There It Is: Obamacare Employer Mandate Delayed For Companies With Under 100 Employees

Just as we predicted it would happen, here it comes:

  • OBAMACARE EMPLOYER MANDATE TO BE DELAYED FOR SOME COMPANIES

Specifically, according Bloomberg, businesses with 50-99 workers have until 2016 before being penalized for not providing health-care coverage to full-time workers, according to final regulations released by Treasury.

Additionally, businesses with 100 employees or more must offer coverage to at least 70% of full-time workers in 2015 and 95% in 2016; those that don’t will face penalty;  Exemption in place for seasonal workers, those defined as generally at jobs 6 mos. or less/yr "While about 96 percent of employers are not subject to the employer responsibility provision, for those employers that are, we will continue to make the compliance process simpler and easier to navigate,” Asst Secretary for Tax Policy Mark J. Mazur says in statement e-mailed by Treasury. Furthermore, businesses with less than 50 employees are not required to provide coverage or fill out any forms in 2015.

Why is this not surprising? Recall what we said a few short days ago:

... the only reason why Obama is suddenly willing to compromise over every aspect of his "crowning achievement" is that finally its tactical, and strategic failure has become clear for all to see. So it would be best to enact it piecemeal, and claim success for whatever legacy aspects of the system are working, while blasting everything that his unprecedentedly complicated, centrally-planned contraption has unleashed.

 

Finally, why three years? Because by then Obama will be gone (absent some very radical changes to presidential term rules), and Obamacare will be someone else's problem.

Then again Hillarycare sounds so much better than Christiecare.

And so Obama's crowning achievement is just a little less crowning. However, the true negative impact will be borne not by the current president but his successor... who will likely do the same and extend the full provisions indefinitely as well, as the last thing the struggling economy needs right now, as we have not tired of explaining for the past two years, is, well, Obamacare.

The Treasury Department rolled out Monday afternoon more tweaks to the health care law's requirement that all large employers--those with 50 or more workers--provide insurance coverage to their workers. This is the part of Obamacare was supposed to take effect at the start of 2014, but was delayed by the White House this past summer as the White House was facing significant push back from employers.

In today's final rule, the Obama administration is essentially relaxing the employer mandate for 2015--in a big way for medium-sized businesses, and a smaller way for the largest employers. Here's a rundown of the key changes.

1. Employers with between 50 to 99 employees get another year of transition.

The Obama administration will give medium-sized businesses another year's pass on providing insurance coverage to workers. Treasury estimates that about 2 percent of American businesses fall into this category, but does not have numbers on how many people work for businesses of this size. For these companies, the employer mandate does not take effect until 2016.

Employers who want to take advantage of this particular exemption will need to certify with the federal government that they are not cutting back on positions just to fall below the threshold. "It's simply so they don't game the system," one senior administration official told reporters on a phone call this afternoon. "They have to certify they're not doing that and not dropping their coverage."

2. Employers with 100 or more workers aren't required to cover everyone.

Previous regulations had required large employers to offer coverage to 95 percent of full-time employees to be considered in compliance with the employer mandate. Today, Treasury is ratcheting that requirement back: Large companies that offer coverage to 70 percent of their employees will be counted as fulfilling the employer mandate. This is a transitional measure and, by 2016, large employers will need to hit the original, 95 percent target. Treasury estimates another 2 percent of American businesses fall into this category, with more than 100 employees, but again, we don't have numbers on how many workers those companies employ.

3. Volunteers won't be counted as full-time employees.

There had been some tussling on Capitol Hill over whether certain volunteers - mostly volunteer firefighters - would count as full-time employees, for purposes of the health care law. Today's rule clarifies that they do not count as employees--which eliminates any incentives to get rid of volunteer positions.

There are other, smaller tweaks in the new Treasury rule that deal mostly with how, exactly, employers are supposed to count how many hours employees work (for seasonal workers, for example, or teachers, this can actually be a pretty difficult task.)

It's hard to to know how many people will be impacted by these changes since there isn't great data on how many people work for the different-sized employers.

OK Another crack at it. ALL entitlements fall under the umbrella of the Social Security Act. If you do not have the number you are not part of the system. If you are not part of the system you are not eligible for benefits. SS, medicare, medicade, food stamps, AND OBAMA CARE. You cannot even apply without the number which you MUST make voluntary application for. WHY?? Because you must WAIVE constitutional judicial protections of CONTRACT and PROPERTY in exchange for benefits within "the system" that are nothing more than extraordinary protections paid for with money from the public treasury. A (taxable) privilege that can be modified or taken away at the will of the legislative body that created them.

 

Here, if you doubt me, pull the case and read it:

 

"Florenzano v. Olson, 387 N.W.2d 168 (Minn. 1986), and M.H. v. Caritas Family Servs., 488 N.W.2d 282 (Minn. 1992), are probably the two most often cited cases in Minnesota on the definition of both common law fraud and negligent misrepresentation.  In both cases, only the negligent misrepresentation claim survived.

In Florenzano, an insurance agent hired by Mrs. Florenzano advised her that she would be a “fool” not take the “once-in-a-lifetime” opportunity to withdraw from the social security program because she would still receive coverage under her husband’s social security benefits.  Mrs. Florenzano relied on this advice and withdrew from the social security system.  She subsequently became totally disabled due to multiple sclerosis.  However, because she had followed the insurance agent’s advice and withdrawn from the program, neither she nor her two children were eligible for social security disability or dependent benefits.  Had she continued to participate in the social security system, she and her children would have been eligible for those benefits".

Folks, listen up. Notwithstanding that there exist NO statutory outlet from "the program", We have a judicial remedy. The States sold us all down the river and they not only violated the federal contract clause, but they handed the feds the power to walk around the apportionment clause. Again if you doubt this, read the dissent in the Obama Care case as to the frustration of the court as to the apportionment of direct taxes. RIGHT THERE IN BLACK AND WHITE, the USSC just gave all of us the clue as to the correct argument. Notwithstanding, The so called self proclaimed constitutional experts missed it AND none of these arguments has ever been before the judiciary. Yes I know the SS ACT was upheld by the USSC. Irrelevent. Weak arguments under the due process clause has nothing to do with a federal question against the States. Expanding the scope of federal excise(s) to include the ability to use property (wage) as a unit of measurement to calculate the indirect privilege tax? Really? The States have that power? Not according to USSC precedent.

 

Who am I? I'm a fricken nobody with no law degree and no credentials. What I do have is 30 years and over 60,000 hours of research into the areas of law we are dealing with.

Another day and another example of why Obama should be impeached and that is irrespective of whether the Senate goes along. How many times has he changed just the ACA law alone. I think it's up over fifteen times now. Bring in all the other examples of not upholding the law. Even Boehner just this past week said it's pointless to pass immigration reform because this president can't be trusted to enforce the law. Apparently while many of us voted for a president it appears Obama thinks he is a monarch. It's past time to teach him a basic civics lesson.

When congress goes home with their hat in hand they face local business owners back in their districts.  They book a room at the local big restaurant or Masonic Lodge or Rotary function and they have to stand up in front of their constituents and tell them they are doing their best, but the damned (insert party here) makes it hard.

They have no explanation of what they did in terms of Obamacare because they did not even know what they passed.  It is incumbent of the Obama White House and the DNC controlled through the Chicago/Mossad Complex to give cover to the democrats in their regional races and fund raising to kick the can down the road.

Meanwhile, all those people not covered are still going to have to pay someway somehow, meanwhile costs will go up another 100% before any employer mandates arrives and by then nobody will be able to afford anything, especially getting sick.

When will the exemptions run out and Walmart and McDonald's really ever pay any money?

The only folks getting a pass are illegals - soon to be registered democrats.

The absurdity of tying health insurance coverage to employment is becoming obvious here.  Most people I worked with when I was an employee had no idea how much coverage cost. Many barely knew how much was coming out of their checks each pay period, never mind how much their employer was forking out.  When I would tell people it amounted to a 25%-40% additional compensation, they thought I was nuts.  When I told my employer I'd forego the coverage but take the 30% raise, they laughed in my face. 

This is one of the biggest Charlie-Foxtrots I've seen in a long time.  Trying to keep the private insurance companies healthy and profitable despite the fact that they've contributed hugely to the price spiral means automatic failure.  Keeping the tie between employment and health insurance is a brutal job-killer, as we see.

We were already nearing a tipping point where health insurance, and actual health care (which is not the same thing) were becoming too costly for a rising number of employers and families.  That's what provided the urgency to get ObamaCare passed.  It's not a new concept; the Heritage Foundation wrote up basically what we see here in about 1993 as the insurance industry's response to the specter of "HilaryCare."  The intervening 20 years have brought the point of collapse this much closer, though.

It's going to fail, and the next President will have to scrap it and open up Medicare to everyone.  It'll happen more quickly if the next President is Republican.  Trying to go back to the old system now will topple the works; too many people now know how much money is at stake.  And a Democrat will have to move slowly, pretending the turd isn't a turd.

When do individuals get their exemption........oh wait, they don't have lobbyists, I forgot.

But wait, isn't the major complaint is that Obamacare favors unions?  Oh wait, THEY ARE GETTING SCREWED OVER TOO.

Remember guys, the whole "single payer will eventually happen" thing is a myth, just like the reconomy is "recovering" (this coming from a guy who leans left).....it's all a gigantic "level" (aka bluff) to give the insurers more places to put their tenticles and privatize health care even further.

For $150 USD per year (6000 PHP) you can get basic national health insurance in the Philippines that covers pretty much everything. Not a typo-- $150 per year. No death panels.

 

Low deductibles and pays 75% for private hospitals. I'm still looking for the catch, but there doesn't seem to be any. You can even supplement that with international insurance plans that are out there. And many meds are not prescription in Philippines and very cheap.

Just had a friend who's girlfriend with no insurance in Philippines developed a sudden problem. She received initial tests, transfusions of 4 units of blood over 3 days, and  2 follow up tests.  Total cost = $450 USD.  She sent copies of bills and all the work done. I saw them. 

He paid, she's fine. But I told him to just buy her the insurance. Only 90 day exclusion period for any pre-existing.

This is nice and all but someone still has to foot the bill. Every delay shrinks the pool of money for the 3r's and guess who is going to get fucked in the end all the insurance plans that are not eligible for the 3r's. Every private insurance plan premium is going to be jacked up to the point no one can afford them in turn collapsing the whole health insurance system except for the companies being reimbursed by the 3rs. No one is going to offer private insurance since there is no incentive to do so when you no one can afford it and the government will reimburse only obamacare plans.

Take some time to read the rules about risk adjustment. reinsurance and risk corridors. 2 billion allocated by the Treasury trough taxes and 10 billion taxed off of private plans are not going to be enough at the current rates to reimburse these super high risk obamacare plan pools that no one wants to sign up for. They are going to bankrupt the whole private insurance plan system to make Obamacare affordable by disincentivizing insurance companies from offering private plans period.

Which is good for Herr Obama as the wealthy having much to lose will stay quiet or at least a much inactive political force.

Another group I think will be the rapid rise of religious care. What form it takes is yet depending on, as a reaction, to a stable Obamacare. When, and if it ever does become stable.

They have also refused to act despite numerous lawless acts committed by Obama.

The only proper response from the Republicans today would have been, "This utter lawlessness will not stand. We have filed for impeachment, and will be adding additional charges in the coming days."
