Guest Post: America's Obamacare Nightmare Is Just Beginning

Tyler Durden's picture

Submitted by Robert E Moffit via TheNationalInterest.org,

This week the U.S. Supreme Court ruled that the federal government could continue to subsidize health-insurance coverage through Healthcare.gov, the federal exchanges. An ecstatic President Obama declared that Obamacare is “here to stay.”

No, it’s not.

A judicial victory doesn’t automatically translate into a political victory, let alone a policy success. Once they’ve quaffed their celebratory champagne, the president and White House staff will need to suit up and get ready to play some hard-nosed defense.

Here’s why. The driving force behind health reform has been the desire to control rising health-care costs. From 2008 onwards, President Obama promised that his reform agenda would reduce the annual cost for the typical American family by no less than $2,500. After a while, it became a rather tiresome talking point. But it was pure nonsense from the start.

Health-care spending increases were slowing down well before Congress enacted Obamacare. But with the onset of Obamacare, health-insurance premiums in the exchanges jumped by double digits, while deductibles increased dramatically. If you liked your doctor, you would be able to keep you doctor, the president insisted, but maybe not, in reality, depending upon whether or not your physician networks narrowed. Looking toward 2016, health insurers say premium costs will soar.

In the days, weeks and months leading up to the King v. Burwell decision, commentators obsessed over the roughly 6.4 million persons who could lose health-insurance subsidies. With the Court’s ruling, they can keep the federal subsidies. But that doesn’t come close to ending the debate.

Roughly 6.4 million persons in thirty-four states could have been negatively affected if the Court struck down the federal exchange subsidies. But there is a much wider universe of persons adversely affected by the law: the roughly 15 million persons in the individual and small group market who don’t get—and won’t get—the federal government’s health-insurance subsidies. Under Obamacare, millions of Americans are forced to pay more for their government standardized coverage, regardless of whether they like it or not, whether they want it or not, or whether or not it forces them to pay for medical procedures that violate their ethical, moral or religious convictions.

So, the debate will intensify over the primary issue: costs. In every state, the fundamental components of state health-care costs—the demographics, the underlying costs of care delivery and the competitiveness of the markets—are juiced up by expensive federal benefit mandates and individual and group insurance rules and regulations. These all drive costs skyward. As my Heritage colleagues have demonstrated, this regulatory regime forces young people to pay up to 44 percent more in premiums. Washington’s subsidies simply try to hide the true costs of the law; they don’t control them.

The law remains unworkable. The complicated insurance subsidy program itself has been a mess. H&R Block reported that about two thirds of subsidy recipients had to repay money back to the government because they got bigger than allowable subsidies. With the individual mandate, the administration has been granting lots of exemptions to insulate most of the uninsured from any penalty. That’s rather predictable; after all, even candidate Barack Obama argued that an individual mandate was unfair and unenforceable.

As for the employer mandate—another fractured cornerstone of Obamacare—the administration has delayed it for one year. Even liberal supporters now want to repeal it, fearing damage to the labor markets.

And what about those big “savings” from the Medicare payment reductions? They were earmarked to help cover the costs of the insurance subsidies. Yet the Medicare Actuary and the CBO have both routinely dismissed the massive Medicare payment cuts as either unrealistic or unsustainable.

Meanwhile, other problems mount. The state exchanges are financially troubled. Coverage is still insecure, especially when loss of employment is tantamount to a loss of a health plan. Bureaucracy, red tape and paperwork plague the system, increasing costs and frustrating doctors and patients alike. All of those problems are getting worse, not better.

This is the second time in two years that President Obama has declared the debate over Obamacare to be “over.” Here’s a better prediction: America is entering into the next phase of an equally contentious but broadly educational debate over the direction of the nation’s health-care future.

In a free society, debate is over only when the people decide it’s over.

Biggest scam ever.

You either pay the fine or sign up.  So the government or insurance company get revenues.

If you sign up, in most cases, nobody (like in CA with CoveredCalifornia) takes the insurance meaning that the insurance company collects the premium without any payment liability because nobody claims on the insurance because no doctors or hospital take it because payments and paperwork are .... you get the picture.

Corporatocracy (like in Cloud Atlas, Mitchell describes it beautifully) in action.

Secular versions are concierge care, or direct care (same diff) - then make sure you don't get a federal tax refund, because you can still tell the IRS to fuck off when they send you angry letters demanding the payment of your "tax" / fine, for non coverage.

Well, thank God we don't live in a free society or that might be a problem for Obamacare.

Name me one government entitlement program that was ever eliminated due to it being an utter failure and complete fiasco.  One.

Let me rephrase the question.  Name me one government entitlement program that was ever eliminated.

Its not an entitlement program; you are actually forced into paying for it.  Even poor people.  Only the bottom quintile of the income spectrum actually gets an "entitlement" at no cost.  And they also still pay taxes (sales, income, etc).  And have wages garnished to pay for medical debts not relating to what the "affordable act act" covers.

It's an assualt on every American's already strapped wallet.  What happens when premiums surpass300-400-even 500 dollars?

It would make most USA USA workers, citizens PUKE. I tell you puke as a chronic condition IF they actually saw what other parts of the world set aside in budgets for health care.  Some places it is free.  Some places it is minimal and free for those that cannot afford....

But no.  USA has to bring in a mandated system that narrows the field of insurance providers. Makes it illegal not to subscribe to outrageous premiums and totally over the moon health costs.

Then they do the double dance. The Obama polka.  And bring in TPP so profits of drug firms as enshrined.  Let's all do the vaccine dance.

It's just like everything else. Everybody's health, sick or not, is a commodity that will be financialized every which way but loose; rife with blatant and unpunished scandal and fraud. How this "system" performs has nothing to do with getting healthy or being affordable. The bottom line is profit for a handful of sleazebags, that's all that matters.

Making this a "law" is absolutely sinister.

The 1965 Immigration Act killed America, the people had no idea.

Obamacare is yet ANOTHER wealth transfer from US, the White populace, to the people of color. At the same time .gov is, effectively, killing off the Golden Goose, i.e. White America. I tell you there is a METHOD to their MADNESS.

Jeff Sessions a real American...

Sessions On SCOTUS Obamacare Ruling: ‘Should Dispel For Good The Illusion We Can Rely On Judges To Save Us’

WASHINGTON—U.S. Sen. Jeff Sessions (R-AL) issued the following statement today after the Supreme Court acted again to rescue the unconstitutional Obamacare law and the illegal executive actions stemming from it:

“The Supreme Court’s Obamacare acrobatics should dispel for good the comforting illusion that we can rely on judges to save us. Whether on socialized medicine, executive amnesty, or any other action which erodes our Constitution and the authority of Congress, conservatives will have to rally the everyday voting citizen. There is no greater power than winning the trust and loyalty of the American people. We will need to put down the donor agenda, pick up the banner of the American worker, and carry it to victory.”

It's only OUR $$$ that .gov rips from our blood:

Attorney General Loretta Lynch announced .gov will “fast track” $29 million to victim families of the June 17 shooting at the Emmanuel African Methodist Episcopal Church in Charleston South Carolina, Reuters reports. This amounts to over $3.2 million per family.

That comment by LBJ is one of the few truthful statements that have ever been spoken by a US politician in the last 75 years.

This guy was pretty wise too.

The British newspaper The Times of 27 August 1859 printed a letter about the use of the ballot for voting in the United States, written by Richard Henry Dana, Jr. to his friendLord Radstock. In the letter, Dana reports:[3]

Our experience has shown us that in the excitement of great popular elections, deciding the policy of the country, and its vast patronage, frauds will be committed, if a chance is given for them. If these frauds are allowed, the result is not only that the popular will may be defeated, and the result falsified, but that the worst side will prevail. The side which has the greater number of dishonest men will poll the most votes. The war cry, "Vote early and vote often!" and the familiar problem, "how to cast the greatest number of votes with the smallest number of voters", indicate the direction in which the dangers lie.

Know someone who went to the doctor for stomach issues. Had surgery for the same thing a few years ago.

The Dr. told him a second surgery wouldn't do much, and would leave himself open to a malpractice lawsuit. Told the guy to go home and fix it with diet and fiber.

Ever heard the words 'malpractice lawsuit' leave a doctor's mouth in front of a patient? Strange days.

You'll also never hear a physician prescribe homeopathic or herbal remedies for a specific ailment or condition. They are all bound by strict AMA guidelines that require the physician to adhere to specific pharmacological regimens, physical therapy, or surgical intervention.

Any deviation from these guidelines can result in disciplinary action, up to and including revocation of the license to practice medicine.

If any news agency in USA had the balls they would publish a comparative health premium/benefit survey of "leading industrial G7 or G20 nations".

USA USA should take look at France, UK, Canada, Sweden, Norway, Denmark, Germany...on and on.  Places where a suture in an emergency ward does not put someone in bankruptcy.

Take a look at nations where healthcare of the taxpayers has been a priority.  Because it makes sense to keep your sheep alive.  Places where being a doctor is not the fast track to millionaire.

Countries that,  If my kid is ill I take them to the Emergency.  Period.  And do not have to take out a second mortgage to pay for 4 stitches and a bandaid.

Ofoolacare?  With premiums so high WTF?  Nobody can afford it now anymore than they could in the past.  I think you kids down south of 49th are seriously deluded.

Husband doesn't get health insurance. She was paying $500 a month last year. This year it's $1,200 a month, with a $10,000 deductible.

She's been told it's going to $1,800 a month, and a higher decuctible. This doesn't reflect the 50% increases the insurance companies want next year. Plus, business is down the toilet and the boss is stiffing her on her commissions.

They're about to lose the house.

Even though the government gouges our eyes out to pay for these programs they often do not pay the company providing the service for varying reasons.  Apparently, this commonly happens with state funded childcare as well.  I knew a woman who ran a daycare who could no longer afford to take state pay for that reason.  It doesn't seem to matter if it's a state or the feds, they are probably stealing the money at an increasing rate.

Expect big mergers in Healthcare as the goal is a "Single Payer System" or total monopoly administered by private company that pays politicians to serve them....fascist Healthcare.  In the end, supply of doctors and hospitals and other entities in the medical supply chain will become so bureaucratic that it becomes 3rd world healthcare with luxury pricing.  Obesity will be the next premium target; first it was smokers...no one spoke up because smoking has been demonized, but notice your Primary Care Physician is notating your BMI (Body Mass Index) on you and your children and these go into a Federal database and in the future all who are considered obese will pay more.

Maybe it went down something like this as the machines largely run the ACA which most can't bring themselves to see, so here's "Scalia".  "I'm not messing with those ACA machines, what do you think you guys are going to do about it?" and thus so the ACA survived.  This was no question to begin with of course as stopping subsidies would have literally caused an algorithm explosion with the the Quants that work at insurance companies to quickly devise new policy models, so in essence they didn't want an algo battle either:)

My employer provided family plan is:

65:35 split cost total monthly premium of $5000

Yes that is $60k a year to cover a family. My out of pocket would be $1700 per month.

Plan details:

HMO select plan. Zero out of network coverage. No Minute Clinic coverage. No urgent care coverage outside the single hospital network.

$6500 deductible

$100k yearly max coverage/ $3 million lifetime

$15/$30/$90 prescription drugs online ordering only

$30/$50/not covered bought in Pharmacy

$35 copay

My employer doesn't have to worry about paying $40k for each employee because nobody can afford this plan. Through the exchange a similar plan is $1900 a month and I would have to bear the entire cost and I don't qualify for subsidies. Last year including insurance company payments to health providers my family spent a total of $1100 on care and prescription drugs.

So I don't have health insurance for my family and I have to pay a penalty to the IRS and my state because my state requires coverage. So I am fucked.

Sorry but I'm not interested in overpaying $59000 for insurance.

I have Medishare and so far they've been great.  My premiums are only $160/mo. They pay 100% after you meet your deductible, even if you are out of country. I chose a high deductible to get the lowest monthly rate. But even a deductible of only $500 would have increased the rate to about $280/mo.
