St. Louis County Police Releases CCTV Clip Detailing Events Of Last Night's Shooting
In a modification of the infamous Greedo scene from Star Wars, tonight's latest fatal shooting at a gas station in Berkeley, MO boils down to one thing: who threatened to shoot whom first. As a reminder, the local police department said that "the man had pointed a handgun at an officer who approached him and another man outside a gas station where the officer was conducting a routine business check in the suburb of Berkeley. Fearing for his life, the Berkeley Officer fired several shots, striking the subject, fatally wounding him."
Moments ago, in order to quell further speculation, the St. Louis County Police just released a CCTV clip (shown below), highlighting the moments just before the fatal shooting which, indeed, appears to show the victim pointing a gun at the officer first, in which case this is nothing than a case of an officer engaging in self-defense.
It remains to be seen if the facts will be enough to cool local tempers.

At approximately 11:15 PM on December 23, 2014, a police officer with the City of Berkeley was conducting a routine business check at the Mobile Gas Station located at 6800 N. Hanley when he observed two male subjects on the side of the building. The Berkeley Police Officer exited his vehicle and approached the subjects when one of the men pulled a handgun and pointed it at the officer. Fearing for his life, the Berkeley Officer fired several shots, striking the subject, fatally wounding him. The second subject fled the scene. The Berkeley Police Department requested the St. Louis County Police Department's Crimes Against Persons Unit to handle the investigation. St. Louis County Police Detectives have recovered the deceased subject's handgun at the scene. At this time, I cannot confirm the identity of the deceased subject. The investigation is on-going and further details will follow as they become available.

You need to be 19 (unless in the military) to get a license to carry a gun in Missouri.

In general I don't support Police.
I don't support the institutionalization of the legal cartel, believing such things are better handled locally.
I believe that the centralization of power necessary to have an integrated court and police system is necessarily both corrupt and corrupting.
However, I believe I spy a handgun in the hand in front of that police cruiser.

I can't see much of anything in this video. It does appear someone raised his arm near the end, maybe with a gun in hand. However, at the risk of asking the non-obvious...
Seems to me people often raise guns to "freeze" a situation, to say "okay, everyone, cool your jets, stop being crazy, let's figure this out". And indeed, seeing a gun pointed at you or someone else definitely does tend to get that reaction, especially if augmented with something like, "hey, let's just settle down here" or "cool your jets everyone", or "cool it, let's talk this out".
Given the cops today are insanely quick to escalate the most trivial of nothingness, I can imagine that is what was happening here, as I saw several people including the supposed perp slowly milling around the cop car.
So my question is this, out of mere "symmetry". What should someone do if a cop pulls a gun out? What should someone do if a cop points a gun? Should you assume the cop was going to shoot you, and if possible, shoot first? Because THAT is the assumption here, of those who claim that the mere existence of a gun, or the mere pointing of a gun is cause for shooting to kill.
I know this is a tricky question for this video, because we're so far away, and we can't hear anything. If the guy holding the gun is saying "I'm gonna kill you right now MFer" or something, then a clear, specific threat has been made, and self-defense (by "officer" or anyone else) is justified.
But... not being a long time gun freak, I do have a question about "presumption". It has always been my assumption that if someone has a gun, they have a right to have a gun. And if someone takes out the gun, and doesn't point it at you (and has no reason to), to be aware of what's going on, but not to assume you can shoot the guy. And if you're in a situation where "bad stuff seems about to happen" and someone points a gun, the presumption is NOT that he intends to kill, but typically the appropriate and intended response is for others to make clear (by raising their hands) that they do not intend to start a shooting war. And BTW, if someone raises a gun and does not start shooting (which this guy didn't from what I can see), the presumption to me is... he doesn't intend to start shooting, he intends to "freeze" a situation before it gets out of hand, or to prevent someone else who seems to be going out of control verbally from going out of control.
Now, I've always wondered if there is some universal assumptions in cases like these. There sure as hell oughta be.
But if the presumption is... anyone who raises a gun is gonna kill you... that has to apply to pigs too. So whatever the conclusion, let's be consistent. And for those who spend a lot of time with guns and lots of others around them with guns... what are the assumptions as best as you can state them? I'd sorta like to know, because I've always wondered about the edge cases.

It is past the time when we need to recognize that we have millions of people in this country who are illiterate, prone to criminality, and have been raised as wild animals.
