Caught On Tape: Cop Grabs, Smashes Phone Of Woman Recording Him

"He told me that I had to go. He said I was interfering with their investigation and I told [him] that I was on a public sidewalk and I had the right to film them.." And then this happened...

 

 

As MyFOXLA reports,

Beatriz Paez says she was doing nothing wrong taking video of U.S. Marshal executing warrants on San Juan Avenue Sunday. She saw people in handcuffs. “Around 8 people including women were held at gunpoint on their stomachs with their hands held behind their back,” says Paez.

 

But, when one marshal saw her recording, “He told me that I had to go. And, I told him I had the right to film and he said I was interfering with their investigation and I told them that I was on a public sidewalk and I had the right to film them.”

As The Washington Post notes,

...the courts have consistently held that the First Amendment protects citizens' right to record the police when they're on the job. The police can't stop you unless you're interfering with their work -- and they can't take away your smart phone or delete the recordings just because you took video.

 

Police need a warrant to mess with the content of your cell phone.

And again, she obviously was antagonizing them because we did not see what she was saying BEFORE she kept running her mouth she had a right to be there. Lame he did that? Sure. But if she stood back further and wasn't being a smart ass or whatever just before this camera started rolling...

All I am saying is just cooperate a little bit, it's common sense. If we know some cops go nuts and fly off the handle why egg them on and try to get that to happen? I surely wouldn't want to cause more problems for myself than I already have LOL.

knocking her phone out of her hand and crushing it is not asking her to stop filming? they asked to stop filming and she asserted her rights to film from a safe distance. no one asked to move back apparently implying she was okay to be where she was. the response she gave was in line with someone asking her to stop filming.

 

there was a crime committed by a person charged with arresting people who commit crimes. there were many witnesses and film from 2 cameras. more than enough for a da to bring charges against the cop. nothing happened. none of these poloice officers did their duty and you want to lay some blame on the victim? and you are not a cop? you went to the wrong school of thinking.

no seriously, the broad was the only one that close. she was saying its her right to be there implying they asked her to back up BEFORE this camera started rolling. she was not a safe distance. she was 10 feet away from the cops. guy filming was ACROSS the street at a reasonable distance.  the guy swatted her phone becauae that is the only reason she was so close. go across the syreet and film. if you have ever done any type of work where someone hovers basically over you to watch, you'd realize how annoying it is. I can guarantee if she had kept filming but backed up enough, they would have let her film all she wants. and no really, im not a cop, i own a manufacturing business. to me its just common sense, keep back a bit. If she was across the street and not <10 feet away from the marshalls and this happened then damn straight it would be bullshit. she was too close and running her mouth that she was allowed to be where she was. as lame as it sounds, she asked for the cops to intervene.

The big problem with that is qualified immunity.  IMO, the cop wouldn't have it in this case, but it is the first line of defense that will be brought up nearly 100% of the time if you sue a cop individually.  They fundamentally either have to be doing something outright criminal (he was in this case,) or they have to be violating "clearly established law" with regards to civil rights (which he was in this case.)  The problem is that a lot of this kind of behavior never meakes it into the courtroom with this kind of evidence, and people flat out refuse to believe that it happens.  Well, that's changing, but in the meantime, you've gotta live through the period of change.

We're not done yet here:  Basic liability insurance provided via taxpayer funds, but any risky behavior and claims due to officers breaking the law that results in an increase in the insurance premium, has to be paid from the officer's own personal funds.

That won't work until the laws are changed. Even when the police lose a lawsuit, it is the taxpayer that pays for it, not the individual police person. You have to make the specific police person liable for their own actions.

If they don't feel like they are capable of doing their jobs without qualified immunity for abusing people and their property, they can find honest work. The ONLY legitimate function of and police force is to protect against or investigate crimes against persons or their property. Victimless, vice type crimes obviously not included. I'm going to go out on a limb as at those assholes were probably not investigating or preventing a real crime either. IMO she would have been perfectly justified in shooting his ass, as id at tht qualified for assault, and she had a very legitimate fear of him inflicting death or serious bodily injury against her.

No.  In private professions, insurance only goes so far.  You can still be sued as a person.  It does not dismiss your civil liability.  Insurance is just a financial buffer.  And for cops, the cost would get shifted anyhow right back one the public.  It all boils down the $ either way, absent the personal liability.

Likewise, penalizing thier pension funds will only kick up more financial problems.  Cops will simply turn up the heat on generating ticket and confiscation revenue.  The whole shit storm will just spool up even further.

What another poster said here is that these folks need to start getting slammed personally for civil rights abuses at least.  Brought up on criminal charges where appropriate.  No more grand jury/DA reach arounds either.  And if convicted of a crime or abuse above a particular preset level, say goodbye to pension asshole.  And/or jail time, fines, etc.

Big noisy court cases played out in public for a long period of time. This is how the progressives have done it for decades and it directly affects politics, especially if it can be made even slightly racial or sexist. Minneapolis has been unwilling, for decades, to root out the small percentage of cops whose behavior accounts for millions of dollars in payouts annually.  I read in a story about one case, that the city itself doesn't pay the settlements.  They have insurance which does that. And the insurance is subsidized in such a way that premiums don't rise, nor is coverage cancelled, for repeated claims and payouts.

I'd support an initiative that forced cops to purchase their own individual liability insurance.  Many professionals have to do this as a condition of working in their field.  I do.  I buy a $2,000,000 General Liability policy, which costs me about $1,700 per year.  I imagine police work, being somewhat more risky than my profession, would cost more; perhaps twice as much.  I wouldn't mind the City reimbursing officers for that coverage.  But then, when there is an incident and a lawsuit, the City would contest (or choose not to contest) their own liability, and the officer and his insurance carrier would have to defend the officer's conduct and liability.  If an insurer had to pay out too much, they'd drop the policy, just as if I kept filing claims on my car or home, or on my General Liability policy.  Then the officer would be uninsurable, and thus unemployable.  That would have solved several problems in Minneapolis over the past few years, where the same cops keep coming up in situations where the police introduce violence into situations that had not been violent until they arrived.

Insurance coverage that does not cancel, adjust, etc. for claims is not insurance.  Otherwise, the insurer would go out of business. 

That cannot be anything more than a backdoor to taxpayers paying for the bad behavior. 

Having cops carry individual insurance, whether reimbursed or not, I think ends with the same sort of mess anyhow.  Just a conduit for an insurer to make a fortune off of the back of taxpayers... or the State just sets up another smoke and mirrors trick.

The concept of cops representing the State removes them from liability associated with the proper actions of thier jobs.  It should not be protecting them from criminal actions, civil rights abuses, etc.  The real problem here is simply that the law is not being applied equally.  The solution is simply to apply the law equally.

It's not simply about trust.  

How can I verify that proceedures are being followed correctly in hazardous industrial environments if I can't review what's being done?  People make mistakes, and those can be very costly, including loss of life.  In that event, I want to know what happened so it doesn't happen again.  I imagine the families of victims, not to mention insurance co's, unions, trade associations and the general public would also like to know.

I've seen these consequences first hand.  If I'm working in a hazardous environment, I prefer that the people I'm working with understand the consequences of errors and ommisions in the course of their duties.  It makes all of us safer, and it gets rid of those who can't, or won't perform their job correctly.

Incidentally, a lot of companies use these videos in their training programs.  It makes a far greater impact if you can see exactly what when wrong, as opposed to just describing it in written or verbal form.

Trust, but Verfiy, because SAFETY always comes FIRST.

You want privacy?  Stay on your own property and build a fence.  The cop throwing that phone should have been arrested on the spot by the other law enforcement officers on the scene for destruction of private property.  The fact that he wasn't bellies the argument there are no good cops.  I'm glad that people are filming everything they can, and even looked into installing video in my car for when I get stopped.  In court the officers word carries more weight then a civilians in both the judges eyes and with the jury. 

We need more tools at our disposal then less on BOTH sides.  It's getting close to all out war already.

Sorry, if you are in a public area, you are fair game.  Period.  This is doubly true for police.  If you are walking down a public sidewalk and I want to take video of you and you don't like it, tough shit.  Same goes for a security camera on the outside of a store that takes video of the sidewalk that you might want to walk down.

The eyewitness testimony, backed up by a reporter who later visited the site to show where the Police investigation was, vice where the woman was, indicated she was filiming from over 150 feet away.

The person who recorded the viral video said, "When you see police near her, it is only because they came to where she was recording."

 

So...In the video you can see two officers facing stage right, and a third (who destroys the phone) facing the camera.   The impression is that the arrest is happening feet from the woman with the phone.  Not so.  The two facing right are 150 feet, and four houses away from the other officers who are actually doing the "bust"...during which they, ironically, were releasing people one-by-one...according to the witness.

Shortly, something besides a phone-smashing stinks here.  Why were they 'arresting' people, "Facedown with guns to the head" ...and then releasing them????

The normal procedure is to put them facedown to cuff and disarm them.  The difference implies they were doing something other than arresting, and using their "guns-to-the-head" to do it.

Might that be why the police walked 150 feet to smash this woman's cell phone?  So there would be no record of the 'not-arrests' that they were doing??

I didn't see anything she was doing that "iinterfered" with the work.  She wasn't elbowing in, leaning over their shoulder, or getting between them and their subjects.  Plus, Mr. Big came from the other side of the group, one of the farther members being "interfered" with.  I agree, you should be able to sue personally.  There are no limits to bad police behavior because none have been set.  When it's out of their personal pocket, things will change, and fast.
