17 States Sue Obama Over "Unconstitutional" Executive Action On Immigration

A year ago, following the whole Supreme Court farce, a bevy of states proved there are more than just "idiot voters" left in the US, when they decided to sue Obamacare outright over one or more of its provisions. They were promptly shut down by a judicial system that is as corrupt as the government itself (needless to say, both working at the behest of their true financial puppetmaster: Wall Street). And yet, in the aftermath of the now epic fiasco that is Obamacare, and not to mention the violent reaction to the administration as demonstrated in the midterm elections, the president may have a tougher time to brush away the next round of adverse reactions against his latest hugely unpopular executive order, one involving the amnesty of over 5 million illegal immigrants.

According to AP, Texas is leading a 17-state coalition in suing over the Obama administration's recently announced executive actions on immigration.

While many top Republicans have denounced Obama's unilateral illegal immigration clemency move designed to spare as many as 5 million people living illegally in the United States from deportation, or, as some put it, win the democrats 5 million heretofore non-existing voters, earlier today Texas Gov.-elect Greg Abbott took it a step further Wednesday, filing a lawsuit in federal court in the Southern District of Texas. And once he did, the seal broke and everyone wanted in on the action, and Texas was quickly joined by 16 other, mostly southern and Midwestern states, including Alabama, Georgia, Idaho and Indiana.

Abbott argued Wednesday that Obama's action "tramples" portions of the U.S. Constitution. Which, let's be honest here, never stopped the "constitutional scholar" before.

The lawsuit raises three objections: that Obama violated the "Take Care Clause" of the U.S. Constitution that limits the scope of presidential power; that the federal government violated rulemaking procedures; and that the order will "exacerbate the humanitarian crisis along the southern border, which will affect increased state investment in law enforcement, health care and education."

To be sure this won't be the first time Texas and Obama don't see eye to eye. Or last. Wednesday's announcement marks the 31st time the attorney general in this fiercely conservative state has brought action against the federal government since Obama took office in 2009. The only other high-profile lawsuit against the immigration action has come on behalf of Arizona Sheriff Joe Arpaio.

House Majority Leader John Boehner told lawmakers this week that the GOP-led House may vote to undo Obama's executive action, but the move would be mostly symbolic, as Obama would certainly veto such legislation and the Democratic-led Senate would go for it, either.

Abbott wasn't alone: Potential 2016 presidential candidate and current Texas Gov. Rick Perry, who leaves office in January, also spoke out against the executive order earlier Wednesday, saying it could trigger a new flood of people pouring across the Texas-Mexico border. Perry and Abbott also have said the order will promote a culture of lawlessness.

Perry said at a news conference that Obama's 2012 executive order delaying the deportation of children brought into the U.S. illegally by their parents triggered an unprecedented wave of unaccompanied minors and families, mostly from Central America, crossing into the U.S. this summer.

 

"In effect, his action placed a neon sign on our border, assuring people that they could ignore the law of the United States," said Perry, who has deployed up to 1,000 National Guard troops to the border.

The federal lawsuit involves the following states: Alabama, Georgia, Idaho, Indiana, Kansas, Louisiana, Maine, Mississippi, Montana, Nebraska, North Carolina, South Carolina, South Dakota, Texas, Utah, West Virginia and Wisconsin.

Then again, one may wonder about the theatricality of all of the above: if republicans were truly fed up with the authoritarian head of the republic, they would just impeach him and be done with it. The fact that despite the howls of displeasure they have yet to do anything substantive, once again merely shows that both democrats and republicans are merely two all too eager parties on the receiving end of kickbacks by what we earlier dubbed, the world's biggest organized crime syndicate.

All those who want to get to the bottom of corruption in America, are urged to focus on Wall Street first, foremost, and only. Everything else is nickel and diming smoke and mirrors.

The following postulate seems to void the plaintiffs’ grievances:

As stated before and viewed from a legal perspective, immigration directives issued by DHS (i.e. Johnson memos) apparently cannot be reviewed by the courts – Judicial Review may not apply to this situation. Let’s also reiterate that immigration is not a civil affair per se, instead it is governed by Admiralty Law – registration of aliens.

Willful ignorance displayed by members of Congress, State officials and the political class while dealing with the immigration issue is an irrefutable evidence of constituents’ stupidity (specifically those who are fervidly opposed to any sort of temporary relief granted by the Executive Branch to certain unlawfully present immigrants) and excoriating the current President on immigration is not going to elevate their brutish status.

Perhaps these “pseudo mathematical expressions” may help:

Uh what about Title eight and the Walter-McCarran, Immigration and Nationality Act of 1952?  In order to enter the U.S. you need a visa and the number of visas that are permitted to be disbursed are limited by law.  By deferring prosecution, even for humanitarian purposes, you are violating these laws.  Go back to Daily Kos and come up with some better arguments, ya Bastard!!!!!

The state legislators would better spend their time calling for an Article V state run constitutional convention at which their representatives can propose, and the legislators can later ratify amendments to the Constitution that drastically restrict, or even terminate the federal government.  A very powerful tool that they have yet to use since the original adoption of the Constitution.  Seems like it better be now.  Later will clearly be too late.

It's funny that calls for a Constitutional Covention are so frequently met with obections that the process would be open to runaway political actions that would destroy the country. 

From my perspective, most of what was worthwhile about the USA has already been destroyed by runaway politics, and that a new Convention, or some other scary "radical" step, is the only possible way to salvage what once worked pretty well.... 

At this point, there's damn little left to lose.

Its worse than that, in my opinion.  Republicans in Congress WANT THIS (think:  Chamber of Commerce et al).  They just can't be seen openly supporting it without causing their base to revolt.  If they really wanted to stop any of this why did Mitch McConnell IMMEDIATELY after the elections take off the table their two biggest weapons- impeachment and government shut-down?

Maybe the states can get this done, but then you're depending on the Supreme Court which is a damned shaky bet.

95-97% of what the Fed does they don't need to do because the states could just handle it - how many wedge issues would no longer dominate the American politcal landscape if we just let the states decide?

Tell me again why anoyone would want to be POTUS. The POTUS seems all powerful but is he really? He must wait for Congress to do a damn thing in most cases, and he presides over constant political whining and bullshir. I would have no paitence for these damn babies, yet they sue when someone else acts. The least productive Congress in history feels emboldened to act against the POTUS, they oppose all nominations where no one wants to work in the admin now. I've been thinking about this for a while. If you put the plight of the common man or woman in the US in light of this quote form Gandhi, where on the continuum would we be?

I'd put my money that Mr. Average Joe or Jane (the middle class, if you will) is somewhere between the ridicule and fight stage.

So, how long until the end-game? Six months, a year, two, three? I'd go for recession early in 2016 for $800 Alex.

Americans are quietly overthrowing their government by not obeying the laws. It's actually pretty easy, since there are so many laws, they cannot possibly be enforced adequately.

The various levels of government, from local to federal, are pretty much faking it at this point. They have little control over a general populace which generally ignores them.

The en-ess-aye, ISIS, ebola, cop shootings, etc. fear factor is mostly a charade, all just cover for theft by the banks and government, working in cahoots to fleece the population. People aren't taking it so easily and their numbers are growing.

Am I the only guy that gets that this score was settled with the Civil War??!! The Fed won. Period. End of story. Fed trumps state. That's what the war was fauht for - to determine who had supremicy. We now know.

The civil war was about ending slavery.  Slavery is over.  No need for another war since any states leaving won't be doing so in order to violate human rights.

Some states were fine with slavery - some - well, it fucked with their economy (see: northern states). It was at that time up to the states to decide. The Fed made it their business to legislate and wage war against the states (under the guise of "civil rights"), but the real war was over who had supremacy. Also known as, soverignty. And we know who won. 

Also, the 14th Ammendment did less to grant rights to slaves, as it stripped rights/soverignty from the Americans, and subjicated them to US Citizen status.

slavery was definitely the wedge du jour.  also, not sure what you mean by fucked their economy, plenty of yankee traders made a buck off the backs of the unwanted population from africa, frequently sold out by their own people usually to the arabs, who then in turn often did deals with ship owners from a certain tribe to get them to market.  the best part is, only a small fraction of kidnapped africans who survived the voyage across the atlantic ended up in the u.s., so really they were the lucky ones, they could have ended up somewhere like haiti.  but to hear the left you'd think these were the most downtrodden people on the planet ever who can't even be talked about in terms of REALITY, only within the confines of a predetermind politically correct narrative.  and anyone who dares to question the narrative in even the mildest terms is a racist nazi who probably hates everyone that's not white.  because, slavery.  neat trick.

You're basically right, but the "selling" of the war to the average Union citizen relied considerably on Abolitionist sentiment ("Mine eyes have seen the Glory...."  yada, yada).  Selling an aggressive war based on tariff policies is tough PR.

Johnny always goes away to die for Freedom.  That's just how the "American" script runs; it's become a pretty sad, shop-worn little story, but it still seem to motivate the rubes.

i think you're closer to the truth in that many yankee soldiers fought out of a sense of patriotism (see sullivan ballou letter) because they believed the lies about the south, or as a way to advance themselves, or just get paid, spoils of war, or maybe jsut have some food to eat, etc.  lots were conscripted, sometimes right off the boat.  irish were considered disposable.

the propaganda is thick around this particular bit of history.  i can only imagine what people will be saying about the world wars 100 years from now.

and it can be equally argued the Johnny Reb wasn't fighting to maintain the plantation system. Most southerners didn't own slaves and in fact fought out of a deep sense of a belief inself determination and liberty. Read some of the writings of the era from the foot soldiers. They believed in the southern cause as a fight against the North trying to subjugate them. In fact many identified the cause with the revolutionary war. The war was not about slavery per se but the subjugation of the south at the mercy of the northern political and economic interests. If you look at the North and South and comapre them, the South shouldn't have lasted more than 6 months. They lasted 4 years. They fought because they believed in the states rights. 

I would have to add that the outcome from a moral perspective was never in question, but that wasn't what drove the sides to war.

Having worked in Detroit for 30 years, moving to the Southwest was a revelation. The "illegals" people are worried about work their collective asses off for minimum wage, raise families and rarely cause problems. Most I have encounterred are respectful and courteous. As with any demographic, there are some rotten apples. 

Our indigenous fourth generation minorities, on the other hand, have ravaged the Welfare and Social Security system,  turned every municipality they infest into a war zone, and made colledge and professional sports activities resemble the primate exhibit at the Bronx Zoo. They have been in this Country for 250 years, understand the customs and language, and are still at the bottom of the social and economic ladder. Darwin had it figured right! 

Five million WORKING hispanics are a positive addition to society. If only we could offload about 40 million chiselers, one POS President and staff, things might start looking up!

Alex Rios, 18, Nathaniel Carrillo, 16, and Gilbert Tafoya, 15, have all been charged in the murders of two men sleeping in a vacant lot on 60th Street at Central.

In the criminal complaint, police said the teens admitted to killing the two men and injuring one other after coming home from a party Friday night.

The complaint says they admitted to using bricks, sticks and a metal fence pole on the victims.

Police said the men were beaten so badly, they have not yet been identified.

According to police, the teens also admitted that they had been randomly attacking homeless people throughout the city for the past year and that they had attacked at least 50 people just in the last couple of months.

APD is working with outreach programs and to reach other victims who may have never come forward.

Lone survivor in double homicide fought giggling teens

An Albuquerque homeless man who goes by the name Skeets has bruises on his shoulders, arms and legs from an attack by teenagers this weekend that left two people dead.

"There was about five of them, but there is only three they caught," he said. "I was asleep, they cheap shotted us while we were asleep."

Two of the people he slept near died from the attack. Skeets is the lone survivor.

"I got up and I was fighting for them for awhile, trying to do my best, but these guys there were too many of them and one had a bat and kept hitting my uncle," he said.
