Birth Tourism: How 1000s Of Pregnant Chinese Women Visit The US To Give Birth (& Get A Passport)

Did you know there exists a highly lucrative business in America that consists of helping pregnant Chinese women get into the U.S. merely to give birth and get their children passports? Yep, neither did I.

Fiona He gave birth to her second child, a boy, on Jan. 24, 2015, at Pomona Valley Hospital in Southern California. The staff was friendly, the delivery uncomplicated, and the baby healthy. He, a citizen of China, left the hospital confident she had made the right decision to come to America to have her baby.

 

She’d arrived in November as a customer of USA Happy Baby, one of an increasing number of agencies that bring pregnant Chinese women to the States. Like most of them, Happy Baby is a deluxe service that ushers the women through the visa process and cares for them before and after delivery.

 

There are many reasons to have a baby in the U.S. The air is cleaner, the doctors generally are better, and pain medication is dispensed more readily. Couples can evade China’s one-child policy, because they don’t have to register the birth with local authorities. The main appeal of being a “birth tourist,” though, is that the newborn goes home with a U.S. passport. The 14th Amendment decrees that almost any child born on U.S. soil is automatically a citizen; the only exception is a child born to diplomats. He and her husband paid USA Happy Baby $50,000 to have an American son. If they had to, she says, they’d have paid more.

 

A week later, five men from Homeland Security Investigations, the sheriff’s department, and the fire department arrived. At first He thought they’d come from the homeowners’ association. Then she saw the bulletproof vests and handguns. They showed her a search warrant. She recognized the translator from the previous visit. “Then they asked me a lot of questions, and I became nervous,” she says.

 

The HSI agents told He she wasn’t in trouble. That turned out to be only sort of true. They were investigating the owners of USA Happy Baby—Dong and her husband, Michael Liu—for suspected tax evasion, money laundering, and visa fraud. Although it’s legal to travel to the U.S. to give birth, it’s illegal to lie about the purpose of a visit—or coach someone to do so. For two hours the agents gathered documents, including the family’s passports, and made copies of He’s e-mails and texts. “They took my son’s immunization record, even the paper I used to record his milk time,” she says.

 

Homeland Security and the IRS have been investigating the growing business of “birth tourism,” which operates in a legal gray area, since last June. The industry is totally unregulated and mostly hidden. Fiona’s apartment was one of more than 30 baby safe houses that HSI agents and local law enforcement searched in Southern California that day in March. They came with translators and paramedics, almost 300 people in all. The investigators focused on three agencies—USA Happy Baby, You Win USA Vacation Resort, and Star Baby Care—using a confidential informant, undercover operations, and surveillance, according to three affidavits.

 

No one knows the exact number of Chinese birth tourists or services catering to them. Online ads and accounts in the Chinese-language press suggest there could be hundreds, maybe thousands, of operators. A California association of these services called All American Mother Service Management Center claims 20,000 women from China gave birth in the U.S. in 2012 and about the same number in 2013. These figures are often cited by Chinese state media, but the center didn’t reply to a request for comment. The Center for Immigration Studies, an American organization that advocates limiting the scope of the 14th Amendment, estimates there could have been as many as 36,000 birth tourists from around the world in 2012.

 

The U.S. and Canada are the only developed countries that grant birthright citizenship. For those who believe U.S. immigration policies are too generous, birth tourism has become a contentious issue. “It’s like somebody giving birth in your living room and saying they’re part of your family,” says Ira Mehlman, the spokesman for the Federation for American Immigration Reform.

 

After the March raids, 29 Chinese mothers and relatives were designated material witnesses and ordered to stay in Southern California until the federal court decided they could leave. Fiona He moved from her apartment in Rancho Cucamonga to one in another part of the Inland Empire. “I want my children to have the best they can,” she says. “But I had no idea I would have this trouble. We didn’t hurt anyone. We just found an easy way to stay here to give birth. Is that wrong?

 

If a woman says she’s traveling to give birth, the consular and customs officers may request proof that she can pay for her hospital stay. (The same would be asked of anybody seeking medical treatment in the U.S.) “Keep every single one of your invoices as evidence that you didn’t use the public charge,” Zhai says, referring to Medicaid. “If you have receipts with big sums, such as a watch worth tens of thousands, or a diamond ring, save those too.”

The consular and customs officers “may” ask for proof?

There’s a lot of money to be made in laundering Chinese money into America, as well as in getting Chinese citizens a green card or residency.

I can't really get worked up about this. If they want to come here and pay cash to have a baby here, knock yourself out. I still don't think having a baby here should grant that baby citizenship, but whatever. At least they don't hope the fence, show up at a hospital to give birth, and then get the government to pay for it along with many other welfare programs. It very well may bite them in the ass later, though. These people are obviously wealthy to afford this, and I have no idea Chinese inheritance works, but whatever these babies get from their parents or grandparents, Uncle Sam is going to demand half of it, regardless of what the Chinese govt takes, even if they never set foot in the US again.

If things really got out of hand, they could easily change the law so that recipients of these passport loophole prove that they didn't do birth tourist, or that they lived in the USA for x and x amount of years. If they didn't live in the US At that point they can either give up their passport or pay some crazy head tax.

They don't need to change the rules. As a China resident Chinese domicile they are taxed on their worldwide income as residents in China. Having a green card also means they are regarded by the US as being US domiciled also, so they pay taxes in both countries either as residents or not.

Of all the passports you can buy, who the fuck wants a US passport?

Most Asians still consider this the GOLDEN MOUNTAIN .. its here for the taking .. even Vietnamese want to come here . but more difficult to come from Vietnam than from China .. and most of it is about STUFF .. Asians have an pov that America is still the land of opportunity and wealth .. even though I see less police presence and see more freedom in Vietnam at this point .. then in the US .. there is corruption in Nam but probably no more so than in the USSA. Bringing the third world here .. we will end up Brazil at some point . if we are lucky. I have friends who have moved to Chile .. wiht their own set of problems but the friends still prefer that to what they find here.. friends who live in Vietnam most of the year .. simply becuase it is cheap and they feel welcome . you can live fairly well for less than 2K per month.

One of the problems with that is they drive housing in these areas through the roof, putting it out of reach for a lot of locals. They don't care what it costs since their primary concern is having a hard asset out of reach of the Chinese govt. The funny thing is, I think they may not understand how shit works in 'the land of the free'. Desperate governments do things like confiscate the assets of foreigners. And they seem to be REALLY misunderstanding just how 'property rights' work in this country when the govt wants something of yours.

True. Happening here in San Diego. Three homes near a friend of mine sold for $700k+ in three days! Cash. It's a high demand area because it's fully built out but this is nuts. Local average wage is under 50k here. Even with some creative financing Joe average here would be hard pressed to get one of these homes.

My favorite pregnant Chinese woman had already been naturalized (and married) by the time she got pregnant. 33 wonderful years and counting, plus I get to eat authentic Chinese fairly often. I just wish she'd quit bugging me about learning Mandarin. I already 'speak' a dozen or more other languages, but she says it's not the same, since only computers and other programmers understand those languages.

I don't mind the Chinese moving into my area. They pay cash, take care of their lawns, are quiet, drive nice cars [all one color and it's not purple] and they are fairly friendly and don't sit on their front porch at night drinking beer 'wit da boyz.'

I live 1 block away from a birth tourisim apartment complex in the San Gabriel Valley (Basically AsianTown USA) of Los Angeles County.  They "raided" the Pheasant Ridge apartments in Rowland Heights a couple months back, but if all the papers are legit there's little law enforcement can do.  I see pot bellied Chinese ladies walking up and down my block all day.  I grew up in this area and the Regan Amnesty really has taken the "American" out of this area.  Tons of businesses with Chinese owners and Mexican workers.  English as a third language LOL!

Laws.

A law (along with its enforcement) has zero bearing on the law being right or wrong or ethical or moral, its just a law. Hitler & Stalin had many MANY laws, it didn't make their laws right or just.

There is no other way to uncomplicate the non-complexity in the explanation of law or its enforcement, it can be quite tyrannical but its still "the law".

Even most Asian Americans(I happen to be Mixed, consider myself Asian, since I'm from there - even though there are Moronic Negro Cults who've been trying to get me locked in with them somehow) are starting to get annoyed by them.

Some retard(s) has(have) even tried make the harassment into some sort of PhD Study (I hear, may be sponsors/participants may include Staff/Board/Alumni of USC, Loyola, Mt St Mary's, Pepperdine, UCSD(someone published some defamatory study years ago), UC Irvine, Soka University, Biola, Fuller Theological Seminary, Grambling, Howard, Georgetown, Univ of Phoenix, ITT, CS Long Beach, CS Dominguez Hills, and CS North Ridge).

So when I get any type of medical service, the very first I get asked is for my medical insurance coverage. Sometimes it is even before "How are you?".

I would like to hear/observe the conversation when one of these Chinese ladies goes to a hospital for the birth and she is asked about her insurance coverage. I will take a wild stab in the dark and guess the Chinese women don't have  medical insurance coverage.

Let me explain something to you.

Thousands of times everyday an illegal goes to a hospital ER in Cali. The first question is " Do you have insurance." ( actually the ER clerk has checked no on the box so this is a formality) Then the next question is "we request a $10 copay" which is denied. They are then escorted to their bed and I get to see their family with a roll of bills paying for food in the cafeteria.

It's a racket which has been going on for a long time. Sad thing is it gets to a point where they think they deserve it so taking it away will get ugly. Not that I mind but some get a little squeamish when contemplating the possibilities.

I am married to a Vietnamese .. her aunt lives in CA... gets most things paid for by state ... drives a nice car .. gets free hospital and wondering how come it cost us 30K or thereabout for birth of our son .. sucks to be a tax paying citizen anyway you look at it. One onsoloation . its ot going on much longer . watch the rats leave the shop at that point .. her aunt is considered rich in Vietnam and spends her 'savings' from not having to pay for a lot of stuff on gifts for the relatives. As I said this system is not sustainable .. tick tock .. tick tock.

Let me trade some inside information. 

I lived with a woman from China and she filled me in.

The Chinese people despise the Americans as they are portrayed on TV.  When asked about Canadians, she said "same thing".  The rich kids on the block aren't so rich any longer.  This is how they think after decades of envry.  -   We've been living well for long enough, they think, and are undeserving of our lavish lifestyles, fat, gluttinous, lazy, unattractively bloated from steroid-injected food supply, feminized by the estrogen in the water supply, whiny brats.  And they know their govt has covered the bill for Americans to live well despite the fraud, the neverending wars, the unfairness is what they see.

One child policy in the middle class has led to Little Emperors and when they begin running the show in America, you may change your mind.  If they do hire you, it will be as a slave in lieu of money owed, that is, if you can work 15 hours a day without complaint.

SBA loans work the same way .. minority SBA loans were meant primarily to help American blacks set up small business instead most of them loans go to immigrants .. in one study I read .. out of 45 small business loans on 3 went to American blacks.. the rest went to new arrivals from ME or PAK etc. THey figured out how to pass these loans onto the next set of relatives who come over .. you can buy a green card.. you can 'invest' in a business they say 150K but its usually a lot less and be a p[remanent resident .. we need real reform but too late .. we are toast .. so enjoy the ride while you can . cause the USS Titanic is going down with most of the passengers . a third saved in one sort of life boat or another.

This is how the courts and slimy politicians have bastardized the vague and poorly written 14th Amendment to allow the invasion of the US by foreigners. Specifically they have bastardized "and subject to the jurisdiction of the US" to mean simply "subject to US law", when it really means "subject to the jurisdiction of the US and no other foreign country", like the explicit words of the Civil Rights Act 1866 say, and which the 14th Amendment is modeled after, and which is still part of US statute.

Here's what is says:

"That all persons born in the United States and not subject to any foreign power, excluding Indians not taxed, are hereby declared to be citizens of the United States; and such citizens, of every race and color, without regard to any previous condition of slavery or involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall have the same right, in every State and Territory in the United States, to make and enforce contracts, to sue, be parties, and give evidence, to inherit, purchase, lease, sell, hold, and convey real and personal property, and to full and equal benefit of all laws and proceedings for the security of person and property, as is enjoyed by white citizens, and shall be subject to like punishment, pains, and penalties, and to none other, any law, statute, ordinance, regulation, or custom, to the contrary notwithstanding."

It is hard to find that text because it exposes the lie.

 

That law was made into an Amendment in order to make it more forceful in effect on states who may have tried to disregard the Civil Rights Act 1866, so as to protect the newly freed slaves. It is well held in SCOTUS jurisprudence that the 14th Amendment did not "change" the Constitution, it merely reinforced the Bill of Rights for the benefit of newly freed slaves (See Fitzgerald v. Green among others).

In fact In Revised Statutes 1872, a massive review of US statutes and the Constitution, a "citizen" is defined as "one subject to the jurisdiction of the US, and no other foreign country."

To get around these inconvenient FACTS, the GAO and 7FAM simply lie, and leave out the "and no other foreign country", when describing either the CRA 1866 or the 14A (go ahead, look it up-- they even go so far as to edit it out of the debates on the 14A as written in the Congressional Globe) when even at the same time say that citizenship is based on "jus sanguines" (blood), and even as the Constitution's Preamble says that the rights of citizenship are passed to our "progeny" (children).

To say otherwise is basically kidnapping, and creates all sorts of ills, such as this "birth tourism" and situations where the parents are illegal and the kids are US Citizens. But all of Congress, including the controlled opposition of Sens. Paul are cowards. They have accepted the understanding of the 14th Amendment that anyone born here is a US Citizen, leading to foreign invasion, as have the courts--- and it is all a lie.

The understanding of the case of Wong Kim Ark (169 US 649 (1898)) is a lie also. It did not say that anyone born in the US is a citizen, it held that anyone born in the US of legal resident aliens is a citizen precisely because the legal residence of the parents, and their allegiance during the time of that legal residence, makes their children "subject to the jurisdiction of the US" and citizens, within the meaning of the 14th Amendment, if born here:

"The amendment, in clear words and in manifest intent, includes the children born within the territory of the United States of all other persons, of whatever race or color, domiciled within the United States. Every citizen or subject of another country, while domiciled here, is within the allegiance and the protection, and consequently subject to the jurisdiction, of the United States. His allegiance to the United States is direct and immediate, and, although but local and temporary, continuing only so long as he remains within our territory, is yet, in the words of Lord Coke in Calvin's Case, 7 Coke, 6a, 'strong enough to make a natural subject, for, if he hath issue here, that issue is a natural-born subject'; and his child, as said by Mr. Binney in his essay before quoted, 'If born in the country, is as much a citizen as the natural-born child of a citizen, and by operation of the same principle.'"

Wong Kim Ark, 169 US 649 @ 693

That is the direct holding of the case. Anything else said about simple birth equals citizenship is a lie.

Let me clarify a few things about FATCA.

As per IRS code, you can make up to 90k a year tax free working overseas.  (not for US govt jobs).

I started working overseas in 1989.  After 330 consecutive days outside of the country, you can apply for ''bonafide overseas resident'' status from the IRS.

I qualified for that in 1991.   

Since that time I have never lived or worked in the USA and last year officially renounced but NOT because of taxes.  

I have another nationality now. and US govt can't do fuck all about it.

Probably more to do with the tax situation. Acquiring US citizenship doesn't require you to give up the Uk passport and you retain health benefits, but it does require you to file taxes every year even after you head back home. I'm guessing the chinese mothers aren't aware that they're imposing the same bs on their kids. Another reason they have kids offshore is to allow them to circumvent the one child policy.

But this is entirely USA's fault.  Why do they have such stupid citizenship laws in this day and age?  This can easily be remedied by making citizenship available by birth to ONLY the following:

1.  If either or both parents are a citizen

2. If either or both parents are a permanent resident

3. If either or both parents have a long-term residency/right to work, such as refugee, employment visa, etc. and is resident for more than 5 years.

 

The below should NOT quailty:

1. If the parent(s) is on a tourist visa

2. If the parent(s) is holdilng a temporary work visa with a stay of less than 5 years. 

3. If the parent(s) is on a student visa

4. If the parent(s) is an illegal alien

But we all know this will not happen. The pwoers that be need more low wage workers and more members of the "correct" political party to keep this scam party going.
