The Untouchables: Government Employee Can't Be Fired Despite Watching 6 Hours Of Porn A Day At Work

Even though investigators found 7,000 pornographic files on his computer and even caught him watching porn, he remains on the payroll.

 

Five years ago, the General Services Administration (GSA) spent more than $800,000 on a lavish conference in Las Vegas. They were served 1,000 sushi rolls costing $7 each and a clown and mind reader were hired for entertainment. Two managers were initially fired but got their jobs back after the MSPB reversed the decision.

 

The GSA was ordered to “cancel the appellants removals” and give them back pay plus interest. Meanwhile, the organizer of the convention was never technically fired. He was allowed to retire.

It was just brought to my attention that prosecutors in the General David Petraeus case are suggesting two years probation and a $40,000 fine, rather than the one-year prison sentence his misdemeanor charge carries. If it were you or I, and the government didn’t like our political activities, the feds would undoubtably try to put us in a cage for as long as possible. Must be nice to be an oligarch. After all, insiders don’t jail other insiders. This is not a free country.

It’s not just Petraeus and other oligarchs either. Status quo minions often also receive special treatment for their tireless service to the plutocracy. You know, such as watching six hours per day of porn on the job.

We learn from CBS News that:

In the private sector, if you’re caught viewing porn on company time or intimidating a co-worker, you’d probably be fired immediately; not so if you’re a federal employee.

 

A CBS News investigation looks at how hard it is for the U.S. government to discipline or fire employees who behave badly. With examples ranging from extravagant to explicit, civil service rules meant to protect public workers from political pressure may be backfiring, and costing you big, reports CBS News correspondent Don Dahler.

 

At the Environmental Protection Agency (EPA), red tape is preventing the removal of a top level employee accused of viewing porn two to six hours a day while at work, since 2010. Even though investigators found 7,000 pornographic files on his computer and even caught him watching porn, he remains on the payroll.

 

At a Congressional hearing, EPA administrator Gina McCarthy was asked why she hadn’t fired the employee and said, “I actually have to work through the administrative process, as you know.”

 

He said those rules make it nearly impossible to fire poor performers or problematic employees, even when they’ve committed egregious violations. 

A CBS News analysis of cases under review by the Merit System Protection Board (MSPB), an appeals board for federal workers, found other instances of employees who had committed seemingly fireable offenses who were later reinstated to their jobs, often with back pay and interest.

Taking into consider administrative leave and the general costs of the procedure itself, Stier said, “There is no question that taxpayers are losing hundreds of millions of dollars, in a conservative estimate. They are losing more than that because they are losing the ability to get the very best out of government.”

I admit it was damn hard to fire a gov't worker even before Obozo - I personnaly know of many hard to fire piss-poor white gov't workers.

But now AFTER Obozo... it's virtually impossible to fire a "person of color" gov't worker.

I would welcome any folks who have worked in gov't facilities (as I did for over 20 years as a contractor) to add to and expound upon this. Let us hear from you...

Agreed. Central banks wouldn't exist without govt. These oligarchs steal from us via legalized theft courtesy of govt. Tax code, enforced by govt guns , written by oligarchs for themselves. I agree with you on plenty of things, LTER, but this isn't one of them. This is government in action. You say you want government , there you go. What you are witnessing IS government. All of them. Since getting rid of it all together isn't real likely, the focus should be taking as much power away from them as possible, not giving them more control over anything. The more government you have, the more oligarchs there will be.

Governments are just one way of concentrating power. The other is through the private ownership of the means of production – and in todays financialized world another concentration of power is through the direct and indirect private ownership of the monetary system. Yes, the fascist governments (and political structures – the links between corporate entities and ‘governments’) of the Western world is a threat to humanity (our freedom, but in reality also the future of the human race – there’s a real possibility these ignoramus can destroy the eco-system and/or blow us all up in a nuclear holocaust). But the power would still be concentrated in too few (and incompetent) hands if the governments suddenly went away.

Well, my point is: it’s the concentration of power we should fight. Private or public. Right now the public sector is a servant of the private sector – we all know who owns the political parties of US (two parties with the same masters).

Let’s focus on the oligarchs – the fascists – and let’s not be distracted by all these petty stories about individuals in the lower stratus of the pyramid. Look up!

One more point on this issue: there’s an obvious interest from the private owners of the US (EU) states (the bankers – 0,01 %) to discredit all other powers than private power. If it was possible (and if there was a will) to conduct investigative journalism into how private companies worked there would be plenty of skeletons here as well – some scandals do make to the headlines (the amount of drugs taken in Wall St., the prostitution industry surrounding all nests of bankers/hubs of financial institutions, money-laundering for terrorists (CIA/Mossad/NSA/MI5-agents) and narcotic-syndicates etc. etc.). I think there’s a general and understandable decay of working ethics all around. And why be a loyal worker? Loyal towards what/whom? Actually a fair argument could be made, that those watching porn does less damage than those ‘doing their job’ (the job in todays f*cked-up world being to service the 0,01 % agenda).

I worked for Fed.gov too. There is some sort of epidemic of people shitting in offices and hallways in federal buildings too. It happened twice in the hallway on the floor where I worked. I read about the Denver office where they also shit in the hallways.

I worked in an NHTSA office - the people who bring national campaigns to police to threaten people to wear seatbelts.  The woman in charge of the office made like $150,000 (this was 10 years ago) and drove a Jaguar.  She started in the office as a Secretary and merely stuck around for a long time - it wasn't like she studied how to be a nanny-stater or developed some sort of public reputation as such.  No, she just collected an asston of money to do...I'm not really sure what they did in this office.

Small family owned mfg biz I worked at years ago had a fair number of mexicans working there. They would leave the asswipe in the waste basket, refused to flush it even after being told how many times to flush it.Fucking disgusting, especially when you add the summer heat in a non AC area.

Fast forward 20 years, and a mexican I work with who has lived here his whole life, does the same often, but not always. It's almost as if it's a trait or something. I have told him to knock it off, we have good sewer systems here in the civilized world. Makes no diff, still happens a few times a week...at least he's trying.

Honestly, as an EPA employee, or most agencies for that matter, him looking at porn is probably better for the average citizen than him doing what he is paid to do. At least while watching porn he can't help enforce or write some draconian new regulation for an industry his political appointee boss doesn't like, or take away what few civil liberties they still pretend we have. Hate to say it, but if they ALL just looked at porn all day this country would probably be in better off. (Yes, obviously firing them all and doing away with these agencies all together would be better, but you get my point)

Don't take a few sensational stoies and apply them to the 22 million federal, state and local employees.  There are always some bad apples, even in the private sector.  The problem is the labor unions and the beurocracy have made it too difficult to get rid of the bad apples.  This is a problem for public sector manages all over.  But is you dont have enough protections, politicians will go on the warpath against government employees who don't toe the line.  You need a balance.

This goes on all the time, why do you think people get into or fight to get into these jobs.  They know that ít's nearly impossible to get fired, hell even spying it depends on who did it and who that person is connected to and the public may never hear about it and the person will still be on the job.  There is another reason also.  Remember that show on USA called Burn Notice about the govt. spy that got essentially fired but they couldn't allow him to leave Miami his home town because he just knew to much information and how the govt. works etc. etc..  Many times govt. positions for people getting out of the military and/or who have been in govt. service is done this way because they know to much about what they have been doing and how the govt. works and other things and losing these people makes it easy for someone to use them against the govt. either people in the US or an agent from another country. 

So it's good to keep them on the "reservation" and then let them retire.

Seems this is what happens when the New Paridigm is full of useless eaters. We have gotten to a point where we, generally speaking, just don't need as many proles to keep the gears turning.
A few key players make things happen. A group sits at the top and pulls the levers. A very large group are just housed and fed.
And then there is .gov. And their job seems to be to come up with new and innovative ways to shear and fleece the few remaining productive.
At some point, this hits a tipping point, and it comes crashing down.

In a free society anyone can make a union, and anyone can fire employees on whim (unless contract states differently). Though for an efficient government I'd propose a law that if any public employee goes on strike or threatens to leave if another employee gets fired (that is lawful action of a union in private company) - fire them. It would actually make sense to pay beaurocrats pretty well, if their numbers were down and they faced consequences of their actions. Sure let this important regulator get a lavish salary, but for any court certified screw up - he's liable with his whole net worth.

I think we may be viewing an opportunity, and mistaking it for a problem. 

Maybe we could all chip in to create a non-profit foundation to provide free, high-quality, high definition, raging hot porn to suit every salacious taste for every White House staffer, Senator, Congressman, Capitol staffer, and employee in the FedGov, and various statehouse and municipal governing bodies who apply.
