Hillary Clinton's FBI Investigation Is A "Criminal Probe": Post

Following the embarrassing Snafu two weeks ago, in which the NYT reported, then unreported, that Hillary Clinton had sent at least four emails from her personal account containing classified information during her time heading the State Department and as a result both the DOJ and FBI had gotten involved (with lots of confusion over what is active and what is passive voice) many were confused: was or wasn't the DOJ or FBI involved, and if not, why not? After all, there was sufficient evidence of enough negligence to merit at least a fact-finding mission.

Last night we got a part of the answer, when WaPo reported that what the NYT reported, then unreported, was in fact accurate: "The FBI has begun looking into the security of Hillary Rodham Clinton’s private e-mail setup, contacting in the past week a Denver-based technology firm that helped manage the unusual system, according to two government officials.

Also last week, the FBI contacted Clinton’s lawyer, David Ken­dall, with questions about the security of a thumb drive in his possession that contains copies of work e-mails Clinton sent during her time as secretary of state."

As a reminder, David Kendall is "a prominent Williams & Connolly attorney who defended former CIA director David Petraeus against charges of mishandling classified information." That Clinton has resorted to using him reveals just how far she thinks this could escalate.

As the WaPo further added, "the FBI’s interest in Clinton’s e-mail system comes after the intelligence community’s inspector general referred the issue to the Justice Department in July. Intelligence officials expressed concern that some sensitive information was not in the government’s possession and could be “compromised.” The referral did not accuse Clinton of any wrongdoing, and the two officials said Tuesday that the FBI is not targeting her."

Maybe that's true, or maybe that's how the Amazon Post was told to spin the narrative. However, moments ago a far less liberal outlet, came out with its own interpretation of the ongoing FBI escalation involving Hillary, and according to the NY Post, "the FBI investigation into former Secretary of State Hillary Rodham Clinton’s unsecured e-mail account is not just a fact-finding venture — it’s a criminal probe, sources told The Post on Wednesday."

The feds are investigating to what extent Clinton relied on her home server and other private devices to send and store classified documents, according to a federal source with knowledge of the inquiry.

 

“It’s definitely a criminal probe,” said the source. “I’m not sure why they’re not calling it a criminal probe.

Well, there are several reasons, one of which is that a presidential candidacy would be all but scuttled if they had to fight a criminal probe at the same time as they were trying to convince the rest of the US of their pristine moral character.

The DOJ [Department of Justice] and FBI can conduct civil investigations in very limited circumstances,” but that’s not what this is, the source stressed. “In this case, a security violation would lead to criminal charges. Maybe DOJ is trying to protect her campaign.”

Clinton’s camp has downplayed the inquiry as civil and fact-finding in nature. Clinton herself has said she is “confident” that she never knowingly sent or received anything that was classified.

As reported on July 24, the inspector general told Congress that of 40 Clinton e-mails randomly reviewed as a sample of her correspondence as secretary of state, four contained classified information. Post adds that "if Clinton is proven to have knowingly sent, received or stored classified information in an unauthorized location, she risks prosecution under the same misdemeanor federal security statute used to prosecute former CIA Director Gen. David Petraeus, said former federal prosecutor Bradley Simon."

Which also explains why she hired his lawyer.

The statute — which was also used to prosecute Bill Clinton’s national security adviser, Sandy Berger, in 2005, is rarely used and would be subject to the discretion of the attorney general.

 

Still, “They didn’t hesitate to charge Gen. Petraeus with doing the same thing, downloading documents that are classified,” Simon said. “The threshold under the statute is not high — they only need to prove there was an unauthorized removal and retention” of classified material, he said.

 

“My guess is they’re looking to see if there’s been either any breach of that data that’s gone into the wrong hands [in Clinton’s case], through their counter-intelligence group, or they are looking to see if a crime has been committed,” said Makin Delrahim, former chief counsel to the Senate Judiciary Committee, who served as a deputy assistant secretary in the Bush DOJ.

 

“They’re not in the business of providing advisory security services,” Delrahim said of the FBI. “This is real.”

To be sure, this may just be the Post trying to stir the pot with its "sources" ahead of what promises to be the most watched republican primary debate in history. But on the off chance Rupert Murdoch's outlet is accurate, then one wonders why and how did Obama greenlight such an investigation, whose blessing could only come from the very top.

And if the administration has decided to sacrifice Hillary, whose favorability numbers just plunged to the point she may not need outside help to prematurely end her presidential run, just who does the current regime have in mind for the next US president?

(a) Whoever willfully and unlawfully conceals, removes, mutilates, obliterates, or destroys, or attempts to do so, or, with intent to do so takes and carries away any record, proceeding, map, book, paper, document, or other thing, filed or deposited with any clerk or officer of any court of the United States, or in any public office, or with any judicial or public officer of the United States, shall be fined under this title or imprisoned not more than three years, or both.

(b) Whoever, having the custody of any such record, proceeding, map, book, document, paper, or other thing, willfully and unlawfully conceals, removes, mutilates, obliterates, falsifies, or destroys the same, shall be fined under this title or imprisoned not more than three years, or both; and shall forfeit his office and be disqualified from holding any office under the United States. As used in this subsection, the term “office” does not include the office held by any person as a retired officer of the Armed Forces of the United States.

 

Hillary Clinton willfully, unlawfully, concealed, removed, mutilated, etc... and that's just the first sentence.

Case closed, I recommend prison.

Right now, the obama administration is prosecuting a naval officer for shooting back at that guy who went on the shooting spree in TN because he had a personal firearm on federal property, but isnt prosecuting billary for lying under oath and deciding that rules that she agreed to don't actually apply to her while storing classifeid info on her own server instead of using the email system provided to her.

IIRC, Hillary did not engage in any attacks on Obama during his first campaign on the issue surrounding his birth place. In the interrm, we now know he uses a SSN that once belonged to a Harrison Bounel (SP?) who diied in the 80's . The SSN administration has gone to great lengths to hamper an investigation into this matter even though that SSN was issued in Connecticut as indicated by the 1st 3 digits (as a result of this incident the SSN administration changed how they issued numbers and now they are not traceable to a specific state). Also, as a result of Sandy Hook, the CONN state attorney general ruled that SSN's are not to be searchable on death certifificates, don't ask how that is related to Sandy Hook.

So, the question becomes IF Clinton can trace the FBI involvement to a "green light" from the Obama administration AND this results in her having to drop out of the race, does Clinton retaliate with a nuclear bomb disclosure that blows this administration out of the water with regards to his SSN. (oh please do it)????

My favorite is the Whitewater foreclosure on the dying cancer victim, who had financed some property and paid almost all payments, and when he went into the hospital with all the problems of cancer, they overlooked a payment.  As soon as it was brought to his attention, he paid what was owed.  Not good enough.  So the contract said they (we mean CLINTON) had the right to foreclosure and repossesion.  And that's what happened.  Cancer victim be damned.  She intends to own the WHOLE FUCKING WORLD.  So remember folks, vote for her twice, so you can get it right up the pooper.

How Bill And Hillary Handled Foreclosures

“What this crisis is at bottom is a total loss of trust,” Senator Hillary Clinton told Joe Scarborough and Mika Brzezinski on the MSNBC Morning Joe show Tuesday. “People don’t believe what they are being told, Americans have no reason to believe either their government or the Wall Street banks…”

“Human nature being what it is, people are going to test the limits,” of any system, she indicated, which is what we have seen. “Let’s get together, recognize that we need new frameworks that keep people from abusing either the public trust or the private trust.” …

These and similar pronouncements from the Clintons about protecting “the little guy” have brought to mind some excerpts we posted back in January from Peter Schweizer’s (oh so aptly titled) book, Do As I Say (Not As I Do), pp 106-109:

… Then consider the Whitewater investment. Forget for a minute about all the scandal associated with the word and the convoluted financing arrangements. Look at it for a minute as a pure investment—the biggest business venture that the Clintons had ever been involved in prior to the presidency.

Back in 1978, Bill Clinton was a popular Arkansas attorney general running for governor. He was campaigning as a reformer, an advocate of “consumer protection” and “rights for the elderly.” Like Hillary, he was concerned about unscrupulous “private corporations.” And as he has so often done in his public career, he made a point of claiming the moral high ground over his opponent.

An old friend and political operative, Jim McDougall, came to Bill and Hillary with an investment idea. He wanted to purchase 230 acres of land situated along the White River in the Ozark Mountains of north Arkansas and subdivide it to sell lots as vacation sites. McDougall promised huge returns, on the order of 20 percent a year. The Clintons thought it sounded like a great plan. Hillary in particular had high hopes for the property. While publicly criticizing Ronald Reagan’s tax cuts, she wrote McDougall in 1981: “If Reaganomics works at all, Whitewater could become the western hemisphere’s Mecca.”

The Clintons put no money into the investment. But Hillary, as an attorney in private practice, played an important role in establishing and running the venture. And what a venture it was meant to be. Whitewater was not designed as a regular real estate company. The plan was to sell lots, mainly to elderly retirees and middle-class families, by advertising in small-town newspapers. (They advertised several times in Mother Earth News.) Ordinarily, of course, when you buy a piece of land and finance the purchase, you receive a copy of the deed. If you start missing payments and can’t work things out with the finance company, they will eventually repossess the property. After paying off fees and debts, you will get back any remaining equity.

But the Clintons and McDougall did things differently. When customers wanted to buy a lot, they signed a simple purchase agreement. But this was no ordinary real estate contract. The small print at the bottom read: “In the event the default continues for 30 days … payments made by the purchaser shall be considered as rent for the use of the premises.” In other words, the buyers did not actually take ownership of their property until the final payment was made. If a buyer missed just one monthly payment, all their previous payments would be classified as rent and they would have no equity in the land at all.

This sort of contract was illegal in many other states, because it was considered exploitative of the poor and uneducated!’ One look at the experience of those who bought into Whitewater and you can see why.

Clyde Soapes was a grain-elevator operator from Texas who heard about the lots in early 1980 and jumped at the chance to invest. He put $3,000 down and began making payments of $244.69 per month. He made thirty-five payments in all—totaling $11,564.15, just short of the $14,000 price for the lot. Then he suddenly fell ill with diabetes and missed a payment, then two. The Clintons informed him that he had lost the land and all of his money. There was no court proceeding or compensation. Months later they resold his property to a couple from Nevada for $16,500. Hillary has always very indignantly maintained that she and her husband “did nothing wrong” with regard to Whitewater. After all, they lost money in the deal. But they have always avoided discussions about how the business was structured, and how it exploited the very people they have often professed to help. In the meantime, Sen. Hillary Clinton has gone on to champion the cause of going after banks and other lenders for “predatory mortgage lending practices.” In an amazing feat of moral dexterity, she cosponsored the Predatory Consumer Lending Act, claiming that mortgage fees are too high. (No, the law does not outlaw the type of financing scheme she was involved in.) …

Bear all this in mind when you hear Hillary shedding her crocodile tears about predatory lenders and unfair mortgage foreclosures.

The FBI has no discretion as to what it investigates. The United States District Attorney makes every single one of those calls as to where resources will be aimed.

So that the FBI stays on the reservation and away from crimes that the government doesn't want investigated.

The FBI choosing to run with a case or not based on politics rhymes with my experience in science. In that field, the NIH/NSF decide what topics are worthy of research, and people doing unrelated or, horror of horrors, antagonistic research lose their funding. And of course, the universities will not suffer a prof not bringing in research cash. BTW, when a prof brings in $1 million in research, $450k-$650k is eaten up in university admin fees.

I worked in renewables, and what caused me to leave on conscience was seeing that global warming, while real, is minor compared to issues that the NSF isn't giving much money to. GW is push so much not so much on truth, but more because it's an easy way to sell giving government power to dictate daily life. If much bigger issues like ocean dead zones or Colony Collapse Disorder were brought up, then ag subsidies and corporate farming practices would come under question.

It's not much of a stretch to say that pretty much every arm of the federal government is primarily political in purpose and function, with a good few turns happening by accident or to keep face.

Like I've said elsewhere, the most important votes are internal elections to decide who leads the major parties, along with what the plaforms are, and those elections are already done. The ones elected are the ones that the news media calls to get the 'expert insider opinions,' and as such are the people that the rest of the major party members get their instructions from.

In January we will get the final confirmation on who gets to be one of the two candidates. And by mid-January all the important votes will have already been made and the rest is just a show at that point. People are predictable, even if just 3-5% organizing in each state would flip nearly every election that mattered.
