Clinton Charity CEO Explains Tax Reporting "Mistakes"

Last week, Hillary Clinton had what we called a “Geithner moment” when a Reuters investigation revealed that the Presidential candidate’s family charities had failed to report “tens of millions” in contributions from foreign governments on annual tax returns. For its part, The Clinton Foundation was quick to point out that when it comes to charities, it is exemplary in terms being forthright, but the missing disclosures will likely serve to fan the flames for Republicans who claim Clinton’s ties to the charities could make her susceptible to the influence of outside interests. 

Meanwhile, the Foundation’s claims to transparency will surely be put to the test as the former First Lady ramps up her bid to return to The White House and as questions linger regarding contributions from foreign governments while Clinton was Secretary of State. Here’s an excerpt from a Washington Post piece published in February:

The Clinton Foundation accepted millions of dollars from seven foreign governments during Hillary Rodham Clinton’s tenure as secretary of state, including one donation that violated its ethics agreement with the Obama administration…

 

Some of the donations came from countries with complicated diplomatic, military and financial relationships with the U.S. government, including Kuwait, Qatar and Oman…

 

Rarely, if ever, has a potential commander in chief been so closely associated with an organization that has solicited financial support from foreign governments.

Now, the Clinton Foundation is out with a public admission of its reporting “errors” as acting CEO Maura Pally describes, in a lengthy blog post, the supposedly innocent nature of the mistakes and the “unprecedented” steps the Foundation has taken in the past to avoid conflicts of interest between Hillary and foreign donors. Judge for yourself:

Over the past few days, many questions have been raised about the Clinton Foundation, its initiatives, and the financial support that allows us to do the uniquely impactful philanthropic work that we do at home and around the world.

Without question the Foundation’s accomplishments stand on their own. From fighting obesity by helping create healthier learning environments for more than 16 million students; to working to combat one of our greatest global threats, climate change; to lowering the price of lifesaving antiretroviral drugs that have benefited more than 9 million people fighting HIV/AIDS; one thing is clear, the Clinton Foundation has not been afraid to take on big challenges and see real results.  

Just as important as the results we see, is how the Foundation has transformed philanthropy into a collaborative effort by bringing NGOs, local stakeholders, government officials, private sector actors, and others together to maximize their collective investments. It seems logical, but fifteen years ago, that just wasn’t how philanthropy was done.

As the Foundation’s impact has grown, so too has its commitment to transparency. When Hillary Clinton was appointed Secretary of State, we took unprecedented steps to avoid potential conflicts of interest by going above and beyond what is required of any philanthropy and instituted voluntarily annual disclosure of all of our donors on our website. We also established a policy around the foreign government contributions we accept, recognizing that in order to continue our life improving work we rely on the contributions of government, as is the case with most large scale global charities.

Today, our donor disclosure and foreign government contributor policy is stronger than ever. Since Secretary Clinton decided to run for President, we have committed to disclosing all of our donors on a quarterly basis.  In addition, we announced that we will only accept funding from a handful of governments, many of whom the Foundation receives multi-year grants from, to continue the work they have long partnered on.

The Foundation has 11 different initiatives, some of which function in organizationally different ways. One of these 11 initiatives is the Clinton Giustra Enterprise Partnership (CGEP), which is focused on advancing innovative solutions to poverty alleviation on a global scale. CGEP has come under heightened scrutiny this past week and I want to explain how it operates.

The Clinton Foundation executes all of the work that CGEP does. CGEP does receive financial backing for projects from an independent Canadian charity called the Clinton Giustra Enterprise Partnership (Canada), which Frank Giustra established so that Canadians could support the initiative’s valuable work and receive a charitable tax credit. CGEP (Canada) provides funding on a project-by-project basis and this money goes exclusively to CGEP projects, not to the Foundation’s general operating fund. 

Like every contributor to the Foundation, the Clinton Giustra Enterprise Partnership (Canada) is publicly listed as a donor on our website. But as it is a distinct Canadian organization, separate from the Clinton Foundation, its individual donors are not listed on the site. This is hardly an effort on our part to avoid transparency – unlike in the U.S., under Canadian law; all charities are prohibited from disclosing individual donors without prior permission from each donor.

I also want to address questions regarding our 990 tax forms. We have said that after a voluntary external review is completed we will likely refile forms for some years.  While some have suggested that this indicates a failure to accurately report our total revenue, that is not the case. Our total revenue was accurately reported on each year's form – our error was that government grants were mistakenly combined with other donations. Those same grants have always been properly listed and broken out and available for anyone to see on our audited financial statements, posted on our website.

So yes, we made mistakes, as many organizations of our size do, but we are acting quickly to remedy them, and have taken steps to ensure they don't happen in the future. We are committed to operating the Foundation responsibly and effectively to continue the life-changing work that this philanthropy is doing every day.

The Clinton Foundation just announced that it will revise its tax returns for 2010, 2011, and 2012 after revelations by the Reuters news organization that it neglected to report foreign government grants on its tax returns as required by law. Charities are required to provide a breakout of their government grants, including from domestic and foreign sources, in Part VII, line 1e of IRS form 990. In a statement on its website, the Clinton Foundation explained that it had apparently "mistakenly combined" its foreign government funding with other funding.

This isn't just highly questionable... it's downright improbable.

Having served in senior management of a non-profit with the same tax status as the Clinton Foundation for nearly 30 years, I can testify that it's very hard to mess this up year after year. Not only would the Clinton Foundation's management need to get it wrong repeatedly, but its CPA would as well. And even if the CPA messed up, the errors most certainly would have been caught during an annual audit.

Auditors don't just take a charity's word for the sources and amounts of grants, but contact the sources to verify the information supplied is correct. So, I wondered which firms could have served the Clinton Foundation so poorly from 2010-2012.

It turns out that it wasn't two firms, but a single firm: the Little Rock, Arkansas branch of BKD, LLP. That the Clinton Foundation chose to use a single firm for both CPA services and its independent audit for multiple years is significant as it violates charitable best practices.

Ever since the Sarbanes-Oxley Act (formally, the Public Company Accounting Reform and Investor Protection Act) was adopted in 2002, the splitting of general accounting and auditing services has become standard practice, not just for publicly-held corporations but charities, too. The splitting of accounting and auditing services was a direct result of the Enron scandal.

And now, it appears that the Clinton Foundation may be the charitable equivalent of Enron. The accounting firm Arthur Andersen helped Enron cook its books because by doing so it could also keep much more lucrative contracts with the company.

During the early 1990s, Arthur Andersen learned that it could considerably boost its profits if its auditors approved what the Wall Street Journal called, in a 2002 article, "aggressive accounting tactics" by some of its clients. One of its first big financial successes from using these tactics was when it helped Boston Chicken hide franchise losses in advance of an IPO. In the auditor's performance review, he was praised for turning "a $50,000 audit fee into a $3 million full-service engagement."

BKD could have been the Clinton Foundation's Arthur Andersen, approving "aggressive accounting tactics" to hide millions of dollars in controversial government grants in the one document that the public has an absolute right to see - the Clinton Foundation's federal tax return. It is troubling, too, that like Arthur Andersen, BKD's professional conduct has been questioned by government regulators.

The Little Rock Arkansas branch of BKD, the very branch the Clinton Foundation used for its audit and other accounting services, is currently being sued by the Federal Deposit Insurance Corporation (FDIC) for $17.5 million in connection with the failure of the First Southern Bank of Batesville. Between December 2008 and September 2010, First Southern Bank purchased $23 million in fraudulent district improvement bonds from Little Rock attorney Kevin Lewis. BKD was the bank's accounting firm at the time and the FDIC says the firm failed to do its job.

Lewis was sentenced to 10 years in prison in 2011 and BKD's association with the case certainly became widely known at that time. Yet, the Clinton Foundation did not make its curiously-timed switch to the firm Price Waterhouse Coopers until 2013.

If the IRS can free itself for a moment from its witch hunt of conservative non-profits, it might want to examine the books of the Clinton Foundation.

By the way, Charity Navigator is a good resource, I always look at the % they spend on administration verses what is disbursed mission wise.

Some charities are very good in that respect. Don't boycott them all.

Remove Non profits and remove 99% of the deductions.  Just give a credit for a few at the extreme bottom.

....You might be interested in knowing that the "charity" had 35 employees with reportable compensation (that is, over $100,000) and their top five combined had $2.6 million in direct (that is, cash) compensation and another $278,000 in benefits for approximately $3 million -- or 1/3rd of all spending on "charitable causes".  On a grossed-up basis the charity spent $21.8 million on salaries and wages or approaching three times what it spent on "charity."

Let's just remember that it's not just Hillary's family charities that have been funded by foreign governments but also the whole United States by Chinese, Japanese etc bond buying.

Hillary is what she has always been and should be given credit for consistency despite it being a very unbecoming consistency.

For those of you that are familiar with how these charities work, here is some history.

The Kennedy's have been running this scam in Massachusetts for decades.  They get businesses and people to donate money to their Citizens Energy Fund or whatever it's called.

Then every Kennedy draws a $500k per year salary to manage the fund and they give people money to buy heating oil.  So you say, well at least some people are getting some charity for heating oil.  Well, a few years ago a news station did an expose and followed an oil guy around and he was delivering oil to these million dollar homes in the wealthier suburbs.  When asked about it, the Kennedy's said it would be humiliating for the people requesting assistance to be asked to verify their financial situation.  If there is no verification process what exactly are the Kennedy's being paid to "manage."  So the charity really is Kennedy's make money and their wealthy friends get free heating oil.  I am sure they give one deserving family some oil so they can put them in their marketing campaign.

 

Clintons just borrowed the scam on a much larger scale.  Fighting obesity, racism, hunger, earthquakes, volcanoes, high tide, ...

The hidden issue here is more than just the need to file amended tax returns -- it will be that everyone will get to see what and when and who gave money -- and be able to match those up with Hillary's schedule and her actions.  That will keep this in the news for a ling time -- and unlike the book -- the proof will be in the tax returns for all to see.

Good post. For the TLDR (too long didn't read) crowd: 40% of people are innate communists. 40% of people are innate facists. The two party system creates an entrenched tax code (crony capitolism) that appeals to both, if for no other purpose than allowing them to live in denial of what their core condition/beleifs are. The 20% is a dispersed group of sheep under threat of state force, and will seek safety in a herd or find isolation. We are in a period of time whether neither is safe harbor, from either group.
