Secret Court Permits NSA To Keep Collecting Our Data
Earlier this week the FISA court ruled the NSA can continue the bulk collection of phone metadata until November 29. This comes after Congressional gridlock allowed for Section 215 of the Patriot Act, the legal cover for the collection program, to expire on June 1.
The secret court’s ruling overturns that of the US Court of Appeals for the Second Circuit, which ruled in favor of the ACLU’s suit claiming Section 215 could not be reasonably interpreted to allow the bulk collection of our phone data back in May. In his statement, FISA Judge Michael Mosman irreverently stated, “Second Circuit rulings are not binding on the FISC, and this Court respectfully disagrees with that Court’s analysis, especially in view of the intervening enactment of the USA Freedom Act.”
Speaking of the Freedom Act, let’s back up for a minute. If you recall, the Freedom Act was enacted on June 2 and gave the NSA six months to drop its spying program, but permitted the agency to continue collecting data during that time. The only catch is that the act didn’t include language that related to the Second Court’s ruling, so it was left unclear whether or not collection could legally resume, until the FISA court stepped in and trumped a federal court of appeals’ decision, that is.
Maybe this absurd decision to “revive” a “dead” spying program actually has some genius behind it. What if they just need a little more time to complete amassing enough data so they can create the best algorithmic trading platform in existence? Maybe then, they could capture the profits to erase the debt! After all, why wait to hash Twitter when you know what people are typing as they type it… hold on… someone’s at the door.

i think all you future duckings have two ways to go. off the grid, which usually means utilities, but includes schools and medical care, and fire and police, or you need a social quotient. in the jobless society you are worth whatever value society places on your abilities and your intrinsic social worth, are you a good citizen. its going to be a difficult formula but thats why we have algorithms. your worth will determine how well you live, where you live, all those things. if your social quotient is pretty low, you might well consider going it alone. outside the dome it can be pretty rough. social quotient is your ticket as a consumer. we've already had some problems with this system, UCLA med center does transplants for instance, the criteria for transplants is based on a social quotient, so if you need a new heart but you ruined the last one doing drugs and hurting other people you wont qualify. so americans were denied liver transplants at UCLA while japanese gangsters (yakuza) moved to the top of the list by virtue of making large donations. this is wrong, but of course that doesnt mean the merit system is dead. if anything it will be the only system. it wont be enough just to have money, there wont be any money. this meta data gathering process is prefiguring the moment when they can determine your social Q. there is some very pure logic to this, anyone can amass a pile of money, and any sociopath. if some evil person has a lot of money, in this brave new world it wont matter. he will be seen for what he or she is. of course having your moral value measured by others may offend your sensibilities, there will always be room outside the dome.

FISA is the de facto supreme Supreme Court of TPTB, more powerful than the people's SCOTUS for what TPTB need. This is to over turn the old but still immensely popular imaginary functioning constitution, of the old and now defunct US of A, when needed with lawful legitimacy of the FISA court. Anyone who failed to see this was in the offing is an utter fool. The declaration by Cheney of the emergency Continuity of Government Act on the morning of 9/11/2001, and upheld every six months since by executive decree was the political coup d'etat that finished the republic. The TPP is now the transfer of the dead republics power to make law of the land to those that ran the coup. Only revolution can restore any degree of democratic self rule for the people now with a new Second Republic or what have you, with a new flag and a new dedication and with the old myths of the first republic washed away with the truth..

On the one hand they tell you ignorance of the law is no excuse and then they pass all sorts of secret laws and hold court behind closed doors and gag order the transcripts.
Now I’m hearing about binding ‘secret’ executive orders and trade treaties that no one is allowed to read.

not sure how amassing phone data applies to stock market trading. if the government had the perfect trading platform why would they need it, they can put just about any number on the stock indexes they want. manipulating the indexes is one way to achieve their 2% inflation target

I think the "perfect trading platform" is a metaphor for everything and anyone they might want to control.
okay so they have an algorithm which puts the metadata together, and automatically prints a ticket to GITMO with your name on it. its still a metaphor. hfts cause small moves in stock markets, the difficulty is when the algorithm shuts down because it doesnt like the data its getting, then you have no liquidity, and in metaphoric terms, there is never a cop around when you need them. which i believe describes the upcoming crisis.

Thus, the civil servants and military officers of the NSA and the "judges" on the secret "courts" violate the US Constitution, which many of them have sworn an oath to defend, on a daily basis.
Standard behavior and character for most government employees, Edward Snowden excluded, of course.
We were doomed to this fate under Federalism HH, but that's a story for another time. Then again, human nature being what it is, even a 'loose confederation of independent states', likely would have seen the same fate, perhaps delayed a spell for the simple reason of not already being 'bound' together from the jump start.
the right of people to be secure, implies some sort of restraint, and the problem with this new millenium is that not enough of them go to jail, crimes are committed in broad daylight, presidents lie steal cheat and murder and the bankers hold their hand.
