"We Blew It," Chuck Schumer Says Democrat Focus On Obamacare Was Wrong

With friends like this, who needs Republicans. President Obama may be turning over in his golf cart this Thanksgiving weekend as no lessor Democrat than Chuck "get back to work, Mr. Chairman" Schumer said Tuesday night that Democrats acted wrongly in using their new mandate after the 2008 election to focus on the issue rather than the economy at the height of a terrible recession. As National Journal reports, Schumer exclaimed, we "blew the opportunity the American people gave [us]." Little late to distance yourself from this cluster-tax chucky boy...

 

As National Journal reports,

Sen. Chuck Schumer upbraided his own party Tuesday for pushing the Affordable Care Act through Congress in 2010.

"After passing the stimulus, Democrats should have continued to propose middle-class-oriented programs and built on the partial success of the stimulus, but unfortunately Democrats blew the opportunity the American people gave them," Schumer said. "We took their mandate and put all of our focus on the wrong problem—health care reform."

The larger problem, affecting most Americans, he said, was a poor economy resulting from the recession. "When Democrats focused on health care, the average middle-class person thought, 'The Democrats aren't paying enough attention to me,' " Schumer said.

Had Democrats pushed economic legislation, he said, "the middle class would have been more receptive to the idea that President Obama wanted to help them" and, in turn, they would have been more receptive to the health care law.

 

Schumer said he told fellow Democrats in the lead-up to the passage of the Affordable Care Act that it was the wrong time to pass the law.

 

"People thought—and I understand this—lots of people thought this was the only time to do this, it's very important to do. And we should have done it. We just shouldn't have done it first," he said. "We were in the middle of a recession. People were hurting and saying, 'What about me? I'm losing my job. It's not health care that bothers me. What about me?' … About 85 percent of all Americans were fine with their health care in 2009, mainly because it was paid for by either the government or their employer, private sector. So they weren't clamoring. The average middle-class voter, they weren't opposed to doing health care when it started out, but it wasn't at the top of the agenda."

As Fusion reports, another mutiny?

It was a characterization with which top Democrats took issue, all the way up to House Minority Leader Nancy Pelosi (D-California), who was instrumental in getting the Affordable Care Act passed into law as the speaker of the House. Through a spokesman, Pelosi said there are “14 million reasons that’s wrong” — referring to 14 million Americans that have gained insurance coverage through various provisions of the law.

 

“We came here to do a job, not keep a job,” Pelosi said in a statement.

 

Schumer’s comments on Obamacare came as part of a larger criticism of the Democratic Party’s strategy since 2008 and a look forward to what he said the party needs to do to recapture momentum heading into 2016.

Jon Favreau, a former speechwriter, criticized Schumer for “confirming the public’s most cynical beliefs about the political process.” And Jon Lovett, another former speechwriter, went on an extended rant on Twitter that ended with him saying a test for prospective Democrats is whether they “listen to” or merely “tolerate” Schumer as a prominent voice within the party

Schumer's reasoning for this outburst...

Democrats were targeting the uninsured, a population that he said makes up only about 5 percent of registered voters.

 

Only about one-third of the uninsured, he said, are registered or eligible to vote.

Which just about sums it all up... why 'help' people if they don't vote... or donate?

Give it another year and it will become obvious to all that the sweet spot on the profit curve for those companies derives from the fact they have been relieved of the legal obligation to provide any benefits whatsoever in return for your monthly payment.

You see, the Supreme Court has declared your monthly premium is NOT that; but rather it is a TAX payment. There is not a legislative or judicial body anywhere in the world that is about to define what benefits must legally be provided in return for a TAX payment.

That is why DC, the insurance companies and Schumer (when he thinks nobody is looking) are all partying.

Yes, with Mr.Roberts anything can be allowed or reconciled via "the law" in order to preserve the states claims, even a dictatorship. If anyone ever thought "mans law" alone would stand between the state and your natural rights that was the latest wake up call that it cannot and will not.

The mandate is a full-on frontal assault toward the individual, all the while wrapping itself in the cloak of some collective good. Think of it, using "the law" to criminalize the individual who takes no action, who does absolutely nothing.

If you want to assert & keep your individual rights you were always going to have to fight for them and defend them. FOREVER. There never has or ever will be any other way.

The Supreme Court decided the "premium payment"  mandated by the ACA was a tax; otherwise it is un-Constitutional. Congress may NOT force individuals to do business with a company.  They may, and have done ao with the ACA, force you to pay a tax. The fact is that the insurance companies are merely collecting it. And that America has been taken for a suckers ride over all this  by Congress, the Supreme Court , and the insurance companies.

It is amazing that it has taken Americans this long to

The "individual mandate" has two pieces to it;

"according to the Chief Justice: “Those subject to the individual mandate may lawfully forgo health insurance and pay higher taxes, or buy health insurance and pay lower taxes."

 Roberts ruling itself appears to uphold ONLY  the second part of the individual mandate; not the first part.  The ruling specifically describes the "shared responsibility payment" as the tax payment being compelled in the absence of purchase of an insurance product.

The individual mandate remains tied up upon the Constitutionality of  Federal compusion to purchase a service or a product.  That has yet to be defined by Courts.

The problem with the ACA and the court rulings so far is the ambiguity of implementation and intent forced by the acknowleged political subterfuge.

That ambiguity provides Congress, regulatory agencies, and insurers with considerable "wiggle-room" with respect to obligations that may or may not be incurred by the ACA legislation and court rulings, and what ever contractual fine print exists-or does not.

At the end of the day  even a definition of a "shared responsibility payment" has its own ambiguity-that term may equally applies to ANY insurance payment or TAX payment any of us may make. 

If the entire "individual mandate" morphs into, or is indeed  a "tax payment" -there is very little residual ambiguity to concern the courts.

I work for a fortune 500 co, just a brave, not a chief.  In all honesty no hype, I received a 20% increase for 2014 premiums, and now a 30% increase in premium for upcoming 2015.  Just my health care premiums are in the top ten of my annual expenses.  The deductible and out of pocket max has been raised substantially too.  ACA what a joke it it wasnt so sad and punishining

The whole healthcare system is now a forced payout to the insurance companies for a service most can not afford to use even though they paid for it. So basically a stick up, hand us your money!

I feel like they went....ok, how much money do people have left after we steal what we can through overpricing resources via bills? Whatever that figure is for each person, that is what we will charge them for healthcare. And then they wonder why the economy is stalled, idiots!

I get someone at his office occasionally reading my privacy related posts and yeah this has been all over the news.  It's a 180 degree turn for sure but what happened here was the fact that neither party expected "The Machines" to run the Affordable Care Act either and perceptions are a dangerous thing today and I harp on that all the time.  Unlike marets, there's no "kill" switch for self healing:)  But on that note, there's lots of Quants working for insurers, some who used to work for hedge funds, armies of them.  All you have to do is look at classifieds to verify this and it's been a big hire process as modeling policies now has gone beyond what it used to be with actuaries, they need the heavyweights in here, you know the kind that can model and rip pennies ouf of thin air, like they do for high frequency trading software. 

Well golly gee, guess where those quants went when the hedge fund biz models got tough?  Health insurance companies and they expect us to move through the healthcare system like we're  a chunk of data/money on markets.  United Healthcare has been the king of this oh boy are their data systems screwed up.  They have been firing doctors who see Medicare Advantage patients, right and left and give them no reason.  We know the real reason here it was "algo said"..ho hum just like the frigging markets.  Also too those who buy a United policy via the exchanges should be aware that those doctors are being reimbursed a shade above what Medicaid pays so some of them are electing to pass to be in network.  It's so bad that Johns Hopkins jumped in line to sue them over that., so Unite fired them too as they are knockig off hospitals as well as doctors.

Sure the administration is screwed up with this but just like banks, the insurers play the same game and they win with complexities.  Why do you think we have all those high deductible policies coming out that dump more cost back on consumers..look no further than those Quants that used to work for Hedge funds and banks, modeling is modeling and in this environment they forget there's people tied to those algos and numbers.  It's screwed.  It's the Attack of the Killer Algorithms with our health now too.

No wonder Schumer has lost faith, right?  They didn't expect the insurer machines to roll in like this as they run it and neither did the government as all focus on verbiage while algos and computer code run hog ass wild, just like the financial business so that's what we are living today.  It gets worse too as if the Supreme Court makes a ruling that impacts all these policies, well guess what, we all get tossed into algorihtm hell as all of a sudden, things won't be covered. 

Also of interest this week is none other than Darrell Issa, the richest man in Congress and is in California in the district just south of where I am and he's doing another oversite hearing in December.  Whoopee, as he wants to somehow prove the numbers that accidentally left the dental insurance numbers in the original count was intentional.  I say give it a break as a bunch of hard working tech folks, and I've been one of those before, with this massive query job probably forgot to uncheck the box for the dental sign ups.  They fixed it but Darrell can't let go:)

 

 

I’m on Twitter and “in Darrell's face” to get Andy Slavitt instead of Tavenner to testify, he’s the data man and the #2 person at CMS now that was hired from United and cut his teeth at Goldman Sachs as a banker and then at McKinsey before going to United and now at CMS. 

Would be interesting to see if Issa has enough guts to go after him as that would be a nice battle for sure.  Like I said in the tweet is was just 3 months ago that Tavenner told all her hard drive crashed and she lost her emails…right..she didn’t even know they were stored on Outlook exchange. 

This is kind of a pointless testimony as Issa wants the run down on the enrollment stats and being on that tech side, it was probably a genuine error from the folks who did the work as it’s running some massive queries and forgetting to eliminate the dental enrollments from all the numbers, an easy enough error to make and HHS fixed it immediately so Issa want to somehow prove “they did it on purpose” I think.  For a man who owns a technology (auto alarm) company, he’s really not that well versed with technology but he’s the richest person in Congress right now.

I say let's go get him:)  Oh read this post above if you like and Rockefeller didn't like Slavitt very well when he was at United and testified a few years ago so let's get Issa and Slavitt together for this:) Man this would be a huge meltdown and worth the watch for sure, with egos spraying the walls.

Schumer's tired of this kind of stuff but case in point here is "insurers won" and the government didn't even see them coming, it's all math models and now we're stuck with "the machines" a not so digital literate Supreme court who probably bit of more than they can chew and we all hang in the rafters with all of this.   Even at CMS we can't get away from bankers or former bankers in this case and that man thinks like one as everything at CMS is quantitated.  I though the other day maybe it's payback for him as United has been in CMS for years mentoring their models and I have that straight out from a couple of former CMS employees.   The guy lives in a huge mansion in Minnesota, not too far I think from the former United CEO who was caught on back dating stocks in 2008  who paid a fine and still lives like a king as well.

I emailed Schumer's office and asked him to respond regarding his negotiating the TTIP and TPP in secret. I asked why if we have a free market society is the federal government pushing GMOs on trading partners. Both treaties demand that Monsanto and others are allowed to take over their markets. The funny thing about these trade agreements is their own reports note it will only increase trade by less than 1%- so the primary reason for these trade treaties is increasing market share to the multi nationals and corporate farmers. Chuck never answered- I guess he was busy bending over for his masters. I hope they have genetically modified dicks so he can't sit for a week.
