What If Gold Is Declared Illegal?

Tyler Durden's picture

Submitted by Bill Bonner of Bonner & Partners (annotated by Acting-Man.com's Pater Tenebrarum),

The Beginning of the End

Over the weekend, the lines in Greece stretched along the street. Around the corner. Down the block. Lines to get cash. Lines to buy gas. Lines of people eager to get their hands on something of value. Food. Fuel. Cash. Pity the poor guy who was last in line …

… the poor taxi driver, for example, standing behind 300 other people, trying to get 200 lousy euros out of an ATM. Like a tragic nightclub customer … among the last to smell the smoke. By the time he headed for the exit, it was clogged with desperate people, all struggling to get through the same narrow door at the same time.

last in line

Being the last in line usually means you have waited too long.

Image via archives.gov, Al Capone’s Soup Kitchen, Chikago 1931

Remember: When a bear attacks in the woods, you don’t have to be faster than the bear. You just have to be faster than at least one other hiker…

Likewise, you don’t have to be the first one to get your money out of an ATM. You just want to be sure you get your money before the machine runs out of cash. And when a bear attacks Wall Street, you don’t have to be the first to sell. But you definitely don’t want to be the last.

storming the bank

People storming a bank in Shanghai in December 1948. The paper currency had just crashed, and the Kuomintang decided to make a distribution of 40 grams of gold per person. People desperately wanted to obtain their gold before the banks ran out.

The Dow lost 350 points on Monday – its biggest point drop in two years. On Tuesday, Greece was expected to default on a $1.7-billion payment to the International Monetary Fund (IMF). And on the other side of the planet, analysts are looking at “the beginning of the end for Chinese stocks.”

We doubt it is the beginning of the end. More likely, it is just the end of the beginning. On Friday, the People’s Bank of China cut rates to a record low, after stocks in Shanghai slipped 7% in a single day (the equivalent of about 1,300 points on the Dow).

Analysts expected a big rally in response to the rate cut. Instead, the Shanghai Index plunged again on Monday, dropping 3%. Greece… China… said one commentator interviewed by Bloomberg: “You have a potentially very ugly situation this week.”

Our guess: Stocks in the U.S. and China have topped out. Old-timer Richard Russell, who has been studying markets since 1958, agrees:

“I believe the top has appeared, like the proverbial thief in the night. The Dow has fallen below the 18,000-point level, and is now negative for the year.

The Transports, which have led the way recently, are down triple digits for today and are only 89 points above the critical level of 8,000. The Nasdaq has closed under 5,000. At the market’s close, gold was up 5.3 at 1,179.”

When Gold Is Declared Illegal …

But wait … What about silver and gold? As regular readers know, we recommend having some cash on hand in case of a monetary emergency. But a reader asks:

“In the same vein as your reader’s question as to what good cash is when it’s declared illegal, what good is gold when gold is declared illegal?”

First, precious metals aren’t illegal, so far. Second, making something illegal doesn’t necessarily make it unpopular. President Roosevelt banned gold in 1933. The feds wanted complete control of money. The dollar was backed by gold. So getting control of the dollar meant getting control of gold.

Once the feds had the gold, they could devalue the dollar by resetting the dollar-gold price from $20 to $35. In an instant, people lost more than 40% of their wealth (as measured by gold).

Executive_Order_6102

FDR’s infamous gold grab. Under the cover of an economic emergency, the government executed one of the most brazen acts of theft yet witnessed in a democracy.

That ban lasted for 42 years. It ended in 1975, largely because of our old friend Jim Blanchard. Jim set up the National Committee to Legalize Gold and worked hard to get the ban lifted.

Today, the feds don’t need to outlaw gold. It is regarded as “just another asset,” like Van Gogh paintings or ’66 Corvettes. Few people own it. Few people care – not even the feds. They are unlikely to pay much attention to it – at least, for now.

That could change when the lines begin to grow longer. Smart people will turn to gold… not just in time, but just in case. It is a form of cash – traditionally, the best form. You can control it. And with it, you can trade for fuel, food, and other forms of wealth. Lots of things can go wrong in a crisis. Cash helps you get through it.

Generally, the price of gold rises with uncertainty and desperation. Gold is useful. Like Bitcoin and dollars in hand (as opposed to dollars the bank owes you), gold is not under the thumb of the government … or the banks. You don’t have to stand in line to get it. Or to spend it.

Yes, as more and more people turn to gold as a way to avoid standing in lines, the feds could ban it again. But when we close our eyes and try to peer into a world where gold is illegal, what we see is a world where we want it more than ever.

bullion

Buy it as long as nobody cares about it. By the time they care, you’ll want to have as much as possible.

In San Diego yesterday, we got a light rain and 3 lighting strikes. The local news went nuts and reported the beach was closed.  I asked them how they closed a beach, since it's just a strip of sand next to a big ginormous body of water. The conversation ended with me telling whatever intern runs the twitter feed that "you missed my point".

Exactly what does illegal mean in this context? Do they have gold sniffing dogs?

Of course the is precedence of gold being declared illegal as with bitcoin and the ramifications of that on the market price, but the real question is one of confiscation, and it is far easier to confiscate bank accounts, 401k’s, and pension funds. I noted the confiscation point in a piece about how gold should not be held in an investment portfolio, but he missed the point that while it may be more likely that gold is made illegal than any other asset, the even more pressing issue is one of ease of confiscation. Stealing physical gold from people is not easy logistically or morally (not for TPTB but for the gruts going to safe deposit boxes or door to door), most electronic assets on the other hand...

"Gold sniffing dogs"

I remember reading that when the warlords controlled China they could always spot the rich people because they were the only people who were relatively clean (they could afford soap) and not incredibly thin (they could afford food).   So after a point it's really simple.

If you want to hang on to your gold just starve yourself and cover yourself with filth so you can pass for a "normal" person.

you can also melt gold and silver coins down to make smaller denominations by the gram or 2 or 5 or whatever gram size bullion nuggets you want to make.  If a so-called fiat dollar value per ounce of gold one day becomes so excessive that you couldn't buy anything small and practical with an ounce of gold "worth" 5000 dollars (or whatever), then just melt it down into practical sizes so that you can use it better for trade.  At that point people aren't going to care if your gold or silver looks like a fucking coin stamped out by the U.S. mint or any other private mint.  They're just going to want to test it for authenticity, and it's harder to fake fractional buillion than it is larger coins or bars.  And test kits are not expensive and neither are little digital scales or counter-weight scales.

A silver Eagle is considered worth 1 fucking dollar which is what is stamped on every single one of them by the U.S. mint.  A gold Buffalo is stamped with 50 dollars.  Who the fuck is going to adhere to that bullshit dollar denomination ever???  It's completely ridiculous to even put a dollar value on those coins or any gold or silver (or platinum or paladium) coins.  And after the shit hits the fan all premium or numismatic value is going to be completely lost on any precious metals because it just won't matter anymore at that point.

So just melt the shit down to smaller sizes that will be spendable for other products.  Believe me...silver and gold are most definitely money.  Have been for 5000 years, and after all this fiat burns itself out silver and gold will still be right there and everyone is going to want it.  It will not be hard to place values for products and services per grams of gold or silver.

still can't figure out the "You can't eat gold" sheeple...geez...they'll fucking starve to death before they ever learn anything.

Well in the Inland Vallies, specifically here in Lakeside, there was torrential, heavy rain, with many lightning strikes.

It seems as if it is gearing up to do it again as we are very humid and overcast.

As for closing our beaches you just close off the access points and ticket anybody out on the sand as many are fearful sheep.

I guess that you can sneak in after the closing, as many do.

But the market for Gold will move underground, just like Drugs.

Many will sneak in under cover of darkness but at great expense. We know that just has served to make some people, dealers and producers, very wealthy.

And as for Gold Sniffing Dogs...LOL

Once you understand the true depth of murderous dispair of your governments and militaries....thinking about value, investment, and protection is so trivial.   They own the systems.  They own legality.  They own media, religion, commerce, education, everything.  If they dont want you to have something it will become "illegal" on their legal system that they own.

Accepting the truth that there were no commercial plane crashes on 9-11 and that the trillion dollar global war against religions was staged, allows you to focus on whats really important to each of us.  Material things disappear because you realize they will always be controlled or affected by these mass murderers.

"Material things disappear because you realize they will always be controlled or affected by these mass murderers."

I understand the point you are making, and I have posted similar ideas in the past.

But the word "always" is a red flag.  The level of chaos that we are brewing may yet be enough to fundamentally change the system.  If that happens, it will be very ugly, and none of us wants to live through it.  But what we want won't matter.  In chaotic systems like that (only chaos will be strong enough to allow fundamental change), people revert back to primordial desires and thought patterns.  In that situation, the mass murderers will not be able to control what they control now.  When humans are civilized, fat, and at peace, they are relatively easy to control.  When they are panicked and have nothing to lose, no one will control them.  The mob will rule.  What are desperate people going to want?  What will you want when you're desperate and panicked?  That's where to focus attention.

Focusing on spiritual and non-material happiness is paramount, I agree.  But that doesn't have to be opposed to material preparation as well.   We just cannot attach ourselves too tightly to those preps.  Because no matter how well we prepare, events may not allow us to keep anything material.

Long story short, be prepared with material supplies and be spiritually prepared if your material preparations fail.

gold has been removed from the american lexicon.  most could not tell gold from brass.

in FDR's day people had gold coins in their pockets and they trusted the govt.

smart people have their gold vaulted in places like singapore.  by the time the us govt considers banning gold their power around the world will have been seriously reduced, and they won't be able to bully other countries to do their will anymore.  they certainly will have no sway in a foreign bank that is alined with the BRICS, and things like fatca will be history.

It already was.  In the USSA, it is illegal to prevent rainwater from flowing off roofs and into gutters, down gutters into streets, and down streets to wherever the rain normally flows.  So, if you walk outside wearing a cotton shirt that absorbs rain, you are breaking the law by preventing water from taking its "natural course".

There will be no need to confiscate gold.  In fairness to the "hoarders" who refuse to patriotically put their money into T-bills or other Federally approved investments all future gold transactions will:

Confiscating gold is simply another elite scare tactic to keep people occupied with material trivia.

It is not a question of 'if' but only of 'when'.   Gold is as much a political lightning rod as it is real money.    And like anything else in today's current sound-bite addled, pop-culture environment, all that's needed is the right amount of 'red meat' to toss at the public in order to light a firestorm of sentiment against 'greedy gold hoarders' who lie in wait for disaster to strike, and then profit from it...    Owning gold could easily be turned into a 'Confederate flag' issue.   The 'swarm' need only be directed at whom to attack.    Think of a politician grandstanding - maybe even suggesting that people rat out others who they think might be buying/selling/trading/profiting, etc., from physical gold ownership.

The problem with precious metals is, they are not so precious to the masses.

To the masses, Gold, Silver etc... are just "chunks of metal", they cant play candy crush on a silver bar, they cant eat it . . .  they cant use it as a tool . . . they would much rather spend their money on the latest Iphone or flatscreen TV to watch football on.

The market for gold and silver is pretty much limited to everyone who can afford it and even then, only say . . .  20% of those people (if even that many) have any real interest in the metals.

The world is just different from what it was in the past. . .  until some crisis wipes out all the banks, gold and silver and other precious metals will be about as useful as their weight in steel or copper to the masses, and you dont see a lot of people hoarding stacks and stacks of copper for no good reason . . .  now do you?

Not saying gold and silver dont have a role to play in the modern world, just saying for the great majority of the people (who you would intend to exchange your gold and silver to for services in return in the future) it doesn't really mean much.

Something to think about anyway.

I disagree, why supress it so violently if it isn't a competing currency?  They can bash it into single digits, when the paper is worthless the metals will have value.  I have a 250 dinar bill with Sadam's mug on it.  I like to put a 1oz. Ag round next to it and know that I can use the paper for asswipe or firestarter, and buy bread with the Ag.

fdr did it b/c it was constraining $ supply at time.  in 2015 only thing constraining $ supply is access to a keyboard & ability to locate f2, 0 & enter keys.

the only way I see a repeat is if people start transacting in gold (/silver) coins like other countries have outlawed transactions in dollars.  I don't see modern govt having a problem w/people sitting on it but (much like bitcoin) if it becomes an effective way to avoid debasement (and/or taxation which is that scenario is largely semantic).  however as others have stated in the scenarios where people would be transacting in metals the effectiveness of govt in enforcing bans will be highly suspect (like dollar prohibitions were in moscow when I was there in 93)

What if all those derivative contracts were retroactively declared illegal???  USAGov has rewritten tax law, criminal law - all sorts of laws - retroactively applicable.

What happens if it becomes apparent that all those 700 trillion (depending on the season) are declared nul and void?

First off: Game over for the banks and corps who are depending on them to "balance" their books.

Second off: Governments who counted on the deriv gamers are dead in the water. Maybe some are really dead.

Third off: The living humans are left with algebra. Cross off the self-cancelling debts. Make arrangements with those who are owed. It wouldn't be "100s of trillions". It would be some trillions but much less. Demand destruction, you know. Funny books would be dead.

Those Over The Counter, Off Balance Sheet Derivatives are going to die. Either way. Might as well spare the people the pain of being dragged through what Greece is going through on a blow by blow. The big difference between now and 1933 is that there is a much bigger global market for gold, and that it is much easier to move gold to those other markets. If they ban gold in the US then you will see lots of new pawn shops open just across the northern and southern borders.

"Have anything to declare?"

"No Señor Border Guy, and unless your dog can smell gold, you ain't gonna find mine".

Those things have a shorter shelf-life. The idea of the gold and silver is so you can preserve some of your 'wealth' for future spending. You buy what you need and can use now, but keep the rest in a form where you can control it, and its value won't be eroded to nothing while you watch, helplessly. Regardless of what your foolish governments and banksters do to your economy and its fiat money, YOU will be able to "spend" your stashed PM's to grease the palms of those nurses when you need it most.

Wed, 07/01/2015 - 19:35 | 6260154 Bemused Observer
Bemused Observer's picture

Yes, I believe this too. I think that in a crisis situation, it may be easier to "spend" small pieces of jewelry than it will be to negotiate with coins or bars.
Other than silver US coins, few Americans would even recognize most PM's in coin form. And of course, the first thing they'll notice is the 'face value', which will be significantly lower than the actual value. This will color their perceptions of its value (and I'm talking about the majority of people who aren't familiar with PM's as money..) and you may have to explain why the quarter YOU have is worth so much more than the one HE has, when they look pretty much the same to him.
Odds are, most of us who are stacking will be little islands of sound money in a sea of idiots who have no idea of what ANYTHING is worth anymore. They may not wish to TAKE our stacked coins or boullion, at first...
But everyone knows what a pretty gold or silver necklace looks like, and understand that good jewelry is a "valuable thing", regardless of what they know about gold or silver. So, a bunch of small, lightweight chains, rings, or best of all, charms, is a good thing to have on hand. I have tons of old gold and silver charms, many have moveable parts, and the detail is amazing. I get them for next to nothing, and just toss 'em in the box. They're mostly old, and very well-made, marked 'Sterling', or 14k...instantly recognizable to most people I'll encounter on a daily basis.
And people LOVE those things! The form gets their attention, the content then becomes easier to 'sell'. If someone had something I needed, I'm certain I could find something or things in my 'magic box' that would gladly be accepted in exchange. I got something for everybody in there...:-)
Brand new Maple Leaf coins may be a good investment, and you should keep some of those too, but I think a lot of people might worry about forgeries and not be sophisticated enough to tell the difference, especially with coins. They might be harder to trade on a day-to-day basis. You might have to make a 'special trip' to trade those to someone who knows their value.
But if my neighbor has eggs, and I need them, one charm will make that happen pretty smoothly.

Oh I disagree, those who are confused about the legal tender value, will very quickly learn what that is about!

Also having 1oz silver coins worth approx $20 are not worth counterfitting the silver eagle or maple leaf quality of the stamping, it would be akin to counterfitting a $20 bill, not worth the trouble.

gold may be worth trying to counterfit the maple leaf 1 oz coin or the Murakin equivalent, but i doubt that also.

Fear-mongering article.  The US is the only place where gold was made illegal.  And note that this was due to the pressure of a private money cartel: the Federal Reserve.

There is NO need to ban gold.  If the price were to skyrocket -- as gold proponents claim -- then the Gov can decide to either do Nothing (because so few people own it), or they can tax its sale.  If there's a "run on gold", the Gov can simply be the First In Line, and you can figure out the rest.

But no, of course, it cannot happen here, we are exceptional after all...

If you make it illegal only criminals will own it, and a criminal I will be.

If I remember correctlty. In Dmitry's video about the fall of the USSR most items were very difficult to aquire if they were available at all, but the Chechen's ran the black market and they could get you what you wanted. Hmm what would a black market guy want for payment? FIAT, no I dont think so, Gold, maybe Silver, ya that's it.

If they make it illegla they would have to do it world wide. No point in making gold illegal in the USA if its legal in China, Europe, Australia, SE Asia etc.

They don't have to make it illegal, just tax it to death.

Is why I have some gold and silver, but careful about having too much. If the local govt puts big taxes on it can lose too much, but globally gold still the real deal, and thus shares in a top quality low debt gold miner another useful way to own gold.

Though at the moment, waiting for the bigger market crash, which will drive down all stocks good and bad, to jump into a gold miner I have in mind.

If they do it in India & China 50000 tons will be the yield.

(If the people are stoooooooopid enough)

----

Btw Evil USA can always do that by fighting a war with China or better by making India & China fight each each other, both weakened then America loots both of them and Kerry off the 50K tons of gold on its aircraft carriers & on spy planes.

----

BarackHomObamma on Pot : Are you listening ??

Great Plan eh ??

----

Btw both have WMD which is a great excuse

(as in Iraq)  ;-)
