Senator Bernie Sanders Asks NSA If It Spies On Congress

From VT Senator Bernie Sanders:

U.S. Sen. Bernie Sanders (I-Vt.) today asked the National Security Agency director whether the agency has monitored the phone calls, emails and Internet traffic of members of Congress and other elected officials.

 

Has the NSA spied, or is the NSA currently spying, on members of Congress or other American elected officials?” Sanders asked in a letter to Gen. Keith Alexander, the NSA director. “Spying” would include gathering metadata on calls made from official or personal phones, content from websites visited or emails sent, or collecting any other data from a third party not made available to the general public in the regular course of business?”

 

Sanders said he was “deeply concerned” by revelations that American intelligence agencies harvested records of phone calls, emails and web activity by millions of innocent Americans without any reason to even suspect involvement in illegal activities. He also cited reports that the United States eavesdropped on the leaders of Germany, Mexico, Brazil and other allies.

 

Sanders emphasized that the United States “must be vigilant and aggressive in protecting the American people from the very real danger of terrorist attacks,” but he cited U.S. District Court Judge Richard Leon’s recent ruling that indiscriminate dragnets by the NSA were probably unconstitutional and “almost Orwellian.”

 

Sanders has introduced legislation to put strict limits on sweeping powers used by the National Security Agency and Federal Bureau of Investigation to secretly track telephone calls by millions of innocent Americans who are not suspected of any wrongdoing.

 

The measure would put limits on records that may be searched. Authorities would be required to establish a reasonable suspicion, based on specific information, in order to secure court approval to monitor business records related to a specific terrorism suspect. Sanders’ bill also would put an end to open-ended court orders that have resulted in wholesale data mining by the NSA and FBI. Instead, the government would be required to provide reasonable suspicion to justify searches for each record or document that it wants to examine.

I really do believe that this will rattle the lot of them.  I think that their collective asses are on the line if they don't push back on the NSA.

The entire world knows what a joke the US and its spying is (well, not as humor per se).

Congress has been around for a LONG time, it's an essential tool for TPTB.  The NSA?  It can be rid of to surface as something else, just as has been the case for quite some time (this is not new shit, people!).

Again, it's a pretty simple and direct question.  Had Ron Paul asked it everyone would be fawning over it and calling it brilliant.

Sigh... glad to see that someone else is frustrated that this has come down to nothing more than a name-calling, social gossiping "discussion."

Don't you know that only Ron/Rand Paul can speak these same words and not be ridiculed (and people believe that if these messengers spake it that it would be so, and God would then have it).  Since neither are uttering those words we'll just have to feel that they're doing good work through pictures of them...

Anyway, back to discussions that have some actual actionable content... Do you know for sure that merely writing a letter such as this gets it "on the record" (in the Congressional Record)?  If it doesn't, then perhaps someone like Rand Paul can reference it in a congressional session and get it entered as such? (let's put aside the "fact" that that would be blashemous to have a "libertarian" reference something in support of what some "socialist" mentioned and game theory it)

No, the letter would not automatically become a part of the Congressional Record.  

It would have to be read/discussed during a Congressional session, or be formally entered as a part of a Congress members Extension of Remarks, or be a part of a Committee meeting where it would be entered in the Daily Digest.  These are the ways things become a part of the official Congressional Record.

Let's see what happens.

The obvious question, and one that apparently eludes all of these elected fucktards, is why the NSA is not reporting and directly responsible to the ELECTED REPRESENTATIVES OF THE CITIZENS OF THE UNITED STATES? I mean who the fuck is driving this bus? Doesn't anyone want the answer to this question? If the NSA doesn't report to the Congress then who the fuck controls them and their mission? Who decides who gets spied on? Who decides what happens to this information. This has shadow government written all over it. But, apparently this concept is way beyond the ability of Bernis Sanders to conceive it. He just wants to know if HE is getting spied on and pretty please leave us alone.

Sanders' questions aren't driven by curiosity, but, IMO, as a means to set Alexander & Co up for eventual  prosecution.  I hope, anyway.

I'd have liked for Sanders to have asked: "Given that the NSA has been and is assembling vast 'profiles' on US citizens, and given that these citizens fund the NSA and the NSA works for these citizens, is there any reason the NSA cannot or should not be compelled to comply with any request by said citizens to receive full access to their own full profiles"?

The interesting thing is, Sanders is a full on socialist.  If this was about imposing a socialist society then one would think he'd be down with the program.  Since he is apparently not down we can conclude it isn't about socialism.  Whew, that only leaves every other vile plot known to humanity but at least we don't have to worry about socialism.

Well, without having a basis in which to anchor your legislation to (flag to rally around) you're not going to get there.  So, the point misses the mark...

Staking something like this letter in the sand then provides others to grab as their picket pin.  Who knows, maybe someone like Rand Paul will do something with it (outside of election or budget time)?

Again, I find this letter to present a lot of fun for constiuents to ask their congressperson whether he/she is OK with being spied on how long do they think before the NSA exposes their dirty secrets.

McCarthy essentially got clubbed for being a threat to folks in Congress (when it became clear that it became serious when it was no longer regular folks that were being hauled through the muck).

It is not like they follow the laws anyways. You don't have to when you a spying apparatus like that. Sanders can chirp all he wants nothing is going to change when they can indiscriminately leverage that apparatus to apply pressure to affect outcomes in their favor. And in the instances where they can't they just kill you if you become too much of nuisance. This is going to take ALOT more than compromised self interest first blow hards paying lip service to fix this problem.

There is a reason why things are firewalled in the first place like domestic and foreign, investment and savings, etc. These assholes and not just the NSA it includes all them including Mr. Sanders there have systematically removed them all. It is beyond simple legislative fixing at this point.

Why ask the obvious?  Here is indisputable proof that the NSA spies on Congress from the agreement the Obama administration signed with Israel handing over all data collected on Americans to Israel without any legal requirements in March 2009:

The most extraordinary passage in the memo requires that the Israeli spooks “destroy upon recognition” any communication provided by the NSA “that is either to or from an official of the US government.” It goes on to spell out that this includes “officials of the Executive Branch (including the White House, Cabinet Departments, and independent agencies); the US House of Representatives and Senate (members and staff); and the US Federal Court System (including, but not limited to, the Supreme Court).”

The stunning implication of this passage is that NSA spying targets not only ordinary American citizens, but also Supreme Court justices, members of Congress and the White House itself. One could hardly ask for a more naked exposure of a police state.

I am no longer amazed by this sort of thing but I was amazed that the American press basically ignored both of these aspects.  I'm not saying its some vast media conspiracy, just that news editors seem to not want to touch it if it involves Israel looking bad.

It is not just Israel. Before the firewalls were taken down all the spy agencies had agreements to spy on each other's countries communications. The Canadians intercepting US cell phone communications, etc. The only difference was that information couldn't be used in a court of law domestically. Now with the faux war (no declared domestic enemies) on terrorism they've basically turned the US in foreign battlefield with the citiizens as the undeclared domestic enemies. This is why we have fucking laws and protections that are supposed to be clear absolutes above courts for this very reason. If they are not enforced then we might as well stop making any pretenses on all sides because we in essence have no functioning federal justice system.

Our laws are based on precedent so even if they stomp all over the constitution, if the chicken shit people we elect to protect and defend the constitution are afraid that if they speak up they might not win their next election, we have no legal defense. The constitution has no defenders, least not ones who's oath of office is to do so. SCOTUS has now become a social litmus system that interprets our constitution and its guaranteed freedoms based upon how effective the media has been in convincing us we need neither.
