Supreme Court Legalizes Gay Marriage Nationwide In 5:4 Decision

Following yesterday's historic 6:3 Supreme Court decision enshrining the tax known as Obamacare, there was little surprise moments ago when in one of its last remaining decisions in re: Obergefell v. Hodges, the most liberal Supreme Court since 1960 just declared gay marriage legal nationwide. The decision, supported by all the women on the SCOTUS, came down in a 5:4 vote with Ginsburg, Sotomayor, Kagan, Breyer and Kenedy voting for, while Roberts, Scalia, Thomas and Alito dissented.

As always, the most interesting contents are in the dissent, which today was, ironically, written by Roberts who in the past 48 hours has made many friends and maybe even more enemies. Some of the key remarks:

... this Court is not a legislature. Whether same-sex marriage is a good idea should be of no concern to us. Under the Constitution, judges have power to say what the law is, not what it should be. The people who ratified the Constitution authorized courts to exercise “neither force nor will but merely judgment.”

 

Although the policy arguments for extending marriage to same-sex couples may be compelling, the legal arguments for requiring such an extension are not. The fundamental right to marry does not include a right to make a State change its definition of marriage. And a State’s decision to maintain the meaning of marriage that has persisted in every culture throughout human history can hardly be called irrational. In short, our Constitution does not enact any one theory of marriage. The people of a State are free to expand marriage to include same-sex couples, or to retain the historic definition.

 

Today, however, the Court takes the extraordinary step of ordering every State to license and recognize same-sex marriage. Many people will rejoice at this decision, and I begrudge none their celebration. But for those who believe in a government of laws, not of men, the majority’s approach is deeply disheartening. Supporters of same-sex marriage have achieved considerable success persuading their fellow citizens—through the democratic process—to adopt their view. That ends today. Five lawyers have closed the debate and enacted their own vision of marriage as a matter of constitutional law. Stealing this issue from the people will for many cast a cloud over same-sex marriage, making a dramatic social change that much more difficult to accept.

 

The majority’s decision is an act of will, not legal judgment. The right it announces has no basis in the Constitution or this Court’s precedent. The majority expressly disclaims judicial “caution” and omits even a pretense of humility, openly relying on its desire to remake society according to its own “new insight” into the “nature of injustice.” As a result, the Court invalidates the marriage laws of more than half the States and orders the transformation of a social institution that has formed the basis of human society for millennia, for the Kalahari Bushmen and the Han Chinese, the Carthaginians and the Aztecs. Just who do we think we are?

 

Understand well what this dissent is about: It is not about whether, in my judgment, the institution of marriage should be changed to include same-sex couples. It is instead about whether, in our democratic republic, that decision should rest with the people acting through their elected representatives, or with five lawyers who happen to hold commissions authorizing them to resolve legaldisputes according to law. The Constitution leaves no doubt about the answer.

As for the president's immediate response...

... as a candidate for president, Obama told Rick Warren’s Saddleback Church that marriage could only extend to heterosexual couples. “I believe that marriage is the union between a man and a woman,” Obama said at the time. “Now, for me as a Christian — for me — for me as a Christian, it is also a sacred union. God’s in the mix.

And here's Mike Huckabee's different 'perspective'...

Former Arkansas governor and 2016 Republican presidential candidate Mike Huckabee made the following statement in response to the Supreme Court's ruling on Obergefell v. Hodges.

 

"The Supreme Court has spoken with a very divided voice on something only the Supreme Being can do-redefine marriage. I will not acquiesce to an imperial court any more than our Founders acquiesced to an imperial British monarch. We must resist and reject judicial tyranny, not retreat.

 

"This ruling is not about marriage equality, it's about marriage redefinition. This irrational, unconstitutional rejection of the expressed will of the people in over 30 states will prove to be one of the court's most disastrous decisions, and they have had many. The only outcome worse than this flawed, failed decision would be for the President and Congress, two co-equal branches of government, to surrender in the face of this out-of-control act of unconstitutional, judicial tyranny."

 

"The Supreme Court can no more repeal the laws of nature and nature's God on marriage than it can the law of gravity.
Under our Constitution, the court cannot write a law, even though some cowardly politicians will wave the white flag and accept it without realizing that they are failing their sworn duty to reject abuses from the court. If accepted by Congress and this President, this decision will be a serious blow to religious liberty, which is the heart of the First Amendment."

If that were true, and you believe completely in evolution, what of the 95% of species that have disappeared from the earth? Hydrocarbons? There is no "purpose" to anything unless you do believe in God. Otherwise we are here to serve whatever it is that WE believe important, if nothing more than satisfying a hard dick.

Sexual deviancy is what it is, deviant. It may somehow provide a purpose beyond our knowledge, but most evolutionary mutations are just that, and fail. What is a birth defect????Should we celebrate and promote them as well? The problem is that the rational mind seeks reason and purpose and reject that which cannot be affirmed. That is considered hate by progressives. When some heart felt program is proposed and anyone asks how much it costs, they are beat about the ears until they submit to the cries of anguish.

When society was more fragile and reproduction was revered and essential for human survival, sexual deviancies were seen as a real threat. Accurately today not nearly so much, unless you consider our recent data informing us that whites are not replacing themselves and are instead being replaced by other more prolific races, ones coincidentally that are not very tolerant of homosexuality. Go figure.

Accept the fact that for much of what we see, it provides no directed purpose, but everything has an effect. The human brain is about the only thing that actually creates purpose in its actions.

Not mention the little things like cutting your beard or eating shell fish.

I am for gay marriage, but Im against all these whiny hipster douchebags who have not shut the fuck up about it for the past decade. Even the WSJ was literred with articles on this topic every week. Some fruits couldnt marry, yea I get it, life is shit, deal with it. I hope you all can see where this is going. In a civilized nation, after being repressed and denied rights for decades, a minority might take a victory like this cheerily, and go on living content lives for the rest of their days. Thats not whats going to happen here. Gay rights will still be making the news every week. They will still find something to bitch about, some supposed grand social injustice that in actuality is quite minor compared to all the other injustices of the world. 

We are already seeing it. Hearing about bakers and caterers who were admonished after objecting to taking orders for a gay wedding. I have no problem with two dudes marrying. But I do have a problem with two dudes forcing someone who is uncomfortable with gay marriage being an active participant in their endevours. 

So yep, Im happy for gays today. But I am worried because clearly gays and their supporters do not just want gays to be 'tolerated'. They want them to be embraced and loved and told how brave they are for being gay, which isnt going to happen, no matter how many laws they try to pass. And frankly, it sounds kind of gay anyway

I am a straight atheist, so I don't have a dog on either side of the fight.  I couldn't give a fuck less what two consenting adults do in bed.  But I am tired of the gays persecuting the Christians for not bowing down before the gay rights movement.  You're a man who wants to marry a man?  Fine, go for it.  Leave the Christians alone, though. Freedom of religion is enshrined in the VERY FIRST AMENDMENT to the United States Constitution.  In fact, freedom of religion is the reason why the European invaders arrived on these shores in the first place.  So whenever a court somewhere grants two homosexuals a monetary award for discrimination, I'm left scratching my head.  According to the Christian religion, homosexuality is a sin.  These courts are demanding that Christians sanction and participate in the propagation of this sin.  That removes their religious freedom.  The logic seems really simple to me.

Congratulations to the gays and lesbians and the other members of the alphabet soup called the gay rights movement.  Do you think you could accept your victory and stop bulldozing the rights of your fellow citizens?  Nope, didn't think so.  They will not stop until society EMBRACES their movement.

Notice how they never try this shit in Muslim bakeries?  In Islam, homosexuality is a crime punishable by death.  Maybe Christians should start beheading random people.

This was never about marriage as it's been understood for millenia: sexual exclusivity primarily for the purpose of raising a family.  It was about trying to ram homosexuality down the throats of the rest of us.  The funny thing is that most women luv the idea of homosexuals, even though it puts them out of business (so to speak).

Almost all homosexual marriage are shams, little more than gay theater--especially those unions between men.  They mostly continue to have unlimited, random sex.  Not that hetero couples don't have affairs, but there is no comparison in terms of scope and scale of the infidelity where the gays are concerned.

Yes, imperial courts are well known for their hypocritical & contradictory "rulings" which is what this court has become, imperial.

In the past we have "ruled" that ObamaCare is a tax (even though Obama's lawyers argued it was not, that it is a "penalty") and "the tax" is paid to private corporations and not any government entity. Yesterday we informed the world that we are also mind readers, finding the words of the law completely irrelevent to what we presume the intent of the law is.

And everyone wonders why I've discarded any notion of law or justice through this legal system.

I understand the sentiment behind what you say. I also feel the sense of bewilderment waking up every day in a country I recognize less and less with each day's passing. I don't have an answer, and won't even hazard any guesses any longer. I am emotionally tapped out with it all.

I have reached the cynical point where every day I do something productive that further strengthens my own personal position for when SHTF. A close circle of like-minded friends, a tightly knit, self-supporting community, intersecting lanes of fire for everyone else.

I hope it happens this very instance, let the chips fall where they may. Afterwards, we shall see what there is left to work with.

The court is not an elected body, its not the congress or the executive, it is not voted in or out or held accountable in any way, yet its "rulings" overstep these boundaries with increasing frequency like any other bloated, sloven apparatchik device, revealing more & more of the of the Deep State persona that it is. But in the end they can only win when we stop opposing it and them.

Let me preface this by saying I am a Christian and do not think government has any role in marriage. None, nada, zilch. For those Christians or advocates of traditional (one man, one woman) marriage who are going bananas right now I have some questions:

  • Would you as a Christian recognize the validity of a marriage that is performed in church by a church official without a state license?

  • Should Christians recognize the legitimacy of a marriage between a male and female conducted by a civil authority not in a church? What if that civil authority is an atheist?
  • Should Christians recognize the legitimacy of a marriage between a male and female conducted in a church by a Christian minister but not registered with the state via marriage license?
  • Should the state / society recognize the legitimacy of a man and woman conducted in a church but unlicensed?
  • Should Christians recognize the legitimacy of a marriage conducted by someone licensed through Universal Life Church or some other internet ordination entity?

How these questions are answered goes a long ways into determining how a person feels about the state and government.

It’s about self-determination and the states desire to limit it. In a perfect world, gay people would have always had this right, just like there should have been no slavery. The reality is, the idea of marriage is bigger than a religion, if a society deems marriage with certain rights and privileges. I certainly don’t believe a church should be forced to give its approval, but I don’t like the Mormons who spend their money trying to block states from giving anyone any right.  

We would be a far greater nation if we spent our energy fighting against injustice, instead of fighting against individual rights.

It is indeed sad that gay rights is associated with this time of great injustice in America. Obama is a disaster, as is the Patriot Act, Obamacare, and his push for TPP and Amnesty for illegals. America is a lost cause, not because of this shred of light in an otherwise dark sky, but because we have become so indoctrinated into identify politics, and we only support those ideas that we benefit from directly. We all line up on our side of an issue, always ready to criticize, yet missing the big picture, how a certain idea will fit into the larger scheme…We are like children, and they treat us as such.

It was at this point that those in the court witnessed Chief Justice Roberts begin to whisper to fellow conservative Justices Scalia and Alito. Justice Roberts then became visibly red in the face at this point and some reports even state that you could audibly hear Roberts say, “Really!?”

When you get to the highest court in the land and you can't decide (a 5 to 4 decision is not a decision), then the matter should be undecided. At this level all decisions should be 9 - 0 or no decision rendered at all. What is law when it's a toss up!

Further, what privilege does a marriage partnership ... or any partnership ... bring. It should bring none. If there is one it should be removed. We should not be adding to it. Next people will be declaring a privilege from a partnership with their dogs, horses, dead brothers and sisters and who knows what else.

The people who ratified the Constitution authorized courts to exercise “neither force nor will but merely judgment...

It appears to me in this "decision", as with Obamacare, the SCOTUS has done exactly what Roberts says above isn't the role of the Court.

The Surpreme Court has become just another interpretive body taking what they want and fitting what is written into it.  The last of the defenses of this once great country are being unraveled at blinding speed and what will be left is a society of self-absorbed, unrestrained moral relativisits where what is good and right is completely in the eye of the beholder.  Nothing new here this was predicted a few thousands years ago in several books of the Bible.

Let's see, in the past week we've begun to remove signposts of our past (confederate flag), rile up the darkies, promote more ass-humping and same-sex sex, turn constitutional law on its head by further enhancing the deadly Obamacare crap, and did I miss anything?

This should all turn out just fine.

I would like some gay married couples to move out here to farm country. We've already got our quota of porch-sitting welfare assholes, so why not some fags?
