Administration Enforces Radiosilence On Obamacare Enrollment Numbers

Tyler Durden's picture

During this morning's Congressional hearing on the failure of Obamacare, one of the developer's let slip a little too much truth:

While the self-proclaimed 'most transparent' administration fights off the French and the German over spying 'lies', and gags insurers from publicizing how many people have signed up for Obamacare, it seems the cover-up goes even further with everyone involved silenced (for now).

The CGI's statement confirms more evidence of the administration hiding the truth as InForum noted recently:

Feds ask Blue Cross Blue Shield not to release exchange numbers

The Obama administration asked North Dakota’s largest health insurer not to publicize how many people have signed up for health insurance through a new online exchange, a company official says.

During a Monday forum in Fargo for people interested in signing up for coverage via the exchange, James Nichol of Blue Cross Blue Shield of North Dakota told the crowd his company received the request from the federal government earlier Monday. Nichol is a consumer sales manager for the company.

Still, a spokeswoman from Blue Cross Blue Shield says about 14 North Dakotans have signed up for coverage since the federal exchange went live Oct. 1. That brings total statewide enrollment to 20 – less than one a day.

we *know* that the enrollment numbers are high

how do we know?

because we the people elected the lawmakers who voted for this legislation

it was a mandate

from we the people

because we have been clamoring for compulsory insurance

and that is why we are signing up for it

in droves

Many sources that say: Total Bankster/Corp. Bailouts foreign and domestic equaled 16 trillion$ over the last five years.

But that 3.7 Trillion$ (approx.) in the last 5 years for Welfare is far more important or the 6 Billion$ on this subject.

Not to mention the Trillion$ that have been poured into the MISSC(SS = Security State) in the last decade...Justified by the lies of 9/11.

Funny how outrage works isn't it?

Because they say so, thats why!

Can't you see that people, being forced under threat of IRS sanction, are crashing this brand new, gleaming Amazon/Google-like, 600 million dollar, un-affordable health care crisis thing-a-mah-jiggy because they don't want to go to jail, where their healthcare needs would certainly be provided for frrreeeee!

Krugman says its just a demand problem, overwhelming the supply of rocks, for the breaking windows that didn't need to be broken and were perfectly functional that needs to be solved now...then its all clear sailin ;-)

AlaricBalth's picture

What's up nmewn?

I have read the only means of sanction the IRS can utilize when collecting a penalty for non-enrollment is the garnishment of the fine from an individuals income tax refund.

"Unlike other taxes and penalties, the ability of the IRS to enforce and collect the mandate tax is constrained. Under § 1501(g)(2) of the ACA, the agency is precluded from using its traditional means of collecting fines and back-taxes. The law provides that those facing the penalty “shall not be subject to any criminal prosecution or penalty” for nonpayment. Moreover, liens and levies cannot be placed on the property of the uninsured. Therefore, the only means of collection at the IRS’s disposal is the garnishment of the uninsured person’s income tax refund. This narrow window affords intuitive would-be tax-avoiders the opportunity to flout the system."

http://americanactionforum.org/weekly-checkup/loophole-gives-uninsured-w...

I haven't had a refund since the 80's so to hell with them.

Edit: from US code ACA 1501(g)(2)
(2) Special rules
Notwithstanding any other provision of law—
(A) Waiver of criminal penalties
In the case of any failure by a taxpayer to timely pay any penalty imposed by this section, such taxpayer shall not be subject to any criminal prosecution or penalty with respect to such failure.
(B) Limitations on liens and levies
The Secretary shall not—
(i) file notice of lien with respect to any property of a taxpayer by reason of any failure to pay the penalty imposed by this section, or
(ii) levy on any such property with respect to such failure.

You have to admit, this is a particularly Chicago-style brazen, out the backdoor cronyism is one thing. In your face "I'm a dictator and will decide patronage based on my executive privilege & regulatory enforcement" is another.

I think its time for the House & Senate to have their own standing armies too.

That should settle "law" once and for all ;-)

Hey there Alaric...just surviving on this end, beats the 50-50 shot with the alternative.

Yeah, thats the way I understand it too. They confiscate any overage you pay in federal income tax. Isn't that touchy-feely, Big Brothery watchin after your best interests (for them) type stuff all over again?...lol.

Like you, I run it down to the very nub & under, usually paying THEM every tax return, anywhere from $100 to $1,500, they can wait for their payday, just like me and everyone else.

If the "law" stays in force it will be amended in the future (just like every other law) to where they will lien your property or garnish your wages or seize it from your bank account...of this I have no doubt. They tied it to the IRS for enforcement...again...very touchy-feely. Our children can look Forward! to a century of amendments to this.

At least we've finally put to bed the old statist/elitist canard that taxes are "voluntary". And I have never done tribute very well either...I find it revolting ;-)

I think that 30,000 number was floated in NY, and the truth was something like 70% of that was enrolled in Medicaid, which really is just a side part of 0zer0care because it is administered by the state. So those people really signed up on a state run site, not the 0zer0care site. The truth is probably much closer to the 14 N.Dakota figure. If people were signing up in droves, then the lamestream media would have no trouble rounding up anecdotal examples to plaster all over the news 24/7. Likewise, 0zer0 wouldn't have needed a fake pregnant fainter as a prop to his 0zer0care ShamWow commercial. He would have had REAL success stories as examples. The fact that neither is happening shows this is just a first class govt clusterfark. Oh, BTW, there is another number floating out there as well. Some 16 million can expect to see their healthcare plans cancelled because of 0zer0care. So much for "If you like your plan, you can keep it." Better get that website fixed PDQ... the hole is getting bigger everyday.

If they were smarter, and they aren't, they just should have enlisted Fuckerberg to have enrollment done as a prerequisite to using Facebook(US).  That would have precluded spending more than $1/2Bn BennyBucks on a new site which doesn't work and has no value whatsoever but at least gotten their numbers up. Then again, the exodus from FB would have cost Fuckerberg another bundle in stock value when millions dropped it. Eh, it's only taxpayer money and more debt...

Basically they are calling him a tit sucker for doing what any family that can get spousal coverage would do regardless of who they work for.

It is called household budgeting and finance that people who live in the fucking real world have to deal with.

Progressives are fucking idiots.

"Of course there's a cost to taxpayers," Kleinbard told HuffPost.

As with any family on employer-sponsored coverage, Heidi Nelson Cruz's health insurance essentially functions as untaxed income. Rather than pay her an additional $20,000 in salary, Goldman compensates her just as much through her health plan, which the Cruz family won't have to pay taxes on.

Assuming the Cruz family falls into the highest tax bracket -- generally a safe assumption for a Goldman managing director -- Kleinbard, like the economist Dean Baker, estimates that the $20,000 Goldman plan amounts to about $8,000 in taxes that the general public won't see.

"Instead of getting compensation in cash and then shopping for insurance, they're getting an $8,500 federal subsidy," Kleinbard said. "If Goldman said, 'Here's cash, go buy your own policy,' that would cost them $8,500 in federal taxes. By structuring it this way, Goldman has saved them $8,500."

Just trying to sort through the statist mindset & pretzel logic gives me a headache.

The "cost to taxpayers" is...exactly zero.

The loss of tax revenue to the federal government is $8,000-$8,500, if they can ever decide on an exact figure.

Here's an idea, let's TAX GOVERNMENT EMPLOYEES on the value of their healthcare subsidy (which is twice the cost to federal government per employee according to some HuffPo cock smoker's "definition").

At some point these fools need to slapped upside the head like dumb-ass useless bitches they are.

The "cost" is the amount the employer PAYS not the amount of "benefit" the employee RECEIVES. They are different amounts. Anyone who does not understand this belongs on the bottom of the social pyramid.

Unfortunately, and particularly when talking about US employees- their COST ALWAYS EXCEEDS THE BENEFIT and usually does so by at least five figures.

Rant over...

Step 1:  Implement a plan which is not single payer to pander to the middle.

Step 2:  At roll out, fuck it up and piss people off so they cant get coverage.  Make people pay the "fine" for zero coverage and waive to fine for your voting block.

Step 3:  "Save the day" with a single payer plan which increases the "penalty" on non-enrolled as well as non-approved plans.

Step 4:  Implement a new tax which applies across the board for everyone and implement complete single payer.

Those that have been immunized, never had the flu and thus have no natural immunity are screwed. I'll take my chances with the flu until I'm 65 or so, then take the vaccine. Those alive long enough ago to have been exposed to the 70s swine flu did better with the most recent iteration (admittedly a pussy by flu standards)

They can not garnish wages, they can not put a lien on your property...

They can only take the fine from your TAX REFUND.

"However, it is not subject to the enforcement provisions of subtitle F of the Code. The use of liens and seizures otherwise authorized for collection of taxes does not apply to the collection of this penalty. Non-compliance with the personal responsibility requirement to have health coverage is not subject to criminal or civil penalties under the Code and interest does not accrue for failure to pay [the fine] in a timely manner." Therefore, the only way that they can collect the penalty or the fine is by taking money from your refund.  If you are not owed a refund, they cannot get money from you.  They can't issue a lien.  They can't garnish your wages.  They can't use any of the normal procedures available to them if you owe them money, even though the Supreme Court has said it's a tax.  So for those of us -- I mean, folks, I'm in fat city.  I'm in fat city because I always structure to where I owe money.  Well, not entirely.  There have been years.  But if you structure your taxes so that you do not get a refund, you do not have to buy insurance and you do not have to pay a fine 'cause they can't collect it from you if you don't have a refund due.  And that is just another nail in the coffin of Obamacare imploding on itself."

Thanks for that tip off, Duc888. I live in Massachusetts, the first plank of this un-Affordable Care Act which came here first, and it is enforced under threat of being illegal if one does not comply. This is riches for the insurance company and their DC lobbyists, of course. But it is intimidating for law-abiding people, like me.

Now I will make the time to opt out after researching whether your comment applies in MA.

Another way this scam works: most people who can afford to pay for their health insurance are much too busy earning a living to get involved in the minutae of bureaucracy, unless provoked.

Now, I am provoked. The scam ends for me pronto.

I saw this on Limbaugh's website too.  The only caveat was brought up by a listener and is recorded on the transcript...the problem with this is that they aren't obeying their own law.  Obama is making adjustments as he goes, and the HHS Secretary has what amounts to a blank check in regard to shaping the law (which is written in as part of the law).  So yeah, they'll take it from you however they want when it comes to actual practice.  These Marxists are pissing on the law left and right; the Rule of Law means nothing to them.

Although I was never a fan of the ACA, it does not strike me as completely valid that problems with the website, even if it took a few months to work out the kinks, were fatal to the concept. However, it occurs to me that something new may be happening. Is it possible that the administration has totally miss-understood the potential market for health insurance? That even if these ACA websites worked perfectly, that the amount of uninsured signing up for new insurance is but a fraction of what the govt estimated? The ACA plan was written by people who do not as a matter of idealogy believe in the free-market definition of supply & demand. Many of the new policies appear to have very high deductibles, so that after paying say, $6,000 per year for insurance, the mark then pays the first $8,000 or so of medical cost before the insurance kicks in. Why else is the govt so determined not to reveal sign-up numbers?

Rep.  Joe Barton (R-Tex.) grilled CGI’s Campbell on a warning on the Web site that information visitors entered into the system would be subject to greater disclosure than the medical forms Americans typically fill out. That information is protected under the Health Insurance Portability and Accountability Act (HIPAA), a privacy law.

“Are you aware this was in the source code? Do you think that’s HIPAA compliant?” Barton asked. “Admit it! You're under oath.”

“Sir, that is CMS’s decision to make,” she replied, referring to the Centers for Medicare and Medicaid Services, the agency within the HHS that is overseeing  implementation of Obamacare.

“We're telling every American if you sign up for this, or you even attempt to sign up, you have no reasonable expectation of privacy,” Barton said. “That is a direct contradiction of HIPAA, and you know it.”

“That is a CMS call,” Campbell said. “That is not a contractor call.”
