The 17 Elements Of Martial Law

The term “Martial Law” is thrown around with reckless disregard. "Is America under martial law?" is a question that is often discussed in the Independent Media.

Martial law occurs when the prevailing regime feels threatened by the message being offered by the loyal opposition. When normal means of censorship and marginalization fail, despotic regimes resort to martial law with all intended brutality of a violent crackdown on all of those being perceived as the “enemy”.

Seventeen Martial Law Characteristics

Most experts agree that hard core martial contains the following 17 essential elements:

1-Mass roundup and/or execution of political dissidents

 

2-Dusk to dawn curfews

 

3-Rationing of essential resources

 

4-The seizing of personal assets such as food and water

 

5-Control over all food and water

 

6-The prohibition of weapons of any kind including guns, knives or chemicals which can be turned into explosives

 

7-The confiscation of property, homes and businesses

 

8-Arrests without due process

 

9-Massive “papers please” checkpoints with intrusive searches

 

10-Forced relocation

 

11-Forced conscription into various labor camps and even into the military

 

12-Outlawing of free speech

 

13-The installation of massive surveillance programs and the establishment of snitch programs

 

14-The total control or elimination of religion

 

15-Control of the media

 

16-Executions without due process of law

 

17-Total suspension of the Constitution

6-The prohibition of weapons of any kind including guns, knives or chemicals which can be turned into explosives - puh-lease. the more guns out there the better. they will never be in the hands of an organised militia, led by a coherent strategy. Instead they will be used as they are now: not at all, or in violent crime & assaults

7-The confiscation of property, homes and businesses - just repo them or bankrupt the owner

8-Arrests without due process - 'due process' got redefined some while back

9-Massive “papers please” checkpoints with intrusive searches - what the fuck for, Facebook & google tracks you way better than the Stasi ever dreamed possible 

10-Forced relocation - why bother?

11-Forced conscription into various labor camps and even into the military - again, why bother? when there's no jobs and the military is always hiring, why force anyone into it?

12-Outlawing of free speech - opposite, get everyone talking across each other at once, no-one will organise effectively.

13-The installation of massive surveillance programs and the establishment of snitch programs - see above, google, facebook + rendition

14-The total control or elimination of religion - why bother, it's an opiate

15-Control of the media - why bother, it's an effective distraction. . . 

16-Executions without due process of law - why bother, anyone effective and non-violent is marginalised, anyone effective and violent will receive all the 'due process' they can handle.

17-Total suspension of the Constitution - why bother? who would notice in such a way as to get anyone else to care?

Martial Law is no longer needed. You've sedated, distracted and monitored yourselves into irrelevance & submission. Congratulations. America has conquered herself.

I'd just like to point out that there's nothing wrong with wishing people to get what they deserve. There's really no other way to learn, grow up and become an adult. Getting what you deserve is recognized in many cultures and in our Western culture is often stated as, "You reap what you sow." In the East it is the Law of Karma - or cause and effect. Good can only come from good, and evil cannot create good, but only more evil. This is the unchangeable law of this universe.

We don't have freedom because, in the aggregate, we don't deserve it. If people would return to the foundation of morality/ethics - not causing harm i.e. the non-aggression principle - we would all be free tomorrow.

The good thing for us is that all these troubles are not real, but only wild phantasies. There is absulutely nothing wrong in this good Earth except some bad ideas. There is nothing to change but oursselves.

The wonderful thing about a belief in Jesus Christ is that you don't het what you deserve after a life of sin,  I never undrstood the whole grace/mercy thing until someone put it to me in these terms:  Grace is given to you unconditionally - you get it without doing a thing; mercy is what you don't get even though you deserve it. I think if more people would just read and study the bible on their own and quit listening to the blatherings of "men of God" they would be better off.  Seek and you shall find.......

The way you put it, it does.  Perhaps if you said something that qualifies what you intended to say then it would not be like that.  "Popular organized religion" or some such would be a possible example.

If you are not an atheist then you must follow some kind of religion.  You take the opiate you criticize?  Maybe in your mind you have clarity and consistency but it does not translate in your writings.  Of course a lot of people seem to agree with you and that is a fearful thought considering you are using blanket statements to condemn an idea.

All of your counter scenarios are only valid so long as Americans remain economically comfortable and the welfare checks keep rolling in.  As soon as monetary devaluation becomes undeniable, price inflation becomes unbearable, and people start starving and losing access to their favorite toys, unrest will occur and martial law becomes inevitable.  It's ignorant to think that the government has been training the military in civil reponse for no reason.  It's also ignorant to overlook the fact that martial law has been tested in places like New Orleans and Boston without reason.  The TSA isn't fielding VIPR unit checkpoints on highways just for kicks and the police aren't being militarized just for yucks.  And, the DHS isn't ordering billions of rounds of ammunition for fucking "training purposes" either.  Not to mention all the continuity of government executive preparations taken by Bush and Obama.  You really think all of this is being done if the government has no intention or no need for domestic control measures?  I wish I lived in your fantasy world...

Real martial law can only be declared by the military (and that means a traditional millitary, a militia, or a fucking armed neighborhood watch) after a civilian government has fled, been ousted, strung up by lamp posts, or been otherwise removed or destroyed.

 

Civilian governments that are still in power cannot by definition declare "Military Law aka Martial Law" without first ceding power to the military.

So far the only credible martial law scene in recent memory was in the aftermath of Katrina and before that, the Rodney King riots. Everything else is simply militarized police shitting on the constitution (e.g. Boston, Ferguson, and I have no idea what label to put on the spastic police action in CA during the Dorner episode.)

During the Civil War President Lincoln declared martial law and suspended the Writ of Habeas Corpus, based specifically on a law passed by Congress and signed by the President effective during the rebellion giving him that suthority under clearly defined conditions.  Under Proclamation 113 he used that authority in the State of Kentucky, for one example.  However, the Civil Officers and Authorities were not replaced by military officers, elections were not suspended, the Legislature of the State of Kentucky was not suspended from meeting and conducting their Constitutional duties, etc.  It was hardly a complete military takeover of the government of Kentucky.   

Now.  Regarding those MRAPS.  They are going to be big, expensive and very obvious white elephants for the police departments using them.  There is no domestic logistics and maintenance system to support them.  In other words, your local NAPA or other auto parts stores are not going to stock any parts for them and won't be able to order them either.  

They are too slow to outrun the slowest domestic car or truck.  I am sure that my huge diesel powered F-250 4X4 handles like a sports car in comparison to the MRAP.  So forget getting anywhere in a hurry.

Even in a domestic insurrection one or two will hardly prove adequate, as a properly prepared Molotov-gelatin cocktail will turn them into roasting ovens for the police officers inside them, not that I am suggesting or approving such actions.  Merely pointing out the obvious.  

Even an M1A1 Abrams tank can be disabled in the same manner.  That's why tanks deploy with infantrymen going into combat.  They are there to protect the tanks from from enemy infantrymen.  The final battle scene in "Saving Private Ryan" gives a credible example of what infantrymen can do against armored vehicles in urban combat if they are not protected by their own infantrymen.

I live under "Marital Law."  My firey redheaded wife's nickname is Wolverine and I sleep with one eye open.

As a marriage goes it works for both of us.  As a nation we have been as a general observation sleeping with eyes wide shut.

What passes for leadership in government is laughable.  The lobbyists run our country.  Washington has become an out of control monster.  You will know we have martial law when the EBT cards are shut off.  People with any desire to open their eyes and look around know something isnt quite right.  Here in Obamaville last night in the nether regions of south Chicago a woman and 3 of her kids were hit by gunfire while sitting in their home watching TV with the womans grandfather.  He was also hit and he was killed while holding one of his great grandsons.  Where is the outrage Mr Obama?  Where is the outrage,  Mr Holder?  Where is the outrage Mr Sharpton?

See,  we are being led.  We are being led and some including myself would say we are arleady there.  Look around your neighborhood.  America was once a place where hard work,  integrity and grit would allow you to go as far and as fast as your ideas and determination would take you.  That America is gone.  I am not so sure it can be retrieved. 

To those who think local cops will gather and open fire on fellow citizens i think you are mistaken.  We know where they live.  Will the National Guard fire on fellow citizens?  Do you know the National Guard soldiers that live in your neighborhood?  To those who wish for TEOTWAKI  be careful what you wish for.

I will be 60 this year.  I don't recognize my country.  Am I guilty of looking the other way for too long?  Probably.  See I was the guy working his ass off since I was 12.  I was the guy that for my whole life paid taxes,  employed people,, trained people,  raised three college educated daughters who married and are now working raising families and and the newest generations.  I was the guy who worked 90 hours a week and paid employees first before my mortage when starting out.

The world owes no one anything.  We are at a tipping point as a nation.  The powers that be at all levels as reached so far into our wallets and our everday lives that there is no gaining back any semblance of the America that once was.  Government has become an all consuming monster.  Society is indeed bread and circuses.  Local news just announced that in another local Obamaville Chicago suburb some monster killed a baby with a power saw.  Any questions.  Do you recognize the country you grew up in?

Martial law backed up by a whiff of grape shot is the wet dream of power freaks.  Events like Boston can last a couple of days.  Events like Katrina can last a couple of weeks.  People cower and submit because they are placed in a temporary environment that will be lifted as things return to normal.  The locking down of a city like Boston beyond a couple of days would very quickly have fallen apart. 

Consider the murders, rapes, gambling, drugs and prostitution that go on in the nation’s prisons.  Once the inmates have acclimated to the existing control mechanisms, they devise work arounds to meet whatever demand there is. 

Walking down a street with your buds all geared up, backed up by MRAPs is an adrenalin rush.  Standing on post day after day in the heat and cold and bugs gets boring.  Once you get bored, your vigilance drops. Then, you become a target of opportunity.

According to my copy of Black's Law Dictionary, Martial Law can be declared First by the Congress; second, by the President if Congress cannot convene.

Quoting: "...when Civil Authority has ceased to function or has become ineffecive....it depends on the will of the military commander...(and) which suspends all existing civil laws as well as the civil authority and the ordinary administration of justice."

Many of the item points posted by the author may or may not happen.

However, there has to first be a complete breakdown of State and Local LE capabilities and State Militias. This includes the NG and the 23 States possessing State Defense Forces.

I never know how to take Hodges. He raises many valid points, but he borders on hyperbole/panic.

The best course of action I can figure is keep your eyes open and nose to the wind. Be prepared to stash and run if you have to- but you will have to figure out that time window individually.

Hodge's point #14 is not mentioned in any text or reference in the Law.

Seeing as how the "element of surprise" is essential for the Government to successfully apply Martial Law (which by the way HAS been in effect since the 30's and renewed by every Congress in secret), then from what I can see in the comments posted, ya'll are ripe for the picking.

I have long thought that the "Forced Relocation" thing is SO 20th century...totally unnecessary and a complete waste of resources.

The owners of this country want everyone right where they are where they can still be marginally useful as they are bled white with taxes and debt held by the banking system.

The last thing they need is thousands, millions of people under their direct charge that need to be sustained in "FEMA Camps".

And even if they wanted to kill everyone, the worst way to do it is in extermination camps.  Disposing of all the bodies is a total nightmare....just ask the people who have done it; the Nazis.

Much easier to just allow people to rot right in the leaking shacks they currently occupy and then force them clean up the mess with their own tax dollars.

Yeah, yeah, OK.  Another sensationalist proof of what everyone here already knows.  The Police State is not coming, it is here and becomes more pervasive and powerful every day. 

So, what do we do?  Bunker in and hide, move the the boonies where we might be found only after urban power and control is consolidated, and become target practice?  Shoot first and often, so as to facilitate an effective escalation of the pro-Police State and anti-"terrorist" propaganda and action?  Write letters to our Congresscritters asking if we might please have our country back?  Wait 'til we are if FEMA camps, so we can conspire to instigate food fights against the guards, armed with our plastic sporks and mashed potatoes?

Negative features of humans, negative emotions, career or monetary incentives for all careers that cause prosecution of Innocents, Advantages for the Few & the Connected, Government Legislation that transfers Taxpayer Money to Wealthy Interests, and Loopholes and Lobbying that grant advantages, Tax Breaks, Incentives for Job Cuts, Incentives for Outsourcing jobs overseas, and Incentives for using Slave Labor overseas which can not be audited.

How about we talk about how Capitalism and Propaganda can be Fascist. Moving more people on to welfare, food stamps, and granting them tax Credits payable in cash doesn't fix half of the problems. Just like going to a new world war won't fix any of the problems.

It was proposed by the Northern Ireland Government and approved by the British Government. Due mainly to faulty intelligence, many of those arrested were Catholics or Irish nationalists who had no links with the IRA. Loyalist paramilitaries were also carrying out acts of violence, which were mainly directed against the Catholic and Irish nationalist community, but no loyalists were included in the sweep.[1]

The introduction of internment, the way the arrests were carried out, and the abuse of those arrested, led to mass protests and a sharp increase in violence. Amid the violence, about 7,000 people fled or were forced out of their homes. The interrogation techniques used on the internees were described by the European Commission of Human Rights in 1976 as torture, but the European Court of Human Rights ruled on appeal in 1978 that while the techniques were "inhuman and degrading", they did not constitute torture.[2] It was later revealed that the British Government had withheld information from the ECHR and that a policy of torture had in fact been authorized by British Government ministers.[3] In December 2014 the Irish government asked the European Court of Human Rights to revise its 1978 judgement.[4]

The policy of internment was to last until December 1975 and during that time 1,981 people were interned;[5] 1,874 were Catholic/Irish republican, while 107 were Protestant/loyalist. The first Protestant/loyalist internees were detained in February 1973.[1]
