Internet Gambling Ban: A Winner for Sheldon Adelson, A Losing Bet for the Rest of Us

Most Americans, regardless of ideology, oppose “crony capitalism” or “cronyism.” Cronyism is where politicians write laws aimed at helping their favored business beneficiaries. Despite public opposition to cronyism, politicians still seek to use the legislative process to help special interests.
For example, Congress may soon vote on legislation outlawing Internet gambling. It is an open secret, at least inside the Beltway, that this legislation is being considered as a favor to billionaire casino owner, Sheldon Adelson. Mr. Adelson, who is perhaps best known for using his enormous wealth to advance a pro-war foreign policy, is now using his political influence to turn his online competitors into criminals.
Supporters of an Internet gambling ban publicly deny they are motivated by a desire to curry favor with a wealthy donor. Instead, they give a number of high-minded reasons for wanting to ban this activity. Some claim that legalizing online gambling will enrich criminals and even terrorists! But criminalizing online casinos will not eliminate the demand for online casinos. Instead, passage of this legislation will likely guarantee that the online gambling market is controlled by criminals. Thus, it is those who support outlawing online gambling who may be aiding criminals and terrorists.
A federal online gambling ban would overturn laws in three states that allow online gambling. It would also end the ongoing debate over legalizing online gambling in many other states. Yet some have claimed that Congress must pass this law in order to protect states rights! Their argument is that citizens of states that ban Internet gambling may easily get around those laws by accessing online casinos operating in states where online gambling is legalized.
Even if the argument had merit that allowing states to legalize online gambling undermines laws in other states, it would not justify federal legislation on the issue. Nowhere in the Constitution is the federal government given any authority to regulate activities such as online gambling. Arguing that "states rights" justifies creating new federal crimes turns the Tenth Amendment, which was intended to limit federal power, on its head.
Many supporters of an Internet gambling ban sincerely believe that gambling is an immoral and destructive activity that should be outlawed. However, the proposed legislation is not at all about the morality of gambling. It is about whether Americans who do gamble should have the choice to do so online, or be forced to visit brick-and-mortar casinos.
Even if there was some moral distinction between gambling online or in a physical casino, prohibiting behavior that does not involve force or fraud has no place in a free society. It is no more appropriate for gambling opponents to use force to stop people from playing poker online than it would be for me to use force to stop people from reading pro-war, neocon writers.
Giving government new powers over the Internet to prevent online gambling will inevitably threaten all of our liberties. Government bureaucrats will use this new authority to expand their surveillance of the Internet activities of Americans who have no interest in gambling, just as they used the new powers granted by the PATRIOT Act to justify mass surveillance.
The proposed ban on Internet gambling is a blatantly unconstitutional infringement on our liberties that will likely expand the surveillance state. Worst of all, it is all being done for the benefit of one powerful billionaire. Anyone who thinks banning online gambling will not diminish our freedoms while enriching criminals is making a losing bet.

that's not the real issue, most of those people would self destruct on something. the real issue is the parallel shadow banking industry, the vampire squid, run by the powerful CBs in the G20. these people direct the flow of cash surreptiously between themselves, through fixed FX markets, rigged LIBOR, and all sorts of carry trade swindles. now with much more money flowing through this subterranean river, you expect your freedoms to actually be better, because you happen to believe in everyones right to do what they want to themselves? your control of the global banking cartel and the polticians they annoint, will disappear much faster than you gain that illusory freedom of playing blackjack in your pajamas. there are two schools of Libertarians, the old school, Ron Paul and the new corporate rights Libertarians, when you vote for the first one, you end up getting the second.
The only nit I have to pick with Mr. Paul's writing, is his use of the term 'likely', when describing what may or may not happen. He should simply stick with 'Will', because when it comes to government Force, there is no 'likely' happening of anything, rather it Always 'Will' happen.

I have friends in Baja, ex patriots, who live there for one reason only, online gambling. My neighbor who is only 35 and has a degree, does it professionally. He make a good living from it.
Why Mexico?
The off shore sites they use are accesable from Mexico, not USA. I suppose big bro has cut these places off from citizens for awhile now, meanwhile Mexico benefits by renting homes, etc to the gamblers who help support the local economy.
Many ex pats choose Mexico as it is close to home for things like the VA and family, but they are free there, not like their homeland.

Dr.Paul is correct as usual, but I think this one of allowing gambling sites is a difficult one to sell as a constitutional or moral issue to the public. I would tackle this from the enforcement perspective as the only way it can be enforced is by banning IP addresses and URLs associated with gambling sites - setting a dangerous precedent of blatant censorship of what people can see on the net.
If the censorship/blocking isn't done at the ISP level, then the enforcement would have to be based on the user records of visited sites, for which I'm sure the NSA would be delighted to provide data on every American. The citizens would then be in the ridiculous situation of going to jail for seeing an advert for gambling on their browser.
I don't want to be one of those ZHers who keep bashing the USA, but almost every day the corporatists, bankers, and the Federal govt give reasons to exclaim, WTF! Even though the UK is not much better (Worse in some aspects) I am dumbfounded by how bad things are for the ordinary people living in America.

All gambling is legalized theft of people with feeble minds. If statistically you are guaranteed to always lose then you are bing robbed with your consent.
The only way it can be argued that it is not theft is if it has entertainment value to the player however these feeble minds actually believe that they will get rich and entertainment is not their primary motivation.
I suggest that that is also true of saving as currently generally practiced in the USA.

We were a bit innocent in our attempts and we have paid the price. We learned the hard way. They won't let go either as we must be in some database. I know some folks from 2008 and some younger folks from 2012. We can't get jobs because we are poison I guess. Would I do it again? Yes.

Somebody on one of these threads made a good point the other day, expressing the thought, essentially, that blaming others - bankers, politicians, certain religious or ethnic groups, for our own misfortunes was missing the point of personal responsibility.
And isn't that the soul of what's today known as libertarianism? We make our own decisions, though I must admit that making decisions based upon poor choices - like voting in some countries - isn't exactly what I'd consider much in the way of freedom.
Still, take your own path. I've found that ignorance can be your friend. Just don't pay too much attention, and maybe the spies and surveillance community will just pass your by.
I think a lot of what's being thrown around as gospel about the depth and reach of the surveillance is a bit of a reach.
Let's do some math.
320,000,000 people in America. Maybe 200,000,000 adults. OK?
You want to watch each of these people an average of fifteen minutes a day.
Your guys work 6 hours a day. Really, and that might be a stretch, and, a lot of that time, they're not paying attention.
So, an average moron working for your spyteam can monitor, on average, 24 people a day (15 min per person = 4 per hour X 6 hours = 24 people monitored per shift per slave, er, moron, er, worker.
To monitor 200,000,000 adults (leaving the kids totally on their own, wow!) at a rate of 24 per monitor, would require 8,333,333.33 employees. Really. So, there has to be a better way, right?
Screening phone calls and internet traffic. That would probably be easier and more efficient. Check.

The method for recording our activities are digital, meaning every credit card purchase, every channel you watch, every website you visit, power usage, vehicle type, location (GPS on iToy), conversation (digitized and transmitted)...ETC...all of these things are recorded for the primary purpose of:
BEING REVIEWED and used against you LATER IF/WHEN someone accuses you of commiting an act against the state.
HOW do you think politicians are OWNED.
DO you not understand, with this level of knowledge, you can be easily FRAMED. Anyone (government) with that level of insight, can paint a (false) picture of your activities, present it to a judge, and have you searched and arrested.
No jury can look at that type of framing and let you return to your family. The more they know, the easier it becomes to silence opposition. And remember, YOU may not be the target in the matter, they may want a family member or insider information at your place of employment.

I work with 'big data'. There are two parts to any message datum - the actual information, and the 'wrapper' - the time and date, recipient(s), method of communication, etc. The wrapper is often called 'meta-data', and it's all you need to form a pretty good picture. (Someone else on ZH did a good summary of this using the American Revolution's Boston-based patriots as a start - without knowing the details of what happened at a single meeting, the tracking of meeting attendance at 'suspect' organizations would quickly lead you to linking names like Adams, Henry, Revere, etc) In "Spycatcher", ex-MI5 Peter Wright showed how they identified the chief Russian spy in London simply through the volume and length of telephone messages, without knowing the content of any of them. By recording purchases, travel (through hotel, restaraunt, even gas station receipts), communicatinos, websites visiited, etc., TPTB have accumulated a vast dossier on any one that can be looked at two ways.
The first way, as you suggest, is to build a case against anyone thought to be a threat. But the second way is to use it to build a complete picture of the forces arrayed against the fascist state, and then infiltrate, incite, and incapacitate through a variety of means. A rag-tag, not very important group might be incited to a small crime, and then all arrested pour encourager les autres, as the French say. A more disciiplined group might be infiltrated, tracked, and used to find other groups within or without the country. This was the method O'Brien used in "Nineteeneightyfour" - using Smith to catch Julia as well. Neither approach bodes well for an overthrow of the current fascists.

and so, to follow on your points -- and because you ended your post with a question disguised as a statement -- i'll say that you've pretty-well established what i believe are the parameters of its methodologies and the specifics of its focus. its primary objective is to support the continuity of whatever is in power; for that is ALWAYS the elemental focus of any power -- to secure its primacy for as long as possible.
when evaluating this paradigm it must first be understood that they've think-tanked every conceivable contingency and have developed strategies to contain and ultimately neutralize whatever threats it's programmed to recognize...and they have the resources to contend with just about anything anyone could imagine. and to my mind, the obvious failure of this system is its inability to anticipate an attack on its weakness; its only projected strategies are premised on an attack of its strengths. in other words, this system assumes that a rival will attempt to undermine its strength rather than slipping down and slicing its Achilles heel.
and if this system has any weakness, it's the faith that undergirds it. people need to believe that what they are doing is ultimately for a justifiable good and also that it represents some notion of progress. and when you come to the central pillar in the temple of the amorican mythos you find 'the new good'. what i mean by that is reflected in St. Paul's sermon on mars hill. when he came into the city gates, it is said that the wise men of athens were sitting around waiting for something new. and the apostle to the gentiles then addressed the wise men of athens as to the identity of the 'unknown God' occupying some place of esteem in their pantheon.
this system's architects understand this fundamental human impulse; and they, like the Apostle Paul, understand how to convincingly define the nature of a new god to its expectant adherents. i should say, they 'did' understand how to convincingly define the new god of the 'new good' for the world and the citizens at the seat of its power (we the american people), but many if not most are doubting the ultimate goodness of it all and its become so stale as to loose its currency of newness. rotten and rotting is the swelling impression. and as Christ said, "when salt loses its saltiness, what good is it? it is to be cast on the dung-heap."

Who knows where we're going? But, banning internet gambling (I admit to never having heard mention of this bill, but I will look into it), is simply ludicrous, not to mention the potential for even more government looting of the public.

I'll say this, "sadly Dr. Paul is wasting his time reciting to morons who think that people walking into a corner store to buy a ticket that allows you to have a chance at winning a large sum of money is good for the state, province or country because it creates wealth in certain areas is a good thing". As a Canuck I have watched our own country turn into Slot machines, roulette tables and card games. Not to mention the corner store choice of games of which a new one comes out every other week it seems. The latest government thought around the whole mess in Canada was, "how can we get students to play more and buy more tickets?" "They are not playing enough?" or so this type of thinking goes. The very first thing that comes to my own mind is, "exactly how fucking stupid do you have to be in order to conjur forth a thought of this nature and believe it?". It reminds me of the member of congress back a few years who went on record saying that a way to solve the job dilema was to get people trading more. Of course he was serious. I am a trader myself and I know how fucking hard it was for me to become profitable.
I am reminded of a debate I had a few years back with one of the employees of the OLG (Ontario Lottory and Gamaing Corporation) where his argument was based on, "well we put $25,000 worth of winnings into the area each week". I simply stared at him, nodded my head and walked away. Obviously his justification was for his high priced government job related to the industry and his near sighted, distorted thinking that somehow more good was coming of all this than bad. Adelson is a corrupt Jew. I can say that because I am one. A jew that is. Making billions from others losses is a complete and utter sham. I do not begrudge his riches, only how he aquired them. His argument would be, "ya well if you don't like it then don't play", or "I do more good than bad". Gone would be any sort of thought as to how much human productive capacity was lost as a result of his industry and the morally bankrupt people in it. He is one of the reasons why pepole dislike Jews activities. However he is not alone. Western governments the world over think it is "well....ok because it helps create wealth and tax revenues in areas that would otherwise not have them". It is a completley moronic argument that any child of 4 could see through but yet easily justified by our present stupid, leaders. When I was younger gambling was just that, "gambling". It was highly discouraged and chased away from an area as fast as you could and for very good reason. It was looked on with disdain and grouped into a topic you would normally be discussing when talking about drug dealing and whore houses. Yep, I'll second that. Had to go volunteer at a casino for my kid's public school last year. It brought in 60k to buy necessary things like smart boards and ipads. Brutal on so many levels.

I'm against legalized gambling -of any kind. I've lost a fortune on the stock market. But I am against federal prohibitions and regulations of any kind. let the citizens of sovereign States regulate their own activity -subject to minimal oversight from the federal courts to preserve the freedoms set forth in the Bill of Rights. If the States were doing their jobs, and not preempted by Big Brother Feds -the wall Street ciminals would all be in jail.
Indian gaming is the ultimater form of crony capitalism. The tribes get licenses from government and are reliant on state and local goernments to allow transportation access for gamblers. THis money pit is immence in California and has made the indians and the Democrats bestest financial buddies to the tune of hundreds of millions of dollars.
My understanding on "Indian" casinos is that because the brick and mortar is located on a foreign nation's soil, the particular tribe operating it is pretty much at liberty to conduct their business any way they see fit. In other words, if the particular purveyor of an establishment decides to renege on a pay out of an otherwise "legitimate" winning, there's nothing our cherished 535, DC judiciary or even our beloved leader's Executive Order can do about it. i dont want to get snarky with mr paul , who i respect, but it was internet gambling (casinos) through offshore accounts funded by venture capital groups to recycle illegal campaign funds for the GW2 illegal funds via Tom Delay at the behest of Jack Abramoff (who was playing one american indian tribe against the other) which funded the trillion dollar theft of the UST, which Bernanke had to monetize (somehow), and ultimately led to the TAXPAYER bailout. now sure you run a war off balance sheet, you have to expect these things. recently CA had a bill to open gambling to other than reservation tribes, but the public beat it down. i guess there are too many statists, who think campaign financing should continue to lurk in the shadows, wherever vice can provide a front for the activity. but hell man what is the state lottery, but a giant ripoff. in the end the CA voters are right, keep gambling on the indian reservations, or in Nevada. but ultimately the access to dirty money channels is not going away, either way.

A bit O/T, but it would improve readability GREATLY if we had a simple feature that collapsed a single posters comment box by default so we didn't have to listen to them. I don't mind skipping over the trolls much, but sometimes the thread becomes very hard to read (i.e. long and skinny) because of a gaggle of idiots. It can be a real pain in the ass on my phone.
Or maybe a mouse-over to see who voted how, not that I care that much. It would help shed light on agenda-driven voters ...

Well, I didn't up or down him but I suspect some of those votes came from people uninterested in a side bar discussion to the issue at hand, could be wrong, who knows.
The main issue as I see it is favoritism, cronyism, purchased at the expense of all of our liberty.
The federal government using (or being used for) regulating, law, licensing as "tools" to promote or (in this case) ban one venue of gambling over another is simply wrong. Personaly, I'd rather have 1,000 multi-millionaires instead of one multi-billionaire, not that there's anything inherently wrong with one multi-billionaire, its when that one multi-billionaire chooses to infringe on our liberty (if I chose to gamble on-line) that I start having a major problem. And as a diclaimer, I have never done on-line gambling or fantasy football or set foot in a casino.
If Adelson thought he could buy enough votes to get Friday-Saturday night card games banned in homes all across the country, he certainly would, to drive that business in his direction. We as a nation should always err to the side of more freedom not less.

This is an interesting post because it's calm and rational, and apparently the reference to Warren Buffet is correct, also; according to the un-authorized biography by his daughter; his idea of a perfect business model would be a monoply so he could charge as much as he wanted; so the friendly grandpa from Omaha is definitely a public relations exercise. On the other hand, he once bought about 1/3 of the Silver Bulliion in the Comex Warehouse; for cash; he "took delivery' as they say, and had it all registered in his name. this caused Silver to jump from $6/oz. to $7/oz. overnight; in one day. He did this because he and his buddy are constantly researching available statistics and they knew in 1998 that we were in for some kind of super crash and possible inflationary burn-down; but he sold it all again, at a loss, sometime later; according to the daughter because he didn't want to be a "bad guy" who had profited from everyone elses problems; so apparently the friendly grandfather thing is important to him emotionally. This whole process mystified the Futures Traders completely, they ran an article in Futures Magazine to the effect that he had finally beome senile !
