The Senate, held by Republicans, orchestrated a sham by opening and closing the Senate every few days while conducting NO BUSINESS at all. 30 seconds a day, every 3 days, to show that the Senate was NOT in recess.
Meanwhile, the majority of Senators were nowhere near Washington DC during the weeks that they perpetrated this scam, happily collecting their paychecks for vacationing at home.
The Question before the SUPCO is whether the Senate was in Recess or not, which affects whether the President can fill vacancies that the Senate refused to consider, despite the fact that the vacancies resulted in boards being unable to function due to the lack of a quorum.
Also to be considered, whether the President, of whichever party holds the WH, can make appointments of long standing vacacies or if the vacancy has to occur during the Senatorial Recess.

The president cannot declare the senate in session, or dissolve the senate at will. Under your thesis, the president controls the agenda of the senate, or you simply do not care about law because you want Obama to be your dictator.
But the most truly obvious indicator that you are a dumbass is that the Republicans have NEVER held a majority int he senate while Obama has been in office. You are a bafoon of high order, and a dangerous one at that who would grant the president the power to dissolve the senate. And yes, giving him power to to decide when the senate is and is not in session gives him the power to dissolve it. He can simply claim it is not in session when ever it pleases him to do so.
For example, let's say the senate is poised to remove the president from office - opps, no problem, the president can just declare the senate is not in session anymore. And any opinion from the supreme court that give the president any perogative to decide when the senate is or is not in session, in in limited fashion, is a step in the direction of tyranny. See also the original 12th Amendment, which contemplates the removal of the President due to "CONSTITUTIONAL DISABILITY", and was replaced by the 25th Amendment.
