The TSA Is a Complete Waste of Time
Today, we continue our series “The Good, the Bad and the Ugly.” As you’ll recall, our premise is that in a world where everyone is a lawbreaker, it’s hard to spot the real criminals.
Below, we turn to the bad …
Last week came a report proving that the TSA has been wasting our time and shamelessly bullying us all for years. There was always a surreal and even cruel quality to airport security checks.
We recall how we stood in line, as the TSA agents forced a frail, old lady, well into her 90s, to get up from her wheelchair… painfully shuffle into the body scanner… stand with her hands over her head… and totter out the other side.

What you can obviously not see above is that the man undergoing the scan is actually concealing a gun. In fact, one can get “anything” through these scanners undetected.

She could barely stand… but the scan proved inconclusive. We looked on in disbelief as the TSA agent forced her to repeat the exercise. Did anyone believe the frail woman posed a threat to airline safety? The TSA agents? The people lined up, waiting to go through the same routine? Of course not…
But no one objected – not even her son, your editor. We have all been trained to keep our mouths shut, even when we are subjected to senseless inconveniences and indignities. To what end?
A study done by the TSA found travelers were easily able to smuggle mock weapons and fake explosives past the screeners. In 67 out of 70 cases, TSA agents missed the banned items and let the passenger go by. If they had been real terrorists, Washington might be a smoking ruin by now. Two questions arise: Why bother? And why haven’t there been more terrorist attacks?
Scaring, Bullying, and Stealing
The first is easily answered: The security checks could be stopped immediately with no appreciable loss in real safety. The second question is easily answered, too: There aren’t any terrorists. Or there are so few, it is not worth worrying about them.
Yes, the Department of Homeland Security is just an excuse to scare people, boss them around, and take their money. Wait, you might say… If we send the TSA packing, terrorists may take it as a green light to go on the offense. But what difference would it make?
Nine out of ten of them would glide through the checkpoints anyway. Also in the news is the Export-Import Bank. It helps American companies sell their products overseas by financing and subsidizing the purchases for foreign buyers.
This costs U.S. taxpayers money – about $2 billion over the next 10 years. But it boosts the profits of the companies involved. It is nothing but legalized larceny. It takes money from some people against their will and gives it to others. Most favored is Boeing.
A small group in Congress has been trying to get rid of the Export-Import Bank for decades. But it is an uphill battle. Naturally, the cronies want to keep this zombie institution alive. And the U.S. Chamber of Commerce – a nest of cronyism – has launched a $1-million campaign to save it.
The Chamber of Commerce had an ad campaign a few years ago called “Save Free Enterprise.” But who wants to save free enterprise? Not the Chamber of Commerce – it wants to save free money, not free enterprise.

When the Crooks Are the Cops
Here’s another candidate for the “bad” category: DEA agents and local police deserve a good whack with a hard stick. Thanks to the Department of Justice’s “civil asset forfeiture” program, they’ve been helping themselves to other people’s money by pretending the money has done something wrong.
Normally, a civil – as opposed to a criminal – procedure involves a dispute between two private citizens. But in the case of civil asset forfeiture, the dispute is between the cops and a thing – cash … gold … a house … or a nice new yacht – they suspect has been involved in a crime.
No due process is needed. The owners of the disputed items are guilty until proven innocent. Often, of course, the supposedly “ill-gotten gains” are not ill-gotten at all – until the cops get their hands on them. All over the country – and in Canada, too – police are turning into crooks… taking money that doesn’t belong to them.
In one recent instance, a young man called Joseph Rivers was taking the train from Detroit to California, hoping to start a new music video company. He took with him his life savings – $16,000, in cash.
But the lucre was just too filthy for the DEA to resist. After boarding Rivers’ train at the Albuquerque Amtrak station, searching its passengers, and discovering the cash in his bag, they simply took it from him.
The Washington Post covered the story:
“The agents found nothing in Rivers’ belongings that indicated that he was involved with the drug trade: no drugs, no guns. They didn’t arrest him or charge him with a crime. But they took his cash anyway, every last cent, under the authority of the Justice Department’s civil asset forfeiture program.”
Joseph Rivers had his life saving confiscated on a train, as far as we could ascertain mainly for the crime of being black and because the opportunity presented itself. That the people doing the confiscating work for something called “the department of justice” is more proof that we have well and truly arrived in Orwell’s dystopia.

Guilty Until Proven Innocent
Once the cops have seized your property, the burden of proof falls on you to get it back – even if the cops never charge you with a crime. “We don’t have to prove that the person is guilty,” an Albuquerque DEA agent told the Washington Post.
In another case, a couple had $118,000 seized from their bank account. Their crime? None. They were merely the targets of money-hungry agents from the U.S. Secret Service because their small business required them to make many cash transactions.
The agents took the money under the civil asset forfeiture rules, which empower government employees to take first and ask questions later. The couple spent years battling to get their money back. By the time the courts finally ordered the feds to hand back the cash, the couple had spent $25,000 on lawyers – money the feds refused to reimburse.
Want more bad guys? The woods are full of them. How about the bums at the Federal Reserve? How about the entire “security” industry? How about the zombies on the government dole? How about the drug industry? Or take Congress… Please.

I'll call the cops to come write the report of some dude breaking into my house and being shot if they insist on documenting that.
I'm all for the concept of having a police force. Right now though, with the exception of small town forces, you have folks that show up to write a report 60 minutes after being called AND if they do happen to stumble across a crime in progress they proceed to shoot first and maybe ask questions later.

Like "actual info" matters to much of the crowd here? I was a cop for over 30 years and personally know literally hundreds of cops. Were there bad eggs? Sure. just like there are bad priests, teachers and ZHers. The problem is there are about 800,000 law enforcement officers in the US. Be generous to me and say 5% are dickheads. That's still 40,000 bad cops which is horrific. So paint with a broad brush about all bad cops and mindless programmed robots. Most people on here have had no actual experience on which to base a valid opinion. I've got a graduate degree and spent my career in the trenches, trying to make the institution of law enforcement better. When I read on here the anti-cop diatribes it used to make me mad. Now I find it more funny. ZHers who can't wait for a cop article to come up so they can blast all 800,000 are the mindless uninformed robots, not the overwhelming majority of ethical men and women who are protecting us.
Free individuals have a right to chose their own security services. It's not the need for protection that's at issue, it's the fact that the state imposes a set of laws and a security apparatus upon supposedly free people. Like any other "solution" proposed from the top down this is an unworkable system. The people who receive the "service" don't have the ability to freely change providers when they are dissatisfied with that service. So there is little motivation for the police to improve their services from the consumer's point of view.
Consider this. Pizza is good and sometimes it's really good. That's because we still have a free market in pizza. The guy who makes crappy pies goes out of business while the guy who makes good pies increases his sales. Imagine what the state of pizza would be if we all had to pitch into a government pizza fund and we all received something resembling a pizza at intervals convenient to the bureaucrats operating the system. That would kill the utility of pizza because those who pay for the pizza have no say in what they get or when then get it. The very simple market mechanism of "that which is good sells while that which is bad does not" no longer applies. That would be a tragedy in the realm of pizzas but the concept is that much more importantly applied to security services as the safety of one's family is paramount.
Thing is, if you're as good of a security expert as you claim to be you'd likely profit greatly from working in a free market security service as opposed to a compulsory service. The rewards for both you and those you serve could be immense.
Here's an example of free market cops. It works:

“Unlike the police, we don’t respond after a crime has been committed to conduct an investigation and – some of the time, at least – arrest a suspect,” Brown elaborates. “Our approach is based on deterrence and prevention. Where prevention fails, our personnel are trained in a variety of skills – both psychological and physical – to dominate aggressors without killing them.”

The fact that would-be terrorist assumed the scanners COULD detect weapons was probably a good enough deterrent; but obviously now the cat is out of the bag... we will see a lot more terrorist attacks. Even fake security cameras work as a theft deterrant so long as the thieves think the cameras are real.

I don't understand why people would hire lawyers to get their money back. All the lawyers usually do is write letters and fill in forms. You used to have to go to the library to figure that out, but now it is all online. I doubt it takes more than an hour to figure it out. I know lawyers have to make a living too, but I stopped using them about 25 years ago when I discovered I could do everything myself, and in many cases better than a lawyer.

Legal documents that don't involve you being the party in a court case is one thing. If you're actually going to have to argue in front of a judge, it's quite another. Now, you're dealing with having to know these:

And if the DEA takes your cash, you will have to go to court to get your cash back. Not following the above rules is a big reason why it's often a bad idea for people to do things pro se. If you can follow the rules, whether or not the court will respect a polished pro se litigant depends on what court you are in. I'm lucky where I am. Some people in other areas could go in, make a sound legal argument and lose whereas an attorney could have made the exact same argument and won because the court is bias. If you aren't willing to learn those rules, or if you live in a biased district, you will find that there are reasons to hire an attorney.
So if you have played the game according to their rules, they'll let you win every once in a while. As long as a cops isn't on the other side. What a racket.

If cops can legally confiscate money without proof of crime, then blame Washington and blame yourself for voting for these cocksuckers.

AGAIN.... laws provide THE FRAMEWORK FOR THE EXECUTIVE SCOPE. The laws were made to fight drug crime. The leeway given for police was much too large and infringed on constitutional rights. This is what you get when politicians fuck up. But maybe having studied constitutional and administrative law as minors, helps to understand this better. Though I presumed it quite straightforward.

Not only was Joseph Rivers the only person in his train car questioned by DEA, but he was the only black guy as well. Of course he made the classic mistake of engaging in conversation with the agent rather than stating that he did not wish to engage in conversation and that he did not consent to a search. Live and learn....
According to agents if Rivers would have refused they would have confiscated the bags and then get a warrant to search them. Once he was targeted there was no way he would escape the clutches of the DEA.
Start reading case law. Look for cases where qualified immunity is denied in your circuit. In such an encounter, stream video, and use the knowledge you have gained from reading the case law to start setting the LEO up for either a 42 USC S 1983 lawsuit (for locals,) or for a Bivens Action (for feds.) It's what I did at my last traffic stop when the cop was really getting ready to start digging through my shit, and it worked. Never consent to a search, and if they are doing the whole "you're acting suspicious," ask what crime they suspect you of having committed. When they inevitably say "you're acting suspicious" several more times, ask if you're being detained. Now, if they say yes, they actually have to be able to articulate specific facts that, when taken together would lead a reasonable person to believe that a crime is being or is about to be committed - i.e. they have to be able to mention what crime. If they think that they might be on video, you need to be very firm but polite about what crime they syspect you of. If they pull something trivial out of their asses, you might be able to sue them, but it's doubtful that it would amount to much. If not, collect $15,000 and proceed directly to go. If they start beating on your ass, and you survive, it's the jackpot.

In an encounter between the police and myself, there is one huge difference between myself and most people who don't understand the legal system. I am not thinking about "OMG, I'm going to get arrested and spend the night in jail," I'm thinking about the admissibility of evidence and qualified immunity. Why? You only have rights if you force others to respect them. If I use physical force, I'm going to have 50 cops literally gunning for me the way things are today, but if I threaten to take part of their paycheck, they're going to leave me alone.

And if you decide those differences are VERY significant, consider working on the campaign of whichever candidate you end up feeling is more likely to protect your interests.
