What 4th Amendment? Police Across America Are Using Radars To See Inside People's Homes

Tyler Durden's picture

Submitted by Mike Krieger via Liberty Blitzkrieg blog,

The intentional erosion of public privacy is no accident. It’s not merely a simplistically stupid overreaction to the dangerous world we live in either. It is a very deliberate and nefarious plan being intentionally implemented by the American oligarchy; i.e., the super rich and the super powerful. This is precisely why the establishment freaked out about the Edward Snowden revelations, and it is why every single minor event is immediately manipulated into an excuse to give the government and intelligence agencies more power.

While we already know a lot about the NSA’s unconstitutional and fascist policies when it comes to the web, the decimation of the 4th Amendment is also being eagerly practiced at a more local level by police departments across the country. USA Today published a very important article on this topic earlier today. Here are some excerpts:

WASHINGTON — At least 50 U.S. law enforcement agencies have secretly equipped their officers with radar devices that allow them to effectively peer through the walls of houses to see whether anyone is inside, a practice raising new concerns about the extent of government surveillance.

Those agencies, including the FBI and the U.S. Marshals Service, began deploying the radar systems more than two years ago with little notice to the courts and no public disclosure of when or how they would be used. The technology raises legal and privacy issues because the U.S. Supreme Court has said officers generally cannot use high-tech sensors to tell them about the inside of a person’s house without first obtaining a search warrant.

Complete and total lawlessness.

Current and former federal officials say the information is critical for keeping officers safe if they need to storm buildings or rescue hostages. But privacy advocates and judges have nonetheless expressed concern about the circumstances in which law enforcement agencies may be using the radars — and the fact that they have so far done so without public scrutiny.

Should the primary concern of society be to keep police officers safe, when many officers have absolutely zero regard for the sanctity of life when it comes to the public? They signed up for a dangerous job, whereas these poor souls were just their innocent victims:

Video of the Day – Watch as 8 Police Officers Fire 46 Shots and Kill a Homeless Man in Broad Daylight

19-Month-Old Toddler in Critical Condition After Cops Throw Flash Bang Grenade into Playpen

Video of the Day – This Is What Happens When You Call the Cops

Now, back to the USA Today piece.

Agents’ use of the radars was largely unknown until December, when a federal appeals court in Denver said officers had used one before they entered a house to arrest a man wanted for violating his parole. The judges expressed alarm that agents had used the new technology without a search warrant, warning that “the government’s warrantless use of such a powerful tool to search inside homes poses grave Fourth Amendment questions.”

Other radar devices have far more advanced capabilities, including three-dimensional displays of where people are located inside a building, according to marketing materials from their manufacturers. One is capable of being mounted on a drone. And the Justice Department has funded research to develop systems that can map the interiors of buildings and locate the people within them.

The radars were first designed for use in Iraq and Afghanistan. They represent the latest example of battlefield technology finding its way home to civilian policing and bringing complex legal questions with it.

More evidence that the “war on terror” is coming home, and the targets will be average citizens engaged in non-crimes.

Those concerns are especially thorny when it comes to technology that lets the police determine what’s happening inside someone’s home. The Supreme Court ruled in 2001 that the Constitution generally bars police from scanning the outside of a house with a thermal camera unless they have a warrant, and specifically noted that the rule would apply to radar-based systems that were then being developed.

Still, the radars appear to have drawn little scrutiny from state or federal courts. The federal appeals court’s decision published last month was apparently the first by an appellate court to reference the technology or its implications.

But yeah, USA! USA!

Amendment IV
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

In legal terms the United States is currently in a State of War, thus constitutional rights are suspended if the Sovereign deems necessary (under these extraordinary circumstances, actions carried out by the Executive branch cannot be overseen by Congress or the Judiciary). Additionally, ordinary Americans are utterly ignorant about their own legal system and most of them don't even know the contents of the Constitution.

Consequently, Mike Krieger's post is pure bullshit, period.

the government’s warrantless use of such a powerful tool to search inside homes poses grave Fourth Amendment questions.

The supreme court has upheld the "I didn't know it wasn't legal," from the police already.  This should really come as no surprise.  As far as I know, they still have stingrays.

Yes indeed, ignorance of "the law" is no excuse citizen! Unless you work for the state, of course...lol.

I love the way its phrased:

"The new technology raises legal and privacy issues because the U.S. Supreme Court has said officers generally cannot use high-tech sensors to tell them about the inside of a person’s house without first obtaining a search warrant."

"The Supreme Court ruled in 2001 that the Constitution generally bars police from scanning the outside of a house with a thermal camera unless they have a warrant, and specifically noted that the rule would apply to radar-based systems that were then being developed."

Just one word inserted, generally, provides the state a loophole large enough to drive an M1 Abrams tank through.

The Bill of Rights specifically states:

"The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."

I failed to find the word "generally" anywhere in the text and they need a warrant to use it lawfully.

Period.

Yes sir you are correct. Yesterday on National Propaganda Radio, they reported  on how the French government, as a result of the Paris charade, is now going to hire 'thousands' of new security personnel, form a new agency to protect French citizens, and of course be more diligent in monitoring communincations of the French people.

Hmm.

Let me see here. The formula seems to be:

1. Stage false flag attack.

2. Continuously change the story until a totally preposterous set of 'facts' is used to back up said story.

3. Use the media to bombard with population with fear inducing stories.

4. Use the manufactured crisis and the sheoples' fear to expand goverment reach and control.

5.  Explain to citizens how this is for their own good and how giving up their liberties will keep them safe.

6.  Hire large numbers of new government workers, expand government, and destroy liberty, while telling us that it's the 'terrorists that hate us for our freedom' .

Terrorism only works if it terrifies  you.

I remain un-terrified and ready to defend hearth and home.

The reason for this is so that according to a textbook raid it is to invade your home at the most opportune time. 1). When you least expect a forced entry, and 2). When you are most vulnerable (the latter would be preferably during a time when you are completely compromised, naked, and most vulnerable).

No-knock, means you'll first reach for your socks instead of your Glocks.

We're gonna need a bigger tinfoil hat.

Radar is just a EM wave, and is defeated accordingly.

Line the outside walls with conductive foil or mesh, and ground it to earth. You now have a Faraday Cage, that is totally impenetrable to radar. And all radio waves, coming in or going out.

But beware of your landline, which is a tunnel in and out.

im not sure the type of metal used matters, but the field has to have a certain impedence, it has to match the frequency of the waves you are trying to intercept. if you remember the old cb radios the antenna had to be cut to the length that reduced the SWR, or standing wave ratio to its lowest possibel level. now i am with you on this, to protect ourselves from these RF waves we must build an antenna which most closely matches most of the frequencies and then sends that signal to ground, like the old lightening rod. that antenna has to cover the field not merely the user, so its complicated, what you need is an antenna field. i am sure it can be done. and oncve you can prove that anyone beneath the shielf is getting zero rf you can sell these things like crazy.

Need a multiband radar jammer.

There's always a way to counter technology. Sometimes it's rather simple like aluminum/steel siding.

Walt Whitman lived at a time before the USA was a nation-state of the NWO and before the politicians were all contractors.

He did not live during a peaceful time as I have. For some reason I don't feel lucky.

I'm baffled on this NWO you speak of.

World Orders have been way before Walt Whitman. Occassionally they get reset and the players change but there have always been elitists and the slave population.

Just because it has been mentioned bluntly by Bush one doesn't mean there wasn't a NWO way before then.

NWO is simply the powers that be fighting over wealth and turf and using us as cannon fodder to achieve it. That's been going on for centuries.

Terahertz radar, same as TSA was going to use, or are they using it?

http://www.technologyreview.com/view/416066/how-terahertz-waves-tear-apart-dna/

Oops.  Don't terahertz me bro, you wouldn't like me when I'm terahertzed.

Thu, 01/22/2015 - 07:19 | 5691523 css1971

You don't even need terahertz radar. You can do it with timed pulses of light.

If you know when a particular pulse was sent and when the reflection came back, you can use it to calculate how the light bounced within a structure. Basically real time ray tracing.

This is still at the research phase at the moment but with enough computing power, a pulsed light source and a camera you can build a real time 3D model of a structure and everything within.

Been a happening for years.  The police or whoever can sit across the street and intercept every keystroke you type on your key board.  Lasers can be emplyed to listen in on conversations your having in your home as the windows vibrate and the laser detects these vibrations.  We worry about this technology and yet this has been going on since mid to lat 80's.

If your computer is not in a faraday cage it is not secure also known as tempest approved systems the government and other entities use to secure their computer systems from emitting signals.

FLIR can do the same thing using thermo imaging if it is sensitive enough.

I am pissed but not alot you can do about it and it will get worse.  I have enough shit to worry about being a working stiff.

"as they sit across the street"

Up here in the woods there is no "across the street". It's a hundred yard winding driveway to my house. No way radar is going to spy on me. My dog will set your ass to running if you get too close. Set yourself free, get out of town.

In addition to the use of these being among the worst violations of privacy...

I guess it wouldn't hurt to ask what that depth of scanning in those devices does to the living organism?!!!

But hey?.... After Fukushima and everything else we have done with the use of banned ordnance depleted uranium, white phosphorous and cluster munitions in Iraq, Afghanistan, Libya, Syria and Ukraine our health is pretty much of an afterthought anyway!
