IRS 'Kinda Sorta' Apologizes For Seizing Small Business Accounts Without Warrants

Twenty-seven years ago at the 1988 Republican National Convention in New Orleans, George H. W. Bush accepted his party’s nomination to run for President of the United States.

(This was when he announced Dan Quayle as his running mate, to which Senator John McCain later remarked “I can’t believe a guy that handsome wouldn’t have some impact.”)

In his acceptance speech, the elder Bush famously told America that he wanted a “kinder, gentler nation.”

It took nearly three decades, but it seems that his wish has finally come true. Sort of.

Last week, the Commissioner of the Internal Revenue Service appeared in front of the House Way and Means Oversight Subcommittee… and apologized to taxpayers, specifically those who have had their assets seized and bank accounts wrongfully frozen.

He actually used that word.

“To anyone who is not treated fairly under the [tax] code, I apologize.”

This is pretty astounding.

You see, in the Land of the Free, the Internal Revenue Service, along with hundreds of other state and federal agencies, have the power to seize your assets and freeze your bank accounts, almost instantly in many cases.

You don’t need to be convicted of a crime. You don’t even need to be doing anything illegal.

If you (or your assets) are simply at the wrong place at the wrong time… or if someone so much as suspects that maybe, just maybe, you might be doing something wrong, your assets can be frozen.

Bear in mind, this isn’t anything that goes to court. No one puts you on trial or gives you the opportunity to defend yourself.

It’s a purely administrative action. They just go and do it. And they’re not shy about using their authority.

One case highlighted in front of the subcommittee was of Mr. Andrew Clyde, a gun-shop owner in Athens, Georgia.

Mr. Clyde’s is an obvious criminal terrorist whose heinous, immoral act against society was making a series of deposits into his bank that were all less than $10,000.

His bank viewed this as potentially suspicious activity; US law requires banks to report deposits of more than $10,000. But if they see customers routinely depositing amounts less than that, they assume that customers are doing this deliberately to avoid reporting requirements.

This assumption alone can cause many banks to snitch on their customers, tipping off the IRS that something ‘suspicious’ is happening.

This is all the IRS needs to seize people’s assets. And, once frozen, citizens must go through lengthy and expensive battles to get back their money.

In many cases, it’s not even worth the fight. There’s no guarantee of success. And even if someone gets robbed of $100,000 or more, it might not be worth spending 2-3 years away from running his/her business to get the money back.

The cost of doing so would be greater than the reward of recouping the lost cash.

But here’s the even bigger irony: the IRS believes that if people don’t step forward and fight them, then it is a de facto admission of guilt.

In other words, only criminals don’t fight to get their money back. Only the guilty make a rational cost/benefit analysis in determining whether they should indefinitely neglect their businesses and wage an expensive and uncertain legal battle against the most intimidating organization in US history.

So despite the rather hollow apology from the IRS, it’s clear these guys still need a reality check.

One key lesson to highlight here:

If you hold savings at a bank in the United States, you need to understand that your bank is an unpaid spy of the federal government. They WILL report you for anything you do that they view as potentially suspicious.

Moreover, they are required by law to file a certain number of ‘Suspicious Activity Reports’ each year. So even if you’re not doing anything suspicious, if you simply stand out a bit more than the next guy, you’re going to get reported.

Oh yeah, they won’t tell you about it either.

Bottom line, even if you’ve never broken the law, you could potentially be frozen out of your savings. No one ever believes it will happen to them… until it does.

So make sure you have at least some form of savings somewhere else. Establish a foreign bank account. Hold some gold at a private, non-bank facility. Or even build up a small stash of cash savings.

This way, should the worst happen, you’ll at least have access to some emergency savings to tide you over.

This post has been up for about 4 hours as of this moment and we have nearly a page and a half of comments.  Not much mention of any practical course of action to throttle or KILL the IRS.

Commentors on ZH don't actually DO anything in the real world.  At least they don't think along lines that would lead to ACTION; action that would change anything in their lives.

There is a bill (HR-25) in the House of Representatives (currently before Ways and Means) commonly known as the FairTax bill, that would end the IRS forever!  But nobody ever talks about it (except me).  Maybe someone carps about how the the system would never let anything happen to their paymaster or some other bullshit excuse to do nothing, see nothing, hear nothing.

....now, wait for it... wait for it... some gov troll/IRS employee (like the "9th Doctor") will come along with a smart-ass remark fresh outta their half-bakery, and that'll be the end of it.

Society gets what it deserves.  It really does!

If you get a notice of seizure (or in your case, deficiency, since I guess you don't keep your savings in a bank where the IRS can simply sieze them without due process) and they use banking records or snooping by whatever means to locate your PM's, you are going to confront them with an AK-47 when they come knocking?  Are you really going to do that?  Are you suggesting others should do the same?

I don't think you are.  I don't think that kind of advice is valuable to anyone.  Individuals will always be outgunned, and ultimately the same is true for groups of individluals.

And any armed conflict with the IRS is nutty anyway - as sick and nutty as the Internal Revenue code itself since THE IRS EXISTS AND DOES WHAT IT DOES BECAUSE YOU ALLOW IT TO!!!

Where do people get the idea that the IRS is a big bad oppressive government made system that's being forced down their throats???  You allow it!!!  You allow it by not understanding why and how it is that the vast majority of people in this country just go along.

You allow it by not trying to understand the psychology behind people who either look like deer in headlights or have an aneurysm when conversaiton turns to the IRS.  People who just mutter something like "well, ya gotta pay your taxes" and change the subject.

You allow it by not fully understanding the issues that underpin the 4th Amendment as they apply to everyday life.  You allow it by failing to understand just how SICK the Internal Revenue code is:  how it sickens people, corrupts their ability to think clearly, makes them do things that are absolutely insane from an economic standpoint and especially how it discourages participation in business that would create jobs and undercut bureaucratic meddling in economic activity.

I've watched one movement after another to eliminate the IRS come and go over decades because there was nothing to replace it with.  There was never any realistic replacement to rally around.  The FairTax is the first practical rallying point that has now become proposed legislation (HR25).  And, NO ONE WANTS TO TALK ABOUT IT! ...of all places, on ZeroHedge!  Of course, some of you commenting on ZH would have to put your bunny slippers back on and return the beer to the refir in mom's basement, and sober up a little so you could learn about something new: The FairTax.  The legislation, the current talking points, the implications it would have if you actually had a job or ran a business.  You'd have to think about how it applies to your own life.  You would especially want to understand how it will restore the 4th Amendment and help to change other laws that are nearly as bad as the hated Internal Revenue code..

If a large number of like minded people were to involve themselves in this and create a broad concensus in the population, the FairTax legislation would pass and the IRS would pass out of existence.  It would be a new day economically.

If the government were to use a heavy hand to block something that had widespread grassroots support... that is, block the passage or implementation of something like the FairTax legislation, and the will of the people were denied, maybe I'd think about setting up a small arsenal of weapons myself.

But for now, the militia's, tax protestor's, the Joe Stack's (guy who flew his plane into an IRS building) serve no useful purpose.  The IRS loves em!!  They know it will come to nothing, and they will go on doing what they are doing  for ever and ever.

The FairTax?  Now that puts the fear of God in those bastards.

My friend, I sympathize with your feelings, and with most other commenters (the ones who aren't trolls, IRS employees or welfare bums).  But, if you want to live free in country that is not a police state... you need to bring enlightenment and the FairTax legislation to the wider society... which might actually start voting if there were something or someone representing something worth voting for.

Yes, I am suggesting others do the same, because when the fiat system crumbles, government will become extremely forcible as they attempt to salvage the situation.  

And you can waste all your time and energy trying to change the system with your vote, and your legislation, but thats not how the system works.  

There are people in government, and there are people who are not in government. 

You are not in government.   You are getting sheared like the rest of the private citizens, and NOTHING YOU DO WILL CAUSE THE SYSTEM TO CHANGE before the system collapses on itself.   I hope for your sake you hide as much of your wealth as possible, and are armed to the teeth.

Funny thing is that all of this theft, and related cases, are public information, and as such my CAAPL keeps getting longer and longer.

I wonder if those involved have ever considered a) what they are doing is treason, as outlined in the "Law of the Land," the Constitution (A3,S3), that they took and oath to uphold, b) that some of us are making lists of the treasonous, and their crimes, and c) that the Internet does not forget?

In addition to the Four Rs, the American people should be compiling a list, call it the Crimes Against the American People List (CAAPL)?? A list of known pol, crat, functionaries (funcs), and bankster criminals that they are aware of.

Oath violating and treasonous gun and badge thugs, corrupt pols and crats, thieving banksters, etc. should be placed on it. At a minimum, their names, crimes, and positions, should be kept for future reference for accountability, trial, and punishment.

When the DC US finally collapses, these lists can then be used to root out the known criminals that will think that they can hide among their victims--no "Truth and Reconciliation," and no quarter.

The biggest issue with all of this is in the fight to get it back.

Deposit 7-9k 4x each week, suspicious (Must be trying to evade the 10k rule)

Deposit 32k once a week or 16k twice a week - suspicious (Where are you getting that much cash??? - Must be drugs/illegal activity)

Not to mention, if you get robbed, the police will say "Why did you keep that much cash--> why did you not put it in the bank daily??"

Your account is seized.

You hire 1 laywer, the govt has 10+ on the case on the taxpayers dime.

You have 5-10k budget, they have 100k++

No one is going to spend 50k to get 25k back - that is just stupid.  Yet the govt sees that as you being "guilty" - afterall - they would easily spend $1m if needed in prosecution of the 25k in order to "keep" it.

Plus they do not take into account that if they seize 200k, that might be the only funds someone has - there is no funds to fight it because the govt has seized them all.  That does not make them guilty, that makes them a victim with no recourse.

The govt  has almost unlimited resources and answer to no one.  If they spend 500k to put a guy in jail for 2 months for tax evasion that is a victory for them.

I understand the need to have some checks and balances to detect illegal behavior.  The "guilty unless you can prove you are not" just does not cut it.

This just goes to show  that Americans need to hide what they are  doing - not because its illegal but because they do not want to get caught up in this bullshit.  And, in hiding - you are even more "guilty" than before.
