Kentucky Man Arrested For "Terroristic Threatening" After Posting Song Lyrics To Facebook

Tyler Durden's picture

Submitted by Michael Krieger via Liberty Blitzkrieg blog,

It seems as if the never-ending stream of American plebs being arrested for the most innocuous activities, things that were seen as completely normal just a few years ago, is continuing its irrational march forward toward peak nanny-statism, at which point everything will be criminalized.

This disturbing trend has been a key topic for Liberty Blitzkrieg in 2014. Here are the three most recent absurd cases from July and August alone:

South Carolina Woman Arrested for Cursing in Front of Her Kids

The “Nanny States of America” – Mother Arrested for Allowing 7-Year-Old Son Walk to Park Alone

Connecticut Man Arrested for “Passive Aggressive” Behavior to a Watermelon

The latest incident involves a Kentucky man, 31-year-old James Evans, who was arrested and spent eight nights in jail for posting song lyrics to Facebook. No, this is not a joke. Local station 14News reported that:

Family members say Evans posted the following on Facebook on August 24:

“Student bodies lying dead in the halls, a blood splattered treatise of hate. Class dismissed is my hypothesis, gun fire ends in debate.”

The family says it’s lyrics from the song “Class Dismissed” by the band Exodus.

Mike Drake, the Muhlenberg County school resource officer, says multiple agencies received calls concerned about the post.

So Evans was arrested for terroristic threatening.

The warrant says Evans was arrested because, “he threatened to kill students and or staff at school.”

“Whenever we found out that he actually got arrested for lyrics, we were all shocked,” said Ashelynn. “We couldn’t believe that you could do that or get in trouble for that. I don’t personally agree with the band or the music but I agree that you should have the choice to listen to it if you want to.”

Maybe I’m missing something here, but how is posting lyrics equal threatening to “kill students and or staff at school.” Also, notice how the word “terrorist” is thrown into the charge. As I have said for years, the entire sham “war on terror” will be used to justify putting regular citizens in jail for pretty much anything.

Think eight nights in jail is more than sufficient for this non-crime? Think again. It appears Mr. Evans will be forced to undergo a mental evaluation.

While the lyrics in question certainly don’t leave you with a warm and fuzzy feeling, they pale in comparison to the lyrics I recall listening to growing up and which my classmates recited endlessly. After all, isn’t this supposed to be America. Aren’t we supposed to have a right to offend?

The band Exodus, which composed the song agrees. We learn from Consequence of Sound that:

In response to the incident, Exodus’ manager released a statement, explaining that while the “band does not promote or condone terrorists, threats or bullying,” they are “somewhat baffled by the fact that this man being charged for what seems against his first amendment rights of Freedom Of Speech.”

In a separate statement, guitarist Gary Holt explained that the song “was written as a view through the eyes of a madman and in no way endorses that kind of fucked up behavior. It was the Virginia Tech massacre perpetrated by Seung-Hui Cho that was the subject and inspiration to write the song, one in which we put the brakes on playing it live after the Sandy Hook shooting, as we did not want to seem insensitive.”

Holt added, “As some of us in Exodus are parents, of course these things hit close to home; it’s every parent’s worst fear. These moments are the stuff of nightmares, and life, as well as music, isn’t always pretty. But when we start to overreact to things like lyrics by any band, including Exodus, and start arresting people, we are caving in to paranoia and are well on our way to becoming an Orwellian society.”

Good thing the terrorists didn’t win or anything…

Do these count?

"How soft your fields so green, can whisper tales of gore,

Of how we calmed the tides of war. We are your overlords."

You things are thrilled with fright
For I am out tonight
You things are paradise
You whet my appetite

Sick things in cartridge
Tapes my stars
Sick things, pretty things
Play things, my things

_______

Beat on the brat
Beat on the brat
Beat on the brat with a baseball bat
Oh yeah, oh yeah, uh-oh.

What can you do?
What can you do?
With a brat like that always on your back
What can you do? (lose?)

_____

and the worst of all.....

Well, we rolled up Interstate 44
Like a rocket sled on rails.
We tore up all of our swindle sheets,
And left 'em settin' on the scales.
By the time we hit that Chi-town,
Them bears was a-gettin' smart:
They'd brought up some reinforcements
From the Illinois National Guard.
There's armored cars, and tanks, and jeeps,
And rigs of ev'ry size.
Yeah, them chicken coops was full'a bears
And choppers filled the skies.
Well, we shot the line and we went for broke
With a thousand screamin' trucks
An' eleven long-haired Friends a' Jesus
In a chartreuse micra-bus.

Well, we laid a strip for the Jersey shore
And prepared to cross the line
I could see the bridge was lined with bears
But I didn't have a dog-goned dime.
I says, "Pig Pen, this here's the Rubber Duck.
"We just ain't a-gonna pay no toll."
So we crashed the gate doing ninety-eight
I says "Let them truckers roll, 10-4."

This really saddens me.

I did my MBA in The States and always considered it a place to migrate if things get uglier enough in the country where I live now (some undisclosed place in Europe). I loved the place and the people there, plus I don't like the collectivist/socialistic bents of the people here.

But for God's sake man, are you people going really fast down the drain now or what? the thing I always liked about US it's its love for freedom and individualistic nature. You can do whatever you want, as long as it doesn't hurt me, BUT... you bear the consequences of your actions.

And now... obamacare (socialistic healthcare), war on drugs (80% -I'm pulling the number out of the air- victimless crimes), Homeland Security Act (soviet-style police), and so on.

I guess Germany will be the just-in-case option now, but I don't really know how individualistic-socialistic is the scale there (and I'm told it's gonna be a cold winter there). I don't know maybe Switzerland.

I'm white does anybody know a mainly caucasian country which respects freedom, property, and individual rights? (gun owning rights are good indicators of the former and a must, i.e. conceal carry is allowed, the use of guns is allowed in defense situations, and so forth)

The kid could have taken some basic precautions, like indicating they were song lyrics. Probably most of the people who called in and reported the therat didn't know, thought they were the kid's own words, and were frightened. I don't feel bad for the kid at all. I don't think he should be arrested, but an investigation was definitely in order. There are enough real things to be concerned about that we shouldn't go feeling bad for a kid who posts about shooting up his school on facebook. It's fucking dumb.

Everyone should be looking at the third world for possible escape.  Look into the Philippines.  There are gun laws but guns can be had and you can get around speaking english.  There are several ex-pat communities especially in Luzon.  I like the south the best.  Cebu and Davao are two that I liked. If you like it cool look into Baquio but it is crowded as are a lot of their cities.  If you can learn languages and can tolerate their food there are dozens if not a hundred islands you can live on.  If you are single you won't believe how attractive you are.  Bring money with you because you won't be able to work.  And there is government corruption, corruption, corruption as are all countries the Spanish conquered.

Benny the Bouncer

Benny was the bouncer at the Palais de Dance
He'd slash your granny's face up given half a chance.
He'd sell you back the pieces, all for less than half a quid
He thought he was the meanest-
Until he met with Savage Sid.

Now Sidney was a greaser with some nasty roots
He poured a pint of Guinness over Benny's boots
Benny looked at Sidney:
Sidney stared right back in his eye.
Sidney chose a switchblade
And Benny got a cold meat pie.
Oh! what a terrible sight,
Much to the people's delight.
One hell of a fight.

Sidney grabbed a hatchet, buried it, in Benny's head.
The people gasped as he bled:
The end of a Ted?

Well, they dragged him from the wreckage of the Palais in bits.
They tried to stick together all the bits that would fit.
But some of him was missing
And "part of him" arrived too late,
So now he works for Jesus
As the bouncer at St. Peter's Gate.

Hotel California is copyright material. The local authorities need to throw copyright infringement on top of the terrorism charge and saddle this Kentucky fried rube with a lifetime of insurmountable debt.

Posting a thinly veiled threat and hiding behind a flimsy defense like, "these are just lyrics" can't be tolerated. There is just such a legal precedent as yelling fire in a crowded theater to incite panic, speech isn't free.

Astoundingly, judges ruled in favor of admitting the lyrics in 80 percent of those criminal trials. (A few were overturned on appeal.)"

Funny with the "middle aged woman with a huge ass" but what's the problem? Poor blacks were the first to figure it out through long experience. If you haven't figured out that the popo are the enforcers for the 1%, spending most of their time writing tickets to generate revenue to pay their oversized salaries and benefits, not to mention an extra tax for the city. I know, I know, if you didn't overstay your parking meter and break the law you wouldn't get a ticket. or, not put your registration sticker (every year need a new on, ka-ching) you criminal. I hate to agree with you about speech not being free, but....We no longer live in a freedom orientated society.

Maybe some of our freedoms we thought we enjoyed were illusions.  At least there was a time when the state was very subtle, lest folks perceive them as denying their liberties. Now the state just doesn't give a shit.  Now there are more than enough tv educated citizens to toe the line.  They could BBQ dissidents in most neighbourhoods and folks would go right along with it if their favourite TV people announced how important it was to fight terror or protect their freedoms.

I don't think the fellow who posted those lyrics meant them as a threat.  He will, however; serve as an example and pay one heck of a "stupid tax" for his actions.

Freedom of speech has essentially been erased through the process of political correctness.  For example...in many countries they have legal remedies (including jailtime) for those who make public "facts" that contradict the holocaust story. In good ole' USA, the government murders those who won't tow the line.

     http://www.free-edgar-steele.com

The matter of the lyrics should have been dealt with through a phone call or some peer related guidance.  The charges in this case will be used to rationalize further curtailments on free speech and/or other liberties.  All to make us safe from terrorists and keep us free.

Roland, the headless thompsom machine gunner,  Warren Zevon

Roland was a warrior from the land of the midnight sun
With a Thompson gun for hire, fighting to be done
The deal was made in Denmark on a dark and stormy day
So he set out for Biafra to join the bloody fray

Through sixty-six and seven they fought the Congo war
With their fingers on their triggers, knee-deep in gore
For days and nights they battled the Bantu to their knees
They killed to earn their living and to help out the Congolese

Roland the Thompson gunner
Roland the Thompson gunner

His comrades fought beside him, Van Owen and the rest
But of all the Thompson gunners, Roland was the best
So the C I A decided they wanted Roland dead
That son-of-a-bitch Van Owen blew off Roland's head

Roland the headless Thompson gunner, Norway's bravest son
They can still see his headless body stalking through the night
In the muzzle flash of Roland's Thompson gun
In the muzzle flash of Roland's Thompson gun

Roland searched the continent for the man who'd done him in
He found him in Mombasa in a bar-room drinking gin
Roland aimed his Thompson gun he didn't say a word
But he blew Van Owen's body from there to Johannesburg

Roland the headless Thompson gunner
Roland the headless Thompson gunner
Roland the headless Thompson gunner
Talkin' about the man, Roland the headless Thompson gunner

The eternal Thompson gunner still wandering through the night
Now it's ten years later but he still keeps up the fight
In Ireland, in Lebanon, in Palestine and Berkeley
Patty Hearst heard the burst of Roland's Thompson gun and bought it

I'm not sure you are balanced at this point. Are you depressed? What is going on?

Anyway I just drank half pint of 101 proof US Rum. I have no clue what you are talking about.

Well if you have inflexibility, mob mentality, or Group think about lynching people,... that seem to fit a description of the criminal mind... then you are just an "Unthinking Thug".

Best of Luck.

Well I should explain I don't look for buddies in this blog or other blogs. That separates me from the followers and the joiners I suppose. I just post stuff and most I expect is some ego boost... so I've not chased posters in anyway.

Goddamn fucking stupid assholes! you stupid shit FDA inspectors. The human body is simply a large bag of E.coli that has legs. Just because something has ecoli doesn't mean it is dangerous. It depends on the strain. Raw dairy by it's very nature has higher bacterial counts. I eat raw cheese and raw milk all the time. Yes, if the cows are raised in an unsanitary environment it is unsafe. However you erroneously think by pasteurizing the filthy product makes it safe. Many food borne illness outbreaks have occurred from pasteurized milk yet this is down played and raw milk vilified. I am so sick of your fascistic tactics and stupid propaganda! FOAD and eat shit ( which basically describes what your approved corporate " milk product" contains)

I think that the general rule with raw milk is that you should be able to talk to the people who produce it.  If Albertson's sold raw milk, you wiould be an idiot for buying it there, else it would be hella expensive because of onerous regulations that don't scale down to local farmers.  A local dairy where I can get a sense of whether or not it is clean?  That's a totally different story.

Tue, 09/09/2014 - 00:51 | 5196510 Miffed Microbio...
Miffed Microbiologist's picture

Mark McAfee of Organic Pastures is a good friend of mine. He asked me to give a talk at one of his local presentations on the benefits of raw milk ( one of the remaining few things Cali hasn't fucked up...well yet) Big burly guy and full of energy. He admits some people should not drink it due to certain health conditions. He showed me one of his experiments where he inoculated raw milk with Listeria and after incubation, could not isolate it. He did this with pasteurized milk and was able to isolate massive amounts of Listeria. This is because pasteurized milk is a dead product that is a good culture medium. Without competition from other bacteria, the pathogen grew rampantly.

When I worked on my husbands dairy 30 years ago, coliform counts were expected to be under 10CFU. In many states is is now 100 CFU. This is a dirty product considering pasteurization lyses ( breaks apart) bacteria which remain in the milk, often the source of milk allergies rather than lactose intolerance.

Corporate raw milk? That's about as safe as a purported benevolent dictator.

Miffed;-)

That natural balance is a powerful thing, if you can figure out how to take advantage of it.  It's the same in soils when growing food.  If you can have enough healthy and beneficial organisms, you have to worry little about harmful soil organisms.  A lot of fermentations depend on this too.  I think this ties into the bigger picture of where we have gone wrong.  When you look at something like GMOs, you see where we are trying to absolutely control nature.  Oh, sure, it takes scientific knowledge to be able to manipulate genes, but that doesn't mean that it is the wisest course.  And I think that we should pursue knowledge of genetics.  But we must not let our hubris lead us to the point where we are trying to absolutely control nature.  That absolute control will require absolute knowledge, which we will never have.

Instead, we should learn how to work with nature.  We should learn how to nudge it to our advantage.  Some things we can outright control, others, not at all.  We need to learn our limitations, and expect to be stymied on the outright control front more often than not.  Pretty much anything biological, expect to be stymied if you go for outright control, period.  That doesn't mean that we should give up on the ideas of antibiotics, but rather that we should be more thoughtful of how we use them.  I think that you, having watched an antibiotic effectiveness go from 70% effective down to 30% effective in a period of three or so years after it was introduced into agriculture will appreciate that.
