St. Louis County Police Releases CCTV Clip Detailing Events Of Last Night's Shooting
In a modification of the infamous Greedo scene from Star Wars, tonight's latest fatal shooting at a gas station in Berkeley, MO boils down to one thing: who threatened to shoot whom first. As a reminder, the local police department said that "the man had pointed a handgun at an officer who approached him and another man outside a gas station where the officer was conducting a routine business check in the suburb of Berkeley. Fearing for his life, the Berkeley Officer fired several shots, striking the subject, fatally wounding him."
Moments ago, in order to quell further speculation, the St. Louis County Police just released a CCTV clip (shown below), highlighting the moments just before the fatal shooting which, indeed, appears to show the victim pointing a gun at the officer first, in which case this is nothing than a case of an officer engaging in self-defense.
It remains to be seen if the facts will be enough to cool local tempers.

At approximately 11:15 PM on December 23, 2014, a police officer with the City of Berkeley was conducting a routine business check at the Mobile Gas Station located at 6800 N. Hanley when he observed two male subjects on the side of the building. The Berkeley Police Officer exited his vehicle and approached the subjects when one of the men pulled a handgun and pointed it at the officer. Fearing for his life, the Berkeley Officer fired several shots, striking the subject, fatally wounding him. The second subject fled the scene. The Berkeley Police Department requested the St. Louis County Police Department's Crimes Against Persons Unit to handle the investigation. St. Louis County Police Detectives have recovered the deceased subject's handgun at the scene. At this time, I cannot confirm the identity of the deceased subject. The investigation is on-going and further details will follow as they become available.

The video from the Citgo station in Arlington VA across from the Pentagon should confirm this.
Living in an area where there a lot of police shootings, you know when it's justified when they can't wait to show the video. Hemming and hawing? Claiming that "video doesn't show everything?" They don't trust their officer. But if its justified and they have video, it will be on the next news release. It tells you something about the public trust and police.

St. Louis County Police Chief Jon Belmar said the officer was questioning the 18-year-old and another man about a theft late Tuesday at a convenience store in Berkeley when the young man pulled a 9mm handgun on him. The officer stumbled backward but fired three shots, one of which struck the victim, Belmar said. The gun with six rounds and a defaced serial number was found at the scene, police said.
St. Louis County Police Chief Jon Belmar said the dead man, whom Belmar did not name, had been previously arrested for assaults, armed robbery, armed criminal action and stealing since he turned 17. “He was known to law enforcement,” Belmar said.
Demonstrators at the scene and family identified the victim as Antonio Martin.
"This doesn't make any sense for them to kill my son like this," Toni Martin-Green told the St. Louis Post-Dispatch at her home near the University of Missouri-St. Louis campus. "I am trying to be calm."
Some protesters questioned why the officer couldn't use pepper spray or a stun gun.

I know where I grew up, convenience stores and gas stations would give free coffee and such to police officers so they would come in the store.

A routine "business check" means several things: 1. Many businesses offer free coffee and/or food to cops who stop in {cheap security}. 2. In some instances, the cashier is a "cop groupie", and services him in the cooler where there are no cameras. Early one morning I came upon a red faced cop coming out of the cooler behind his twenty something concubine. This goes on more than you realize. 3. Some businesses are targeted by local thugs, and are robbed on a regular basis. These businesses are known to police who drop by to make sure everything is alright. I suspect the officer came to the store for one of the above mentioned reasons.

If you believe in equal protection under the law and due process and all that, then you have to remember that this video would give a reasonable person reasonable doubt. It could be that the guy was pointing his finger, but can you say that you believe that beyond a reasonable doubt? This cop will never be convicted over this, and if it were me shooting somebody and claiming self defense, I would very likely not be convicted if I had a similar video as evidence.
Remember, it's not the justice system, its the legal system, and if you really want equal protection under the law, that goes for popos too. Of course, they don't get convicted or even tried when they should, but step back and think for a minute when you ask for a bloodthirsty legal system, no matter who's blood you are calling for.
Of course, there is no "equal protection" when it comes to cops and plebs.
If someone pulls a gun on a cop, the cop can kill them - no consequences for the cop.
If a cop pulls a gun on someone, and they kill the cop, they can expect to be found guilty of murder (and probably a bunch of other charges as well). That is if they are not shot to pieces before getting anywhere near a court room. (And of course those doing the "shooting to pieces"? No consequences for them, and no "due process" for the one just shot to pieces, just a summary execution.)
Unless the one who drew on you was a cop. Then you're fucking toast, because cops are "real citizens" and you're just a fucking pleb.
(You don't even have to have a weapon - just make any one of a number of motions that are remotely similar to drawing a weapon. As long as the cop "got frightened" it's a "good kill".)
Where in the video is the shootee given their "reasonable doubt"? By allowing "law enforcement" to conduct summary executions without much higher accountability than "reasonable doubt", you trash the rights of everyone who is subjected to them. "Reasonable doubt" is a protection against unjust enforcement, not a justification for unjust enforcement (summary execution without any due process). If someone can't handle living up to the higher standard that law enforcement should be held to, then they shouldn't put on the uniform and should seek employment elsewhere, someplace more suitable for someone whose fear (or conditioning) overpowers their sense of justice.
Note that the purpose of my post is to:
1. point out the inequality of how drawn weapons are or are not justification for mortal self defense, and
2. point out that law enforcement can not be held to the same low bar of "reasonable doubt" as any other defendent, because that low bar was created specifically to protect against the actions of representatives of the state, not empower them
The purpose of my post does not include making any personal defense of the shootee in this case (who more likely than not was probably a piece of scum the world is better without -- though such probability alone does not quite constitute just cause).

I have assisted LEOs many times in the past, at accidents, administering first aid, etc..(and will again if needed) but I have seen this shit up close and personal.

A later statement said it was because he saw a large male, behind a petite woman, and feared for her security. (one would think that after she identified him as her son, that would be the end of the stop).
You would just have to know these people, that kid (grown now) is a non-drinking, non-drugging individual, with a hardcore work ethic, volunteer fireman, that really works to better his community and world. In short, anybody I know, would be proud to have a son like him.

The policeman fired 3 times. The report said one shot hit the perp in the face, another hit the left front tire (the cop was falling down, backwards) and they haven't figured out where the third shot went.

9mm is like a BB gun against someone over 280 lbs and esp if they are wearing a thick jacket I read on one of those ballistic web sites the other day. The police near the Seattle area I read voted to use Kimber .45 cal and some police departments still use the .357 magnum revolver.
I laugh at people carrying .32s or 9mm.. You want to stop someone in their tracks., hit them with .45ACP or bigger...
I respectfully disagree. With pistols it is all about quick and reliable shot placement under stress, not caliber.
If you really want to stop a man in his tracks, short of hitting him with a few rounds of 12 ga 00 buckshot, then two to the chest and one to the cranial vault, Mozambique style.
A .45 to the love handles or off the top of the head, is little different than a .22 caliber.
I agree it's about shot placement,but every situation is different. Sometimes just making contact is one's only viable choice in the matter. I am seeing Dept's actually going back to the 9mm, even the FBI after all that change after the Miami Shootout. Their rationale, bullet technology has changed for the better and less wear and tear on pistols. I say bunk on that.
If the bad guy is wearing body armor, as more of them do, a .22 caliber bullet like the 5.7x28mm traveling at a couple thousand fps is much more effective than a .45, .40, or 9mm.
I still really do like the FN FiveseveN with 20 rnds of ss190 for personal defense.
Body Armor = Two center mass which takes balance, disrupts OODA Loop, then Pelvic Girdle Shot and interoccular cavity shot.
Must have a plan before things happen. Practice, practice and more practice.
I still train in the dojo three days a week at 57 years old. Sure it hurts, yes the body doesn't respond like when I was 27.
I still train at the range often, always going with a plan, front sight acquisition, trigger modulation, etc.
But I would say that in a SHTF scenario, I am better equipped to deal with high stress situations than 99% of my peers.
Will some 27 year old gang-banger be able to get me in the final fight? Ya probably, but I'll make him pay...

As long as they aren't wearing the armor concealed, and/or you recognize it in the middle of the fight, and you have the time to get to hits three and four, then you might be ok.
Regardless, getting in a gunfight with multiple bad guys wearing body armor while only having a pistol is a bad day any way you cut it.
The very light recoil of the 5.7x28mm does allow me (and importantly mrs_horseman) to be more accurate on follow-up shots and get them off much faster than with traditional high caliber pistols.
Armor or no armor, two center mass is going to be my first instinctual shot.
After that, then determine next course of action. Generally speaking, this should give you time(1-2 seconds) to assess and take next course of action.
After talking to several friends with much battlefield experience, most engagements don't end with the first two shots.
If multiple attackers, you weren't as situationally aware as you shoulda been, for the most part.
Ambush, then all bets are off and it's every shooter for himself.
We can bench race all we want, but until you're in the thick of it, you won't know how you respond.
Those that train do fare better than those that don't.
One of my friends with 'in your face combat experience' has told me stories of being in a fire fight with trained commrades who freeze up when the bullets fly.
You can never predict who is going to rock and roll and who is going to have trousers that need cleaning.

Multiple attackers usually present themselves all at once.
Very seldom do they send out one person and then another and another.
My Situational reference was to that end. If you saw multiple attackers and hadn't already figured out where to start, which one was most vulnerable or closest or the apperant leader, then you weren't situationally aware.
In the dojo, we always end class with a randori, multiple attackers coming all at once. You have to plan a course of action on the fly as the opportunity presents itself.
That's what I meant in my comment on situational awareness.

There is no substitute for shot placement regardless of what calibre of round that you use. The 9mm is a higher velocity round than the 45 which will result in deeper penetration, which is also one of the 9 mm faults. If you doubt the effectiveness of the 9 mm then study the Winter War. The Finns basically stopped the Red Army using the 9mm KP-31 Suomi submachine gun. At any rate, train well and weekly my friend.
Sometimes one will not have time to aim for placement. Proper training will address that. If body armor is a factor, i want ribs shattered/broken. I want power dump. Carry what your comfortable with and train,always.
I laugh at people believing they need any bigger caliber than 9mm for a handgun.
Face it folks: restricted barrel length will always limit the transferred energy (as bullet weight times velocity) no matter how much grain you use.
I CC a 9MM everyday - and use a .45 ACP as my bump in the night guy.
With the right ammo 9MM is a good round - 124 GR Federal HST in regular or +P will put the hurt on anyone.
Everything is a trade off -
You want 18 shots of 9MM out of a Glock G17- or 9 out of a .45 ACP Kimber?
I respectfully suggest you consider upgrading your bump-in-the-night weapon to a long gun with night sights and a light, to go along with your .45 on your gunbelt.
Why not? The best reason to not go long gun is that you don't want to train with the additional equipment, which is understandable.
However, the chances are good there will be more than one bad guy, and the long gun gives you better odds, especially at night, but only if you train with it.

I have a business in a small shopping center that also has a black barber shop. Their damn customers leave such a mess with empty beer bottles, fast food containers, candy wrappers, cigarette butts ect ect that you have to follow them around with a snow shovel and a dumpster to pick up after them. Also, what is it with being black and not being able to park a car worth a damn? Always ten feet from the curb and taking up at least two spots.

Try bumping into a black person in a crowded grocery store or on a busy train. 7 times out of 10 you're going to get a nasty reaction. Most white/asian/_____ people would say excuse me and move along. They feel like you're the one in their space regardless.

I'm the first to say that I'm no defender of cops and there are real issues of abuse by those that wear the badge, but this hysteria about racists cops being the #1 problem is nonsense.
I don't care what color your skin is, if you point a gun at a cop, you're going to get shot. Same if you try to grab a cops gun.

But if someone points a gun at me - or even starts to pull out a gun in a threatening manner - I will pull mine out and shoot them until they are no longer pointing a gun at me - or threatening me.
Only a fucking idiot thinks you must wait until after shots are fired at you before it is OK to use deadly force to protect your life.
If someone points a gun at you first, cop or no cop, what are you supposed to do? Under what circumstances would this guy be allowed to point a gun at a cop that was asking him questions?
Should the cop have allowed himself to get killed so it doesn't upset the Food Stamp Army? Are white cops not allowed to defend themselves?
Can we at least find real cases of absuse for law enforcement instead of rallying around thugs who completely had it coming?
