Supreme Court Legalizes Gay Marriage Nationwide In 5:4 Decision
Following yesterday's historic 6:3 Supreme Court decision enshrining the tax known as Obamacare, there was little surprise moments ago when in one of its last remaining decisions in re: Obergefell v. Hodges, the most liberal Supreme Court since 1960 just declared gay marriage legal nationwide. The decision, supported by all the women on the SCOTUS, came down in a 5:4 vote with Ginsburg, Sotomayor, Kagan, Breyer and Kenedy voting for, while Roberts, Scalia, Thomas and Alito dissented.
As always, the most interesting contents are in the dissent, which today was, ironically, written by Roberts who in the past 48 hours has made many friends and maybe even more enemies. Some of the key remarks:
... this Court is not a legislature. Whether same-sex marriage is a good idea should be of no concern to us. Under the Constitution, judges have power to say what the law is, not what it should be. The people who ratified the Constitution authorized courts to exercise “neither force nor will but merely judgment.”
Although the policy arguments for extending marriage to same-sex couples may be compelling, the legal arguments for requiring such an extension are not. The fundamental right to marry does not include a right to make a State change its definition of marriage. And a State’s decision to maintain the meaning of marriage that has persisted in every culture throughout human history can hardly be called irrational. In short, our Constitution does not enact any one theory of marriage. The people of a State are free to expand marriage to include same-sex couples, or to retain the historic definition.
Today, however, the Court takes the extraordinary step of ordering every State to license and recognize same-sex marriage. Many people will rejoice at this decision, and I begrudge none their celebration. But for those who believe in a government of laws, not of men, the majority’s approach is deeply disheartening. Supporters of same-sex marriage have achieved considerable success persuading their fellow citizens—through the democratic process—to adopt their view. That ends today. Five lawyers have closed the debate and enacted their own vision of marriage as a matter of constitutional law. Stealing this issue from the people will for many cast a cloud over same-sex marriage, making a dramatic social change that much more difficult to accept.
The majority’s decision is an act of will, not legal judgment. The right it announces has no basis in the Constitution or this Court’s precedent. The majority expressly disclaims judicial “caution” and omits even a pretense of humility, openly relying on its desire to remake society according to its own “new insight” into the “nature of injustice.” As a result, the Court invalidates the marriage laws of more than half the States and orders the transformation of a social institution that has formed the basis of human society for millennia, for the Kalahari Bushmen and the Han Chinese, the Carthaginians and the Aztecs. Just who do we think we are?
Understand well what this dissent is about: It is not about whether, in my judgment, the institution of marriage should be changed to include same-sex couples. It is instead about whether, in our democratic republic, that decision should rest with the people acting through their elected representatives, or with five lawyers who happen to hold commissions authorizing them to resolve legaldisputes according to law. The Constitution leaves no doubt about the answer.

Under our Constitution, the court cannot write a law, even though some cowardly politicians will wave the white flag and accept it without realizing that they are failing their sworn duty to reject abuses from the court. If accepted by Congress and this President, this decision will be a serious blow to religious liberty, which is the heart of the First Amendment."

The FedGov grabbing more and more power vis a vis a SCOTUS that will allow anything the Administrative State desires is a frightening thing. Of course, the Obamacare ruling and the "disparate impact" housing ruling are worse, but each ruling this week has been a building block in the formation of a tyrannical state.
Any freedom minded individual should be mourn the erosion of States Rights, even if States Rights may coincide with things some find distateful or unfair. Life is unfair, then you die.

Two counties in Alabama announced today that they are shutting their marriage license offices. No marriage licenses will be issued for anybody. Period.
There are still some of us who will not submit.
We don't need no damn marriage licenses, anyhow. The churches or similar private organizations should handle marriage exclusively. Then all this gay marriage horse shit would be a non issue. Seriously, if I don't have to pay for gay marriage or see it or support it in anyway, and everyone can just handle their business between consenting adults, then why would I give a fuck? Really. This is how the millenial generation of the South feels. What pisses us off is having all this shit shoved in our faces and being told we have to support it whole heartedly, and subsidizing it with our tax dollars, or we're racists and bigots. We're sick of it.

In the past, the state presupposed it had an interest in marriage licensing, to promote procreation by bringing more taxpayers into the world, curtail disease (oh stop it down voters, the blood test is exactly that), instill its malleable morality and of course extract the license fee itself for a contract it had absolutely nothing to do with.

A normal marriage is a tripartate agreement too; between the newlyweds and the *society* they live in. The State does not equal the society, and society does not necessarily mean the ENTIRE society. There is no reason a marriage (or other such agreement) in one place necessarily must be honored in another.
Yesterday I received an email requesting me to volunteer for the upcoming Pride Parade of which I promptly deleted. However on further thought, I realized this was the first time this has been done. Always before the notice was posted on our intranet, never emailed.
At some point everyone must make a stand. I suspect soon I will be forced to participate. I will not do what I do not believe in. If it costs me my job, so be it.

I have thought about this for a long time. My daughter goes to school with a couple of girls who "have two mommies." I've met both women and they are good people. The girls, both really sweet, kind, and something I strive to make my kids like, were adopted from Guatemala. Two sisters who were given up/lived in an orphanage. They had a truly shitty life ahead of them, but these two ladies found it in their hearts to do an incredibly unselfish act, and with that, changed their lives forever.
So, I guess I end up being on my own side. The side where I hate the government being involved in this to begin with.

Respectfully, pods, the lines are not blurred. One can respect homosexuals as being great neighbors, as doing charitable acts of love (such as adopting those two little girls from Guatemala), etc. That does not give them the right to take over marriage, which is a religious construct legislated by our federal overlords. The problem is that now Christian churches who base their disapproval of gay marriage on their interpretation of Scripture will be forced to perform marriages, thereby violating their doctrine. This is ultimately about persecution of Christians, this is not about anyone's equality.
I am like Miffed: I have chosen my side and I am mentally preparing myself for the persecution to come. Nowhere in the Bible does it say Christians are guaranteed prosperity and rainbows (sorry Joel Osteen); it does say that we will be hated for our devotion. I am prepared to be hated by my coworkers, so-called friends and even family members for my beliefs.
Well if the government was to force a church to perfom a marriage, I would say yes, this unacceptable. If Christians were to campaign against the state even being involved with marriage, then I would be with you. But it isn't.
But, this has mainly been about the benefits afforded to married couples by the state.
I have also seen the argument where the state is going to force churches to perform this or lose their tax exempt status. Well, that is again a contract. If the church contracts with the state to achieve some benefit, well then they will have to uphold the terms of their side of the contract.
As for marriage, two people enter into contract, which is blessed by the state, to receive the benefits that that contract affords them. (3 parties)
Now, if you argue that the state as blurred the entire construct of marriage, I am with you. But they have done that long before this ruling. Just the fact that they REQUIRE you to get a license means they have messed around with the meaning. And, marriage exists outside of religion. Atheists may marry correct? That is because marriage is a contract, a tripartite contract between the marrying couple and the state. In that regard, the state has no business choosing who may or may not enter into that contract to receive the benefits of such contract. If they could, well then whites marrying blacks, or indians marrying japs could be illegal. (many actually argue that this is the origin of the marriage license)
This is the same issue I have with the state of NC allowing the JOP's to recuse themselves from performing a "gay marriage." It is their job to do so, and if it goes against their religon, find another job. Would you support a member of PETA (basically a religion) who worked putting down dogs to be able to recuse themselves from doing a duty specified in their job description?

I never drink the Kool aid. I couch all of my arguments in what the stated facts are. I am not going to entertain that this is some ulterior motive move to somehow limit Christians power.

That is human. Not Christian. Christians may have adopted that, but if you remember the story of The Good Samaritan, that was not exactly taking place at a time when the Christian church had a strong following (was there even 12 apostles then?).
Here are the facts. When a man and a woman want to get married in a church, they MUST receive permission to do so, not from the church, but from the state. I had to present my license to marry my wife to the Catholic Priest who married me. Later on I realized that I was signing a contract, not just between my wife and I, but with the state.
If two men, or two women want to sign that same contract with the state there should be no law that prevents it. What they do with that license is up to them. If they find some sect of a reformed Christian church that wants to marry them, so be it. It does not affect me. Taking that license to a church and forcing them to marry them IS wrong.
There is a war to destroy values in this nation. To make it self absorbed, selfish and uncaring. The media is all about fomenting that divide, hence why I avoid it and ridicule those who consume much of the political media where the format is not open to discussion. Fear and pleasure are the two great motivators, and the media uses both to get you to stop thinking, and start feeling.
Now that we have that out of the way, here are the things I do find abhorrent:
Forcing a private individual or business to serve everyone. Whether that is homosexual cakes, blacks at a country club, or girls in the Boy Scouts.
Having the government force me to buy something, anything, from another individual or company under threat of penalty.
Having the government tell me what I can and cannot put into my body.
Having any gun control laws whatsoever, including barring felons the ability to defend themselves.
Corporate money.
Civil asset forfeiture.
Any and all crimes where there is no injured party. This includes speeding, DWI, drug possession and use, and most every other law there is on the books.

The only thing the government should be involved in is allowing a person to specify what other entity they want to designate for things that are, at least until the term gets changed, considered as "spousal" rights. These would include health coverage and things of that nature. States should just be issuing those kinds of documents, not marriage licenses, not domestic partner licenses.
As for marriage, I still consider that to be a religious rite. And if a certain church wants to perform same sex marriages, so be it. If another doesn't want to, so be it. So if two same sex Catholics want to get married, and the Catholic church says they don't perform those kinds of marriages, time for the two to find another church. You can't force churches to perform same sex marriages.
But I'm pretty sure that's going to come next.

The intent was positive motives - get decent housing into poor neighborhoods. The unintended (disparate) impact is now those familes are FORCED to live in those neighborhoods, becuase that is all they can afford. And now they can sue.

If instead, for purposes of the state - taxes, inheritance, hospital access to information, and pensions - the definition should have been domestic partnership for everyone.
Previously married couples would be for these purposes, redefined as domestic partners, and from enactment forward, all state recognized relationships would be domestic partnerships.
Marrige, a religious ceremony with sacred implications could continue to be offered in a religious setting, independent from the state.
This would keep government out of the business of trying to be religious, and put the real state to couple relationship into a proper context.
People would be free to duke it out with the religion of their choice for the sacrement of marriage, but for purposes of state, all would be allowed domestic partnership status.
But, the equivocation of marriage with it's long time definition provided much more opportunity for division, dissent, and disruption of the social fabric.
