Supreme Court Legalizes Gay Marriage Nationwide In 5:4 Decision

Following yesterday's historic 6:3 Supreme Court decision enshrining the tax known as Obamacare, there was little surprise moments ago when in one of its last remaining decisions in re: Obergefell v. Hodges, the most liberal Supreme Court since 1960 just declared gay marriage legal nationwide. The decision, supported by all the women on the SCOTUS, came down in a 5:4 vote with Ginsburg, Sotomayor, Kagan, Breyer and Kenedy voting for, while Roberts, Scalia, Thomas and Alito dissented.

As always, the most interesting contents are in the dissent, which today was, ironically, written by Roberts who in the past 48 hours has made many friends and maybe even more enemies. Some of the key remarks:

... this Court is not a legislature. Whether same-sex marriage is a good idea should be of no concern to us. Under the Constitution, judges have power to say what the law is, not what it should be. The people who ratified the Constitution authorized courts to exercise “neither force nor will but merely judgment.”

 

Although the policy arguments for extending marriage to same-sex couples may be compelling, the legal arguments for requiring such an extension are not. The fundamental right to marry does not include a right to make a State change its definition of marriage. And a State’s decision to maintain the meaning of marriage that has persisted in every culture throughout human history can hardly be called irrational. In short, our Constitution does not enact any one theory of marriage. The people of a State are free to expand marriage to include same-sex couples, or to retain the historic definition.

 

Today, however, the Court takes the extraordinary step of ordering every State to license and recognize same-sex marriage. Many people will rejoice at this decision, and I begrudge none their celebration. But for those who believe in a government of laws, not of men, the majority’s approach is deeply disheartening. Supporters of same-sex marriage have achieved considerable success persuading their fellow citizens—through the democratic process—to adopt their view. That ends today. Five lawyers have closed the debate and enacted their own vision of marriage as a matter of constitutional law. Stealing this issue from the people will for many cast a cloud over same-sex marriage, making a dramatic social change that much more difficult to accept.

 

The majority’s decision is an act of will, not legal judgment. The right it announces has no basis in the Constitution or this Court’s precedent. The majority expressly disclaims judicial “caution” and omits even a pretense of humility, openly relying on its desire to remake society according to its own “new insight” into the “nature of injustice.” As a result, the Court invalidates the marriage laws of more than half the States and orders the transformation of a social institution that has formed the basis of human society for millennia, for the Kalahari Bushmen and the Han Chinese, the Carthaginians and the Aztecs. Just who do we think we are?

 

Understand well what this dissent is about: It is not about whether, in my judgment, the institution of marriage should be changed to include same-sex couples. It is instead about whether, in our democratic republic, that decision should rest with the people acting through their elected representatives, or with five lawyers who happen to hold commissions authorizing them to resolve legaldisputes according to law. The Constitution leaves no doubt about the answer.

As for the president's immediate response...

... as a candidate for president, Obama told Rick Warren’s Saddleback Church that marriage could only extend to heterosexual couples. “I believe that marriage is the union between a man and a woman,” Obama said at the time. “Now, for me as a Christian — for me — for me as a Christian, it is also a sacred union. God’s in the mix.

And here's Mike Huckabee's different 'perspective'...

Former Arkansas governor and 2016 Republican presidential candidate Mike Huckabee made the following statement in response to the Supreme Court's ruling on Obergefell v. Hodges.

 

"The Supreme Court has spoken with a very divided voice on something only the Supreme Being can do-redefine marriage. I will not acquiesce to an imperial court any more than our Founders acquiesced to an imperial British monarch. We must resist and reject judicial tyranny, not retreat.

 

"This ruling is not about marriage equality, it's about marriage redefinition. This irrational, unconstitutional rejection of the expressed will of the people in over 30 states will prove to be one of the court's most disastrous decisions, and they have had many. The only outcome worse than this flawed, failed decision would be for the President and Congress, two co-equal branches of government, to surrender in the face of this out-of-control act of unconstitutional, judicial tyranny."

 

"The Supreme Court can no more repeal the laws of nature and nature's God on marriage than it can the law of gravity.
Under our Constitution, the court cannot write a law, even though some cowardly politicians will wave the white flag and accept it without realizing that they are failing their sworn duty to reject abuses from the court. If accepted by Congress and this President, this decision will be a serious blow to religious liberty, which is the heart of the First Amendment."

Here very shortly all Christian Churches will be persecuted for not marrying gays. They will be bankrupted and shut down. I really do believe Westerners should legalize marriage between a man and an animal. They should be free to marry whomever they want, so if they want to marry or have sex with horses, dogs, donkeys, chimpanzees or any other animals, they should be free to do so, and the society should not judge them for it. The Supreme Court has made some terrible decisions over the last 30 years (such as approving Indian gaming, allowing SUPERPAC's, etc.), but I support this one. I am not gay, I do not envy gays, but they should have the same rights the rest of us have in America. Isn't that what this country is all about? We shouldn't forget that marriage is as much about legal and property rights as it is about love.

The alleged sanctity of marriage as a religious construct was tossed out long ago with the tidal wave adoption and acceptance of divorce and annulment. Marriage has become and exists as a pure construct of the state for conferring legal benefit and that's it. So to hear the churches moan about religious freedom and take them seriously under the conditions of societal evolution (whether they like it or not) rings dramatically hollow. Their religious freedom was taken decades ago, and more will be exacted as a result of this decision. Religion is counter-intuitive to a progressive worldview and must be destroyed, except when the religion eats itself or destroys others, like Islam is accomplishing around the globe. Militants under the cloack of religion, notsohated. Mealy mouthed pacifists united as religion - they will be assimilated under the state. The only way to truly accomplish that is at the hands of the state, with whom the religious have relied upon to confer them a tax exemption and legal corporate status, among other constructs of peaceful but forced compliance. And taxes will be eventually exacted according to the needs of the state, and thus the shakeout will begin. And the people will be divided and angry again, while the state uses the distraction to again build another brick in the inevitable global world order of redistribution and wealth creation.

The people must be separated from their diety and replaced by the state. Religious order interferes with the state's ability to collect what the state will assert is duly theirs. And by any and all means necessary will that be asserted, with this colegal construct being a part of that necessity. The state has nosed under the religious tent incrementally, and suddenly the religious come to the realization what that meant. Spare us the surprise and shock. Then there is the slippery slope inevitability, that everyone's carnal desire should be legally recognized by the state. It is indeed coming down the pike as well, given that the construct of legal, non-religious marriage only serves to confer legal status and benefits. The only question to ask is that which benefits the state will be decided in the affirmative. If polygamy can be a benefit to the state (and there are any number of constructs that indeed, do benefit the state), then only the passage of time stands in the way. There is no god, the science is settled, blah blah blah. You will sing the songs of your people to your new overlords...and welcome them thusly.

There is no such thing as "gay", "Gay" does not exist, it is simply a construct of the human mind and society but then, so is the concept of marriage so, why shouldn't those who decide to be "gay" be allowed to marry.

I think people confuse sex drive which is chemically based, (testosterone is chemical in nature), with the preferences that people choose to express their sex drive which are simply that, a preference.  Some individuals have a preference for blonds or redheads for example, or short or tall, and some apparently have a preference for members of the same sex which is an odd preference because it is contrary to the requirements of evolution.  In order to work, evolution requires reproduction.  No reproduction, no evolution and obviosly, reproduction is not possible between members of the same sex.

Actually, no.  Wars often have little effect on overall population due to fertility increases just before and just after a war.  For example, the huge post war baby boom experienced in the United states just after WW-2.

Why do we need 3 branches of government?  We seem to be doing just fine with one.  We've got a Congress that doesn't function except to pass laws and treaties that none of them have actually read.  And the Supremes just do what the executive wants.  And while we're at it, why bother having states?  When the federal government trumps any law a state may pass, why bother having state legislatures and gumming up the system with all that unnecessary expense?  If there were no states, think of the redistribution that could be accomplished!!  All we really need is one benevolent President who can give us everything we need and one printing press to fulfill every wish.

This decision will hopefully create added incentive for state legislatures to make the call for an Article V convention at which they can decide whether the federal government as a whole should be sent to the dustbin of history or just have their (usurped) powers dramatically reigned in. I will keep pushing my legislators to move forward. Hopefully other Zerohedgers will work in their states. There actually was a study done at least a decade ago if I remember right, that claimed in it's conclusion that one in ten was gay and that this same ratio was found in every culture they studied.  They claimed or implied that many are in hiding.  I am not sure how credible the study was but it wouldn't surprise me.

I remember after reading that, everytime I was in a crowd over ten I was looking for the token gay....lol  Not that I would be cruel, just a curiosity thing.

It is very obvious that our Founders had a clear view of Jesus Christ's teachings and Jewish ideals in mind when they incorporated Democratic and Republican documents into being, based off  civil law, entrenched in classic Greek, Roman and Anglo-Saxon doctrine with a smattering of Solon and Plato ...and what better way to honor the living Christ and Yaweh for centuries forward then to base our government buildings, courts ,monuments  and banks on the Temple of Solomon and Cathedrals. oh wait...they didn't. They did however found and create them off the Greek Parthenon, Roman Pantheon and named the Capital after Capitoline Hill in Rome. Our early currency is dripping with greek and roman pagan influence.(and still to this day) In addition, multiple founding father's graves, markers and monuments are not adorned with crosses or references to Judaism or the Ten Commandments. They are replete however with Eygptian style obelisks, roman vaults, eygptian style tomb layouts...see where this is going? The claim of 'christianity" seems more like lip service at the end of the day from them, the deeds of heathen men were at work, founded in stone and in the parchments and laws they wrote. Thank "God" for that...but alas, I am an amateur historian and you can stop fooling yourself that Jesus loves us.

I had a famously aggressive jokester of a lezbo sit down next to me at a bar once and in front of a bunch of people say.. "You know how I know you and I are going to have sex?"   "Uh..... that's not going to happen."  Lezbo.. "Because I'm stronger than you."  I laughed and said "appearances can be deceiving"... Lezbo "Don't make this rape a murder." 

She makes me nervous and somewhat disgusted.  The thought of two men humping definitely does not make me feel warm and fuzzy either.  I believe that all men have a right to their own free will barring that they are not victimizing a child, animal or metal deficient.  I prefer Ron Paul's way, let the states decide. 

The supreme court does not care about us and our free will so one must wonder why they have finally come to this conclusion.  It probably serves as a distraction from their shredding of our constitution.  Additionally, we all know about TPTB obsession with child rape and how they are attempting to normalise it in Britain...

Okay, point taken I will never spell "lesbo" wrong again... lol  I actually don't mean to be derogatory either I should say.  I believe everybody is fair game when it comes to comedy and that any gay worth their salt will get that.  If they are offended... oh well. 

I worked with a hilarious lesbo safety lady once, she used a shewee to pee on oilfield sites, mostly I believe to disgust and shock the guys.  I thought it was hilarious.

Nothing else is more important to the largest amount of people in this country, than gay marriage and abortion. The Two Mothers of all wedge issues. For most, gay marriage was never about dignity and marrying the same sex partner you love. Gay marriage is about saving money on filing jointly and the nonworking spouse being awarded the added benefits of social security of your deceased spouse.  Its all about the Benjamins.

Bingo, thats why the laws in my country were changed.  surviving partner gets same benefits as being married. Of course you have to register as cohabiting.   My partner gets my pensions if I kick off first and vice versa.   We are NOT married.
