Judge Rules Obama's Abuse Of Executive Orders Is "Unconstitutional"

A federal judge, Judge Arthur J. Schwab of the Western District of Pennsylvania, used a deportation decision to probe the constitutionality of President Obama’s executive order on amnesty, declaring it “unconstitutional.”

It is about time that Executive Orders are challenged in court for they are absolutely unconstitutional since they smack of a dictatorial abuse of power that denies the people the right to decide the fate of their nation.

Indeed, Texas and other states have already initiated lawsuits challenging the order. Nonetheless, the key here is that ANY such Executive Order is unconstitutional violating the entire concept of a Republic where it is at least a pretense that it is a government by the people rather than a king acting on a personal whim. This is what the law should be – not because of the subject-matter, but any issue.

Obama could just as easily order that the IRS increase taxes to 85% without Congress. Anything would be possible. This is the immigration issue, but the act of an Executive Order is everything. Obama just issued such an unconstitutional order to the FCC directing them to regulate and license the Internet. There is nothing any President could do without a vote from the people

Consequently, Judge Schwab wrote:

“President Obama’s unilateral legislative action violates the separation of powers provided for in the United States Constitution as well as the Take Care Clause, and therefore, is unconstitutional.”

epa seems like a way to carry out environmental legislation and hence a valid use of executive power.  where i feel iffy about the prez is the endless undeclared war, the refusal to prosecute bank fraud and execution of u.s. citizens by executive order.  that's an unconstitutional use of executive orders in my opinion.

schwab may be right on this one but he certainly was mean to tommy chong (wiki):

On January 23, 2002, Schwab was nominated by President George W. Bush to a seat on the United States District Court for the Western District of Pennsylvania vacated by Maurice B. Cohill, Jr.. Schwab was confirmed by the United States Senate on September 13, 2002, and received his commission on September 17, 2002.

 

In 2008, the Pittsburgh Post-Gazette reported Schwab had the "lowest ranking among federal judges" by 797 lawyers in the Allegheny County Bar Association.[2]

 

In 2011, he was accused of bias and recused himself from seventeen ongoing cases.[3]

 

Tommy Chong case[edit]

In 2003, Schwab presided over the case involving Tommy Chong's trial for conspiracy to distribute drug paraphernalia (bongs), and sentenced him to nine months in federal prison, as well as a hefty financial penalty.[4]

 

Cyril Wecht case[edit]

In 2008, Schwab presided over and was eventually removed from the Cyril Wecht federal trial, a case that caused considerable controversy. The defendant, a prominent Democrat in Pennsylvania, alleged that Judge Schwab was biased and the prosecution was political in nature and sought to have Judge Schwab removed, but was turned down. Among the controversial decisions that Schwab made was seeking to keep the names of jurors anonymous, a tactic usually reserved for criminal cases where the jurors may be in danger. This was overturned by the Third Circuit Court of Appeals. [5]

 

After Schwab declared the original trial a mistrial, he was criticized for not following proper procedures before declaring a mistrial, such as polling the jury which would have determined if the defendant should be retried on all counts or just one.[6]

 

One month later he was removed from presiding over the retrial. The Appellate court cited a "combative tenor" in the proceedings and hoped for "reduced level of rancor."[7] On May 14, 2009, the new judge in the case tossed out most of the evidence against Wecht stating it was seized under unconstitutional warrants[8] On June 2, all charges were dropped against Cyril Wecht.[9]

 

West Penn Allegheny Health System v UPMC case[edit]

In 2012, Schwab presided over the West Penn Allegheny Health System v University of Pittsburgh Medical Center (UPMC) case, and in a rare move, the 3rd U.S. Circuit Court of Appeals removed him from case. According to Pittsburgh Post Gazette, "It's rare for a federal judge to get yanked from a case, and twice in four years gets everyone's attention."[10]

I suspect that had a Republican tried to do by executive fiat what Obama has, you'd see the issue plainly - the former professor of Constitutional law keeps doing things that are against the plain language of the Constitution.

Regardless of political leanings, the Executive simply wasn't given this power to ignore, nullify and create law.


Try to focus on the issue, instead of dispensing hackneyed partisan bloviating every time your guy is rightly criticized for his efforts at an Imperial Presidency.

The "law" strikes me as the worst possible cudgel to use in this regard. We obey because the law exists to protect us...even from ourselves. To use the law as some type of "weapon" strikes me as terror indeed.

And indeed Thomas Jefferson...no less than he author of the Declaration of Independence...has spoken on this issue. "These truths are self evident" he said.

I guess I would side with the founders in thinking that there are certain things no government, and no majority, no matter how big should be able to take from people. I think most people agree that govenment should not be able to kill 6 million jews no matter how many people think it is in the publics best interests to do so. Using the constitution is just using the logic and rational of the founders, who made their case extreemly elloquently,  to make that case to others. I think it can be very effective given that the principals on whicih the government was founded are concepts that so many wish to keep hidden for fear that the simple logic of it undermines their anility to bend others to their will.

Either way, the Contitution is a farce, legal definition of government is irrelevant. As government requires the initiation of force, the premise under which it exists is morally inconsistent because if flatly violates the non-aggression principle. It is also logically inconsistent (i.e allowing a small group to steal from me in order to protect my property from theft)

Force exists. There's no way to stop it and we really wouldn't want to even if we could. There will always be many different kinds of people and someone will always claim they are being forced. We always have a choice, even if we don't like the choices available to us.

Force is the overwhelming feature of bad government, not government in general.

Government is how people agree to live together. That's all it is. Anytime you get more than a few people together some form of leadership will emerge. The desirability and durability is entirely dependent upon the people involved.

I"m coming to understand Jeffersons remedy of Nullification more and more every day. When a government no longer answers to the people, when the laws are designed to create crime, and when government are obvious thugs, then it is We The People's responsibility to do good in the world regardless of the thugs in power.

A protection-only government does not require intitatory force.  The Prime Law of no initiatory force will reduce government to its proper purpose of defense, rather than offense, and raise standards of living for everyone.  

The problem is the rule of man and its ruling class of politicians who assume the right to control our lives and businesses for no reason other than we allow them to do so.  End the rule of man in order to launch the wealth of mankind.  Stop voting for Democrips and Rebloodlicans.

So what you're saying is the EPA is also unconstitutional... big surprise. Then again, a vast array of laws passed by congress that force people into programs against their will are also obviously unconstitutional. The problem is the courts have sided with the politicians in contorting a few clauses in the constitution to make nearly any action of the government legal, and where they can't do that they have made the IRS a loophole though which virtually any action can potentially be consider a legitimate action of government including unlawful search and seizure, denying your right to hear your case heard in court, or even buying things the government deem you should buy.

The Constitution is heavily flawed, as it allows five out of nine Supreme Court judges to rule on what is Constitutional or not.

They ruled ACA as constitutional because it is a "tax" and taxing is a power that Congress was given under the Constitution.

Before you guys accuse of me of being a "traitor" for despising our Constitution, you got to remember, many of the founders hated the end result too.  I recommend reading the debates in the Anti-federalist papers.

The Bill of Rights was added on at the last minute, and that's the only thing worth saving, although the 9th amendment was too vague and the list of unalienable rights wasn't comprehensive enough.

It was a step in the right direction, considering the founders barely just got out of Monarchism, but why we have our hands tied to an 18th Century document is comical at best.

I have so many criticisms, there's not enough time for me to list them all here on a comments section to an article, but I highly recommend reading The Constitution Con by Michael Tsarion.  Some of the founders left the door wide open for British agents to come in later and rule subtly.

Correct.

The original Constitutional Convention (ConCon) was convened to correct certain perceived deficiencies in the Articles. What happened was that the Articles were thrown out and a brand-new Constitution was substituted.

Now we are faced with those who want another ConCon. This time we will get the "Newstates Constitution" underwhich we will report to "Overseers".

Not true, and not valid as written anyway.  The Constitution had and has nothing to do with monarchism - the federal government was given very limited powers, but over time the judiciary enabled expansion well beyond the powers provided. 

 

It isn't perfect, but blaming the Constitution is giving a pass to the citizenry which, uninformed and apathetic, let it happen.

Perhaps the only, and I do mean only redeeming point about the ruling the Supreme Court made with regards to Obamacare (don't ever ask me to call it by it's "official" name) was that they did strike down it's legality per the Commerce Clause (effectively putting a stake in it's heart, but not necessarily killing it). EPA was created in 1970 by an Executive Order by President Richard M. Nixon.  This Executive Order was then ratified by committee hearings in the USA Senate and Houser of Representatives.  The creation of the EPA in 1970 was pursuant to 1970 amendments to the Clean Air Act of 1955, which was also amended in 1963 and 1967.  The Clean Water Act was signed into law in 1972.

The Fed judiciary has evolved into a finely-tuned system of political favors & pay-backs.  This decision will be "appealled", which is to say it will be put up for auction and a suitable, higher court/judge will be identified to overturn this ruling... and the game continues.

The SCOTUS is the bottom line - the dike that can stop a sea of judicial corruption - but we've seen the SCOTUS drown itself in the corrupt waters of politics, as well.  The 2000 election (FL recount), Citizens United & ACA decisions should extinguish any naive hope that our Federal courts will uphold the Law of the Land.  Like congress, the judiciary has become mere theater for the few citizens that still pay attention... offering the illusion justice much like a religious ritual offers the illusion of salvation.

The whole idea that it has all been a lie since most of us have been alive is a big damn pill to swallow. What it all means takes time to articulate out into the nooks and crannies of our everyday lives. Some habits are hard to break. Believing in your government is one of them. I loved my civics class so much. I thought our system was so cool. Losing this is like losing your religion, like finding rock solid proof that everything you have been taught about God or Christ is a lie.

Their vote does not count. Regardless of the outcome of the 2000 Elections it was revealed that Statistical Sampling was more of a factor than the actual count of the votes.

 

It would not have been any different if Gore won the Whore House anyway. The Government of the uSA is a continuation of sorts. Presidential Adminstrations are born. Within Four to Eight Years that Administration is replaced. But the Government Agencies and their Administrative Law persists throughout, unchallenged, unchanged. Just part of a continuum. You like Dr. Who...Look at the continuum and understand it from that perspective.

 

And as for the votes? They are manipulated. Furthermore there is no choice. When people come to that realization then they drop out as they are not stupid and know they have no affect. Generally people do not participate in EXERCISES OF FUTILITY.

 

There are many better things for many to do....and more enjoyable to many...like being programmed by their TeeVee.

Legal challenges have to be raised that any elected representative at all levels of Gov't. cannot have dual-citizenship.

Being so amounts to a conflict of allegience, hence treason.

According to pre-last elction ZH article on the subject, 'there are (were) around 27 Congressmen and 13 Senators who currently hold dual citizenship with Israel.'

I have read up on it, it is no more or less mythology than anything else we got going and call religion. It is interesting to watch how the Christian religion evolved through history. Underpinning all religions is something very real. Psychologists who do alpha theta brain wave training can "induce" religious experiences in the brain. I have been there and done that personally. The animals that we are, happen to be wired to do a thing that we reify a little differently from one another, all over the world. This is why I refuse to be disrepectful of any one religion. In other words, I agree with you, and don't.

I figure if God can pull off the big bang, code the physics and make it operational on some level (holigram, whatever)  just how hard would it be for Him to insert Himself into his creation in order to bridge the gap between Himself and the creation.   Why not create a bridge for us to take where the choice to take it is the only requirement? It even makes sense albeit in a crazy way. It's certainly no crazier than the singularity, E=mc^2,  quantum dynamics and DNA arising from nothing? Well, the white house as already come back with the message that says that judges have no authority to challenge Presidential orders. How's that for a democratic republic? Anyone thinking this is anything other than a tyrannical dictatorship?

What do you think our elected Representatives will do? Not a fucking thing. Oh, they'll hold meetings and issue statements but not one fucking thing will be done in the end. Nothing will come from it other than more hand wringing and debate, meanwhile it will end up before the supreme court, who know that their power is not seated in the constitution, but from the president's control of the bloody pulpit. Recall his public tongue lashing of them in his State of the Union speech. This court, like that of FDR, learned quickly who was in charge and changed their wicked ways. After watching the Obamacare decision, we know what to expect.
