New Obama Initiative To Ban Guns For Some Social Security Recipients, Veterans, And Disabled

Whenever one thinks the Obama administration’s war on the Second Amendment couldn’t get any more insane, Barack Obama prances onto the stage to prove everyone wrong yet again.

This time, it is not merely a carefully planned and orchestrated jig on the graves of mass shooting victims or pathetic whining about “gun crime” and the amount of time he must give regarding the issue. It is a push to ban a large number of Social Security benefits recipients from owning guns.

That’s correct. When the Obama administration can’t get its way by attacking gun owners head on, it merely turns to extorting the elderly and disabled whom it holds hostage via their need to receive Social Security benefits – benefits I might add, that are owed to them.

Thus, the Obama administration is pushing to prohibit Social Security benefit recipients from owning firearms if they “lack the mental capacity to manage their own affairs,” a move which the Los Angeles Times reports would affect millions of people whose disability payments – for one reason or another – are handled by other people.

The idea is to bring the Social Security Administration under the jurisdiction of laws that regulate who gets reported to the National Instant Criminal Background Check System (NICS), a database that was initially supposed to pertain to illegal immigrants, drug addicts, and felons.

Of course, it should be pointed out that, with the exception of illegal immigrants, prohibiting American citizens who are not confined to a prison cell from owning weapons is itself unconstitutional. Clearly, the push to add the Social Security Administration and thus millions of SS recipients under this new policy is unconstitutional as well.

Nevertheless, it is difficult to remember a time when a Presidential administration even pretended to be concerned with what the US Constitution had to say about anything.

As the Los Angeles Times reports,

A potentially large group within Social Security are people who, in the language of federal gun laws, are unable to manage their own affairs due to "marked subnormal intelligence, or mental illness, incompetency, condition, or disease."

There is no simple way to identify that group, but a strategy used by the Department of Veterans Affairs since the creation of the background check system is reporting anyone who has been declared incompetent to manage pension or disability payments and assigned a fiduciary.

If Social Security, which has never participated in the background check system, uses the same standard as the VA, millions of its beneficiaries would be affected. About 4.2 million adults receive monthly benefits that are managed by "representative payees."

The move is part of a concerted effort by the Obama administration after the 2012 Sandy Hook Elementary School shooting in Newtown, Conn., to strengthen gun control, including by plugging holes in the background check system.

The Obama Administration and Social Security Administration have been crafting this new policy in relative secret. Finally informed about the issue, the National Rifle Association and the National Council on Disability are both opposing the initiative, the latter in opposition due to the fact that millions of disabled Americans will have their rights eviscerated as a result of this policy. Of the many enrolled who may be affected, disabled veterans are among the high risk category for having their Second Amendment violated.

Please tell your Senator to vote no on the confirmation of Andy Slavitt, a former Goldman Sachs banker, as this sounds like his handiwork.  He seems to have the President's ear right now.  United/Optum want to be the kings of mental health, they own tons of subsidiaries that do behavioral health analytics, tons of them.  They have since taken it down but the company wrote a 90 page report on how to raise your children with healthcare.  I had a former CMS employee point me to that one.  

Again, reading this certainly seems to be yet another of their efforts.  Why do you think they quit the AHIP health insurance lobby group and why do you think the remaining members hired Tavenner.  They are bit tired of the HHS/CMS monopoly with United Healthcare.  Slavitt by the way has some friends at the Center for American Progress aka the CAP.  You may have heard of them, Jonathon Gruber and Zeke Emanuel who wrote the famous article that after 75 you have no purpose and at that age he wants to die.  We all remember Gruber calling people stupid and this guy does the same thing.

He's smart and knows how to build financial models and is the guy Cuomo took down for cheating doctors with out of netwrork pay for 15 years, using some algos to low ball the gathered rates.  Even though he's no longer with United, HHS gave him permission to still work with United and Optum.  I'm telling you this sounds just like more out of his bag of analytics with wanting mental evaluations on seniors, veterans and more.  Of course, United/Optum with their large amount of subsidiaries that do behavioral health, it would mean more business to them.  United Healthcare behavioral health has been in the Silicon Valley area for a number of years, look them up.  They want as much of this business as they can get their hands on.  Again my opinion here but this is exactly where it sounds like this is coming from.

This is not exactly a laughing matter. I watched grown men tear the shrink wrap off a pallet of ammo as it hit the sales floor at Walmart a few months after Sandy Hook. They pushed and climbed over each other and grabbed as much as they could for themselves.

 

Around that time I counted as many as 300 people in line each morning at a local gun store. They were looking to buy anything that wasn't nailed down.

 

This happened (quite recently) in America, not Greece.

You DO NOT own your guns as PROPERTY is defined, understood, and protected under the second amendment. Look, RIGHTS are meaningless without a process of law to protect them. If the courts did not exist, the polical branches could run amuck with no one to stop them. But the courts and the constitution do exist. So a plan. A LEGAL FRAMEWORK had to be created to REMOVE the courts of law and equity from the question.

TO WHIT

There are two distinct groups or classes of people that handle firearms. The first class, Dealers and manufactureres engaged in licenced and taxable business/occupational privilege affecting the health saftey and SECOND AMENDMENT RIGHTS NOT EXERCISED BY THE LICENSEE. The second class? We the people upon which the second amendment protects. The first class subject to SUMMARY ADMINISTRATIVE REGULATIONS UNDER THE FEDERAL TAXING/COMMERCE POWERS ALONG WITH STATE POLICE POWERS APPLIED TO THE BUSINESS. The second class? Reasonable regulation of a fundamental right under protection of the courts of law and equity.

So which powers are YOU subject to and why? In steps the legal framework created by the federal gun control acts and amendments. Manu and dealers engaged in the PRIVILEGE are first and foremost subject to the federal taxing power under the license The USSC has confirmed this is the purpose of the federal license. They create a firearm. The PROPERTY subject to the EXCISE must be identified. The LAW requires serial numbers. Next the PROPERTY is TRANSFERED IN COMMERCE between MANU and DEALER. Summary administrative control over the property as it moves in commerce to insure the collection of the tax every step of the way. SUMMARY siezure and forfiture laws to take property for non payment of the tax or mere violation of the administartive rules associated with collection. Summarized. Summary control over property predicated on a plenary legislative power that poses a political question upon the courts.

And nextup, you. |You want the firearm? Great. Place the cash on the counter and walk away? Nope. The feds need to crawl up your ass. First up. BATF form. TRANSFER OF FIREARM. Fill it out and sign it. THE LAW requires you to admit (waiver) that you are in the same general classification as DEALERS and MANUFACTURERES. YOU did sign the form didnt you? Do any of you believe that the courts of LAW and EQUITY gives a shit WHO is subject to these summary and plenary powers along the chain of TRANSFER????? They do not. In the eyes they mean the EXACT SAME THING AND PLACE THE EXACT SAME RESTRICTIONS ON THE JUDICIARY TO ALL THAT FALL WITHIN THEIR SCOPE. AND NOW THATS YOU

 

FUCK the NRA and their fraud lawyers. AS confirmed by the USSC *see Sonzinsky v US) The second amendment has NO application to those that are subject to these powers within this context. YET the federal ACTS extend these summary and plenary powers against WE THE PUBLIC and these fuckers sit on their asses, play political games and collect millions from their misinformed supporters. As the pharma execs will tell you. Its much more profitable to repeatedely treat a disease than to apply the cure and walk away forever. And so it is.

So when the feds come for your guns in a summary manner or walk around the constitutions prohibitions against ex post facto laws(Charlie Pucket)..... now you know how. THE GOD DAMN PROPERTY WAS NEVER RELEASED FROM THE FEDERAL JURISDICTION AND IT NEVER WILL BE UNTIL SOMEONE PROPERLY INFORMS THE COURTS THAT THE DUE PROCESS CLAUSE HAS BEEN OBLITEREATED ALONG WITH THE RIGHTFUL STANDING OF THE PUBLIC TO REACH THE SECONDS AMENDMENTS PROTECTIONS.

All laws stand until properly challenged. Is the GCA of 1968 constitutional? NO. Do manufactureres and dealers have standing to challenge it? NO. Does the LAW as enacted and enforced place you in the same exact class as those beyond the second amendments protections? YES. Is there a remedy? YES. Has anyone anywhere come even remotely close to presenting the correct legal argument before a court that sits in a capacity in which it can hear those arguments? HELL NO.

Who cares about the legality? The soldiers from the BATF< IRS and local PD. The law will be enforced with deadly force if necessary. refeernce WACO and RUBY RIDGE along with a multitude of other examples

It does not matter. Refer to USSC precedent under the commerce clause. Did the firearm at one point move in commerce? YES? Your fucked. Under the ACT the federal jurisdiction is auomatically extended.

Same applies to in State manu. ALL of that activity is subject to the federal TAXING POWER. The commerce powers are applied to assist contol or movement of the property whether it crosses state lines or not. Look to the phrase IN OR AFFECTING INTERSTATE COMMERCE.

30 years and over 60,000 hours studying government process and constitutional law. What they are doing makes perfect sense. The remedy makes perfect sense. The courts cannot help us until properly activated. Again no one has come close.

George Mason feared that this day would come and convinced the Founders to include a "nuclear" option that allows the states to call a Constitutional Convention to reign in, or eliminate, the federal agent that they were creating.  Now is the time for the states to do what they have never been forced to do before.  Several states have already called for the Convention.  Ohio is in process.  Contact your state representative and strongly encourage (demand) that they get on board.  And, get active in your local militia in case D.C. refuses to folllow the law of the land should they be abolished.

As for guns, they will still permit handguns, of some types, but limit "long guns" of most types.

A bit of balance here:

 

Most European countries have tough, but varying degrees of, gun control.  No one is being rounded up and extermintated.

The UK has tough gun controls.  No one is being rounded up and exterminated.

Russia has gun controls.  No one is being rounded up and exterminated.

China has gun controls.  No one is being rounded up and exterminated.

India has gun controls.  No one is being rounded up and exterminated.

If you think that owning a gun is key to protection against being rounded up and exterminated, then think again.  Processes are underway right now in the States that will lead to just that - whether you have a gun or not.   People with guns are no match for people with tanks, bombers and missiles - keep that in mind. When the time comes for them to use these weapons, they will, without hesitation.  And that time is coming sooner than you think.

You really need to get focussed on broader issues that are potentially affecting your freedoms.  If Americans were half as protective about the rest of the Bill of Rights as they are about the 2nd amendment, they wouldn't be in the trouble they find themselves now.

You miss that outlawing ownerhip, and confiscation, of guns is a step process in anticipation of the day that civil unrest emerges. Due to the massive fascist corruption and theft that's going on, it's only a matter of time. "They" know that. Timing unknown, but it'll be long overdue when it happens.

But I take your point about the range of weaponry available on each side. That's why I've always thought that RPGs might be a better weapon to keep in the basement. And maybe a shoulder-launched missile or two.
