In Potentially "Lethal Blow" For Obamacare, US Appeals Court Finds Insurance Subsidies Invalid In Most States
It may be back to square 1 for Obamacare.
Moments ago, in what NBC classified as a "potentially lethal blow to Obamacare" a federal appeals court has ruled that the federal government may not subsidize health insurance plans bought by people in states that decided not to set up their own marketplaces under Obamacare. The law clearly says that states are to set up the exchanges. But 34 states opted not to, and the federal government took over in those states. The court ruled that federal government may not pay subsidies for insurance plans in those states.
As the Hill reports further, the D.C. Circuit Court of Appeals said the Affordable Care Act does not permit the IRS to distribute premium subsidies in the federal ObamaCare exchange, meaning those consumers must bear the full cost of their insurance.
But... they said socialism is for the greater good!?
The 2-1 decision by the three-judge panel in Halbig v. Burwell sets up a major legal showdown that conservatives believe could deal a fatal blow to President Obama’s healthcare law.
And here is where the government's appeal process is sure to benefit from the NSA's treasure trove of dirt on all those judges who dared to throw a spike in the suboptimally greased wheels of government wealth redistribution:
The government is expected to appeal the ruling to the full D.C. Circuit, but even if the administration triumphs there, the case appears destined for the Supreme Court.
The appeals court’s decision tossed out the ObamaCare subsidies on the grounds that the statutory language of the Affordable Care Act does not explicitly allow enrollees on the federal exchanges to receive premium tax credits.
"Because we conclude that the ACA unambiguously restricts the section 36B subsidy to insurance purchased on Exchanges 'established by the State,' we reverse the district court and vacate the IRS’s regulation," the court said.
Previous courts rejected that argument, saying Congress’s clear intent was to provide the subsidy help to everyone in the system.
And now, the time for a diversionary war has clearly come.

You have no more than the state of California. We have 10X that many, so would it be fair to day it would cost about 10X = $620 per month?
My premium is $300, as a single person. I pay about another $150 per year in co-pays.
So under your system my premium would more than double.

The Federal Exchange is merely a conduit for states without own exchanges: it's pretty clear that Congress intended to subside health insurance. Everyone makes their own laws?

I really haven't seen any sort of discussion about the impact of a law that forces people, most of whom have been living hand-to-mouth, to pony up for medical insurance, even with a government subsidy.
Around my neighborhood, four restaurants have closed in the last couple of months, and many more have parking lots empty on Saturday night, which is a harbinger of more closings to come. With anywhere from $500 to $1,500 per month now earmarked for health insurance, it is easy to see where the money is no longer being spent.
You could certainly debate the point that people should have health insurance for themselves rather than having taxpayers pick up the tab for their ER visits, and Obamacare, even with the subsidies, probably reduces the overall health care costs that were being borne by the government, but that still does not acknowledge that overall impact on businesses everywhere by having all of this money funneled into the health care industry.
My own somewhat cold-hearted personal opinion is that devoting too huge a chunk of our national treasure to health care for the masses is a recipe for long-term disaster. As Lord Keynes remarked "in the long term, we are all dead", and no amount of health care spending will change that result.

Yes, I noticed a lot more vacant store fronts these last 6 months. The smaller businesses are being squeezed. A lot less discretionary money to spend.

Team Obama will appeal to the full DC court of appeals - the judgement was from a three judge panel. Coincidentally, Obama stacked the DC court last year to give him a 7 - 4 advantage. Obama and Reid knew this issue was lethal to the ACA, which is why they used the nuclear option to eliminate the filibuster in order to stack the court.

I don't agree with other posters about single payer coming to pass. Obamacare was a windfall for insurance and a booster for the pharmaceutical industries that received wider revenue distribution.
Both donated heavily to Obama campaigns. The Supreme Court also ruled it a tax with penalties this year and next while the meat of the benefits would start in 2016 (just in time for elections). So from that perspective the bill was a big success to government and political cronies.
I believe insurance premiums will be slightly lower in 2016 and deductables reasonable again. As boomers continue ageing they'll need more meds so I speculate these will be slightly higher in 2016. Fortunately, more generics coming online and Rx's becoming OTC help a little.
Medicare and Medicaid will continue to see cuts over the next four years in services available and things like pain meds and other expensive non-life saving drugs.

The Feds tried to get round the states by offering these subsidies (Dems helping). The States (Republicans bad) did not give you Obama care exchange and reductions.
Now the Courts say that the Feds exchange subsidies must now stop and the feds will obey the law. This will be used against the Republicans saying they killed Obama care destroyed it because of the State not having the exchange.
The prices go up, if you cannot pay without subsidies then the IRS get the fines.
You are bankrupt and blaming the republicans.

Obamacare is an outrageous attempt to foist a Soviet-style communist health care system onto the American public.
These Appeal Court judges recognize the fact that in this country good health is not a birth-right – it is a privilege – and a privilege that should only be available to those who are hardworking, wealthy, and smart enough to pay for their own (non-subsidised!) insurance.
We should not try and emulate socialist hell-holes like Australia, Canada or Scandinavia where every dead-beat can access free public health systems regardless of whether they’ve saved up to pay for it or not.
The US got to be great through people standing on their own two feet and taking responsibility for their own health and wellbeing. Not ONE DIME of our taxes should go towards supporting socialized free health care for those too lazy, poor, old, or stupid to look after themselves.
But what the Appeal Court has done here is only a start. They need to work with the Supreme Court to end all existing socialist programs in this country including Medicare, VA, Medicaid and Social Security. These government-run programs are just pandering to people’s laziness and lack of personal responsibility and are totally un-American.
Medicare in particular is the worst socialist program ever introduced in this country (by another socialist Dem President – Lyndon Johnson in 1965). It’s a single payer government run program funded from taxes paid by YOU AND ME – to support old sick people we don’t even know.
Back in the ’60s the GOP fought long and hard to prevent this communistic system becoming law. As Ronald Reagan said at the time the Dems were trying to force this thing through “If you and I don’t stop Medicare then one of these days we are going to spend our sunset years telling our children and our children’s children what it once was like in America when men were free.” And look where we are now. Exactly where Reagan warned us we would be.
George HW Bush Described Medicare in 1964 as “socialized medicine at its worst” and. Same with Barry Goldwater who said: “Having given our pensioners their medical care in kind, why not food baskets, why not public housing accommodations, why not vacation resorts, why not a ration of cigarettes for those who smoke and of beer for those who drink.”
Social Security is another Communist program that needs to be abolished right now. Did you know that the U.S. Social Security program is the largest government program in the world and the single greatest expenditure in the federal budget, accounting for 20.8% of the total budget? Needless to say it was introduced by yet another socialistic Democrat President – Franklin Roosevelt back in the 1930s. And what is ‘social security’ ? It’s nothing but a program to take hard-earned money from the likes of you and me to allow lazy old people who didn’t bother to save for their retirement during their working years to live high on the hog.
So good on the Appeal Court for striking this first death-blow against Obamacare. Now I just hope they and the Supreme Court will see fit to start unwiding the other socialist and communistical atrocities such as social security, Medicare, Medicade and VA – which are also totally unconstitutional and totally un-American.
