"Some Folks Were Lying?" Medicaid Chief Tavenner 'Steps Down' After Obamacare "Error"

Marilyn Tavenner, head of the U.S. Centers for Medicare and Medicaid Services, plans to step down at the end of February, she told her staff in an e-mail.

As Bloomberg reports, Tavenner didn’t say why she was leaving.

In November, she acknowledged that her agency had made a mistake in its calculation of the number of people enrolled under Obamacare.

 

As a reminder... from November

The Obama administration said it erroneously calculated the number of people with health coverage under the Affordable Care Act, incorrectly adding 380,000 dental subscribers to raise the total above 7 million.

 

The accurate number with full health-care plans is 6.7 million as of Oct. 15, a spokesman for the U.S. Department of Health and Human Services confirmed today, saying the U.S. won’t include dental plans in future reports.

 

“The mistake we made is unacceptable,” Health and Human Services Secretary Sylvia Mathews Burwell said on her verified Twitter account. “I will be communicating that clearly throughout the department.”

 

The error was brought to light by Republican investigators for the House Oversight and Government Reform Committee, using data they obtained from the U.S. Centers for Medicare and Medicaid Services.

“A mistake was made in calculating the number of individuals with effectuated Marketplace enrollments,” said Kevin Griffis, a spokesman for the U.S. Health and Human Services Department. “Individuals who had both Marketplace medical and dental coverage were erroneously counted in our recent announcements,” he said in an e-mail.

 

The new count puts enrollment short of a 2013 estimate by the Congressional Budget Office, adopted last year as a goal by the Obama administration, that 7 million people would be enrolled this year.

What is your premium, deductible, and coinsurance?  What were they 6 years ago?  Many, if not most, of the Obamacare plans actually in use today are $5,000 in-network deductibles, $10,000 out-of-network deductibles, and 30% coinsurnace.  Few specialists signed up for the Obamacare plans because of the low fees, so people are likely to have to pay both the $5,000 in-network deductibles, and $10,000 out-of-network deductibles every year before the insurance will begin to reimburse services.

In summary, 1) you are paying more before the insurance company begins to reimburse services, and 2) you are paying a higher percentage of the costs after the insurance company begins to reimburse services, and 3) you are required by law to purchase health insurance...therefore United Healthcare stock has increased more than 340%, and Humana stock has increased more than 440%!

Well, like I said back in October of 2013...

The following provision, in a nation of
deadbeats that cannot put their hands on $2,000 cash for an emergency,
when combined with $2,000 deductibles and 70/30 co-pays, is going to be
the mother-of-all-unintended-consequences.

Furthermore, health plans from the marketplace could present financial obstacles for physicians, because those health plans are required to have a 90-day grace period for policyholders that do not pay their monthly premiums on time.
While other health plans would cut off coverage if a patient did not
pay their bill on time, the health plans offered in the marketplace
would still indicate the patient was covered during that grace period,
and retroactively revoke payments to the physician for treatment
provided during that time. In those situations, the doctor would be forced to seek payment from the patient for services already provided.

The most important number to determine the viability of the ACA, that we will never learn, is how many Obamacare members made all of their premium payments.  From what I know, it is pathetically small, and thus the whole ACA is FUBAR. 

Save yourselves.  Run away from Obamacare as fast and as far as you are able, just like Tavenner is doing.

Once the IRS knows who you are, whatever project the government undertakes, in this case Obamacare, they will get the money they need from you. If you refuse to enroll in Obamacare and have no health plan the IRS police will get their penalty from your tax refund. You are an enemy of the State.

In short, the Obama/ Democrat/Republican “affordable health care” plan is designed to further cripple America’s hard working middle class because it is a wealth redistribution plan based on ”affordable.”

Don’t believe it?  Then who are the 6 million targeted for penalties?

If you are one of the 6 million or so subject to financial penalties, “the IRS will subtract the penalty amount out of any refund owed.” If you don't get a refund or the penalty is greater than your refund, and you don’t pay, “the IRS could take it out of any future tax refunds. If your taxes are withheld through your employer, the agency could also get the money through that route.”

Here’s the Leninesque caveat: “Several groups of people are exempted by law from paying the Obamcare penalties.

If the lowest-cost insurance plan is more than 8% of your income, for example, you won't be stuck with a fine if you don't obtain coverage. You can also apply for economic hardship exemptions…

“You're not subject to Obamacare penalties if you're a Native American or if you're not an American citizen. In prison? Don't worry …”

This information from The Motley Fool shows just how big the "affordable" discrepancy is: "The Congressional Budget Office estimates that of the 30 million Americans who likely won't have coverage in 2016, only 6 million or so will be subject to financial penalties.”

The two keys are, you can afford to pay and you refuse to pay.

Actually I find the deductibles totally OK, as that is in line with the idea of insurance.

Questionable because gameable by the insurance companies is which providers they select to be in-network.

Totally unacceptable is 30% co-insurance for all amounts over the deductible. Maybe the real costs for the provider are even less than those 30% of the billed amount?

I'm thinking of the rename/rebrand meme.

Obamacare changed to 'Muslim Outreach' should work just as well for that system as it has for NASA.

Since NASA is virtually dead, any slight confusion between the two should be easily overcome with a short advertising blitz.

I am also thought processing a more friendly name for 'derivatives' in general. Perhaps 'Long term care instruments', packaged for the truly needy.

Our mussy overlords will be appreciative of such a gesture of forethought before our subservience begins.

There are whole zip codes where 20%, 30%, even 40% or more of mortgages are delinquent in parts of New York & New Jersey.

These areas have highly inflated prices and dense populations.  We are talking about millions of mortgages that are not being serviced that have been and will be clogging up the forclosure pipline for years.  Who is going to buy these homes?  The people who just proved that they could not or would not pay?  Hedge funds?  Foreigners? 

But, to the point: who in their right mind conceived that these same people would be capable of or interested in paying for health insurance when they are either incapable of or williing to make payments on their mortage or pay the taxes that fund the social services and education system kthey constantly clamor must be maintained and enriched for their benefit?

Someone really needs to analyze the P&L's of the health insurance industry pre-ObamaCare and post.....then we'll know for sure just which special interst group got their payoff.....based on my own experience, I am now paying far more for far less, so someone else is getting my $$ and it is not my doctor.

WTF. Obammy Care is an ENTITLEMENT that falls under the umbrella of the SOCIAL SECURITY ACT. An act tied to State Police Powers (jesus fucking Crist read the damn thing UNEMPLOYMENT< OLD AGE SURVIVORS under POOR LAWS!!!) that requied State/federal cooperation under the federal COMPACT CLAUSE. The god damn federal government does NOT possessState police powers as those are reserved to the States via the TENTH AMENDMENT. However the fed does possess the POWER OF TAXATION. THE FEDS CAN tax the PRIVILEGES it creates. Hence Roberts was correct. The ACT is an operation of the federal taxing power. Obammy Care is the greatest federal TAX increase in history. So with that understanding there was NO miscalculation. The fact that the RATS are jumping ship is nothing more than sideshow entertainment.

 

Mission accomplished. Further, when the feds take over ALL healthcare, your judicially enforceable insurance CONTRACTS will be replaced by an ENTITLEMENT the terms of which can be modified or taken away at the will of the legislative body that created them. NO PROPERTY OR CONTRACT RIGHTS IN THE PUBLIC TREASURY and the courts do NOT deal with political questions. So when the ass clowns in charge decide that your LACK of revenue generating worth no longer justifies coverage, GO HOME AND DIE.

My plan was cancelled last year.  I tried the bronze plan with double the deductible AND premium.  After denied charges, I cancelled.  I purchased temporary insurance with my exemption.  I am joining a sharing ministry this year.  Obamacare is catastrophic insurance at cadillac prices.  Buyer beware!

King v. Burwell should invalidate the whole thing.

 If it were meant in the bill that states that did not create a state run exchange could get Federal tax credits (then paid by employers). then there would be no reason for a state to create an exchange. That is the crux of the Constitutional question put before SCOTUS. Individual state exchanges needed to be created to be compliant with the Commerce Clause--- since they created "INTERSTATE COMMERCE" that was to be regulated by the Federal Governemnt. Otherwise "health care" is well held to be regulated by the individual states.

Of course the IRS definition of "state run exchange" to include Federal exchanges in states that set up NO EXCHANGE is nonsense. (The IRS is already exposed as an arm of the Obama administration).

King has standing as an employer who must pay the tax credits in a state where no exchange was set up.

Roberts even said in the original validation of Obamacare mandate as a tax that the states setting up exchanges would or not would determine if the law was viable and Constitutional. As it is only 14 states set up the exchanges--- so in 37 states the Commerce Clause is being violated.

Game Over.

They should hear the case immediately, since so many people signing up will have their tax credits invalidated-- and thus will not be able to afford the shitty coverage they are getting. One big clusterfuck--- but it is meant that way, as the Marxists always create a crisis in order to "solve it".

They can now not afford the premium b/c we already know they can't afford to use the plan they are forced to pay for. Good luck in 2016 Dems. Nice bait and switch to convice the rubes that Health Insurance translate to Affordable Health Care.

Hopefully if King v. Burwell voids the subsidies, the Democratic Party will go the way of the Whigs by 2020.

Being that the Constitution reserves non-enumerated powers to the states and people, and the DC US does not have the enumerated power of mandating health insurance, Obamacare is Unconstitutional.

Being that the only exception to the twice stated prohibition on non-apportioned direct taxes is the 16th's exception for income, Obamacare is not a Constitutional tax.

Therefore it follows that Obamacare is null and void.

To enforce such an Unconstitutional law is to commit aggression against the people and/or the states. By definition, aggression against people's Life, Liberty, and/or Property is war.

The Constitution defines treason as levying war against them, the people, and/or the states.

Therefore those enforcing Obamacare are in violation of Article 3, Section 3 of the Constitution, and are criminals, as is the entire DC US.

The banksters need to repay us.

As for the apportionment clause argument would you consider the following. The "tax" on wages, ect aka the so called "income tax"is an indirect excise. Yes, your labor is your property and what is exchanged for that property is also "property". That is on one side of the argument. But to have STANDING to bring tjhose arguments depends on the context of the individuals circumstances. For those within the Social Security "system" those constititonal and judicial protections of Contract and property have been exchanged for what the courts of law and equity would classify as extraordinary protections paid for with money from the public trasury. The very basis of a "taxable privilege". The term EXCISE tax and PRIVILEGE tax are one in the same. Your voluntary (coerced) application into the system operates in law as a WAIVER. The privilege tax uses the wage, income, ect as a "unit of measurement" to calculate the indirect excise. So the income tax remains as an excise.

Now back to your apportionment argument. You want a judicial determination on the apportionment clause? Then look to the legal/legislative framework of the ACTS that authorised this abomination. The States when handing their police powers over to the feds (reference federal preemption laws/supremacy clause) were automatically preempted for purposes of taxation and administrative control. But yet, there the States sit. Corrupt as hell from the word go and the founders knew it. Thats why there inserted the CONTRACT CLAUSE in the federal constitution. But let me stay on point. The courts of law and equity in existing case law confirm that passage of the SS Act required state cooperation via police powers.

We live in a universe that runs on the rules of causality. Look to the effect of State action. Can the States accomplish indirectely what they are constitutionally PROHIBITED from doing directly? Can the States hand the feds the power to interfere with the obligation of contracts and at the same time give the feds the power to OVERIDE the apportionment clause? The courts say NO. Neither government has the ability to alter the scope of the powers of the other period. But they did. Why worry about apportioning a direct tax on labor "property" when now you can simply use the property as a unit of measurement to calculate the indirect excise? OOPS. Was this mere oversight? Unlikely

 

That is where the correct argument lies. And unless you have a world class legal team with deep pockets the argument would never reach the USSC. When peaceful redress becomes functionally impossible, violent redress will ensue.

And so it will be.

The courts do not back the Constitution, they back power, theft, treason, and tyranny. "We the People" must back the Constitution, we are the Constitution's force, and power. I, you, We, shall demand that the Constitution IS, and that they adhere to its tenets, or suffer us, "We the People."

This is re Medicare, not Obamacare, but it is a very scary look at the future, so here goes.  I had not realized how truly terrible the reimbursement rates are.  My dad had some very complex stenting done at Yale; it was not your run of the mill stenting.  On the bill where the surgeon billed Medicare $4K, Medicare actully paid the surgeon about $180.  On the bill where he billed Medicare $40k, Medicare actually paid the surgeon about $650.  Obviously the initial billings were excessive (although not as much so as I would have guessed, given the technology and infrastructure and training that is being supported), but the amount paid wouldn't cover the cost of providing the service; not a fraction of it.

No wonder it is impossible in CT to find a doctor who is taking new Medicare patients; they have to be losing money on every procedure.

My parents realized a few years ago that their local GP basically sees his Medicare patients as charity patients (given the reimbursements), but we had not realized that surgeons are in the same boat.
