A Staten Island grand jury has decided not to indict white NYPD officer Daniel Panateleo, according to NY1, who allegedly used a banned chokehold and killed Eric Garner, a 400lb black man, who was stopped on suspicion of selling loose cigarettes. Eric Garner's son has called for peace and hopes there is no Ferguson-like response...

A New York City grand jury has decided not to indict the New York Police Department officer accused of killing a Staten Island man by putting him in an illegal chokehold. The NYPD is now preparing for more protests stemming from the decision.

 

Early Wednesday afternoon, CNN, the Wall Street Journal and the New York Post all reported that a grand jury declined to indict the officer.

 

Although the special grand jury declined to indict Daniel Pantaleo, the white officer accused of strangling Garner, who was black, the police department can still reprimand Pantaleo under a basic rule that loosely states if an officer does anything to embarrass the department, then they can be disciplined.

 

"It's sad if they take that position," Ed Mullins, president of the Sergeants Benevolent Association, told Staten Island Live. "I'd be surprised and a bit disappointed if he was used as a political pawn to appease the community."

 

The incident occurred on July 17, when at least five New York Police Department officers took 43-year-old Eric Garner, a Staten Island father of six, to the ground in an attempted arrest on Staten Island. One put Garner in a chokehold that caused Garner – who suffered from asthma – to lose consciousness and reportedly go into cardiac arrest. He was declared dead at a nearby hospital.

 

The Staten Island District Attorney’s Office convened the grand jury in September, but did not announced the list of potential charges against Pantaleo. But prosecutors outside the district told ABC News that the range could have included second-degree manslaughter, criminally negligent homicide, felony assault or reckless endangerment. Legal experts and former prosecutors had said that, despite the medical examiner’s ruling the death a homicide, murder charges were unlikely, the New York Times reported.

“It’s not going to be a Ferguson-like protest because I think everybody knows my father wasn’t a violent man and they’re going to respect his memory by remaining peaceful,” Snipes said. “It’s not going to be like it was there.”

Police in New York City began preparing for potential protests before the grand jury decision was announced.

 

"We, as you might expect, are planning accordingly," New York Police Commissioner Bill Bratton said at a news conference on Tuesday.

 

Bratton did not reveal how many officers were placed out on the streets ahead of the announcement, but he said that officers have been told to walk a fine line between allowing the protesters to express their anger while keeping public order.

 

If they engage in criminal activity, such as vandalism ? actual crime ? they will be arrested, quite simply," he said. "But we have the ability to have a level of tolerance ? breathing room, if you will."

 

There are at least two different demonstrations planned in lower Manhattan Wednesday, including appearances of Parents Against Police Brutality and protesters who say they are taking a stand against "the criminalization of our communities and militarization of the local enforcement agencies," ABC News reported.

Yep, and those cops pensions aren't cheap. Pay your taxes serf , and let the be a lesson to the rest of you. I still don't see enough evidence to indict the cop in ferguson, but come on, how is that not illegal. That had numerous former police officers on every channel talking about how using a choke hold like that is illegal, the only time you are allowed to use that is in a case where you are literally fighting for your life. That guy was what is known in LE parlance as an 'active resistor' which is what is defined as a subject who is offering physical resistance but makes no attempt to harm the officer. There is no reason it should have gotten to that point. Of course, if you allow your country to get to the point where it's acceptable to even bother someone for selling loose cigarettes, these things are bound to happen.

I feel for this guy, it's shameful.  You can smoke pot openly on a NYC street and not get arrested.  They had to arrest him for not paying taxes but it's not the policeman choice, he has to enforce the stupid laws given by our politicians.  Not in defense of the cop but I heard the video shows he was not in an illegal choke hold but in a headlock.  There's a legal difference.

Lets get ONE THING STRAIGHT. Cops DO NOT have to enforce all laws on the books. It's called discretion and common fuckin sense. Shit laws, like seat belts must be worn for adults,yet helmets are off for motorcyclist. Which should be a CHOICE anyway for both. Fuckin loose smokes being hustled and all this caused a innocent life over personal choice to sell loose smokes.Wait till one can't sell a box of ammo and gets fuckin raided.

I get that, If cops enforced all laws placed on the books over the years by statist politicains we'd all be in prison.  When we give up our personal responsibility for a nanny state to protect us, this is the outcome.  Why should an adult be forced to wear a seatbelt? For their own safety? FYI, just in case you might not be traveling alone. your bodyweight multiplies 30 to 60 times in case of a crash when traveling 30 mph which makes you heavier than an elephant. 

on another note. the more there are laws and regulations, the less considering the fellow citizens are. just a personal observation. try to cross a 6 line crossing on foot at night when the traffic lights are off. no fucking driver will stop just because the traffic light doesn't say so, even though there's a zebra crossing. while on the 2 liner where there are no traffic lights at all but just a zebra crossing, 90% will stop and let you through even though you could easily pass few seconds later due to very light traffic at night.

I am hesitant to endorse violence as a means to an end, but so long as the grounds for the violence are understandable AND justifiable, AND THE TARGETS OF THE VIOLENCE ARE LEGITIMATE ONES (i.e. Those causing the problem and perpetuating societal harm) ON MORAL, RATIONAL GROUNDS, then this is CONSISTENT WITH THE 'JUST WAR' THEORY.

Don't need any violence. Just park cars in a co-ordinated fashion at the choke points of the cities arterials (Washington DC would be great as it'd stop politicians getting to work) and bring the whole system to a halt.

No militarized police force can stop this. They are trained for violence, they are experts at violence, they will win in combat scenarios. Peaceful dissent is something they are thoroughly ill-equipped to deal with. Bring a city to it's knees all with a few parking offences.

We have the power but lack the courage. We have been trained well by society, hen pecked with fear by religion. It's the oilgarchs and psycopaths perfect world. They have a boot on our throats and it is so pervavise we barely recognise it anymore.

You all know where the traffic builds up in your city during peak hour. It'd just take 10-20 cars to bring the city to a stand still. It'd make world news and send TPTB scurrying for answres. How many days of people not showing up to work will break the back of big organisations.

His son showed remarkable composure and character in his statement.  Shame on you for calling for violence.  How does looting, vandilism of private (or public) property, or violence further any legitimate cause?  First of all, the public property is PAID FOR by the private citizens.  Second of all, not everyone should suffer for the acts of one bad cop.  How is the killing of innocents justified by what this cop did?  All these riots are just due to thugs waiting for an excuse to do thugish things.  They may have just cause to be upset about police brutality, but this isn't a race thing.  The bad police out there who abuse their positions should be dealt with, but what happened in Ferguson is inexcusable and unjustifiable.

Why in the world woukd local police be used to enforce a silly loose cigarette tax infringement violation with such overuse of force  ?  Perhaps local merchants paid a bit of " protection money" to local police  ?  Should have been investigated.  Far worse tax violations occur in lower Manhattan in selling counterfiet watches, handbags etc, with showcase arrests, fines and confiscation of merchandise----but no chokeholds.  Selling cartons or even packages of cigarretts could represent a large tax loss, however selling loose cigarettes is infinatesimal compared to white collar tax evassion.  Something wrong with Nazi tactics against minorities and those at the low end of economic scale.  Weep America !

point is that's some shoddy excuse came up with after the fact.  they were investigating a fight or...was it  a couple guys attacked someone, I dont recall.  this guy helped diffuse the situation, then the cops show up and to them there IS still a situation, their minds are already made up about what's going on and they dont care what anyone has to say they have an attachment to being obeyed or they get a little chokey on folks.          

 

 I can imagine what the Brown execution was like were it on video, but since we really only have officer wilson's word and 20 other different stories, obviously he's right and completely innocent and  well there's no point in even investigating this matter, now how do you feel about that, mister wilson, please, tell the grand jury your full and complete feelings on the matter, we have plenty of time, I know I'm the prosecution and all but I really dont think I need to bother with this whole schtick right now.

The problem with allowing the sale of loose cigarettes is that many of the buyers are minors. The sellers also are often selling smuggled cigarettes and that undercuts not just the taxman (who I don't give a fuck about) but also undercuts the local shopkeepers (who I do give a fuck about). It is also a gateway crime.

The dead black guy doesn't seem to have been a bad person, and I get his frustration with cops, but once the cops start to arrest you then you are stupid to try to resist. Besides getting a beating you will get charged with resisting arrest and assaulting the cops and then it won't matter if you beat the charge that you were arrested for.

The choke hold didn't cause the death as the guy was complaining (concious, lucid and able to talk) after the choke hold was released. He died because he was 400lbs and not taking care of himself and the stressful situation got to him.

Well, unfortunately, violence is what it is going to take to turn this around because that is the only thing that works. The problem, one of them, is that the protesters initiate violence against their neighborhood stores and loot them/burn them. If the police are the problem then they must be the focus of the violence. You want to stop this kind of shit then take out a half dozen cops, period.

Understand that I'm not advocating this course of action, I'm just saying that why would a cop stop doing a certain action if there were no consequences to him for doing it? It's like raising a kid, you have to give them harsh consequences to an action you want them to stop or they don't stop it.

If several cops didn't make it home and it was FOR CERTAIN that it was the consequence of choking this guy to death, that would make a difference on how every cop there viewed his job. Also, if the community at large SUPPORTED that action by their attitudes, not by deeds necessarily, that would really throw the PD for a loop. Right now they count on the vast majority of the public to recoil in horror when a cop gets killed and quite frankly, I do as well. I was brought up to see them as the good guys but now a whole generation of kids are seeing these cops act like thugs and that attitude the cops count on to keep society in control and safe for them to do their jobs is changing rapidly.

They did it to evacuate the Dorm for a petty Drug Bust. They used it as an excuse to search rooms...to..."Make sure that everyone was out "safely".

 

The police are major violators at many times. My uncle was a cop. He always had the best bongs and the primo weed.

For the record, I am not defending anyone here.  All I care about is the truth.

Ferguson, by admission has different stories about what happened.  Some said he charged.  Some said he didn't.  The concept of GJ is prosecution.  If there is reason to believe there could be wrongdoing - indict.  Rather, Ferguson went the other way.  That because there were mixed stories, they decided not the indict.  That is not how Grand Juries are supposed to operate.  But, they are secret of course.  So, we dont have a clue what went down.  Either way, something smells, IMO.

Correcting bad spelling mistakes is meant to help the person who cannot spell. Spelling and writing well are both good things.

No one is perfect, we all make mistakes but the inability to write and spell your mother tongue in this day and age is really and truly a shame.
