Hillary Commits A Crime And They Defend Her

MSNBC’s Ed Schultz who never saw a Democratic he did not like or a Republican who should not be executed, amazingly admitted in trying to defend Hillary that she is 67 years old and too old to know what she is doing. “There’s a lot of people in her demographic that just don’t want to be overwhelmed by that technology that are going to take the easier, simplest route to do something — I get that.”

You cannot get around the fact that what she did was criminal for when all those emails were subpoenaed by Congress, she failed to produce them or inform Congress she had a secret personal email. That is outright OBSTRUCTION OF JUSTICE and anyone else would go to prison for 5 years. Then when they are discovered, she erases the files. Come on! Why are there three sets of laws – (1) for Democrats, (2) for Republicans, and (3) for the rest of us?

Then her supporter Ed Randel, Former Pennsylvania governor whose wife is a Federal Judge on the Court of Appeals in Philadelphia, argued with a straight face that Edward Snowden hacked the NSA so Hillary was entitled to keep a private server. Hillary’s security would be even less impressive on a computer at her home.

Come on. Rendell is a lawyer and he KNOWS the law. What Hillary did is an absolute criminal act – there is no exception if there is honestly one rule of law for everyone. Can you image what what have happened if Nixon just said sorry, I erased all the tapes. Tough shit!

Then the venomous James Carville blamed the Bush Administration for all the investigations of the Clintons that justified her secrecy. Oh yes, there was Hillary trading commodities and making tons of money in a futures account while she was in meetings that were just a means of money laundering with the wins stuffed in her account and the losses in her lawyer’s account. This was typical kill the messenger. How come she never trades commodities ever since that one wildly successful trade?

All of these excuses are symbolic of the fact that politics is out-of-control. This is indeed the peak in insanity and with this ECM we may see a real turn against these people that just feel they can do whatever they want and then hunt us down to pay their bills.

It is either good and bad | good or bad.

Or implies a single winner

by using Demorgan's laws you can turn good or bad into not (good and bad)

And implies no single winner.

so now you have not good and not bad

good = white

bad = black

If it is not black and not white it has to be grey aka every color between. There can never be an absolute single winner since they are all shades of grey.

However, quite apart from that, even the Democrats understood back then that an impeachment trial undertaken during time of war was simply a nonstarter. Congress does not settle that issue. Eligibility for office of the POTUS, and VP are judicial decisions. Congress is only responsible for the "qualifications and elections of its own members". A1S5C1.

Cruz was born with 3 allegiances (citizenships) Canadian, US and Cuban, as such he is not eligible.

A friend said the other day to me that I had to back Hillary for President because she'd be the first woman.  I responded, first, "Why?" (FWIW, I am female, and the product of an elite women's college, of the sort Hillary attended, during the same era).

My friend, who is highly involved politically in her home state, was aghast, but really had no answer; I pointed out that I had no problem electing anybody who was not morally corrupt, and clearly so, but given the longstanding evidence otherwise re Hillary, I found it no more useful to elect her on the basis of her gender than to elect a DNA resurrected dinosaur on the basis of DNA scarcity.  Both are being elected, theoretically, on the basis of DNA specifics--certainly not performance, and both are equally dangerous.

On reflection, Hillary remains more dangerous, because she holds the media in her grip.  The Dinosaur, unless radically genetically modified in addition to being resurrected, would lack her speech advantage.  Otherwise, they would still be about even.

I took a biotech company public in 2001.  Any employee that was conducting any official e-mail communications or any official electronic business from a server that was not at and under the managment of the company's IT people would have been fired and prosecuted to the full extent of the law, period.

And these people call themselves "educated" cirtical thinkers, FAIL.

Does anyone really believe that, considering all the resources at their disposal, that our government could not provide this bitch with a reliable and secure e-mail account?

A number of (all?) banks will fire you if you send an email from a company account to a personal account.  It doesn't matter what the contents of the email are, you're simply fired.

Everyone knows that she could have been provided with a government managed email account.  The excuse they're going with is that she didn't want two devices when any modern device (including blackberry which survives on government contracts) can handle two accounts... and she had more than one device anyway.  Another excuse is that it was "easier" to call up some guy to set up a brand new domain and server in her home than it was to tell the IT department to create an account for her.  Obviously that decision was made on the basis of who was standing in front of her when she received the brainwave that she needed an email account.  It would be unconscionable to believe that she took considered and positive action to hide her activities from the people.  She's just not that kind of person.  /s  Adding still more incredulity is the fact that the WH press secretary said that Hillary defied policy because in order for this to be true, Hillary would have had to never email or get CC'd on an email that went up to the preezy...or for that matter anyone who knew about the policy.

tl;dr- it's sad and offensive how many blatant contradictions there are in the official story.  It boggles the mind how anyone could think that she's suitable for the presidency, she's not even good at lying.

Pretty simplistic summary of Armstrong's case. The reader's digest version (his story) is that when Princeton Economics called the break up of the Soviet Union he was visited by the CIA and asked for his computer program model. He refused and they concocted a reason to bust him and seize his computer. Unfortunately for the CIA he had a program that wiped the hard drive clean with an unauthorized hacking. That royally pissed off the CIA and he was charged on some trumped up issues surrounding the handling of clients assets. He refused to hand over personal assets or assets that didn't exist (I forget) and was held in contempt of court. While in prison he had at least one attempt on his life which was a severe beating while the prison guards watched. He was in prison for something like 7 years. They were leaving him in there to die. Fortunately for him, he started getting his economic writings out into the general public while in prison. This led to a widespread campaign by his readers/fans (I was one of them) to write to the prison warden and judge to set him free and/or keep him safe. He was eventually offered a plea deal because (in my opinion) he became a liabiility to the justice system. He took the plea deal as it got him out of prison with time served, IIRC. You would have done the same even if you didn't commit the crime. There was ample evidence he provided to support his case and version of events although I have no personal knowledge of whether what he says is true. I gave him the benefit of the doubt because he named names of the corrupt judges/prosecutors and why they did what they did. I'm sure if you looked around you could find the several articles he wrote describing what happened to him and why.

Hillary’s Emails and the Law

The fact that Hillary Clinton exclusively used a private server in her home, rather than a secure government server, to send emails during her four years as secretary of state has raised many questions. She now says that it was a mistake but also emphasizes that she broke no law. News reports typically describe her offense as not following “policy.”

Whether or not Mrs. Clinton violated a State Department rule, her admitted destruction of more than 30,000 emails sure looks like obstruction of justice—a serious violation of the criminal law. Let’s consider some of the basic, undisputed facts, and then the law.

First, Mrs. Clinton was worried that communicating through email would leave a trail that might be subject to subpoena. “As much as I’ve been investigated and all of that,” she said in 2000, “why would I ever want to do email?” But when she became secretary of state, she didn’t have much choice. So she set up a private server in her house. That way, in the event of an investigation, she could control which emails would be turned over.

We know this is true because that is exactly what happened. When Congress subpoenaed Mrs. Clinton’s official communications, or when nongovernmental organizations filed Freedom of Information Act requests for the same, the State Department could not turn over her emails because it did not have them.

The State Department must have known that its leader was using a private account. Mrs. Clinton presumably emailed other officials within the department, and the “from” line would have shown clearly that she wasn’t sending the message from a proper government email address.

Mrs. Clinton claims that she never sent any classified or secret information on her private account, though many have noted that she conspicuously left out whether she received such material. Either way the claim is hard to swallow—one would think it would have left her out of the loop—but let’s assume she is telling the truth.

By her own admission, Mrs. Clinton destroyed more than 30,000 emails once the subpoenas started coming in. She claims that she only destroyed personal records. Team Clinton initially explained that her work emails were separated from her personal emails using keyword searches. Now, after the outcry about how much this method might have missed, Mrs. Clinton is insisting that every email was individually read before the deletion.

Still, this leaves questions unanswered. How did those reviewing the emails define “personal”? For instance, if Mrs. Clinton had emailed a foreign government about a donation to the Clinton Foundation, was that message—whatever its interest to watchdogs or voters—tossed in the trash bin?

The law says that no one has to use email, but it is a crime (18 U.S.C. section 1519) to destroy even one message to prevent it from being subpoenaed. Prosecutors charging someone with obstruction don’t even have to establish that any investigation was pending or under way when the deletion took place. As T. Markus Funk explained in a journal article for the National Association of Criminal Defense Lawyers, the prosecutor “need only prove that the defendant shredded the documents, at least in part, to make life more difficult for future investigators, if and when they eventually appear.”

Legal commentators call this “anticipatory obstruction of justice,” and the law punishes it with up to 20 years imprisonment. The burden of proof is light. The Justice Department manual advises that section 1519 makes prosecution much easier because it covers “any matters” or “’in relation to or contemplation of’ any matters.” It adds, “No corrupt persuasion is required.”

In addition, rules governing the practice of law forbid attorneys from anticipatory obstruction of justice. These ethics rules are drafted by the American Bar Association, but they are also reflected in real law. Virtually every state court adopts them, and violation can lead to disbarment. Rule 3.4 (which has been around for many years) provides that an attorney shall not unlawfully “conceal a document or other material having potential evidentiary value.” Mrs. Clinton is a lawyer governed by these rules. So are any attorneys who advised her to delete her emails.

When the Senate Watergate Committee discovered that President Richard Nixon had a very extensive inventory of White House tapes, both the committee and the special prosecutor subpoenaed them. At the time, some wondered why Mr. Nixon, a lawyer before entering politics, didn’t simply destroy the tapes. The answer was that doing so could have led Mr. Nixon to an indictment for obstruction as well as disbarment.

At the time, I was assistant majority counsel to the Senate Watergate Committee, so I remember that period well. Mrs. Clinton should remember it too: She worked on the House Impeachment Committee, which warned Nixon not to destroy the tapes.

Here’s another reason Mrs. Clinton should know about obstruction: Congress enacted section 1519, making the crime easier to prove, in 2002, as part of the Sarbanes-Oxley Act. As senator, she voted for the law.

This will not mean anything unless a strong alternative Democrat contender can challenge Hillary. I expect the Democrat leaders to squash any competition in the primaries so they hand the nomination to Hillary. Once she locks it, the usual Clinton sleeze will push the email issue aside and turn any Republican questions into an attack on women. The play book is already written - and so far Hillary has slimed her way out of any sserious trouble.

As ZH pointed out a while back, the Democrats have a lock on 40% of the electoral votes they need. They would vote for Hillary even if she was sitting in a jail cell. Thus the battle is really for about a half dozen swing states, with Hillary only needing 3 or 4 of those to clinch.

Will the Dem money brigade (the only group that really matters) put away their checkbooks if Hillary is indicted for contempt of Congress? You know that is why she has held off declaring for Pres. She can't while this scandal cooks along on medium boil.

I think the R's will hold off on subpoeas until she declares and then immediately strike.

Dem's have no fall back. But they must be in full on panic mode. Who will be the first to crack that it is time to cut losses on a dead donkey?

The scandalmongering defense is starting to ring hollow.

If Ed Schultz is saying she is too old to get a grip on technology that has been routine for nearly 2 decades, what makes him think she can handle the complexities of being President. Hillary doesn't get to have it both ways.

I'll say it again:  "Hillary of over".

The reasons mount.

1. As Obumba said: "She doesn't have that new car smell".

2. She's a terrible politician and just plain unlikable.  The Democrats fantasize over here because they imaging that "it's her turn".  Bill was likable.  Hillary isn't.

3. George Soros dumped her in 2008.  When Georgie dumps a politician, they stay dumped.

4. The Obama's don't like her and will leak the dirt that takes her down, starting with "server gate."  Sooner or later,someone will whisper in her ear that there IS stuff that will put you in the slammer.  Just take your loot and enjoy your retirement.
