I'm late to the party, but wanted to comment about the New York incident which is particularly complicated. It's complicated because of the multiple dimensions in question.
#1. Why do we have so many stupid laws that results in the police ticketing and arresting so many people. Why do we have so many rules that it's almost impossible to open up one many business for street trade like the ENTIRE rest of the world can do....okay, that's #1.
#2. The infamous "choke hold". I hear a lot of ignorant people everywhere. Most of who have never been in, or given a choke hold. Tackling someone by their neck is not a choke hold. In my opinion, the police should have left this man alone. Of course. However, he was not being choked....and if you think he was being choked and still saying "i can't breathe I can't breathe" then you have no idea what it means to be in a choke hold. Visit your local MMA gym and ask someone to put you in a choke hold and confirm it for yourself. (ps. people do not die, because they are put in a choke hold)
#3. This dude died. Very unfortunate of course...particularly since what he was doing, should not have been a crime. (see #1 above). But, he did not die because he was tackled "by the neck" and he did not die "in a choke hold" (see #2). The fact that idiot policemen needlessly throw people to the ground and drive their knees into peoples back, and put their knees on peoples heads is completely absurd. It is brutality and it should be stopped. Watch "COPS" and watch people get thrown to the ground for nothing. The autopsy will show if he died from 'lack of air', but if he did, it definitely wasn't from a "choke hold". It's probably true that 99.9% of arrestees who experience this same treatment do not die and that his physical condition exacerbated the dog pile.
If POTUS thinks only black people get treated like this he's completely full of shit. What needs to be addressed is why so many people who get arrested get their face shoved into pavement with some 220 pound jackhole's knee on their neck. Why don't you fix that problem POTUS and we'll all be better off.
According to the coroner it was ruled a homicide, due to constricted airway and chest compression. Maybe you can read about it.
Fine...I'm not arguing with the coroner. They did their job. Homicide. no argument.
I'm making no comment at all about the guilt or innocence of these police officers..maybe the police officer cranked his neck and broke it. My only point #2, was related to the "choke hold" itself.
So I'll read the coroner report and you do this. Invite all your MMA buddies over to watch that video, and ask them a) how many seconds was that dude in a "choke hold" and b) even if they come up with a number greater than 12 seconds, ask them part b) will a 12 second blocked airway kill any man? I won't even comment. Just ask all your buddies who know what they're talking about.
Just to clear up some myths about choke holds, there are two different kinds.
1 blocks the air path while the other blocks the blood path. You can still speak and breathe in a blood choke, but you pass out then die if/when your brain is deprived of (Oxygen from the)blood long enough.
Now, the guy was saying he couldn't breath which means he was in neither and he was fully concious when he was released from the hold around his neck so it's quite clear that he did not die from a choke hold.
It looks to me like he couldn't move his diaphragm to expand his lungs with his own weight + the weight of all the cops bearing down on him, which would explan the difficulty breathing and why it occurred without anyone "choking" him.
I've only seen the video and not followed the story so I can't comment on the situation itself

When a police office tazes a guy with a pace maker and the guy dies.....does the police officer get charged with homocide? Don't get mad at me....I'm just telling you the facts. The answer is "no" that police officer does not get charged with homocide. I talk with my cariology buddies and they chuckle and say "you can't put that kind of voltage into the chest of a dude with a pacemaker." Maybe those cops too, should be charged with homicide....I'm expressing no opinion there....but these are complicated legal and even ethical issues.
As for NYC Cops and their reputation....I don't live there, and I have no experience with with them.
I agree that all circumstances need to be considered, and yes, those questions should be put to a jury, but not just a grand jury. There should be a full airing of the entire affair in a public jury trial, with cross examination.
Watching the video, it appears to me the officer had his forearm exhibiting a lot of pressure on the guy's neck. Call it a choke hold or not I'm sure it resulten in restricting his airway and/or blood flow in some way. Certainly his physical and medical condition didn't help and - but neither did the police help with any form of CPR after the guy went limp. My opinion - all those cops in attendance there were negligent and responsible for the death of this individual.
Oh, one other thing... didn't Garner already pay the tax on those cigs when he bought the pack or carton in the first place? It's illegal then to resell individual cigs? Oh, I forgot, in NY there's also a service fee tax on having your bagel sliced and/or having schmear added to it.
They probably crushed his windpipe and had already pushed the wind out of his lungs with knees in his back.
You guys are right. I don't think he died from choking. I'm just not an expert on how to kill a man like this. I think you can break ribs or cartilage into his heart as another idea.
Also agree the guy should be able to sell on the street trinkets or cigarettes on the street of the worlds biggest Market Place in a country supposed to have "Free markets".

I do Brazilian Jiu-Jitsu (BJJ), so at training I give and get choke holds, of both kinds (blood supply and airway), repeatedly, as part of training drills.
My BJJ instructor regularly "rolls" with (wrestles against) a SWAT team instructor. The latter teaches SWAT teams hand-to-hand combat.
So allow me to comment. You are a moron. These techniques are dangerous, even when performed on, and by, fit, responsible, considerate, trustworthy, self-aware people. There is a small gap between the doing the technique and causing serious permanent injury.
So how big is the margin of safety when some dumbshit cop makes a move on someone who is unfit?
According to my instructor, who also does full-contact karate, BJJ has one of the highest injury rates of any martial art. Many martial artists avoid it for that reason. However, if you are ever in an street fight with thugs or LEO or both (these days, who can tell the difference?), BJJ is probably what you need. That's why I take the risk - to prepare for that one ugly day that my life depends on it.
It is too easy to kill someone with these techniques. Let me repeat that, it is TOO EASY. The more I learn, the more I am unnerved about how vulnerable untrained people are (we call them "civilians") to a trained attacker. It unnerves me no end that shit-for-brains LEOs are being taught BJJ and MMA moves. Civilians have no idea of the danger they are in if some fucking cop decides to try out his "training".
