Caught On Tape: What Happens When You Try To Exercise Your Constitutional Rights In Illinois

What follows is the most powerful recorded police checkpoint scene I have witnessed since posting: Extremely Powerful Video – Happy 4th of July from a Police State Checkpoint, last summer. 

While the former incident happened in Tennessee, the following occurred in Illinois. The American pleb who was accosted by Illinois State Police was DeKalb resident Ryan Scott.

While it starts off slow, make sure you watch it all the way to the end.

While one of the the police officers is reasonable, the other one can’t stop yelling and seems to derive a particular pleasure from repeatedly informing the citizen he supposed to “protect and serve” that “driving is not a right, it’s a privilege.”

What’s also interesting, is you have to wonder if the second officer would have acted even more aggressively if Ryan hadn’t informed him he was being recorded at the end of the conversation.

He seems to have backed down slightly upon understanding the repercussions of the recording. It just goes to show the importance of filming police encounters.

I have been stopped like this, but I was a bit more fluent in my rights and putting the cop on the defensive.  He lost his temper and screamed at me, "IS there a problem why you won't answer my questions because you haven'ty answered one of them yet?!?!?!"  I replied, "I don't have any problem and am just asking some questions.  Am I free to go?"  On my way I went. 

Rights are like muscles and need to be flexed in order to have some definition.

No formal education needed to be a cop and uphold the law.  These cops, like most, are power trippin' floaters, sucking off the state.  When you truly need them, they aren't there.  When you're in an accident and want accountability from the other party, they say Hey, we aren't a collection agency.  Do it yourself.

They've got all the right answers to avoid doing any real work or taking responsibility.

This situation is really quite simple. There are only 2 phrases you need to know.

1) Am I being detained, or am I free to go?

2) I'm not being resistant officer, but I don't consent to unwarranted searches and seizures.

This is how you exercise your rights.

Result of #1: You will either be arrested if there is anything they can get you on, or you will be released. They can't keep you around while they try to dig up dirt on you. If they do you can lawyer up and they will be the one in the hot seat.

Result of #2: Any searches that occur without definitive probable cause will be nullifed in a court of law.

While agree with most of your statements, based on recent ecnounters involving the police, there is very little chance of them losing their badges. Heck, if they can kill you and/or your dog "preemptively", I highly doubt they'll get more than paid vacation for a violation of civil rights. Honestly, I more likely see them getting a medal.

Yeah, unless you are video taping or have a witness, it's your word against theirs and if they lie it can be difficult to prove your rights were violated. It's not always so black and white, but at least knowing how to exercise your rights is better than being ignorant.

If at all possible, they shouldn't be made aware of the fact they are being recorded. Otherwise they can claim you started something, confiscate your camera as evidence pending an investigation, then mysteriously lose it and drop charges. Ideally, one should be uploading the video to the Internet in real time backed up in the cloud somewhere outside of the USSA.

Is it because...

1) We live in the USSA.

2) Cops in Illinois are chatty Kathys and just want to kick it.

3) Drunk drivers are the number one cause of spilled beverages ruining leather seats, and being a cow state, Illinois has to stand up for those who can't stand up for themselves. Otherwise more cows have to die to make new leather.

4) This has been going on for a decade already. People have already been normalized to their loss of rights.

1) The driver was extremely douchy in the way he expressed his views to the officers (don't scream bloody murder yet; there's a counter-point on the way;

2) Despite #1, the 2nd cop lost his cool in a very unprofessional manner, and LEOs should be used to the shitty parts of their jobs (yeah, we all have parts we despise), since they inherently have to socially interact with the public. If the 2nd cop can't deal with whatever other issues he has in his life, as we all do, without losing his shit on a law abiding citizen for an admittedly annoying & needling (but not threatening nor illegal) interaction, he should take a vacation or seek counseling (or hang up the duty belt).

3) LEOs are paid by the taxpayers and serve the taxpayers; this doesn't mean they should be abused verbally or otherwise (and they do put up with a lot of shit - that's what happens when society allows mentally ill people to go homeless), but they don't exercise a position of relative superiority over the general public (they do and can exercise police powers under "color of law" when a crime is reasonably, articulably suspected or verified in progress, hence the need for professional, law abiding, moral LEOs).

4) We really need to establish whether arbitrary checklanes for traffic are or are not only viable, but conclusively establish if they're allowed per our Cosntitution, as they're creating way more stress & conflict than they merit (it's not as if there was a search for a suspected murderer when they pulled him over).

5) The public writ large and government employees at most levels are increasingly hostile towards each other in the fraying and decaying state of modern day America, and that's really tragic.

From an interpersonal perspective, the driver was a douche and the 2nd officer was a bully. The officers would have saved themselves a lot of bad feelings (I feel bad just watching) by sticking to their duties and not feeding the douche bag's victim pose. One solution would be to keep your mouth shut (the 5th amendment) and comply. Do not answer any questions. Lying to police is illegal and them lying to you is legal. Assume everything the police say to you as a lie. Oppose any search, but do not resist. I would recommend stepping out of the car, locking it and tossing the keys, if it gets to that.

The cop was being perfectly reasonable with him, yet he cries out "Am I detained?!?" I'm not a lawyer or officer of the law, but if you're being detained, don't they have to read you your rights? Eh. Whatever. He says that over and over even after clearly being heard by the officer that he was not detained, then proceeds to babble off constitutional rights as if he's about to be tortured or some shit. Puss.

Is a violent revolution what you really want? Yes. With today's technology Poison Gases, explosives, and even Biol;ogical Agents are well at hand with items easily purchased at Hardware Stores, Swimming Poool Supply Companies and Grocery Stores.

 

The people will NOT BE TAKING THIS SHIT ANYMORE and HAVING THE TAXPAYER PAY FOR POLICE MALFEASANCE.

 

The people have had a BELLYFUL OF THIS TYPE OF CRAP!!!

 

I am not the only one publishing that this can be done. There are many others, on many other Discussion Boards, posting this type of information. (Lord knows that I have linked to videos of devices and wrote about simple modifications.)

What exactly did he do illegally?  If the cop had drawn on him and he drew in defense, shots were fired, and the cop was killed, what crime would he have committed there?  If you don't get it, you need to stop the roids and get on a program.  There is no law stating you have to be sweet as pie to anyone, cop or otherwise. He did not pull a cop over and get in his face.  The police started this interaction by pulling him over.  He owed them nothing.

We have too many goddamn cops, exhibit A being the conga line of assholes given AR-15s and body armor everytime there is a parade.  No cop has ever saved me from any thing.  They do like to hassle people for turn signals, speed limits, and speed belts.  What I have found is the cops like to enforce the laws averyone already follows, and then drop the hammer on some soccer mom in a van to show their man hood.  When this clusterfuck of a social order finally implodes the cops are going to be high on the list of payback.

I don't need some short dick, low self esteem, sadist to protect any of my property or person as I am more than capable and more able than 90 % of the meatheads that have unfortunatly been given a badge and gun.

Well, I would have to say that the questions the driver were asking were legitimate, the first officer was handeling it just fine, yet the second didnt like being qustioned and acted inappropriatly. It is unlawful to detain a person with out probable cause, if an arrest were made for a crime then what would have the reason been for the initial stop? Further more, if the Vehicle is an extension of the home for purpose of privacy how does one explain ripping the door open? I could see an officer where I live getting n deep shit for acting like this...and just a heads up Im not another cop hating dope smoker My whole family is cops including a sheriff....so while you purport to support Cops I would say you are excusing a bad one with shitty excuses.

re: calling 911

  Too long a story to go in depth but my family has been dealing with a female stalker for going on 2 yrs. Multiple 911 calls have been made and average response time has been 5 minutes to closer to an hour. The 5 minute one brought 2 very tense and alert cop cars. Probably something to do with me reporting shots fired by me to run off the psychotic drug using bitch. Gunfire apparently gets a quick response. I am in TX, in the county and my property so gun play is allowed. We are bombarded with phone calls night and day during her peak drug binges and/or psychotic breaks. Did finally get her chucked in jail for a few weeks for criminal trespass on 2 separate occasions. Her last shot was an anonymous call to CPS which garnered us an unanounced visit to investigate me for sodomy of my 3 boys and a non-existant grandchild and I am supposededly a meth user. I was asked about guns in the house, "none of your business". I was asked to take a drug test, "Hell no!". In case you did not know CPS is required by law to follow up on anonymous child abuse cases. We talked, she taked to the wife and kids alone one on one. Nothing there and she headed off to screw with someone else. 

  Yes, I call 911. Yes, I make visits and emails to the Sheriffs. It's called a paper trail and in my case covers my ass when I shoot the psycho bitch if she shows up and so much as picks up a rock or waves a stick at me. The cops are busy I guess and they show up after the shit goes down and write reports. Fact of life, we don't get a personal cop to follow us around all day and keep us safe. Which is why the 2nd Amendment is so critically important.

  DUI/seat belt check points are illegal as fuck under our Constitution. If I am weaving down the highway, fine pull me over, fair enough. Just out driving? Leave me the fuck alone and don't get angry at me when I refuse to cooperate at your checkpoints. I do hope the jerk cop gets a lot of exposure in his local media and cop shop.

Yes Headbanger I know what "shit bags are out the cops have to deal with".  The fact that they and our justice system are not dealing with the "shit bags" has a lot of us ready to rebel against the type activity the guy in the video experienced.  The cops are harrassing good law abiding law respecting citizens with mandatory road side seat belt checks, in Texas it is a bi annual campagin they call "Click it or Ticket", while gang bangers are taking over entire neighborhoods and illegal aliens run free.  The Cops would be more respected if they did more respectable work.  They had better get on the side of The People soon.  I predict the lawlessness by our "leaders" and their enablers will not be tolerated much longer.

I've always taken exception to the phrase "driving is a privilege, not a right". While it is convenient and can be fun to cruise along etc., if everyone stopped driving the economy would crash in about a week. In the longer term, all the unemployed factory workers and those employed in acillary plants would also lose their jobs, further worsening the situation.

7-8 times out of 10 when driving, most do so for someone else and not necessarily for themselves or their pleasure.

I think the saying should be "driving is a necessity".

I question the legal information on the NY flyer (note: I'm an attorney admitted in NY). The Pacamor case they refer to regarding placing the summons under the windshield wiper refers to how service of process was achieved in a civil matter. Being pulled over is a criminal matter. Sure, you may be able to frustrate an officer with this fairdui flyer, I'm not sure it's legally sound though. As for the other citation, "CPLR" stands for "Civil Practice Law & Rules", the context of being pulled over by police is criminal, not civil.

Personally, I would advise opening the window one inch, just enough to immediately hand the officer your license/reg/insurance, otherwise keep both hands on the steering wheel, and just hand the documents immediately to the officer upon being pulled over without saying anything or responding (nothing more than shrug of the shoulders, ideally).

Make sure your open bottle of whisky and big bag of cocaine aren't sitting on the dashboard or passenger seat.

Provided, however, that a photostatic copy of the certificate of registration may be produced in lieu of the original certificate. If a vehicle does not have affixed a validating sticker which indicates the plate number, the vehicle identification number and the expiration date of the registration, the failure to produce the certificate of registration, or a photostatic copy of such certificate, shall be presumptive evidence of operating a motor vehicle or trailer which is not registered as required by this article.

The Constitution, like the Bible, is only as good as those empowered to interpret it. Except the Bible is only going to imposed on you by a Priest and the Church, which you are free to leave, whereas intepretations of the Constitution and any other active laws are going to be coercively imposed upon you by the Supreme Court, the Executive branch and the Police, as long as you remain within this country or a citizen of it.

Unless you want to take up arms against them (which is outside the scope of anything I've said here), I am just providing information on the basis of what the Supreme Court & judiciary are currently likely to agree with. But the Constitution is re-interpreted often, lately for the worse, but if you have deep pockets maybe you can afford litigating something all the way up to the Supreme Court -- a Court which is actually constantly "invited" to form a new intepretation of the Constitution by whatever cases come before it. Regrettably, the same douchebags passing all of the bullshit laws here are the same ones who seem to be selecting Supreme Court justices.

But anyway, it is luck that has allowed this country to do "well" for so long, rather than the fact that our Constitution is infallible and so clear so as to only yield one logically consistent and perfect interpretation. If you actually read the Constitution directly and don't consider any context which might provide details to enhance your ability to interpret it (a context which we take for granted, because we have all of these well established interpretations of the various amendments going back centuries at this point), I would say it's not the clearest document (and that is an understatement). I think it is bunk that if somehow we reached this Constitutionally pure Shangri-La that some, e.g., of the Tea Party seem to believe in, that all our problems will be solved. I think we'd be better off not assuming that all our problems are related to misinterpretations of the Constitution, but rather calling out the obvious culprits of our political establishment and their greed and power hungriness as the reason for all of our government's problems. Slavery was once constitutional...

The only point you overlooked in the quote of the must-provide statute is that the police must have probable cause to stop you. They must have reasonable suspicion in order to compel you or control you. Checkpoints are perfectly legal (and constitutional) if when the cop says hello and you say something back and he lets you go. They are also properly authorized (after saying hello) to ask for driver license and other papers IF the cop smells alcohol on your breath OR you display physical symptoms of being stoned/loaded/wasted/buzzed/etc.

Under NY law, there are 2 ways you can be stopped by police while driving: (1) you can be stopped briefly at a sobriety checkpoint, or (2) you can be pulled over by an officer who has observed any driving offense (failure to obey marking for, e.g., swerving out of a lane, failure to obey stop/no left turn/no u turn sign, dead taillight, etc.). At that stage, when you have been pulled over, you must produce your registration, driver's license, etc for inspection upon request according to this statute (VTL 401). 

You actually cannot be pulled over by the police randomly if you have not committed any traffic or other offense in New York. That is, you haven't swerved, speeded, failed to fully stop, failed to signal, etc., etc.. In practice, this may result in you being followed by the police for a good while potentially, waiting for you to make that slip up if they really had a bullseye on you I suppose. So once you're pulled over in New York, you're going to have to produce your ID. They already have enough to demand all your driving paperwork.

Though you may have a point, and I agree that it is essentially over invasive that we have these sort of "papers, please" checkpoints masquerading as sobriety checkpoints, which are most likely way less effective than those cops just driving around finding erratic drivers. But every state has different laws -- New York permits police to ask for your name, though you are not required to carry ID (the NYCLU has good info --> http://www.nyclu.org/node/3249 ), but I think in the context of driving a car, asking to see a license is incidental to the sobriety checkpoint.

An acquaintance of mine was riding as a passenger in Massachusetts. The vehicle was pulled over for a minor speeding infraction and the driver complied by handing over his papers. The officers partner went to the passenger side and asked that individual for his papers. The individual politely asked why and what offense did he commit. The officer asked again and the individaul responded in the same manner as before. The officer did this again and after the same response, opened the door and punched said individual in the face. The individual again refused to provide his papers and asked what his offense was. The officer then backed off and left.

Too bad they didn't record this one.

Thats outrageous... Generally, the police should not be asking the passenger anything unless they have, at a minimum, "reasonable, founded suspicion" that they may have committed an offense/plan to commit an offense (basically the criteria for a "Terry Stop", the sort of stop that is the first part of a "Stop & Frisk", and one step below "probable cause"). And definitely not punching the passenger. If the passenger didn't say or do anything to give rise to some sort of suspicion, that shouldn't have happened -- but I am no expert on Massachusetts law. I'd at least try to sue the cop on civil charges.

EDIT: It seems it's OK to ask passengers for ID according to the Supreme Court, but individual states may impose stricter restrictions on interacting with passengers (New York has stricter statutory standards I am fairly certain, at least, but no idea for Mass.)

The police can ask for pretty much anything. They use their position of power and authority to make people think it is ok.  Power: "If I don't identify myself, he might make up something and arrest me."  Authority: "He knows the law better than me, and he wouldn't ask if it was unconstitutional, so I should do what he wants."

For example, in my state, if the cop has reasonable suspicion you have, are, or will commit a crime, you have to state your true, full name. Law also says that's all you have to say.  The cop can ask for date of birth, SSN, address, etc. but you don't have to give it. ARS 13-2412

I'd like to see a ref that limits what a cop can ask.

I couldn't tell you for other states, but in NY the relevant restrictions can be found in the Debour case (often called the "Debour factors"). For example, at the lowest level, e.g. pre-reasonable suspicion, police officers are not allowed to ask questions that would "reasonably cause someone to feel they are suspected of a crime" (or something like that). I should also note I do not practice criminal law, so this is stuff I know but do not regularly practice. I would again note that the circumstances of a police officer approaching you in the street with some questions differs from the situation of a passenger in a vehicle that was pulled over, which effectively means both the driver and passenger have been "seized" for 4th Amendment purposes. Though actually I would need to look into it a bit further to have an absolutely clear idea of whether you have different protections as a passenger pulled over in a vehicle versus any other random encounter with police.

What are the 3 valid causes of action?

1. Injury or property damage

2. Violation of a legal right

3. Redressability by the court.

 

Need to go back to law school or did they not teach you this (probably not).

Being pulled over by a police officer for a traffic stop, in the circumstances contemplated here, can ONLY be founded in criminal law. I suggest you go to law school, for the first time, as a more sensible way of understanding this, rather than me returning to law school after successfully passing the NY Bar Exam.

Here's to hoping that most of these bullshit laws will be rendered meaningless in the 'great reset', 'great unraveling' or second American Revolution...call it what you will.

 

Laws should not become so arcane that we, the average citizens, have to spend so much of our hard earned money to have annointed ones from the Bar explain them to us.

Completely agree, and I think we should start by banning police officers from lying to us... completely undermines public trust in the "justice" system.

I think we should require lawyers to wear uniforms, like cops. 

It'll make targeting easier when the time comes. And it is coming.

Don't they already swear to tell the truth in a court of law? I have seen LEOs lie their asses off under oath. A lot of good banning them from lying would do. Get real.
