"The Most Egregious Sections Of Law I've Encountered During My Time As A Representative"

Tyler Durden's picture

Submitted by Mike Krieger via Liberty Blitzkrieg blog,

Decency, security, and liberty alike demand that government officials shall be subjected to the same rules of conduct that are commands to the citizen. In a government of laws, existence of the government will be imperiled if it fails to observe the law scrupulously. Our government is the potent, the omnipresent teacher. For good or for ill, it teaches the whole people by its example. Crime is contagious. If the government becomes a lawbreaker, it breeds contempt for law; it invites every man to become a law unto himself; it invites anarchy. To declare that in the administration of the criminal law the end justifies the means — to declare that the government may commit crimes in order to secure the conviction of a private criminal — would bring terrible retribution. Against that pernicious doctrine this court should resolutely set its face.

–  Louis Brandeis, Supreme Court Justice, in 1928

While most Americans are busy Christmas shopping and making preparations for trips to see family, Congress remains hard at work doing what it does best. Giving gifts to Wall Street and trampling on citizens’ civil liberties.

I knew the plebs were about to be royally screwed a week ago when I published the post: Wall Street Moves to Put Taxpayers on the Hook for Derivatives Trades. The piece concluded with the following:

Remember what Wall Street wants, Wall Street gets. Have a great weekend chumps.

Naturally, Wall Street got what it wanted. In fact, this provision was so important to the financial oligarchs that Jaime Dimon called around to encourage our (Wall Street’s) representatives to support it. The Washington Post reports that:

The acrimony that erupted Thursday between President Obama and members of his own party largely pivoted on a single item in a 1,600-page piece of legislation to keep the government funded: Should banks be allowed to make risky investments using taxpayer-backed money?

The very idea was abhorrent to many Democrats on Capitol Hill. And some were stunned that the White House would support the bill with that provision intact, given that it would erase a key provision of the 2010 Dodd-Frank financial reform legislation, one of Obama’s signature achievements.

But perhaps even more outrageous to Democrats was that the language in the bill appeared to come directly from the pens of lobbyists at the nation’s biggest banks, aides said. The provision was so important to the profits at those companies that J.P.Morgan’s chief executive Jamie Dimon himself telephoned individual lawmakers to urge them to vote for it, according to a person familiar with the effort.

The nation’s biggest banks — led by Citigroup, J.P. Morgan and Bank of America — have been lobbying for the change in Dodd Frank, which had given them a period of years to comply. Trade associations representing banks, the Financial Services Roundtable and the American Bankers Association, emphasized that regional banks are supportive of the change as well.

But the regulatory change could also boost the profits of major banks, which is why they are pushing so hard for passage, said Simon Johnson, former chief economist of the International Monetary Fund and a professor at the MIT Sloan School of Management.

“It is because there is a lot of money at stake,” Johnson said. “They want to be able to take big risks where they get the upside and the taxpayer gets the potential downside,” he said.

While that’s bad enough, the lame duck Congress clearly didn’t consider its job done without legislating away the 4th Amendment. Here is some of what one of the only decent members of Congress, Justin Amash, wrote on Facebook:

When I learned that the Intelligence Authorization Act for FY 2015 was being rushed to the floor for a vote—with little debate and only a voice vote expected (i.e., simply declared “passed” with almost nobody in the room)—I asked my legislative staff to quickly review the bill for unusual language. What they discovered is one of the most egregious sections of law I’ve encountered during my time as a representative: It grants the executive branch virtually unlimited access to the communications of every American.

On Wednesday afternoon, I went to the House floor to demand a roll call vote on the bill so that everyone’s vote would have to be recorded. I also sent the letter below to every representative.

With more time to spread the word, we would have stopped this bill, which passed 325-100. Thanks to the 99 other representatives—44 Republicans and 55 Democrats—who voted to protect our rights and uphold the Constitution. And thanks to my incredibly talented staff.

Block New Spying on U.S. Citizens: Vote “NO” on H.R. 4681

Dear Colleague:

The intelligence reauthorization bill, which the House will vote on today, contains a troubling new provision that for the first time statutorily authorizes spying on U.S. citizens without legal process.

Last night, the Senate passed an amended version of the intelligence reauthorization bill with a new Sec. 309—one the House never has considered. Sec. 309 authorizes “the acquisition, retention, and dissemination” of nonpublic communications, including those to and from U.S. persons. The section contemplates that those private communications of Americans, obtained without a court order, may be transferred to domestic law enforcement for criminal investigations.

To be clear, Sec. 309 provides the first statutory authority for the acquisition, retention, and dissemination of U.S. persons’ private communications obtained without legal process such as a court order or a subpoena. The administration currently may conduct such surveillance under a claim of executive authority, such as E.O. 12333. However, Congress never has approved of using executive authority in that way to capture and use Americans’ private telephone records, electronic communications, or cloud data.

Now watch the following video:

Finally, this is what I think of Congress:

What Wall Street wants Wall Street gets, what Louis XVI wanted Louis XVI got.

It one thing when systemic & endemic 'Wall Street / TPTB' bribery and corruption is behind the curtain and sensed by a few, it is another thing when it is realised by the population at large.

Now I am absolutely certain that Louis XVI and his Aristocracy (banksters & military & police) thought their control of every part of the country's mechanisms guaranteed its life long protection and safety, and that it never crossed their mind that it would be even remotely possible that they would be bought to a deathly judgement. This is the exteme arrogance and greed and contempt of the elite, who tramp down the citizens in order to control them absolutely.

BUT it only took a few seminal moments to light a wick that set things in motion..and very quickly changed the whole game.

The USA is very different to the peasants at the beginning of the French Revolution....most Americans are armed, have a variety of guns.

I can imagine all those Diamon, Blankenfeld type banksters, all those systemically corrupt Congressmen, and lobbiests..and the whole elite crew feel absolutely impregnable in their lofty protected positions. Unassailable in any form by the general civilians.

BUT somehow, by some means ....all things revert to mean...and often quickly and violently. If I were these Elite with their latest money grab via corrupt Congress...I would begin to start rubbing my neck..... straws camels black swans and armed public.....

This begins and ends with a Congress which has committed Treason for allowing Hussein Obama, who is NOT a natural born Citizen of the United States, simce he was BORN British, of a British subject father (and likely is STILL a British subject), to attain the office of President. In doing so, Congress has allowed the NWO to deliver the death blow to the Sovereignty of US Citizens. They now protect that treason and the knowledge of its committion. The treason is protected by a useful idiot media and a blind judiciary. Knowledge of the Usurpation of the Presidency is the KRYPTONITE of the NWO's plan, yet even many here see that Usurpation as a "technicality" or they refuse to believe the "conspiracy" (cognitive dissonance). The illegal POTUS was put there for a purpose---- to void the sovereignty of the Citizens of the US (that's somewhat of a big deal)

There can be NO LAW when the chief executive of the US, the "executor of the laws," is an illegal entity. The law is only what those in power say it is. LOOK AROUND!!! If you think it is "not important", then why is the "R Team" promoting their own illegal non natural born Citizen candidates as POTUS and VP candidates? Marco Rubio,Ted Cruz, Rick Santorum, and  Bobby Jindal were all born of foreign or resident alien parents, and are not eligible as POTUS or VP. John McCain was not eligible either, since he was born in the PCZ and was NATURALIZED by 8 US Code 1403--- the NWO made sure that an ineligible POTUS would "win" in 2008 with both candidates being illegal--- and it was done under the distraction of the "financial crisis". Apparently an illegal POTUS is important to someone.

The Criminals are now consolidating their power, JUST LOOK AT THIS BILL!! Hussein Obama, as well as the Treaonous Congress are now domestic enemies of the United States, overseeing its destruction at the behest of the NWO by Cloward Piven strategy.

Unless we water the tree of liberty with the blood of these tyrants there is no going back. Yank the criminal Usurper from the White House and hang his eneablers. That is the only way back. otherwise enjoy your serfdom. You have been complicit by accepting the authority of the Usurper. Consent is legality.

Getting Obama in as President *was* the message. He is not worthy of hate as he is just a clueless puppet. What a great gig he has... golf, private airlines, private chef, Reggie, and all he has to do is read what shows up on a teleprompter.

A show of strength by the NWO to get a black, inexperienced gay who isn't even eligible elected anyway. I insist its like in the movie 'Matrix' where Neo's mouth disappears and Agent Smith tells him "How can you scream if you have no mouth?"

TPTB power over every major area of our lives and constantly show they can change our "reality" as they will, and can do just about whatever they want. The vote in Scotland was another example, as was the Swiss vote on gold, as was the independence vote in Barcelona (which won, but so what).

The only possibility we have is that TPTB start to fight amongst themselves, as I do not believe everyone is on the same page (e.g. Russia, China, Turkey, India, Brazil, etc have different agendas and likely are not willing to allow the Anglo-Zionists to call the shots).

What was necessary for this charade to continue was the tacit belief on the part of the peeps that we were a nation of laws founded on due process and equality.  The curtain has fallen and the little men back stage have been revealed.  It is clear to all who would pay attention that the system has been coopted by the vilest of our species. They murder, rape and pillage with impunity.  The majority of the population is either complicit in the scheme or does not care.

So what are we the minority to do?  First, we must teach the Constitution to all who will listen.  We must point out the flagrant violations.  We must insist that it is not a failed principle.  We must point out that the failure comes from the treasonous bastards who refuse to uphold it.  We must make sure that the Declaration of Independence lives in the hearts and minds of the up and coming generations.  We must instill in them the understanding that these principles are not about what we currently are but about what we ought to be and that any failure we as a nation suffer comes from our failure to live up to these ideals.

And second, by noncompliance, by subterfuge and by outright resistance we must thwart any effort to further disarm the populace.  We absolutely must retain for ourselves and future generations the means to resist the mailed fist of the tyrant.

Collapse is ongoing.  We can feel it.  We can smell it in the wind.  Central managers are attempting the world over to manage the unmanageable.  This is a systemic failure.  It is organic.   It is beyond their poor powers to add or detract.  Centralization is being decentralized.  It is not a one size fits all collapse.    Some places are devolving into barbarity.  Some places will retain their civility.

The best that any of us can do at this point in time is to remain as small a target as possible.  We must affiliate ourselves with likeminded people.  We must help those that we can help.  We must look to ourselves and to our families.

At some point in the future when the old systems have been laid waste and the deceits have unraveled, there will come a time of rebuilding.  At that point, if we have done our job, the remnant will remember once again that all of us are created equal, that we are endowed by our creator with certain inalienable rights that among these are life, liberty and the pursuit of happiness.

I stumbled upon a sermon written in 1770 that was distributed in the colonies. Some say that this sermon galvanized thoughts leading to 1775.

Samuel Cookes Revolutionary Sermon

May 30 1770

AN ELECTION SERMON.

HE THAT RULETH OVER MEN MUST BE JUST, RULING IN THE FEAR OF GOD.  AND HE SHALL BE AS THE LIGHT OF THE MORNING WHEN THE SUN RISETH, EVEN A MORNING WITHOUT CLOUDS:  AS THE TENDER GRASS SPRINGING OUT OF THE EARTH BY CLEAR SHINING AFTER RAIN.  -- 2 Sam. 23:3, 4.

This solemn charge given to rulers is not an arbitrary injunction imposed by God, but is founded in the most obvious laws of nature and reason.

Rulers are appointed for this very end--to be ministers of God for good.  The people have a right to expect this from them, and to require it, not as an act of grace, but as their unquestionable due.

It is the express or implicit condition upon which they were chosen and continued in public office, that they attend continually upon this very thing.  Their time, their abilities, their authority--by their acceptance of the public trust--are consecrated to the community, and cannot, in justice, be withheld; they are obliged to seek the welfare of the people, and exert all their powers to promote the common interest.

This continual solicitude for the common good, however depressing it may appear, is what rulers of every degree have taken upon themselves; and, in justice to the people, in faithfulness to God, they must either sustain it with fidelity, or resign their office.

The first attention of the faithful ruler will be to the subjects of government in their specific nature.  He will not forget that he rules over men

--men who are of the same species with himself, and by nature equal--

-men who are the offspring of God, and alike formed after His glorious image--

-men of like passions and feelings with himself,

and, as men, in the sight of their common Creator of equal importance--

-men who have raised him to power, and support him in the exercise of it--

-men who are reasonable beings, and can be subjected to no human restrictions which are not founded in reason, and of the fitness of which they may be convinced--

-men who are moral agents, and under the absolute control of the High Possesser of heaven and earth, and cannot, without the greatest impropriety and disloyalty to the King of kings, yield unlimited subjection (2) to any inferior power--

-men whom the Son of God has condescended to ransom, and dignified their nature by becoming the Son of Man--

-men who have the most evident right, in every decent way, to represent to rulers their grievances, and seek redress.

The people forfeit the rank they hold in God's creation when they silently yield this important point, and sordidly, like Issachar, crouch under every burden wantonly laid upon them.

And rulers greatly tarnish their dignity when they attempt to treat their subjects otherwise than as their fellow men--

-men who have reposed the highest confidence in their fidelity, and to whom they are accountable for their public conduct--and, in a word, men among whom they must, without distinction, stand before the dread tribunal of Heaven.

Just rulers, therefore, in making and executing the laws of society, will consider who they are to oblige, and accommodate them to the state and condition of men.

Fidelity to the public requires that the laws be as plain and explicit as possible, that the less knowing may understand, and not be ensnared by them, while the artful evade their force.

Mysteries of law and government may be made a cloak of unrighteousness.

The benefits of the constitution and of the laws must extend to every branch and each individual in society, of whatever degree, that every man may enjoy his property, and pursue his honest course of life with security.

The just ruler, sensible he is in trust for the public, with an impartial hand will supply the various offices in society; his eye will be upon the faithful; merit only in the candidate will attract his attention.

The ruler will not, without sufficient reason, multiply lucrative offices in the community, which naturally tends to introduce idleness and oppression.  Justice requires that the emoluments of every office, constituted for the common interest, be proportioned to their dignity and the service performed for the public; parsimony, in this case, enervates the force of government

Isn't this simply the enabling legislation behind our nation's TBTF policy?  Not seeing how it changes anything, as the banks would never be allowed to fail.

This is like having a rich uncle who is addicted to hookers, blow, and gambling, and he passes a law that says we have to cover his gambling debts. WTF?

And what is the effect of providing insurance for his risky behavior?  Why even riskier behavior, of course. This is going to create a stampede to the gambling tables. We are so fucked.

It's been said many times by many people on ZH that Western governments - most notably the United States, UK and EU - have been taken over by a criminal class. They have trashed the Rule of Law, they pass new laws to protect themselves and countless anti-liberty laws to keep everybody down.

None of this is new; it's been bullding up slowly for years in the hope nobody would notice. 9/11 was simply the catalyst to turn up the momentum and justify the militarisation of police, DHS, NSA and other alphabet agencies of The Almighty State.

The trigger point for "enough is enough" will be when they crash the system and attempt to take all. That will be when the day of reckoning is upon us.

Many blame the congress and the president for the downfall of America. I say it is we the citizens, of which I am one, who have failed. We elect wolves rather than sheep dogs that destroy the rights of the Sheeple. We fail to chastise the press that should watch governments every move. We allow schools to no longer teach America’s history, civics and what it means to be an American citizen or even say the pledge of allegiance. We no longer have god as the foundation of a strong family and government. We no longer teach our children to be disciplined and self reliant. We allow our media to denigrate our personal values. We have degraded the respect that citizens once had for their sheep dogs like police and military. We have torn apart the family giving children total control over their parents. We have vilified the American dream of business as a pile of greedy wolves. We have torn our justice system down to make the exception like gays the rule. We have allowed government to regulate our businesses and lives down to the kind of light bulb we use. We have now become a nation of babbling self centered demanding whiners that the founders of America would be screaming at…

I agree with you, but honestly, so what? Nothing lasts forever, and our little Shangri-La was destined to fall apart at some point. And now it has. Time to prepare for a new reality. In the meantime, when you continue to vote and to participate and to listen to what our current malignancy of a government has to say, you just prolong the collapse. STOP PARTICIPATING.

Vooter, I agree completely. When the people continue to vote in national elections they give their consent to these self-serving miscreants to abuse us. If we don't vote, they can't come to power. We must stop giving this corrupt system the legitimacy and credibility it does not deserve.

The American people need to boycott the electoral process for congress and the presidency to effectively collapse the central government.  We can be a free people again, without violence by ignoring the first Tuesday in November when national elections occur.

Heads up folks... Biden will likely be the next President of the US. TPTB will remove Obama from the scene (via scandal or other means), Biden will serve out his term, and be in position to run in 2016.

He will make sure to get reelected of course.

There is a big difference between freedom and democracy (government of, for and by the People) and totalitarian corporate fascist (government of, for and by the multinational corporations).

All exceptional and indispensable psychopath fascist dream of EMPIRE and ruling the world by grand tyranny.

Members of Congress are TRAITORS to all Americans and should be arrested and tried for Treason to the American People and our Constitution.

In the case of revolution, Congress members are going to be on a deck of cards with a bounty on them; think about that Congressman!

Just think, there are only 435 congressional representatives, 100 senators and a puppet king that stands between 300 million+ Americans and equal justice.

What a travesty of freedom and liberty we've become.

In reply to Begintowen: American FORM of democracy is a Representative Constitutional Republic that was overthrown by the criminal bankster corporate monopoly fascist. FDR and Congress had to deal with the corporate monopoly fascist after the Great Depression and FDR saved our democracy by curbing the fascist dog.

Our founding fathers had to deal with the corporate monopoly of fascist EMPIRE in their day and we must deal with them in our day. Most Americans are so brainwashed stupid they do not even know what their heritage is.

Most uneducated but brainwashed Americans do not know the difference between democracy, fascism, communism, feudalism or socialism.

The treasonous criminals are handing out thier marching orders. It does not matter why they follow thier orders. They either do or do not.

I know they wont listen to me because I dont have a badge. Do the job right or go home. Leave our children alone and get it done. Or clear out.

Real honest folks should not be fucked with. That aint the American way for good reason.

"But the regulatory change could also boost the profits of major banks, which is why they are pushing so hard for passage, said Simon Johnson, former chief economist of the International Monetary Fund and a professor at the MIT Sloan School of Management.

“It is because there is a lot of money at stake,” Johnson said. “They want to be able to take big risks where they get the upside and the taxpayer gets the potential downside,” he said.

It isn't potential downside.  It is guaranteed downside, hense the strong desire for the change.  The Big Five investment banks all got leverage waivers and all five crashed.  Leverage increases losses.  The banks know there will be derivatives losses.
