A New York City grand jury has decided not to indict the New York Police Department officer accused of killing a Staten Island man by putting him in an illegal chokehold. The NYPD is now preparing for more protests stemming from the decision.

 

Early Wednesday afternoon, CNN, the Wall Street Journal and the New York Post all reported that a grand jury declined to indict the officer.

 

Although the special grand jury declined to indict Daniel Pantaleo, the white officer accused of strangling Garner, who was black, the police department can still reprimand Pantaleo under a basic rule that loosely states if an officer does anything to embarrass the department, then they can be disciplined.

 

"It's sad if they take that position," Ed Mullins, president of the Sergeants Benevolent Association, told Staten Island Live. "I'd be surprised and a bit disappointed if he was used as a political pawn to appease the community."

 

The incident occurred on July 17, when at least five New York Police Department officers took 43-year-old Eric Garner, a Staten Island father of six, to the ground in an attempted arrest on Staten Island. One put Garner in a chokehold that caused Garner – who suffered from asthma – to lose consciousness and reportedly go into cardiac arrest. He was declared dead at a nearby hospital.

 

The Staten Island District Attorney’s Office convened the grand jury in September, but did not announced the list of potential charges against Pantaleo. But prosecutors outside the district told ABC News that the range could have included second-degree manslaughter, criminally negligent homicide, felony assault or reckless endangerment. Legal experts and former prosecutors had said that, despite the medical examiner’s ruling the death a homicide, murder charges were unlikely, the New York Times reported.

“It’s not going to be a Ferguson-like protest because I think everybody knows my father wasn’t a violent man and they’re going to respect his memory by remaining peaceful,” Snipes said. “It’s not going to be like it was there.”

Police in New York City began preparing for potential protests before the grand jury decision was announced.

 

"We, as you might expect, are planning accordingly," New York Police Commissioner Bill Bratton said at a news conference on Tuesday.

 

Bratton did not reveal how many officers were placed out on the streets ahead of the announcement, but he said that officers have been told to walk a fine line between allowing the protesters to express their anger while keeping public order.

 

If they engage in criminal activity, such as vandalism ? actual crime ? they will be arrested, quite simply," he said. "But we have the ability to have a level of tolerance ? breathing room, if you will."

 

There are at least two different demonstrations planned in lower Manhattan Wednesday, including appearances of Parents Against Police Brutality and protesters who say they are taking a stand against "the criminalization of our communities and militarization of the local enforcement agencies," ABC News reported.

I'm going to give all potential anarchists the key to the mint.

I have a solution to shutting down the system and starving the fascist US government of taxes and you barely have to break a law.

Get 20 people in 20 cars and in a co-ordinated effort drive these cars to the major arterial choke points of the city. The cars need to be driven abreast and from both directions on the road. Park the cars. Lock the doors. Walk away or maybe take a push bike with you and ride away.

This will bring an entire city to a stand still and will not have hurt or injured anyone. At most you get a parking fine.

When/If you get hauled to court just plead insanity. When the judge says you can't pleas insanity to a parking fine just tell him/her that who in their right mind would park on the Brooklyn bridge.

No bombs, no guns, no bloodshed, no innocent victims, no violent confrontations with the police. Just a very cheap and very effective form of dissent that absolutely no militarized police force can combat.

You're exactly right.  Let's make one thing clear: it's a tragic situation that this guy died and no one would want this outcome.  But there's multiple issues here. First, even for bullshit laws, the police have not choice but to enforce the law when they are called to the scene.  In this case, local store owners called to complain that Garner was selling single cigs on the corner and wasn't paying taxes on his tobacco sales.  The cops approached Garner who was contestable.  They asked him to turn around so they could put on handcuffs and he resisted, so they escalated their efforts (which is no small task considering his size).  The cop used a standard choke hold in an attempt to get Garner to comply, but given his size and asthma, he fell unconscious.  For those who consider that to be excessive, would you suggest that the police adopt a policy of doing nothing and walking away if a suspect resists arrest?  Isn't that Obama's foreign policy?

Some of us arrived, earlier than others, at the conclusion that the police simply kill because they know they can get away with it.   Many here at ZH (and elsewhere in the real world) might be swayed to that view by this most recent "ruling", but the simple fact is that some of us were already there, those of us who began paying attention years ago to the way-too-numerous cases of police killing mundanes and getting away with it.  So when I and others decried the killing of Michael Brown, un-saintlike person that he apparently was, it was because we were already wondering what it would take to make it stop.  When will enough people see this for what it is? 

Some people, on the other hand, will never get there.

I know a former cop who shot and killed a homeless guy. The former cop has anger management issues and he admitted the indictment process after a cop shoots someone is designed so he never faces a jury through double jeopardy. When we are asked to respect the law, the authorities mean that the law says cops have the right to murder people.

Choking someone for extended periods of time usually does the trick by setting off other reactions, from what I can deduce.

The extra 200lbs or asthma has nothing to do with this case. 

The Policeman buttocked this one up; and needs to get prosecuted and/or administratively disciplined.  Wrongful Death for certain.  Manslaughter Variants may be appropriate.  IANAL, nor am I with the USDA; but I'd take a good look at the Grand Jury as well...

Last thing we need are Rioters or "Vigilantes", "Going Medieval" - indiscriminately - on our Police Forces.  The Police serve the Public Trust; and miscreants should be removed - via Criminal Proceedings if the Law calls for it - whenever they betray that Trust.

That being said, I've several "Cult associated" Police / Law Enforcement Types - working with "neighborhood watch groups" engaged in Foul Play against me here in Los Angeles.  Funny part?  One group happens to include relatives of a Yeoman who I prosecuted for (Black on Black) Theft years back.  He was also a Moneylaundering/Trafficking suspect but hey, all that matters is that since family and friends are in Local Law Enforcement or Govt Service, that makes Perp Innocent and me a Criminal Menace to Society, right?

Crazy Negro Logic?  Nature or Nurture? I'm half Black, BTW - the Thief actually complained to my CO's Mast/Courts Martial Prelims that I wouldn't "give him a break".  WTF!!  Leaving him on the Island (or the Ship, if we were on one) would have gotten him killed.  

Since his relatives/buddies kept/continue to stalking/stalk me at the VA Med Ctr in Long Beach (and at 24Hr Fitness in Compton/Carson) and other locations - did he get jailed or nailed down the road?  Does this make it a 22 Year Stalking Racket with corrupt Cops and Civil Servants?

Its funny when the FBI(been reporting to them in person, phone, web), CaliBI, USIS/Defense Security Service, Air Force PsyOps, NCIS, Local/Regional Police, and possibly NSA get their fingers in this racket, the result STILL end up being FUBAR'd...

In my experience, posters who go to the trouble of figuring out how to embed pictures in their posts are typically COINTELPRO pukes trying to build up their character's likability, so they can then have a better chance with manipulation in other contexts.

Well, everybody knows I ain't no cop lover but I think most people understand they have "their job" to do, as do we. They are paid to enforce law we elect people to make.

To be sure there are some supreme asshole cops, everyone has ran into them. The sadistic, intellectual fools with a badge and gun, with a badass attitude suffering from Little Dick Syndrome, on his third marriage, still trying to impress buddies by staring at them in the mirror at the gym.

There are the normal ones though, that everyone should keep in mind.

Like the trooper who pulled over an equally sadistic (at times) guy with no badge but armed to the teeth, with a badass attitude from the day he's having, one hot August day. Trooper said "Look, before you say anything...(deleted) I know its hot, I'm getting ready to go home and have a beer myself. Are you drinking & driving down I-75?"

I said yes and showed him my Heineken.

He said "Is that all you have?"

No, the rest is right there, agitated & gesturing to the remaining five in the back seat.

He said "Pour it out."...meaning the open one of six.

I did, as probably 200 cars zoomed by as witnesses. He could have been a complete dickhead, written me up a $500 ticket, provoked me by asking to search my vehicle but we both knew what this was and neither of us really wanted to deal with it.

So with the perfunctory "Don't drink and drive on my highway with a beer between your legs that a lonely, pissed off trucker can see and call in..." I was off.

I drank one to him about ten minutes later for not being "the dickhead from Micanopy" and I like to think he drank one to me for allowing him to get home on time.

It works both ways with the non-dickheads ;-)

my fuck the police credentials cannot be questioned.  a dozen arrests before i turned 22.  accused of assaulting cops twice.  had guns pulled on me three times.  involved in half dozen foot pursuits....

I was filling up with gas in Tulsa one day and a cop car pulled up with a huge white guy just like this. I asked him about his Dodge Charger as I knew the specs on the engines. He did not know anything about it.

In my mind as an ex-military guy I was trying to guess if they had any minimal physical standards whatsoever. In the services you at least have to passa  PT test and meet minimum height-weight standards.

1) I person trying to make a living by being a street vendor without some type of license. This is what happens when there are no jobs or way to earn income.  I was born in Brazil. Witnessed these type of state brutality for years.

Anyway, American cities have to designate areas and street for these vendors and not attacking them.

2) The insensibility (too much testosterone) of these cops in not knowing how to handle these ‘close’ confrontations.

3) Unintelligent and insensitive comments (hedgeless_horseman).

If you look deeper into the story you will see that the day he was killed he wasn't selling cigarettes. He had just broken up a fight a minute or so before the cops showed up and killed him for it.

I doubt the victim would self-identify as a libertarian, but his arrest record for over 50+ petty offenses and his refusal to play by the "rules" says otherwise. Basically, the thugs took out one of the statists' problem--a person who was unwilling to play by their rules and put up with their bullshit.

Weird story.  I was driving north from Washington to Philadelphia for a minor medical emergency for my aunt.  My cell phone rang when I was near Baltimore.  In Maryland you can't drive and talk.  I figured it was important.  (As it turned out it was some dork trying to sell me a crusie - trip on the Costa Concordia.)  I pulled over on the shoulder.  Put the flashers on.  Took care of the phone.  Not one minute passed.  I looked in the rearview, and there were FIVE unmarked cars pulled over behind me.  I nearly s*&t.  I got out slowly.  Told them I was fine.  Medical emergency for my aunt.  They said fine, go ahead.

All I could think was: 1) where the hell aree my tax dollars going to keep that many patrol cars out on the road - like is every sixth car an unmarked cop, 2) glad I didn't make a false move.  Really.  All it takes is one of those nutards to say something like...'what is that in his pocket'...then somebody elese says.....'doesn't look like a gun'....then somebody else HEARS...'he has got a gun'.....then I am Swiss cheese.  BTW.  I am a nice conservative white boy driving a 15 yearl old sedan.  Who knows, maybe I fit the profile of the terrorist de jour.

Scarred the piss out of me.  I DON'T like being afraid.  They couldn't have been nicer......no ugly looks....didn't run my license....but GeeZee PeeZee.

I saw a stop today, some kid in a Miata pulled over.  One cop standing next to the car with his hand on his holster waiting on backup.  This guy stands there the entire time while backup writes the ticket, standing with his hand on his holster.  Before they're all done there's another cop pulling in as well, who gets a "we've got this," wave off.

By the end of it the kid is in tears and all shaken up, and the impression I got was that this was an intended consequence of Officer Tough Guy standing at the ready like he was about to clear houses in Fallujah.  They even made sure to stand and chuckle at backup's car, make lunch plans and such, before anyone left the scene.

The only reason this went to jury is because of the video evidence. The guy who shot the video was arrested something like a week later on 'weapons charges' which he claims were fabricated by the police. He went to trial and plead not guilty... guess who the jury sided with?

I can not believe I am agreeing with you, but I am.  Far too many here have NO idea what is coming or what will happen next, and use some hollywood script idea of the 'noble' revolution and the peaceful reset on the other side.  Ain't gonna be that way kids, its gonna be a helluva struggle and a LOT of Blood will be spilled in the process, and there is NO way around that at this point, the time for a peaceful change past decades ago.........

Intelligence will be counterproductive at the coming economic, oil, and demographic failure. Intelligence, especially science, will be blamed for as the desperate people moves towards mythicism (religion) for answers.

 

The Libertarians problem is that they don’t really understand the problems. I call them “sort of the Ivy League mentality (elites) of the Right; i.e. they delude, lie to themselves, with a vocabulary of jargons and charts”. Tainter, in “The Collapses of Complex Societies” highlighted these “Specialists’ breed that avoids facing reality by speaking in coded words.

 

Libertarians, like the elites, are fascists (we know better. We’re the smart class types). What the Libertarians have to do is wait because they would never rise to power at the current system. So the Libertarians have to wait for a crisis to bring down the current system. And they keep hammering the lower classes to do it for them. But, it won’t happen because the lower classes depend on the system for their survival.

 

So, the Christian Right will be their vehicle to Fascism in America.

You don't actually know any libertarians, do you? I am sure you don't. You are wrong on most everything and libertarians do not do fascism. It is anathema. National Socialists do fascism in the real world. Socialists do fascism which economically is still state control with crony companies. It is the current model of Russia, China and most Western countries all they would not call themselves that. It is still a form of statism and statism to libertarians is like a cross to vampires.
