It says a lot when insurance companies are on the side of the government. Obama and his cronies have eliminated competition and created guaranteed revenue for insrance companies; which results poorer service and no motivation to keep costs down. This is right out of Atlas shrugged. Small business, the largest istorical component of job creation, is struggling and dying. The oligarchs are getting richer as big business gets protected by Obama. He's not different than Putin. Our president is corrupt and cares not if he flagrantly breaks laws because as a calculated political move there is no one to smack him down. My worry is that this guy is dividing the country so recklessly that some angry dissenter is going to fire the shot that will be heard around the world and we'll be in our next civil war.
Obama is a lame duck, so all the "sins" will now be loaded on him, including a market crash.

Cute quoting US legal code when we all know the law means nothing when the President, CONgress, the Supreme (snickers) Court, and the worthless Attorney General does nothing to enforce the black letter law for EVERYONE regardless of status or position.
That's because it is in no one's (in power) interest that that the letter of the law be followed. However, there are alternatives, there is nothing in the Constitution, that prevents the Congress from explicitly devolving authority over immigration to the States. Yes, there would be have to be nullification of certain legal precedents regarding freedom of migration between States, but changing the law is within Congress's authority. And if voters in a given State were stuck with the immigrants they allowed in, and had to pay for their upkeep out of local taxes, they might be less inclined to open the floodgates.
Interesting point. I'm quite certain that the reason we cannot see any Obama college records, is not because he failed Biology, but because he accepted aid as a foreign student. Can you imagine how much $ we spend, on Federal agents sitting on all those folks he went to college with, threatening them with FBI/IRS scrutiny? What on earth does this sentence mean? To work within a law means to constrain yourself to what that law requires.
The actions taken by Carter, Reagan, Bush, and Clinton are generally seen as "fixing" issues that certain laws "should" have addressed, but didn't. They issued executive orders to fix something they saw as needing fixing. The same thing Obama is doing. In this, the President's are no different from each other, in spite of the Republic blathering.
This is a discussion about the constitutionality of executive orders. There is no question that the U.S. Constitution gives the President the right to issue such orders. That same constitution gives the U.S. Supreme Court the right to declare a specific executive order unconstitutional. And they have done so in the past. But they won't declare this particular executive order unconsitutional, because it is not.
In terms of what it does, and in terms of how it is constructed, this current executive order is no different from the other executive orders referenced in the linked article above. They weren't unconstitutional. This is not unconstitutional. Those past executive orders did not make that President a King. Neither does this one.

Only Congress has the authority to legislate. Executive Orders are not considered legislation. Laws are binding on all people. Executive Orders are binding only on the people who make up the Executive branch of government.
It might help to understand that Congress passes laws that are intentionally vague, because they know situations will come up in the future that they can't currently anticipate.
The responsibility of the Executive branch is to implement the laws passed by Congress. The various agencies of the Executive branch accomplish this by creating rules and regulations and enforcing same.
Here is a nuance that many people miss: We are not governed directly by the legislation created by Congress. We are governed directly by the rules and regulations created in the Executive branch in response to that legislation created by Congress.
The President has the responsibility to see that the legislation of Congress is carried out. He does this by overseeing the Executive agencies that create, implement, and enforce the rules and regulations that give meaning and life to a particular piece of Congressional legislation. Executive Orders are part of this process of exercising oversight over the process of creating and implementing and enforcing the rules and regulations.
Executive Orders do not create legislation. Only Congress is authorized to do that. Executive Orders influence how that legislation is translated into rules and regulations, and how those rule and regulations are implemented and enforced. That is behavior that is required of the President by the Constitution.

Boehner is on Obongo's side on Amnesty. The GOP elite are DOWN with making America a 3rd world racial nation. There are exceptions, Jeff Sessions Senator from Alabama comes to mind. Rand Paul sold us out long ago. Cruz is against illegal immigration but all for LEGAL IMMIGRATION, and let me tell you it was LEGAL IMMIGRATION that really killed this nation. griffey247 - please see my post upthread for how the government actually works. Only Congress can make laws / pass legislation. But we are not ruled directly by that legislation. We are ruled directly by the rules and regulations that the Executive branch agencies create, implement, and enforce - as part of their constitutional mandate to faithfully carry out the legislation passed by Congress. When you really get that, all of this stuff will make more sense.
Executive Orders are not laws. They do not affect all people. They are directed at Executive branch workers who are charged by the constitution with carrying out the legislation passed by Congress. They are part of how the President carries out his contitutional duty to execute the legislation passed by Congress.
Most Congressional legislation is non-specific - to leave room for the legislation to apply to situations in the future that are not forseen now. This leaves the Executive branch agencies to figure out "Congressional Intent" in many instances. And, because of this vagueness in much legislation, there is much debate and disagreement over what the intent of Congress actually was when the legislation was passed.
The Executive branch agencies are required by the constitution to carry out the legislation. This means that they must create, implement, and enforce rules and regulations that are much more specific than the underying legislation might be. That doesn't meant that the Executive branch is creating legislation. It only means that the Executive branch is doing what they are supposed to be doing - interpreting the legislation so that they might make specific rules and regulations. Executive Orders are meant to help the Executive branch agency people figure out which particular interpretation to apply to the target piece of legislation. That direction to his worker-bees on how to interpret the legislation is within the constitutional authority of the President.
Honest people can disagree over the interpretation that the Executive branch agencies have placed on a specific piece of legislation. But, again, this disagreement over interpretation does not mean that the Executive branch is creating legislation. They can't create legislation, because they are not authorized by the constitution to do that.
To be fair, most straight men in our society are still teenagers, even in their 50s. Nothing about them really has changed since they were 13 years old.

i have no shame in saying in can't stand the General Public. I'm elitiest in the sense that i hate laziness. and i'm not saying someone working 12+ hours a day to make as much as they can is the goal. it's the mental laziness. sure lets even lop off the botton 50% of obvious drains on society. But even when you go higher is the supposide intellectual ladder. no one has any desire to actually learn more than their chosen speciality. You can be a doctor, but can't turn a wrench, beat it. or a mechanic that doesn't want to learn about the stock market or economics, beat it. Specializaiton is the ultimate form of laziness. specialization, i believe, is also the reason for the extreme polarization today. when you one ever do one thing, it's impossible to see or understand other perspectives.
There are exceptionally bright people. Of course they are Third Deviation. They are well rouded and are multi-skilled and have interests which are extremely varied.
But has it ever occured to you that 98% of the people are not anywhere near as gifted.
It is really not laziness at all. It is a lack of capability.
I do not despise them for that limitation, or, that they fail to fufill MY expectations.
I have just learned to expect less. In that way my expectations are not spoiled. And if they surprise me then I have an interesting interaction to enjoy.
Perhaps it is you who are expecting too much out of them. Just because they are not as bright does not mean that they haven't any worthwhile qualities.

It's official QE4 has begun....boost poplulation in an effort to creat demand! The problem, like all of his policies is that these people where already here creating demand...so all this does is now layer on costs to actually pay them to be here, with benefits. so just like QE1-3, this "QE4" won't work either, but since they think that if it didn't work before, do the same thing but bigger....QE5 will be importing 10million NEW people.
