finally comes to stand up and be counted.

The Founders were against a Standing Military as that will have guaranteed the path to a Totalitarian Military Dictatorship.

Gold and Silver need be Lawful Currency and no Bills of Credit issued. After the HYPERINFLATION of the Continental Currency they were well aware that sound money must be based upon something other than Political Whim. If the people were allowed to choose a Currency then what you will get is actually what we have...a nightmare.

The Constitution, if followed, is adequate to safeguard a people from a Government's Tyranny. The problem is that the People were complacent and did not challenge Governmental Intrusions when they happened. Thus, through incremental erosion of Constitutional Rights, is how we have ended up here.

Now we will pay for our Apathy in trusting those whom have proven themselves untrustworthy. There is blood to be shed in sacrifice for the Future Generation's Liberty. Liberty is something which most of us have not ever experienced. We have been enslaved and are under a strong delusion that, somehow, we are free.

It is time to awaken and open your eyes. All is not as it seems.

Its not like the constitution is being adhered to now, with regard to executive orders running amok.

However, EO's are not a new thing - after a little searching I found out that George Washington signed 8 executive orders. John Adams signed 1 into law. Thomas Jefferson signed 4.

I'm going to give these 3 the benefit of the doubt and say with the new constitution and unified country, they tried EO's to smooth over small areas that the constitution whereas later on, the use of EO's just exploded and I can't find a reason why except it seems kind of a slimy way now that we're 200+ years out from the beginning, to make an end run around congress.

That is a really bad way to go. If some ASSHOLE tries to be a hero, and RESCUES you, there is a good chance that you will be BLIND.

I think about checking out daily, hourly, by the minute. Personally I think that the Insulin Overdose is much better, if not a Gunshot...TO THE NECK.

Most try shooting the Skull and many unfortunates live through that...without a Face or some other gross disfigurement. You may twitch while pulling the trigger and allow for an angle so that the bullet ricochets off of the Hard Tissue.

If you target the Neck, it is Soft Tissue so the chances of ricochet are minimal. Furthermore you will strike the large anounts of Large Arteries the feed the Brain and veins which return the blood to the Circulatory System. You BLEED OUT. Unconciousness in no more than 15 Seconds with a subsequent death. There is no time for a Hero (ASSHOLE) to save you.

Many Headshots can suffer for hours without succumbing to the wound. There are many Historical References to Penetrating Head Injuries where the Victim has survived. Target the Neck if you desire to check out by Gunshot.

See the movie, "The Jerk" when the Dog is renamed from Hero to Asshole. They are actually synonyms. It is quite enlightening. You will understand.

Thanks Tall Tom, you're right blind would really suck and your reply was very educational for me. It's replies like that that make me love ZH. Also, to everyone I have a very very dark sense of humor.

Actually, I really would never do it as I've seen the devastation it causes to families when my friend did himself in because he could not find a job. A very selfish act. I still miss him. I went through the exact same thing as he and started a business instead of offing myself. My postman told me that he has seen a lot of suicides on his route as people are just giving up. I got to be the lucky one to tell his brother the news.

Also, with my luck some jobless FSA type would take time away from his Obamaphone on his way to rent his SNAP card for some hookers and blow to rescue me as they'd be losing a tax paying host. He'd probably get the alert on his Obamaphone with info obtained from the panopticon surveillance grid and beamed straight to him right on time.

Please forgive me bankster overlords for my thought crime as I am truly not worthy of your presence. I promise I'll be a good slave and proudly bust my ass for the FSA and your grandson's 16th birthday private island.

The sheer arrogance of these pricks coupled with my skeptical nature disposes me to believe it is possibly true. A new "Constitution" written by corrupt lobbyists, corrupt cronies, and power drunk politicians all of whom are controlled by banksters. What could possibly go wrong?

Plus, they'll just take care of me in the FEMA camp shower.

Doesn't this amount to overthrowing the government?

This is nothing less than treason!

The difference between sedition and treason consists primarily in the subjective ultimate object of the violation to the public peace. Sedition does not consist of levying war against a government nor of adhering to its enemies, giving enemies aid, and giving enemies comfort. Nor does it consist, in most representative democracies, of peaceful protest against a government, nor of attempting to change the government by democratic means (such as direct democracy or constitutional convention).

Sedition is the stirring up of rebellion against the government in power. Treason is the violation of allegiance to one's sovereign or state, giving aid to enemies, or levying war against one's state. Sedition is encouraging one's fellow citizens to rebel against their state, whereas treason is actually betraying one's country by aiding and abetting another state. Sedition laws somewhat equate to terrorism and public order laws.

well there is merit in debate; always will be. Two sides to every argument. Lets see the premises of this.

1° The old constitution is obsolete in defining the frontiers between collecitive rights and responsibilities and individual rights and responsibilities. Understandable, as two and a half centuries later only a moron would suggest that this post industrial age of nuclear and 8 billion humans is the same one as in 1776-1787, pre industrial age and with empty continents.

2° The current situation of USA makes it lead world player and also in the context of world evolution the iconic example of all its problems : too much power, too much elitist wealth, a consumerista model that is taking the world to peak RM and ecological hell; not to mention political armageddon. So the USA needs to clean out its current model of decision making and power play if it wants to stay top dog; all the while conserving the best of the past.

For those who think this debate is too late and too little anyways, and conducted by the prime phonies to save their corrupt necks, there is no hope in addressing this issue. They be part of the "radical" clique in society hell bent on imposing change through "creative destruction", even it be generalised violence. "We didn't create this mess, but we know how to expedite retribution and reset."

I don't doubt there is some truth is this line of thought. But it is not the determining factor. If those who glean power thru crony corrupt systems that neglect the future, cynically affirming "the unborn don't vote", are the problem they cannot be the solution, as in the immortal words of Einstein. Mind sets have to change for real profound change to occur.

But all we have to set in motion this mindset change is the WRITTEN word of our institutions. And the right way to set about changing the world is always to begin at the source of power; where the written word is.

Its a two edged sword this process. But so is human life itself. And we have no other alternative as if you take expeditive measures in closed conclaves, in conspiratorial expeditive fashion all shrouded in secrecy, you kill the nation. You make it look like a patient suffering from memory loss disease. There is no trace left of the whys and hows of how collective decisions are made. No collective trail called History and that is the unkindest cut to civilization : a return to the dark ages, the age of neo feudalism and even beyond  to Julius Caesar's hegemonial rule ad nauseum. To the victors the spoils...

PS : How do you make democracy work when there is total "regulatory capture" as shown here :

Yeah, well the present constitution says that domestic enemy Obama is not a natural born Citizen, and not eligible for the office he holds.

"No person except a natural born citizen, or a citizen of the United States, at the time of the adoption of this Constitution, shall be eligible to the office of President; neither shall any person be eligible to that office who shall not have attained to the age of thirty five years, and been fourteen Years a resident within the United States." A2S1C4

Contrary to what the apologists of the domestic enemy say, the term of art, "natural born Citizen" has a definite meaning from the body of law known as Law of Nations (natural law). Usage of a term of art in a statutory construction adopts the entire body of law from which it came.

Morissette v. United States, 342 U.S. 246, 263 (1952). See also Miles v. Apex Marine Corp., 498 U.S. 19, 32 (1990) (“We assume that Congress is aware of existing law when it passes legislation”).

Law of Nations is the original "common law" of the United States (See Sosa v. Alvarez- Machain, 542 US 692, (2004), see also Kiobel v. Royal Dutch Petroleum, 569 US____ (2013). See also A1S8C10, that Congress shall punish violations of the law of nations.

Law of Nations defines "natural born Citizen as one born in a country to parents who are its citizens.

§ 212. Citizens and natives.

"The citizens are the members of the civil society; bound to this society by certain duties, and subject to its authority, they equally participate in its advantages. The natives, or natural-born citizens, are those born in the country, of parents who are citizens. As the society cannot exist and perpetuate itself otherwise than by the children of the citizens, those children naturally follow the condition of their fathers, and succeed to all their rights. The society is supposed to desire this, in consequence of what it owes to its own preservation; and it is presumed, as matter of course, that each citizen, on entering into society, reserves to his children the right of becoming members of it. The country of the fathers is therefore that of the children; and these become true citizens merely by their tacit consent. We shall soon see whether, on their coming to the years of discretion, they may renounce their right, and what they owe to the society in which they were born. I say, that, in order to be of the country, it is necessary that a person be born of a father who is a citizen; for, if he is born there of a foreigner, it will be only the place of his birth, and not his country". Vattel's Law of Nations, Ch. 19, S. 212

"The Constitution does not in words say who shall be natural-born citizens. Resort must be had elsewhere to ascertain that. At common law, with the nomenclature of which the framers of the Constitution were familiar, it was never doubted that all children born in a country of parents who were its citizens became themselves, upon their birth, citizens also. These were natives or natural-born citizens, as distinguished from aliens or foreigners." Minor v. Happersett, 88 US 162, 167, (1874) emphasis added.

Domestic enemy Obama was born of a British subject father, therefore he is also a British subject and cannot be a "natural born Citizen" of the United States. He can be removed (see Amendment 25) due to "INABILITY", i.e physical or Constitutional disability (see 3 US Code 19, that the "person acting as president" must step down due to inability).

A2S1C4 is a self executing Constitutional provision, i.e no law or statute is necessary to enforce it. Congress is not acting, and is in fact putting forth more non natural born Citizens , i.e Cruz, Rubio and Jindal as candidates for POTUS and VP, though born of non US Citizen parents. It is up to We the people to protect our posterity and drag the treasoners from their offices and hang them in the public square as the penalty of treason.

well I know people who were on assignment as foreigners at the UN. Their daughter born during their duration on post at the UN, in a NY hospital, was AUTOMATICALLY granted US citizenship as someone born on US soil once she had lived for a prolonged duration on US soil at college.

It is the same inn France. Just saying. As for blood rights, if one parent is of local nationality its enough. Not both.

So I think that in Obama's case you are chasing a red herring, IMO.

That guy Terminator couldn't get elected to Potus as he was born in Austria.

You're wrong OBOT. The term is "NATURAL BORN CITIZEN" not "CITIZEN". All natural born Citizens are citizens,  but not all citizens are natural born Citizens. "Citizen" means "member of the nation". "Natural born Citizen" means a citizen born in the country of parents who are its citizens, i.e one with the municipal eligibility to be POTUS per A2S1C4 US Const.

Terms of Art are not defined by the breakdown of their constituent words:

“Words that are not terms of art and that are not statutorily defined are customarily given their ordinary meanings, often derived from the dictionary. In the absence of a statutory definition, we construe a statutory term in accordance with its ordinary or natural meaning.” FDIC v. Meyer, 510 U.S. 471, 476 (1994).

Thus natural born Citizen does not mean "born a citizen".

“[W]here Congress borrows terms of art in which are accumulated the legaltradition and meaning of centuries of practice, it presumably knows and adopts the cluster of ideas that were attached to each borrowed word in the body of learning from which it was taken and the meaning its use will convey to the judicial mind unless otherwise instructed. In such a case, absence of contrary direction may be taken as satisfaction with widely accepted definitions, not asdeparture from them". Morrisette v. United States, 342 US 246, 263 (1952)

OK point taken, the constitution does say "parents" in plural form. And, although the seven original presidents were not born on US soil they qualified due to their patriotic conduct.

But just for the record and as info :

The US Supreme Court is right:

Here are the words of the Wong Kim Ark ruling, which by the way was AFTER Minor v. Happersett. The ruling was six justices to two (one justice did not vote):

"It thus clearly appears that, by the law of England for the last three centuries, beginning before the settlement of this country and continuing to the present day, aliens, while residing in the dominions possessed by the Crown of England, were within the allegiance, the obedience, the faith or loyalty, the protection, the power, the jurisdiction of the English Sovereign, and therefore every child born in England of alien parents was a natural-born subject unless the child of an ambassador or other diplomatic agent of a foreign State or of an alien enemy in hostile occupation of the place where the child was born.

Fri, 10/11/2013 - 13:55 | 4045891 MickV
MickV's picture

Wrong again. That quote is dicta about natural born SUBJECTS, not natural born CITIZENS (citizens can become President, subjects cannot). The holding of the case is on pg. 693 of Wong Kim Ark where it talks about LEGAL resident aliens coming under the jurisdiction of the United States by the natural law concept of "habitation"(i.e legal habitation creates alegiance to the host country as long as the resident is present in country). The children of those legal residents also come under the jurisdiction of the US, thus they are "born Citizens" (naturalized by the 14th Amendment), however they are not "natural born Citizens, since their parents are not US Citizens.

"and his child, as said by Mr. Binney in his essay before quoted, "if born in the country, is as much a citizen as the natural-born child of a citizen, and by operation of the same principle." Wong Kim Ark, 169 US 649 (1898)

That is the holding of the case, i.e that WKA is a citizen (naturalized by the 14th Amendment) because his parents were legal residents.

"The evident intention, and the necessary effect, of the submission of this case to the decision of the court upon the facts agreed by the parties were to present for determination the single question stated at the beginning of this opinion, namely, whether a child born in the United States, of parent of Chinese descent, who, at the time of his birth, are subjects of the Emperor of China, but have a permanent domicil and residence in the United States, and are there carrying on business, and are not employed in any diplomatic or official capacity under the Emperor of China, becomes at the time of his birth a citizen of the United States. For the reasons above stated, this court is of opinion that the question must be answered in the affirmative". Id @705

The only thing decided was that WKA was a "Citizen" or a member of the nation, not that he was a natural born Citizen, and we already know that "citizen at birth" is not natural born Citizen.
