It appears the situation in Baltimore just got a lot more serious as MD State Attorney Marilyn Mosby states:

Mosby's announcement on the steps of the War Memorial Building was greeted with cheers and applause. She said she told Gray's family that "no one is above the law," and so as The Baltimore Sun details, the six Baltimore police officers involved in the arrest of Freddie Gray – who died last month after being injured in police custody – have been charged criminally, State's Attorney Marilyn Mosby announced Friday.

Officer Caesar Goodson Jr., 45, who was the driver of a police van that carried Gray through the streets of Baltimore, was charged with second-degree murder, manslaughter, second-degree assault, two vehicular manslaughter charges and misconduct in office.

 

Officer William Porter, 25, was charged with involuntary manslaughter, second-degree assault and misconduct in office.

 

Lt. Brian Rice, 41, was charged with involuntary manslaughter, second-degree assault and misconduct in office.

 

Sgt. Alicia White, 30, was charged with involuntary manslaughter, second-degree assault and misconduct in office.

 

Officer Edward Nero, 29, was charged with second-degree assault and misconduct in office.

 

Officer Garrett Miller, 26, was charged with second-degree assault, misconduct in office and false imprisonment.

Warrants were issued for the arrest of all six officers. It wasn't immediately clear where the officers were on Friday morning.

Mosby said Gray was improperly arrested on April 12 because officers had no probable cause to detain him.

 

In a detailed recounting of the events, Mosby described Gray being repeatedly denied medical attention by police officers, even as he asked for medical help and later was unresponsive in a police van.

 

Gray suffered a "severe and critical neck injury" as a result of being handcuffed, shackled and being unrestrained in the van.

 

Mosby said an investigation found officers bound Gray's wrists and ankles and left him stomach-down on the floor of a police van as they drove around West Baltimore. Despite his repeated requests for medical attention, they did not provide it and continued to drive without securing him in the van, she said.

 

Officers on at least five occasions placed Gray in the van or checked on him and failed to secure him, she said. By the time they reached the Western District police station, he was not breathing and in cardiac arrest, she said.

 

Mosby said her office did a "comprehensive, thorough and independent" investigation that began April 13, the day after Gray was injured.

 

"My team worked around the clock, 12- and 14-hour days," she said.

Mosby called on the public to remain calm.

"I heard your call for 'no justice, no peace,'" she said. "Your peace is sincerely needed as I work to deliver justice on behalf of this young man."

My wife was in ER nurse in the Bronx for many years and has seen many criminals taken down by cops. it is very easy to break a vertebrae with enough pressure but when the criminal is flailing and fighting back it just makes the officers become more forceful especially with peer pressure of other officers standing by and making fun of that officer for not putting the man down. I do not know what happened but I can assure you that Freddy Gray was flailing and fighting back causing the officers to use heavy force; this was no homicide. That being said the militarization and extreme force that police use nowadays will add to the rising numbers of deaths from police custody.

I did not reference the arrest. I referenced pressure upon a person's vertebrae and it breaking and the fact that the term homicide is incorrect. I would imagine manslaughter is as close as you could get but good try though.

He was in custody at this time. How he got into custody is surely questionable. I had friends pulled over, car searched and mentally fucked with in Indiana on Saturday. Nothing they could do. I am not excusing the cops. I'm providing some info on vertebrae breaking and cop force from my wife. Nobody knows what happened. It's all hearsay. He was no boyscout. The cops, however, are becoming brutes who treat us all like criminals.

I forgot that your constitutionall protected right to defend yourself from an attacker ends when they have you "in custody". 

We should remember to tell that to kids and girls who are abducted/raped. Once you've been caught you're supposed to stop resisting your attacker.

She was with girlfriends and her son. She just wanted to get going on her way and had nothing to hide, but after a thorough search with nothing found they still treated her like a POS. No apology no nothing just "fuck you deal with it." I understand they are searching for illegal things, but basically forcing a search by walking the dog around their car, the dog farted or grunted or something and the cop freaked saying "we got a hit!!!" Horseshit. They had nothing. They wanna search, the average person will feel forced into it. They will do what they want. The 4th Amendment is dead.

Regardless that excessive force was applied in brutal and sadistic manner, there is no certainty that these ploicemen will even be brought to trial, and much less convicted of anything.

Once upon a time, prosecutors welcomed the opportunity to go to trial. Lately it seems that they are especially reluctant to do so, if the perpetrators work for "the government". Furthermore, the probability of guilt used to be just marginally better than 50% for a grand jury to decide that a case should go to trial. Now 75% of the grand jurors must vote for trial proceedings. Otherwise, the charges will be dropped.

For all intents and purposes, policemen in this country can kill with impunity, and can do bodily, emotional, and psychological harm as much as they wish. . . . Unless, of course, if the person taken by police is a member of "the gated community". In such cases, civil rights, human rights, and the "presumption of innocence" is still paramount.

How will these riots and subsequent charges against various police effect the future.

While one might thin the police would now act with more care and restraint, I think the police might act to hide certain actions even more.

The police in many areas have already been militarized. They won't go back. They will only do more to hide their actions. And in terms of broader civil unrest, do you think the police have learned their lesson and won't disarm the citizens if ordered? I don't.

The problem is prosecutors rely on favors from the police,so they treat them with kid gloves. If prosecutors go after bad cops, they will stop getting convictions and get replaced. That is why we need special prosecutors for thugs in uniform.

The rioters of Baltimore now have their judge, a hanging judge. What good is a jury? The media will provide the jury. The media will not only convict the police, the media will convict the white population of United States. Because, after all, isn’t a police force just an extension of white middle class America?

If comments such as these jolt a person’s sense of justice, they need to keep in mind that no trial has been held, no evidence has been brought before a jury and yet in America the knieves and the ropes are out for the accused. For those who are happy with the Baltimore turn of events, they are happy about the disintegration of the American system of law and justice. For that matter, they are happy about the  dissolution of one of the greatest nations that was ever established on the planet.

The abuse of power transcends any racial overtones. We are dealing with an increasingly militarized police force that increasingly uses tactics that are illegal, inhumane, and harmful in the course of their daily duties and responsibilities to the citizens they are paid to serve and protect. We are seeing abusive and unlawful behavior at every level of common activity - to the point now where just looking at a cop might get one killed (as in the case of Mr. Gray.)

-- If a dog is behind a gated fence and is barking at a police officer, that does not give the cop the right to shoot the dog. The dog is there to protect the property.

--If a women is walking in her neighborhood and takes video in a public space, that does not give a cop the right to manhandle her and destroy her property.

--If a 5 year old is playing on a playground and appears to be holding a dark object in his little hand, a normal human being is not going to shoot to kill first and ask questions later.

--A no-knock welfare check does not give the right to officers to then shoot up a place just because they can.

--No police officer has the right to terrorize any US citizen,

It is much cheaper for a city to pay off the victim's families than go to court. It is also much cheaper to pay off the cops than to pay for all the national guard, firemen, and police support needed to suppress a riot over the course of a week or more.

So, 'convict' each cop, slap them on the wrist, keep them on the payroll or let them retire on a disability, give them name changes and re-location expenses, and carry on.

It ain't the right thing to do, but it gets these idiot cops off the streets, and is better than the usual practice of letting the cops off free and clear. Even with these charges, do you really expect to see any of these cops going to jail?

I'm tired of black men dying in police custody and I'm tired of family dogs being shot and I'm tired of no-knock swat teams accidently shooting and/or destroying property and harming innocent victims. This action (whatever the result ends up to be) is the first real step in forcing the police to rethink their culture of abuse towards the citizens they are payed to protect and serve. It is saying - that US citizens have had enough of the abuse at the hands of law enforcement and no matter what, the police are there to PROTECT all citizens - even the alleged perps. They are NOT cop, enforcer,  judge, and executioner. There are just too many incidents to default into a few bad apples framework. This is, unfortunately, a systemic issue - very much like pedophilia priests. It's NOT just a few bad apples/rare occasions when there are virtually hundreds (if not thousands) of innocent victims of negligence, assault, and murder (women, children, dogs, seniors, black men, etc...) by police across the country on a yearly basis.

1. Institutions, that when faced with serious problems, often default to the "few bad apples" paradigm and rarely, if ever,  acknowledge, let alone address systemic problems.

 

2. Children, like prisoners are not able to properly defend themselves and/or give informed consent. The abuse of power by authority figures - whether that of police or clergy is fundamentally the same.

I think some of these charges are a little over the top. Not because I think these cops shouldn't go to "pound you in the ass" prison but, because I think a jury will have a hard time convicting on overzealous charges.

This federal prosecutor is setting the bar to high and it will be difficult for the jurist to overcome and convict.

The number goal should be to make sure none of these cops collect a dime in pension money and make sure they do some real time, 2 years at least, for a felony conviction.

It seems to me the charges make the burden of proof to onerous for the jury.

I don't want to see these cops walk because the state was over zealous and should have charged these animals with felonies with a lower burden for the jury to convict but, still serious enough to guarantee a 2 or 3 year prison term before eligibility for parole.

My point is:

When they do "overcharge" the cops can end up walking away because the judge will instruct the jury in such a way to give them no choice but to acquit. I think Rodney King was an example.

I have been assaulted by police more than once for little reason so I know and I consider myself lucky my skull didn't crack open like a melon when my head was thrown to the sidewalk for exercising my right to remain silent. I know what it is like to be pummeled by police, arrested for no reason, spending the weekend in lock-up, arraigned only to have charges dropped because I never broke the law. That has cost me plenty of money defending myself against trumped up charges such as assualting a police officer which is a felony and will get you you a few years in prison if found guilty. I always had witnesses to back me up and charges were always dismissed. The police are liars and will kick your ass and falsely accuse you if you don't lick their boots.

I have no love for the police and I think it is chilling that these thugs are armed and their use of excessive force is routine. Police don't contribute anything valuable to society. They do the job because they are either sadist or can't find a real job. Police spend most of their time responding to car crashes, doing the bidding of insurance companies, basically.

I recall my wife getting t-boned by a student who ran a stop sign. I asked the policeman about the report number which was 0264. It was about 10 a.m. and he said this was the 264th accident since his shift began, his shift began at 12 a.m. So 264 accidents in 10 hours, each requiring a police response to fill out a report for hundreds of accidents where no crime was committed. He was actually a very rude pos to me even though I was coming to my wife's aid since I worked near where the accident occurred.

There were, at that time in 2010, more than 1000 sworn officers in a city with a metropolitan population of 211,000 people. They spend most of their time filling out accident reports and responding to the occasional 911 call.

That blew my mind!!! 264 car crashes in a small city in 10 hours! We have to pay salary, benefits, retirement etc. so these armed thugs can fill out accident reports for the benefit of insurance companies about incidents that aren't even crimes!!!!

I began to wonder what the police actually do and I surmised they don't do anything accept fill out police reports about auto accidents, most of their time, and then spending the rest of the time looking to victimize innocent people to take their frustration caused by them being merely elevated metermaids.

Everytime there is a reccesion the first thing the administration does is allocatye money to hire 100,000 more policeman. Happened in 2008-2009 crisis. First Obama did was hire more police.

I am going to the, annual, human rights festival in our town this weekend and this will be my talking point. I hope you all think about it and question whether our public safety funds are wisely spent so insurance companies can have accidents documented? Do we need an armed, militarized police force to fill out accident reports? Let's start questioning the value we recieve as a society by having an armed, militarized police force? And what do they do for all that money we spend in tax money?
