Obama To Overrule Supreme Court? President Considers "Mitigating" Obamacare Ruling

Tyler Durden's picture

Having had his omnipotence chipped away at last week, President Obama has - seemingly - been pushed too far by the Supreme Court's decision on contraception and Obamacare this morning: The White House stated...

Totalitarian? You decide... One wonders if the phrase "do you know who I am?" was uttered this morning?

As The Hill adds,

White House press secretary Josh Earnest said women should be able to "make personal health decisions for themselves,” and called contraception "vital" to the health and well-being of women.

"We will, of course, respect the Supreme Court ruling,” he added.

Republicans cheered the ruling as a victory for religious freedom.

The decision affirms that Americans, contrary to what the Obama administration attempted to impose, have a right to live and work in accordance to their conscience and can’t be forced to surrender their religious freedom once they open a business,” Sen. Ted Cruz (R-Texas) said in a statement.

As long as the U.S. Constitution and the Bill of Rights remain active documents underpinning the Supreme Court (and frankly even this is debatable now) all lof this should be able to be corrected or righted, and set back to the foundation that the US was built on.

Sadly, most americans are so uninformed as to what their rights actually are they don't even question what's happening to them.

Valerie Jarrett (Sitting at the President’s desk): Sir the Supreme Court has that authority. They are the interpretation mechanism fitting our laws against the Constitution.

Obama (Stomping his feet and holding his breath – then he exhales): But I do want them to call my laws unconstitutional! (He stomps more) What if I just say the Court is unconstitutional! (A foot lands for emphasis with each word.)

I’ll get Jay Zee and Beyonce to do a television spot with me, and then go on Oprah to announce we are disbanding the court!

Jarrett: Um… that is not within your power sir.

Obama: Then I’m gonna hold my breath until it is Valerie! You had better figure it out!

Jarrett: Calm down Mr. President.

Obama stares at her with his cheeks full of air. He stomps and begins changing color due to a lack of oxygen.

Jarrett: Mr. President it is similar to a baseball game. You are the pitcher and the court is the umpire. You can’t just send the umpire home because you don’t like his call.

Obama falls to ground and writhes as he holds his breath. He begins slapping his hands on the floor.

Jarrett: Mr. President get up right now or I’m going to call Michelle to come discipline you.

Obama (Exhales and lays still on the floor): You’re so mean to me! (Then he begins to cry.)

What’s all the uproar?

The corporation called THE UNITED STATES OF AMERICA operates under a schema of decrees in all of their conceivable legal fields. Moreover, the Constitution is merely a referential document with no validity whatsoever as a result of the Act of 1871, and considering the fact that this corporation never signed a peace treaty with the Confederate states at the end of the American Civil War (being the latter an implicit ally of the British Monarchy for receiving  advisory and financial support, just  for destabilization purposes only); therefore, the US Supreme Court is just an institution playing a trivial role in the affairs of the Federal Government.

TITLE 50 OF THE UNITED STATES CODE (WAR AND NATIONAL DEFENSE) grants all the necessary powers to the Sovereign (the Executive branch) to overrule any laws and/or opinions issued either by Congress or the Supreme Court – decorative figures in reality.

Anything contrary to this reality is pure whining.

Just more white man's ghost dancing.

Yes, the Constitution was a coup de tat ... but you aren't going to get rid of it by throwing convoluted common law legal arguments at federal judges. They will just laugh, tell him that was very clever, and over rule the objection.

If you want to get rid of the Constitution, you have to do it the hard way, using men with guns.

The same way Obama is doing it.

Dont take your eye off of what is happening here. I hate Obamacare as much as the next sane non-sociopathic person, but this wasnt a hit against Obama so much as it was a hit against our freedoms. As usual when TPTB pretend to bicker it is mom and pop who suffer (in this case mom especially). The Suprene Court chose to shoot this down because women are the least able to defend themselves. Why not strike down the provisions of Obamacare that basically says 'give tax dollars directly to a private entity'? The answer, of course, is that said private entity has money, does lobby, and can defend itself. Celebrate the battle won today, but dont for a second forget that we are losing the war.

Unfortunately there's a lot of competition for the #1 spot, though most have to do with the US Court system subverting the constitution via conflicting laws.

And then of course there is the Intelligence and National Security arm within the Federal Gov. that has little or no oversight at all, and which wields power over all other US Governmental departments.

Much work to be done.

The insanely misguided notion of corporate personhood is one of the biggest threats to the freedoms enshrined in our constitution.

No matter where you personally stand on the issues of contreception or obamacare you should be troubled that this ruling further extends the concept that a corporation has the same rights (but virtually none of the responsibilities) of an individual.

Corporations now, according to the Supreme Court, can hold religious beliefs and seek exemptions from the law based on their personal corporate morality. This does not lead to anything positive for the people nor for the nation.

You have pointed out the real issue here.  Marjorie Kelly dealt with this issue with keen insight in her excellent book  "The Divine Right of Capital".  "Corporate personhood" without commensurate social responsibility as the other side of that right, has made a fundamental contribution to the mess we are in now.

Good points.

There is an inherent conflict in the whole corporation / person issue though, ie:  if corporations are considered people why can't they vote?

The answer of course is that they will NEVER be able to vote because they are not people in the eyes of the US Constitution and Bill of Rights..

The result that has everyone saying "Ha! Fuck YOU Obama!" and high-fiving each other is actually an extension of Citizens United into the religious sphere. But they are too blinded by the Obama-obsession to see how their rights are being systematically subjected to corporate interests, and how their own fears are used against them to make it happen.

They hate big government (justified) but are failing to understand that they are simply replacing one set of masters with another. And those replacement masters are NOT elected and have no legal contractual obligations to you, only to themselves and their shareholders.

Does Obama share stories of his "Coming of Age" in Chicago? Where everything was difficult getting his start. Where he was sexually frustrated. Where he had to turn to odd white people and find nice black people to listen to him and to maybe help him with his troubles.

I wonder where is the Legacy of Barak Obama's torrid days in Chicago. He is our leader right. He should be proud to share who his mentors are and what they said to comfort him.

Because as an Elected President, I think he screwed everyone that is not already rich and "Connected".

Funny but true. Actually it is extremely harmful to men's health as well. The increased amount of estrogens in our environment have harmed us all ( I'm speaking literally though I'm sure some will take this figuratively too). An old boss of mine was trying to see if there was a correlation between the birth control pill use and an increase in homosexuality. He was denied funding as well as told that form of research was deemed inappropriate. Obviously politics trumps science.

"Years ago it was thought that prolonged use of birth control pills would interfere with a woman's subsequent ability to conceive, but this has been shown to be false. Similarly, doctors used to recommend taking an occasional break from birth control pills, but this offers no benefits and may increase your risk of an unplanned pregnancy.

Some research suggests that prolonged use of birth control pills increases the risk of certain types of cancer, such as cervical cancer and liver cancer. However, use of birth control pills also decreases the risk of other types of cancer, such as ovarian cancer and endometrial cancer.

The effect of birth control pills on breast cancer risk isn't clear. Some research indicates that birth control pills slightly increase the risk of breast cancer — but that 10 or more years after stopping the pill, a woman's breast cancer risk returns to the same level as if she had never taken birth control pills. Other studies don't support a link between birth control pills and breast cancer."

Doesn't look too damning to me.

I the Obama, of the People's Democratic Republic of Obama, in order to create a more perfect Obama, establish injustice, domestic intraquility, provide for my defense, promote my general welfare, and secure money you have for myself and my cronies, because you didn't build that, do ordain this constitution for the People's Democratic Republic of Obama.

Article I:

There shall be a congress whose members shall be selected by me. The congress shall be in session when I declare it to be in session, and not in session when I say so. It shall pass all laws as I instruct it. Should congress pass a law and I sign it, I may change that law or enforce or not enforce that law as I desire. Should congress fail to act, I may pass a law by executive order and change, enforce, or not enforce such orders as I desire.

Article II:

There shall be a president, and I shall be him. The president shall have such powers and privileges as he so desires.

Article III:

There shall be a Supreme Court, whose members shall be appointed by me. They can pronounce anything they like, as I shall ignore everything they do if it pleases me.

Bill of My Rights:

1. I shall respect no religion, and prohibit the free exercise thereof as I desire. I may abridge the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

2. A well regulated Militia, being a threat to my security and power, the right of the people to keep and bear Arms, shall not be tolerated.

3. No Soldier shall, in time of peace or war, be quartered in any house if he criticize or think ill of me.

4. The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall be violated as I desire, and no Warrants shall need be issued.

5. Any person may be deprived of life, liberty, or property, without due process of law; and shall have private property taken for my use, without just compensation, as I deem, because you didn't build that.

6. In all criminal prosecutions, the accused shall not enjoy the right to a speedy or public trial, and may be detained indefinitely without trial if I deem them to be a terrorist or other malcontent.

7. In suits at common law, I may deem my agencies and representatives, and I myself, immune from all actions and rulings, nor do we need to respond to subpoena or court order of any kind.

8. Excessive bail shall be required if I deem it so, as well as excessive fines imposed, and cruel and unusual punishments inflicted.

9. The enumeration in the Constitution, of certain rights, shall not be construed to apply to any person other than myself.

10. The powers not delegated to me, nor prohibited by me, are reserved to me

That was exactly my thoughts this weekend when I sadly turned on the Sunday new shows to see what the other half were thinking.  Georgee Stephanopulous show started out with a whole scare segment on how we should be cowering under our desks in fear of terrorists.  Only in like minute 38 did they address the only scandal that matters, which is the IRS scandal which DOES rise to level of high crimes and misdemeanors (abusing power of office to silence political foes is about the worst high crime and misdemeanor there is).  The IRS was IN THE WHITE HOUSE ALL THE TIME plotting the suppression of Obamas political opponents with ValJar and probably Dear Leader himself.  Way way worse than Watergate.   They wont find any emails but they do not need to, cui bono plus what they need is tapes of the conversations from all those meetings at the White House.  If those go missing, then we have a proper Watergate setup, never tmind the 7 people whose emails just accidentally disappeared starting a week after the first congressional inquiry into the matter (WTFF!?!?!?!?!).

In any event Emperor Bowbama is only a year or so from the Ides of March or its political equivalent.

Any ruling that gets the govt of people back...

Government is NEVER "of the people." At a minimum, there is always an oligarchy. Go read about the 'sacred' Athens and see.

That is the nature of government - it is dominance by force - everywhere and in all instances.

Government IS coercion and will never be anything else.

Yeah the parts about the Athens et al being gender-segregated male-only hierarchical caste-based slave societies are generally not mentioned.

Democracy did in fact mean "of the people", but "the people" designated wealthy propertied men and no one else (the definition had not changed 2000 years later when America was founded).

I share your outrage, but not your surprise that it's happening.  When you approach and step over the "50% of the population reliant on government entitlements" threshold, you've reached, quite literally, a tipping-point.  The 08-09 downturn hastened its arrival somewhat, but it would have happened in a few years anyway.  Demographics and guaranteed entitlement programs are a nasty cocktail when the tide starts to turn and run the other direction.

Insurance is for the not-likely-but-not-impossible. If pregnancy was "not likely" there would be no reason for prophylaxis to exist in the first place. QED.

The real issue is of course that we are stuck between the Scylla of subsidizing people's poor decisions/irresponsibility/lack of self-control/general infantileness and the Charydbis of even more unloved, unwanted, unneeded and immensely costly accidents known as children. As if, at this moment in human history, we need even more resource consumption, as if we don't have enough surplus labor, as if the diminishing marginal returns of population growth hadn't reached fever pitch, as if the world as it is could provide a decent life for the people already alive. The next 2 decades are going to hit these people like a fully-loaded ballistic-missile-on-rails freight train.

It's essentially, "give me my free and unrestricted access to birth control, or else, mister, you'll be sorry in 9.5 months, and for the rest of your life."
