Guest Post: A Coming Era Of Civil Disobedience?

The Oklahoma Supreme Court, in a 7-2 decision, has ordered a monument of the Ten Commandments removed from the Capitol.

Calling the Commandments “religious in nature and an integral part of the Jewish and Christian faiths,” the court said the monument must go.

Gov. Mary Fallin has refused. And Oklahoma lawmakers instead have filed legislation to let voters cut out of their constitution the specific article the justices invoked. Some legislators want the justices impeached.

Fallin’s action seems a harbinger of what is to come in America — an era of civil disobedience like the 1960s, where court orders are defied and laws ignored in the name of conscience and a higher law.

Only this time, the rebellion is likely to arise from the right.

Certainly, Americans are no strangers to lawbreaking. What else was our revolution but a rebellion to overthrow the centuries-old rule and law of king and Parliament, and establish our own?

U.S. Supreme Court decisions have been defied, and those who defied them lionized by modernity. Thomas Jefferson freed all imprisoned under the sedition act, including those convicted in court trials presided over by Supreme Court justices. Jefferson then declared the law dead.

Some Americans want to replace Andrew Jackson on the $20 bill with Harriet Tubman, who, defying the Dred Scott decision and fugitive slave acts, led slaves to freedom on the Underground Railroad.

New England abolitionists backed the anti-slavery fanatic John Brown, who conducted the raid on Harpers Ferry that got him hanged but helped to precipitate a Civil War. That war was fought over whether 11 Southern states had the same right to break free of Mr. Lincoln’s Union as the 13 colonies did to break free of George III’s England.

Millions of Americans, with untroubled consciences, defied the Volstead Act, imbibed alcohol and brought an end to Prohibition.

In the civil rights era, defying laws mandating segregation and ignoring court orders banning demonstrations became badges of honor.

Rosa Parks is a heroine because she refused to give up her seat on a Birmingham bus, despite the laws segregating public transit that relegated blacks to the “back of the bus.”

In “Letter from Birmingham Jail,” Dr. King, defending civil disobedience, cited Augustine — “an unjust law is no law at all” — and Aquinas who defined an unjust law as “a human law that is not rooted in eternal law and natural law.”

Said King, “one has a moral responsibility to disobey unjust laws.”

But who decides what is an “unjust law”?

If, for example, one believes that abortion is the killing of an unborn child and same-sex marriage is an abomination that violates “eternal law and natural law,” do those who believe this not have a moral right if not a “moral responsibility to disobey such laws”?

Rosa Parks is celebrated.

But the pizza lady who said her Christian beliefs would not permit her to cater a same-sex wedding was declared a bigot. And the LGBT crowd, crowing over its Supreme Court triumph, is writing legislation to make it a violation of federal civil rights law for that lady to refuse to cater that wedding.

But are people who celebrate the Stonewall riots in Greenwich Village as the Mount Sinai moment of their movement really standing on solid ground to demand that we all respect the Obergefell decision as holy writ?

And if cities, states or Congress enact laws that make it a crime not to rent to homosexuals, or to refuse services at celebrations of their unions, would not dissenting Christians stand on the same moral ground as Dr. King if they disobeyed those laws?

Already, some businesses have refused to comply with the Obamacare mandate to provide contraceptives and abortion-inducing drugs to their employees. Priests and pastors are going to refuse to perform same-sex marriages. Churches and chapels will refuse to host them. Christian colleges and universities will deny married-couple facilities to homosexuals.

Laws will be passed to outlaw such practices as discrimination, and those laws, which the Christians believe violate eternal law and natural law, will, as Dr. King instructed, be disobeyed.

And the removal of tax exemptions will then be on the table.

If a family disagreed as broadly as we Americans do on issues so fundamental as right and wrong, good and evil, the family would fall apart, the couple would divorce, and the children would go their separate ways.

Something like that is happening in the country.

A secession of the heart has already taken place in America, and a secession, not of states, but of people from one another, caused by divisions on social, moral, cultural, and political views and values, is taking place.

America is disuniting, Arthur Schlesinger Jr. wrote 25 years ago.

And for those who, when young, rejected the views, values and laws of Eisenhower’s America, what makes them think that dissenting Americans in this post-Christian and anti-Christian era will accept their laws, beliefs, values?

Why should they?

If I want to live by religious rule, I'll move to some other shithole.

Having these inside the halls of government only gives them more of an air of authority.

This article is like when 5 chefs try and make a soup each by adding their own stuff.  You end up with stuff like I made in college.

I guess I'll take a shot at some of these:

Marriage.  A tripartite contract between two consenting adults and the state. Whether you have a ceromony in a church or Vegas the crux is that it IS a contract.  Let fags enter into this or remove all benefits associated with said contract.

Forced service:  WTF?  I should be able to refuse service to you for any reason I choose.

The state not following the law: Another WTF that is cheered.  Why do I have to follow the law when the state does not?

In short, remove the ability of the government to print currency and all this shit goes away.  Generations of leeches (both individual and corporate) fall by the wayside.  Unjust laws have no money to enforce.  Government shrinks like nuts on steroids. We all go back to trying to make our way through life without being told how, when, with whom, and how much it will cost.

The government has moved into the marriage business because it is lucrative. Had I understood this 30 years ago I never would have partaken in their scheme.

I need no legal binding contract to sleep and live with the man I choose. If this arrangement is unfortunately dissolved, I would do so amicably. But no lawyer would become rich in that process.

No one should obtain a marriage license today and continue this farce. My word is my bond.

The marriage license was introduced during Reconstruction by Democrats in the south.   To prevent interracial marriage.  You didnt need a license before that, I believe.

Marriage licenses were around before then.  Maybe not in most states, and certainly not common in U.S. until mid-1800s.  But southern Democrats didn't invent the idea and southern states weren't the first to require marriage licenses.

Just because the power in charge at that time found the beliefs to be a threat, and tried to eradicate them, doesn't "prove" anything about those beliefs.

For not just one, not just a handful, but tens of thousands to be willing to die (by wild animals, gladiators, burning, crucifixion, etc) for their beliefs, when all they had to do was deny Christ, is the strongest proof that they knew of Jesus resurrection, either as eyewitnesses or through extremely believable accounts of eyewitnesses.

To attempt to reinterpret those events thousands of years takes willful ignorance.

It is better for Lurk Skywatcher to be thought a fool, rather than open its mouth and remove be all doubt.

Right, because the christians bent over in any and every way possible, with the sole exception of the single thing they've been so thoroughly convinced is true that they dont ever even have to question it, or verify any of its tenets, and they really only get to find out when they die anyway...

matter of fact, it is heretical and treasonous to even suggest questioning, as the church proved umpteen times over by killing anyone just about anyone who questioned their "authority"....and of course its perfectly acceptable that the church also scrubbed out any words or even entire books that might have left any shred of a clue that attaining the powers jesus had was attainable by the common man - matter of fact, no, dont do ANY of those, because they INVITE DEMONS!! 

 

THAT would have undercut their entire mind-control premise of "Jesus is a direct son of god"...becuase that is a control mechanism.  If you want to control people, you dont tell them that they are the same chip off the allspark.

its not like Jesus said just that - that we are all like him and by logical extension can attain any spiritual power he had.

Dixie, I grew up catholic and went to catholic schools. I know all of the tales.  I passed my Theology classes with excellent grades.

Once I was done, then I went and researched all of the world's religions in an attempt to gain a bigger picture, because I knew that I was not being told a complete picture.

Clearly, you have no idea who you are talking to, and thus imprint your notions of an unstudied atheist onto me in an attempt to invalidate my words that so stabbingly go against what you have been taught to believe.

I have faith, and I daresay every bit as strong as you purport yours to be - I just dont have faith in the same things and the same contexts.  But somehow it is insulting and inconceivable that one would have a broader context?

 

This all started because I called out kneejerk junking, and because it went somewhat contrary to what was written in the bible, all the bible thumpers come out and....kneejerk junk.  *shrugs*  Whaddya want?  I've done my research, I've done my practice, my beliefs are formed of experience that would get me called insane for being far enough out of line with "normal" experiences of most folk.  And I havent even gone there!

Sensibel people never needed a marriage licence.     Whenb a man and a woman wish to marry all they need is to say their vows to each other in the prsence of their friends and family.      To pay the Government is absurd for a licence for this most private and sacred ceremony.      It is none of the Government's business.

Let the poor deluded people who thought this is what mattered, have it!     Let them go to the Goernment, pay for their licence and call it "marriage" (to do the degrading and depraved things they do if they like, it is not marriage and never will be).     They make themselves look like such fools - which they are anyway.

Well of course Dems didn't invent marriage licenses.   Napoleon imposed the practice in his civil code, in part to furhter weaken a remaining pillar of the ancien regime.  Law makers paid attention to foreign experimentation back then.   Dems did impose state marriage license requirements in the South amidst their campaign to resist the dictates of Reconstruction.

Biblical marriage is not a contract, it is a covenant.  In a contract you make agreement to receive something for giving something, in a covenant, you make no such arrangement. 

The Bible clearly defines the marriage covenant characteristics (men honor your wife, women obey your husband etal) and the few ways it can be dissolved (infidelity, safety).  Hence when the culture decides to define this oldest of man’s institutions based upon fallacious ideas with little historical basis, do not be surprised when a large portion of the believing populace disagrees and disobeys.

If I don't want to rent or sell something to someone, regardless of the reason, that should be my right.  They have the right to not rent or buy from me.

In the last century we have lost something very important.  The ability to live in our own home without having to "pay" someone to stay there.

When I was young, I built my own home.  Ended up selling it some years later and glad I did because the government forces people to pay property taxes or the house goes up for tax sale where I live.  That is bull shit.

In this modern era, if you have no coin you basically cannot "live" anywhere, yet animals in the wild can live somewhere for nothing.

Modern society is screwed up.  If you don't play the game, you are on the fringe and no one will have anything to do with you.

Yep. Agree 100%. Have seen the diversity posters promoting the nonsense in various corporations (most very large always do this) for several decades. Some have posters declaring 'Corporate Citizenship' as if a corporation gives a fuck about a nation rather than their bottom line.

I don't think he's a master of anything...I don't think he is intelligent, and I do not think he's some strategic social genius.

It is much easier to tear things down than it is to build them up.  To build requires creativity and inginuity and intelligence and persistence...a strong work ethic and a unyielding desire to progress.

To tear things apart, to criticize and to pit people against each other is easy and requires no skill...only evil desire.

Well, sad cretins like Obama can only ever excelling in cunning, never in true intelligence:

He can cunningly figure out how to get the most cocaine for the least amount of work, but he isn't intelligent enough to figure out how to be truly and deeply happy in life (ie: which requires the near-opposite of everything he opted to do with himself).

- That being said, as a manchurian candidate, he should have been abused as a child to make him so messed up he would turn into the pathetic puppet he is.  He is a pitiful guy.
