What Constitution? Obama To Emphasize Intention To Use Unilateral Presidential Authority

While the stats of the union remain unremarkable at best, it would appear that despite the rancor in Washington, President Obama will get his way "whatever it takes." As the WSJ reports, the State of the Union address Tuesday night will emphasize his intention to use unilateral presidential authority — bypassing Congress when necessary — to an extent not seen in his previous State of the Union speeches. "We need to show the American people that we can get something done," Dan Pfeiffer, a senior White House adviser, told CNN; it seems no matter how totalitarian and unconstitutional it would appear to be.

President Barack Obama's State of the Union address Tuesday night will seek to shift the public's souring view of his leadership, a challenge the White House sees as critical to shaping the nation's policy direction over the next three years.

 

Mr. Obama will emphasize his intention to use unilateral presidential authority—bypassing Congress when necessary—to an extent not seen in his previous State of the Union speeches, White House officials said.

Mr. Obama will stress that he intends to take unilateral action on a host of other issues: infrastructure development, job training, climate change and education. Administration officials hinted broadly at the assertive new direction Sunday.

 

"We need to show the American people that we can get something done," Dan Pfeiffer, a senior White House adviser, told CNN as part of a round of interviews previewing the speech.

 

The more aggressive, executive-led approach marks a recalibration by the White House after seeing how congressional Republicans responded in 2013 to the president's re-election, a senior administration official said. Several key White House initiatives stalled in Congress last year, including an immigration revamp, an increase in the minimum wage, gun-control legislation and economic proposals.

"He says, 'Oh well, it's hard to get Congress to do anything.' Well, yeah, welcome to the real world. It's hard to convince people to get legislation through. It takes consensus," said Sen. Rand Paul (R., Ky.). "But that's what he needs to be doing is building consensus and not taking his pen and creating law."

 

Sen. Chuck Schumer (D., N.Y.) said in an interview that Mr. Obama's speech wouldn't present "a grandiose agenda. It's going to be a very practical agenda aimed at middle-class people."

One big agenda item is apparently a "pledge" to hire more by US companies...

He also is expected to announce that some of the nation's largest employers, have signed a White House pledge agreeing not to discriminate against the long-term unemployed when making hiring decisions, according to a draft of the policy and interviews with several people familiar with the matter.

But the corporate hiring pledge also shows the limits of executive power. Under the nonbinding agreement, companies won't be obligated to hire the long-term unemployed, and it is unclear how the administration will monitor progress.

More lip-service, more class-warfare, more totalitarianism... just what we need for 'growth'... It does make one wonder if the surge in t-bill yields around the debt-ceiling dates are indicative of some reaction by the Republicans to this aggression?

Anyone cheering Obama's use of executive order, by passing congress probably should think of how it's going to look when the next president comes to power and they don't happen to align to your notion of the way things should be. The groundwork he lays will just empower the next and the next and in a few more elections we will have a true dictator.

For any society, whether a chiefdom or a state, one has to ask: why do the commoners tolerate the transfer of the fruits of their hard labor to kleptocrats? This question, raised by political theorists from Plato to Marx, holds true in modern elections. Kleptocracies with little public support run the risk of being overthrown, either by downtrodden commoners or by upstart would-be replacement kleptocrats seeking public support by promising a higher ratio of services rendered to fruits stolen.

So, what does an elite do to gain popular support while still maintaining a more comfortable lifestyle than commoners? Kleptocrats throughout the ages have resorted to a mixture of four solutions:

1. Disarm the populace, and arm the elite.
2. Make the masses happy by redistributing much of the taxes in popular ways, such as public works.
3. Use the monopoly of force to promote happiness, by maintaining public order and curbing violence. Conflict resolution with a police force and law.
4. Construct an ideology or religion justifying kleptocracy. Bands and tribes already had supernatural beliefs. But those beliefs did not serve to justify central authority, or transfer of wealth, or maintain peace between unrelated individuals. When those beliefs became institutionalized, they were thereby transformed into religion. Hawaiian chiefs were typical of chiefs elsewhere, in asserting divinity, divine descent, or at least a hotline to the gods. The chief claimed to serve the people by interceding for them with the gods and reciting the ritual formulas required to obtain rain, good harvests, and success in fishing. Kings were born of this tradition, divinity. That is why kingdoms devoted so much tribute to constructing temples, which serve as the visible sign of the king's authority. America was founded with this notion "in god we trust" even though many of the founding fathers disagreed with the bible, they knew the importance of an ideology. Institutionalized ideology solves other problems as well. First, it solves the problem of how unrelated individuals are to live together without killing each other, by providing a bond not based on kinship. Second, it gives people a motive, other than genetic self-interest for sacrificing their lives on behalf of others. Patriotism.

That's but a small synopsis of only two page in the book Guns, Germs, and Steel by Jared Diamond. Highly recommended by the Joker.

But I digress. If your kleptocracy is abusing their powers and the amount of your taxes are disproportionately assigned to their own good, and not yours, it is time to overthrow said kleptocracy. If they come after your guns, it is time to overthrow. If the police and judges abuse their purpose of conflict resolution, then it is time to overthrow. If religion forces state policy or state policy rules on religion, it is time to overthrow.

Patriotism - are you so sure you are so much better than the people that live in other countries?

Agree with most of your points except the role of religion. Religion is a consistent opponent of the autocrat historically. So, the solution is merge the religion with the State. One becomes either appointed by God or gods or becomes a god themselves. This leaves no higher power or authority than the State.

What is fascinating is that the atheists states did essentially the same thing. They eliminated the power of religion by denying it's existance and made it equivalent to peddling drugs. They then set up the head of state as the national "father" figure. Instead of a Bible you could carry Mao's little red book. There were more images and statues of Stalin, Mao, Adolf, Kim than any religious icon.

That is the flip side of separating the state in America from any particular religion or denomination. It actually prevents the state from co-opting and consolidating or eliminating religious power. They cannot be one in the same in America...well, unless you ignore or reinterpret the Constitution.

Why should any of this come as a great surprise.  Democracy's achilles heel is the ability of the electorate to promise 
$s for votes, and when that does not work, create and allow and un-elected fourth branch of government (The Federal Reserve) to create / print the illusion of wealth.  The Great and Powerful Obama is just ripping the Constitution apart even further with his decrees and Executives Orders.  Not only is the applause canned during the SOTU, but the applause for the economy has been canned in the Stock Markets with the Fed's manipulation of the markets.

In this REPUBLIC (it is not a DEMOCRACY, since there is not even a "right to vote") the Constitution is the law, no matter what any man says the law is. The POTUS is the executor of the laws, not the maker of laws, which must conform to the Suprema Lex Constitution. ANY thought that the POTUS can make law is Unconstitutional. Hussein Obama will be stating to the whole world that he does not care what the Constitution says, because as it is there is no Constitution, since he, the EXECUTOR OF THE LAWS, is an illegal entity.

The Constitution requires that the POTUS be a "natural born Citizen", a term defined by law of nations (Original Common Law of the United States, SEE Sosa v. Alvarez) as one born in the Country of Citizen PARENTS. Obama is not an eligible "natural born Citizen" because A) his place of birth has not been conclusively established (a picture on the internet is proof of nothing), and B) his father was not a US Citizen at the time Hussein Obama was born (nor was he ever, and in fact had his student VISA revoked and was deported).

US LAW in the form of SCOTUS precedent confirms that Hussein Obama is not eligible

"The Constitution does not in words say who shall be natural-born citizens. Resort must be had elsewhere to ascertain that. At common law, with the nomenclature of which the framers of the Constitution were familiar, it was never doubted that all children born in a country of parents who were its citizens became themselves, upon their birth, citizens also. These were natives or natural-born citizens, as distinguished from aliens or foreigners". Minor v. Happersett, 162 US 167 (1874)

These facts are plain as day, yet the media ignore them, and Congress allows the Usurpation of the Presidency (including Ron and Rand Paul, supposed "Constitutionalists"). We the people are allowing our birth right to be stolen from us in broad daylight. It is important to the banking Cartel that the person acting as President be an illegal entity, because when there is no legal executor of the laws then there is no law, and the law is what evil men say it is. That is what is happeneng directly before your eyes, yet cognitive dissonance won't allow most to accept the enormity of what has happened.

We the People must re-establish the Republic, and remove the domestic enemy Hussein Obama from office and hang the co- conspirators in Congress and the media.

The "person acting as President" can be "REMOVED" (SEE the 25th Amendment) due to "INABILITY" (mental, physical or CONSTITUTIONAL DISABILITY -- SEE the 12th Amendment-- "as in the case of the constitutional disability of the President", and 3 US Code 19). It is up to We the People. The Ron Pauls of the world are merely minders, who talk a good game, and make us think that there is hope, but actually do NOTHING.

Now Cruz and Rubio are being floated as Presidential and VP candidates, when they are also NOT ELIGIBLE natural born Citizens (they were both born of NON US CITIZEN PARENTS, and Cruz was even born in Canada). The problem is no one will ever know this except a select few who search it out  Dont expect the media to bring it up or if they do, it's to deride the people saying it.

Next, no one will prosecute it.

So, knowing this, we can only do two things, get enough people together to demand his removal (pitchforks and torches) but you'll need MILLIONS to stand up.    There were about a million for the tea party. 

So, that won't happen.   New season of Walking Dead is starting, also, survivor and Idol is in full swing.   Nevermind, the people that would march probably can't afford to get to DC.

The problem at hand is with these words "Presidential Authority", as follows:

1. From what derives his alleged authority? Does he have any authority to do anything?

2. In what quality of president is he talking? President of the United States Corporation?

3. What power does this authority has vis-a-vis the free man of the world?

 

Imho the rest is bullshit, as in "would you be ok if i fuck you for 3 minutes or would it be ok if i fuck you for 3 years?" The problem is fucking and lack of consent not the amount of fucking to be had.

The "Constitutional Expert"...??

What must begin is a discussion of the viability of "executive order". It is only "hinted" at in the Constitution..and by definition it is only for clarifying or implementing federal statues....NOT CREATING federal statutes.

So Obama will stand before the duly elected body of our nation and tell them he is going to circumvent them...and the process of representitive government.
He will not finish his term with this dictatorial and dismantling operandi.

i am not expert in executive orders but my understanding is that they apply to the President's executive functions in oredering the execution of already passed law. He can act in gray areas but those areas must still be within his assigned powers. So, the President could order everyone with HHS to work weekends to get the ACA website going. He could order troops to the border to enforce the immigration laws. He would be acting within statutes and his assigned powers. He would not be negating or expanding law or working outside his duties.

Perhaps some Constitutional Law expert might weigh in here.

I did a comparison in a short article of the governing differences of Bill Clinton when he was president and had to deal for the last four years with a very strong republican House and Senate. He worked with them and talked closely with the republican leaders. All three branches of our government worked together because President Clinton believed strongly in capitalism and private industry. One of Clintons favorite expressions was "The era of large central government is over'. Clinton was intelligent and kept the three parts of central government small and efficient for the good of the people.

Our country under Clinton enjoyed one of the best times for the middle class and our economy in our history! He was great!

As an Independent I look for a President first and foremost who believes in our Constitution and the structure it presnts as governing bodies. A Congress made up of two house and the Executive.  Clinton revered that structure and dealt with it even in opposition hands. he never tried to circumvent or create carnage in the oppossing Party! He governed by consenus and America prospered as never before. Balanced budget, vitually no unemployment . Freedom from government spying or justice department interventon in our Press!. No threats to run Government from only one part of our three Houses! Clinton was my example of a great leader!

President Obama acts more in actions like a Chavez when he separated part of venezuelan society using class differences that he split to take dictatorial power in government against the Constitution.

The White House bills this speech as "An Opening Salvo" a militaristic theme against a large segment of his own society!! Is a "State of Emergency" coming? We must ask this! Is it possible? 

We have an overactive Justice department attacking the national press. NSA run amok, The President trying to rule by Fiat! Our constituional freedoms are going, going "Gone". Privacy was the first! I do not mind any philosophy being espoused unless it leads to modification of our Constitution and that's what this presidency is threatening. President Obama will reward government at the expense of the middleclass!!  President Clinton would not have done this!

Let's not forget Clinton's greatest accomplishment....splooging on the front of 22 year old girl's dress....or was it sticking a cigar in her holiest of wholies...A true visionary.

 

But, he was smart, being liked was his weakness, hence his laissez faire style, getting along, etc.

Ugh, you really believe that crap?  Clinton wasn't exactly a small government conservative although I guess he might appear that way after Bush II and now the Obama disaster.  The Clintons were tied up in the Mena Airport smuggling operation, they're nothing but goons, the same as Putin and all the rest.

Obama does not need to be "impeached" to expel him from office. He can be "removed" (see the 25th Amendment) due to "INABILITY" (mental, physical or CONSTITUTIONAL disability, See the 12th Amendment --"as in the case of the constitutional disability of the President", See also 3 US Code 19, that the "person acting as President" can be removed due to "inability").

He will be impeached as soon as Eric "the bagman" Holder gets around to investigating the dozen or so scandals that could tie in to Obama.

Of course your new 30 year treasury might mature before that happens but I am sure Holder is a serious guy.
