Supreme Court May Move To Rein In President Obama's Trampling Of The Constitution

It would appear that there is even a limit for the Supreme Court as to what they will allow President Obama to get away with:

  • *OBAMA'S RECESS APPOINTMENTS QUESTIONED BY U.S. SUPREME COURT

As Bloomberg reports, justices across the ideological spectrum questioned whether President Barack Obama complied with the Constitution when he appointed three members of the National Labor Relations Board during a Senate break.

 

Via Bloomberg,

U.S. Supreme Court justices suggested they may curb the president’s power to make temporary appointments without Senate approval, as the court took up a constitutional standoff between the White House and congressional Republicans.

 

Hearing arguments today in Washington, justices across the ideological spectrum questioned whether President Barack Obama complied with the Constitution when he appointed three members of the National Labor Relations Board during a Senate break.

A company facing NLRB sanctions, backed by Senate Republicans, says the chamber wasn’t in a recess when Obama made the appointments. Several justices today suggested they accepted that characterization.

“It really is the Senate’s job” to determine whether the chamber is in recess, said Justice Elena Kagan, one of Obama’s two appointees to the high court.

The case also may affect 1,000 decisions and orders issued by the NLRB since January 2012, when Obama made the appointments.

Wow, all the Anti-Obama postings on this and only a couple of people that looked deeper into the matter.

The Senate, held by Republicans, orchestrated a sham by opening and closing the Senate every few days while conducting NO BUSINESS at all.    30 seconds a day, every 3 days, to show that the Senate was NOT in recess.

Meanwhile, the majority of Senators were nowhere near Washington DC during the weeks that they perpetrated this scam, happily collecting their paychecks for vacationing at home.

The Question before the SUPCO is whether the Senate was in Recess or not, which affects whether the President can fill vacancies that the Senate refused to consider, despite the fact that the vacancies resulted in boards being unable to function due to the lack of a quorum.

Also to be considered, whether the President, of whichever party holds the WH, can make appointments of long standing vacacies or if the vacancy has to occur during the Senatorial Recess.

All the above ava at NPR and a variety of other sources.

Hey, dumbass, under the Constitution of the United States, the Senate decides when it is in session, not the president, period. The president cannot declare the senate in session, or dissolve the senate at will. Under your thesis, the president controls the agenda of the senate, or you simply do not care about law because you want Obama to be your dictator. 

But the most truly obvious indicator that you are a dumbass is that the Republicans have NEVER held a majority int he senate while Obama has been in office. You are a bafoon of high order, and a dangerous one at that who would grant the president the power to dissolve the senate. And yes, giving him power to to decide when the senate is and is not in session gives him the power to dissolve it. He can simply claim it is not in session when ever it pleases him to do so.

For example, let's say the senate is poised to remove the president from office - opps, no problem, the president can just declare the senate is not in session anymore. And any opinion from the supreme court that give the president any perogative to decide when the senate is or is not in session, in in limited fashion, is a step in the direction of tyranny. The march occurs step by step, measure by measure.

This 'could' be an issue if the Senate still had filibusters, but Obama and Reid took that away too.  Now a straight 51 vote Democrat majority could put any appointed positions back in power without even having a hearing.  I'm just waiting for the political winds to blow the other way, and smile when the national media and Democrats wail about what a Republican President and 51 vote Republican Senate can do...  or undo....

I'm really getting tired of "stupid" in politics and relying on lawyers for text interpretations when code runs and does what ever it wants, most lawyers can't break out out of interpreting text and see how it works with code. 

I couldn't help myself, state of of Minnesota, insurance exchange problems..who do they ask for advice to find a new contractor...Silly Sebelius...who does she recommend, United Healthcare..duh? What they heck?  What a person to ask with such expertise that we saw with Healthcare.Gov..right...

Anyway this makes for a good story as the state dumped their original contractor Maximus in May of last year, the nobody knew what they were doing.  Ok so the news is talking about back in 2007 that Maximus (which is an insurance company too) got hit with a fine of $30 million for medical fraud. 

Well, la te dah, there was another big fine levied that year..against a CEO and company to tune of $458 Million and more...as far as I know it still stands as the largest derivatives fine on record as the CEO and other executives of the company were back dating stock..even the SEC had no problem identifying it..but the news articles focus on the Maximus $30 penalty and don't mention the other one...United Healthcare...who Sebelius recommended to call in to fix their problems..stuff that makes you go hmmmm...

If we are going to dig out fines from 2007 for all involved, well let's get them all out there if a company's history is going to be referenced:)

So case in point this this post...where did they lead to financial gain I think...and how much more legal costs do we want here?  Banks love this stuff as it distracts everyone from where the focus should be with nonsense like this..or we can go back and make Christie's bridge front page news again...lol...oh the disruptions on meaningless efforts.  Again I'm getting so tired of "stupid disruptions" that the news plays out to be some kind of big issue...Sebelius Syndrome lives on..

It doesn't have to be by "IMPEACHMENT", it could be by operation of the 25th Amendment, sec. 3 and 4, and by the statutory framework of the 25 Amendment, 3 US Code 19, which contemplates the removal of "THE PERSON ACTING AS PRESIDENT" due to "INABILITY" (i.e. mental physical or CONSTITUTIONAL DISABILITY). See also the original 12th Amendment, which contemplates the removal of the President due to "CONSTITUTIONAL DISABILITY", and was replaced by the 25th Amendment.

It appears that Tyler Durden and Bloomberg have both joined the congressional obstructionists in denying the president his normal prerogatives in making appointments.  The number of Obama nominations that have been blocked by congressional obstructionists and extortionists has reached an all time record.  Time was when a sane congress accepted the president's right to make appointments, even when they disagreed with them.   No one has taken the matter of recess appointments to the Supreme Court before.  It just demonstrates the extreme some folks will go to when they don't get their way.

polarization was passive at times in american politics, but not the norm? there always has been a healthy partial separation regarding our political spectrum on a somewhat finite timeline, but wars and depressions coalesced the country back into a unified entity. sadly, the polarization we see in the country today is irrevocable. bringing about a total complete destructive separation. the fear of a depression coming about will surely be the prerequisite too wwiii! the plane of time will be separated by a nuclear reaction for the fledgling nuclear family-- now, minutes past three scores three years,... young?!?
