Obama Decrees Ban On Ammo For The Most Popular Rifle In America

Because he can’t get Congress to approve the things that he wants to do, Barack Obama has apparently decided to rule by decree for the rest of his time in the White House.  One of Obama’s latest moves is to try to ban some of the most popular ammunition for the most popular rifle in America.  Previously, the Obama administration attempted unsuccessfully to ban the AR-15.  That didn’t work, so now Obama is going after the ammunition.  This is yet another example of the war on preppers that is going on all over the nation.  Whether you are a gun owner or not, this assault on our constitutional rights should disturb you greatly.  Barack Obama has promised to try to squeeze as much “change” as possible out of his last two years, and in the process he is “fundamentally transforming” America.  But what will our country look like when he is done?

At the top of the Drudge Report today, there was a story from the Washington Examiner detailing this ammo ban…

As promised, President Obama is using executive actions to impose gun control on the nation, targeting the top-selling rifle in the country, the AR-15 style semi-automatic, with a ban on one of the most-used AR bullets by sportsmen and target shooters.

 

The Bureau of Alcohol, Tobacco, Firearms and Explosives this month revealed that it is proposing to put the ban on 5.56mm ammo on a fast track, immediately driving up the price of the bullets and prompting retailers, including the huge outdoors company Cabela’s, to urge sportsmen to urge Congress to stop the president.

As NRA has been reporting since the night the news broke, the Bureau of Alcohol, Tobacco, Firearms and Explosives (BATFE) is moving to infringe upon the rights of law-abiding gun owners with a drastic reinterpretation of a nearly 30-year-old law regulating so-called “armor piercing” ammunition. So draconian is BATFE’s new “Framework” that it would prohibit the manufacturing, importation, and sale of M855 ball ammunition, one of the most popular cartridges for the most popular rifle in America, the AR-15. Not coincidentally, the AR-15 is among the firearms the Obama Administration has unsuccessfully sought to outlaw. If they can’t ban the pie, so the thinking apparently goes, they might at least get the apples.

 

In an effort to thwart BATFE’s attempted action, NRA has worked with U.S. Representative Bob Goodlatte (R-Va.), Chairman of the House Judiciary Committee, to draft a letter to BATFE expressing the lawmakers’ opposition to the proposed Framework. According to the letter, “The idea that Congress intended [the ‘armor piercing’ ammunition law] to ban one of the preeminent rifle cartridges in use by Americans for legitimate purposes is preposterous.” It goes on to state that the law “should be construed in accordance with the American tradition of lawful firearms ownership, as protected by the Second Amendment.” This includes due consideration of “the many legitimate uses Americans make of their firearms including target practice, hunting, organized and casual competition, training and skills development, and instructional activities.“ The letter concludes with several pointed questions for B. Todd Jones, BATFE’s director, including why the agency bypassed the Administrative Procedures Act in proposing such a radical change to its prior interpretation and enforcement of the law.

The crazy thing about all of this is the fact that this ammunition has never met the legal definition of being “armor piercing”.  So what the Obama administration is attempting to do is outside the law.

A recent Infowars article broke this down…

The ATF is trying to ban M855 AR-15 ammunition by declaring it “armor piercing,” despite the ammo containing lead which exempts it from the classification according to law.

 

To be considered “armor piercing” under 18 U.S.C. 921 (a)(17)(B), a bullet must have an entirely metal core or have a jacket weighting more than 25% of its weight, which wouldn’t include M855 rounds because their bullets are partly lead.

 

The definition in full:

 

(17)

(A) The term “ammunition” means ammunition or cartridge cases, primers, bullets, or propellent powder designed for use in any firearm.

 

(B) The term “armor piercing ammunition” means- (i) a projectile or projectile core which may be used in a handgun and which is constructed entirely (excluding the presence of traces of other substances) from one or a combination of tungsten alloys, steel, iron, brass, bronze, beryllium copper, or depleted uranium; or (ii) a full jacketed projectile larger than .22 caliber designed and intended for use in a handgun and whose jacket has a weight of more than 25 percent of the total weight of the projectile.

 

(C) The term “armor piercing ammunition” does not include shotgun shot required by Federal or State environmental or game regulations for hunting purposes, a frangible projectile designed for target shooting, a projectile which the Attorney General finds is primarily intended to be used for sporting purposes, or any other projectile or projectile core which the Attorney General finds is intended to be used for industrial purposes, including a charge used in an oil and gas well perforating device.

Needless to say, this ban is creating quite a bit of panic among gun owners.

Many gun owners are stocking up on this ammo while they still can

Word of ATF’s proposal sparked a run on ammo at some Springfield gun stores, and steep price spikes for steel-tipped military surplus ammo at some online ammo dealers. Rounds that sold for 25 to 30 cents apiece tripled at some some stores after BATF posted its proposal on its web site.

 

“We sold out of what we had in stock,” said Ryan Cook, manager of Eagle Armory in Springfield. “We didn’t have a lot in the store but I might have sold four or five cases after ATF’s statement came out. I called our suppliers but they said there was none available to order. It’s like the ammo shortage before. People are going to panic.”

Like I said earlier, even if you are not a gun owner you have got to be extremely concerned about this erosion of our constitutional rights.

We have a man occupying the White House that seems absolutely determined to stretch the limits of presidential power as far as they can possibly go.

And at this point he has become so arrogant that he doesn’t even care if Congress believes that what he is doing is legal.  Just consider what he said during one recent speech

Pres. Obama is daring Republicans to vote on whether or not his executive actions are legal.

 

Discussing opposition to his executive amnesty orders at an immigration town hall Wednesday, Obama said he would veto the vote because his actions are “the right thing to do”:

 

So in the short term, if Mr. McConnell, the leader of the Senate, and the Speaker of the House, John Boehner, want to have a vote on whether what I’m doing is legal or not, they can have that vote. I will veto that vote, because I’m absolutely confident that what we’re doing is the right thing to do.

This is how republics die.  When one man starts grabbing more and more power and nobody stops him, eventually a dictatorship is born.

This is not what our founding fathers intended.  If they could see us today, they would be rolling over in their graves.

And a lot of Americans are getting fed up.

In fact, according to one recent survey only 47 percent of Americans still believe that Obama loves this country…

While the creepy #ILOVEOBAMA continues to trend on Twitter, fewer than half of American adults, 47 percent, say they believe that the president loves his country.

 

According to a survey conducted by Huffington Post/YouGov and released this week, a whopping 35 percent of Americans, more than one in three, believe that Obama doesn’t love the United States, while 17 percent said they weren’t sure.

 

The poll was conducted in the wake of former New York City Mayor Rudy Giuliani telling a gathering in Manhattan that “I do not believe, and I know this is a horrible thing to say, but I do not believe that the president loves America.”

Personally, I think Dear Leader and the progressives are trying to trigger civil war, so they can clamp down and really bring about the promised "Change."

The m855 has always been designated as AP contrary to what the article says.  It was exempt because there were no pistols that chambered the .223.  The ban on armor piercing rounds for pistols was enacted years ago (not sure when exactly).  The change has not been because of a change in the law or enforcement by ATF.  The change has come about because manufacturers are making pistols that shoot the .223 round.  The m855 was previously granted an exemption to the ban because it could not be used in pistols.  The ATF is considering not granting the exemption in the future.  This article as well as others I have read are false or misleading and I suspect it is to support a rapid increase in ammo sales.

It may have been designated as AP ammo, but that doesn't mean it is actually capable of piercing meaningful thicknesses of plate armor. It is a pretty shitty penetrator and isn't much better than M193 at penetrating anything. So why are they bothering to try to ban it?

My guess is, there is a metric crap-ton of M855 stockpiled since the Iraq war ended. And, there is a huge manufacturing infrastructure built up to produce M855. All Obama is doing is making it more difficult/more expensive for civilians to get their hands on 5.56 ammo by forcing civilians to buy M193, of which there is less available.

Deeming things (ammo, gold, alcohol, etc.) illegal simply moves the sales underground. History has taught us this - remember prohibition. Just ask India how that gold import ban worked out for them. Drugs (you know the ones) have been illegal for decades, and yet they are as easy to get as a pizza. Don't get me wrong, what is happening in this country is tragic - we no longer have a nation ruled by law - we have a dictatorship - it's an insult and a betrayal to every American that has fought (many have died) for this country. But that being said, this government is as incompetent as it is corrupt - they cannot prevent Americans from getting what they want.

1000 feet?  Surely you meant 1000 yards, with a .30-06?

Still, I feel that we will need 5 to 7 man teams, with a couple of snipers, and the rest getting up close and personal.

My 7.62 x 51mm (.308 but chambered for NATO rounds and pressures), Armalite AR-10

should do the trick.  Hopefully you're aware of bullet drop at 750 to 1000 yards, based on BC

and gravity...otherwise, you'll be missing, a lot.

Radical Leftists and Libertarians have a lot in common.  I have no fucking clue what the word "progressive" means, but if it describes "progress" toward whatever the generation of selfie-taking social media obsessed, tech bubble overvaluation, democrat party mafioso, suppress revolution with free phones and EBT we can't pay, while upholding some sort of vacuuous mythological American morality by opening up the borders - then you're right - progressives and libertarians have nothing in common.

I'm not defending this move in the least, as I believe all people have the natural right to arm themselves as they see for with no interference whatsoever from the govt, but all this is for is M855. The other big mil surplus, M193 ball isn't affected, not are the numerous other. 5.56/.223 loads out there. 193 isn't and more expensive than 855. This is just goading the gullible to go out and clear the shelves of all ammo yet again.

If I'm not mistaken M855 is also not as effective as the M193. Lots of complaints during the Black Hawk down battle that the M855 would just make and nice little .22 hole and not cause much damage. Best to go with a .308, really make some noise, and cause some serious damage.

SCOTUS has ruled against this sort of redefining Congressionally given mandates with the EPA green house gas ruling in Mass V EPA. FCC redefining Title II to include net neutrality falls under this precedent as well.

Almost all ammo will be banned based on this new standard. What isn't banned here will be addressed with new EPA guidelines regarding the toxic properties of lead......

SOFT Body Armor vests only offer pistol, Fragmentation, and shotgun protection (birdshot and buckshot, but NOT shotgun slugs). Even doubling up TWO Level III-A soft vests would NOT stop a rifle bullet!

TPTB think Obama is the one they are gonna off when the time is right to install the real dictatorship.  He's doing a great job of carrying the ball down the field for them so expect a real hardcore tackle at the one yard line.

Industry assurances aside, I'm not convinces the rolling shortages of 22LR, powder, primers and bullets isn't actually due to toe Feds exterting some unseen influence.

Remember, Operation Chokepoint was virtually secret until a few gun shops and payday lenders all squawked about their account closures at roughly the same time and put 2+2 together, and it took nearly two years for there to be actual action. All of the major ammunition and component suppliers have federal contracts and have to deal with the ATFE, which has a less than stellar record of legal compliance itself. With some coordinated targeting of contract orders and leaning on certain suppliers to make things unavailable to specific manufacturers over a particular time frame, you could greatly reduce civilian ammo availablitity without a formal ban -- which is exactly what's happened with 22LR.

I would be fascinated to see what would happen if a new ammunition manufacturer went into business that specifically refused government contracts. I'd bet more than even money they'd be "regulated" so hard they'd never successfully ship more than a handful of product.

A marine friend of men told me they were no longer allowed to save cartridges for reloads anymore. Instead they were being collected and sold as scrap metal. A very disturbing fact that has concerned me. Will this go further? I have a good friend that reloads and was willing to teach me. I may be too late.

Look how Missouri dealt with ammo in their constitution:

I too, am so bummed. I lost, not only my gold and ammo in an unfortunate boating accident, but all of my guns as well.

But, there is a bright side to all this:

israel has some of the toughest restrictions on guns and ammunition on the planet, especially when it comes to these items being owned by Palestinians, and yet, "interested parties" seem to be able to obtain these items easily.

Ukraine has (had?) very restrictive gun regulation, as does Russia, but it seems Ukranian seperatists have no trouble getting guns, of ANY caliber.

Syria... the Assad regime had some of the most restrictive gun laws on the planet, yet the rebels seem to have had no trouble at all acquring guns.

The list goes on.

Given the above, I am not worried. Even though I am currently weaponless, because of the boating accident, I am fairly confident that when I need  guns and ammunition, I can get them.

Surely, someone out there has recognized the business opportunity in this Executive Order, and is working like a one armed paper hanger reloading .223 brass.

The right to bear arms is God-given, and cannot be taken away a mere man. This is the only explanation to the ease at which guns can be obtained in all gun-restrictive countries.

My trusty SKS, which although lost to me in the deep, will accomodate any round approximating .308.  (read this first before you do something stupid) The most common firearm in the world doesn't seem to be on Obama's radar. Huh...

apparently, you load your own.... so do I.  I haven't shot anything I haven't loaded myself in years.... well... except for .22 ammo.  For pistols.... you can load 1000 in a couple of hours on a progressive press....  For rifles... you make a round so accurate that no other gun could chamber the round you made for your rifle.... it's within .002 for headspace for the shoulder.... and, for the bullet I shoot... the bullet likes to be jammed about.004....  That is so far out of sammi specs.... however I can shoot the little 2.5" skeet at 500 yards with it all day..... pop your grape at 1000yds.... you can't do that without a custom rifle and hand loads... they're not RELOADS... they're hand loads.

This M855 ban was just an easy "administrative action" to test the waters. The EPA will get involved next to outlaw ammunition containing lead - again, an easy "administrative action." Unfortunately, I just don't see the Republicans - the putative opposition party - doing anything to stop it.

Buy ammunition, and buy reloading components if your are a reloader. Buy lots of it. It will do nothing but go up in value.

The EPA got slapped by the Supremes when they reinterpreted their mandate and tried to not regulate green house gas emissions despite that regulation falling within the Clear Air Act mandate. BATFE is doing the same thing that SCOTUS has already smacked down which is to reinterpret their congressionally mandated sphere of influence. Coincidentally, this is also the same action as the FCC is trying to take with Net "Neutrality".

With all the guns and ammo one might think we might indeed be champions of liberty and beacons of freedom, but I see no relation. Most corrupt and violent government on the planet. Guns don't do shit when all they're good at is helping low lives rob liquor stores.

The last time I remember anyone pointing a gun at a politician was Jared Lee Loughner shooting Gabrielle Giffords in the head point blank and leaving her nearly braindead, which I'm not too sure she wasn't to begin with, considering her pro-bailout and pro-war voting record.

The gunner branded insane, because no sane person, supposedly, ever wants to shoot a politician.

There are plenty of alternatives to the 855 ammo. Its fucked what he is doing but is not an immediate threat to 223 ammo except for market over reaction. Of course I have mine already, so I will wait it out and not contribute to the panic. Prices have fell so much from their highs, if you don't already have it you just haven't been paying attention.
