Without Government, Who Would Force A Men's Barbershop To Cut Women's Hair?

Tyler Durden's picture

Submitted by Ryan McMaken via The Mises Institute,

A barbershop that is set up specifically to serve men, must now pay $750 dollars after a Pennsylvania state investigation into "discriminatory" practices on the part of the barbershop owners.

The owner, John Interval, was fined $750 after he declined to cut a woman's hair. According to Interval:

"I didn’t really consider it so much a discrimination thing as – it’s a barbershop... for guys. You know, I’m not opposed to doing women’s hair...just not in this shop. I don’t even have [the equipment] to do women’s hair." Interval said.

The potential customer, who was forced to endure the hardship of finding an establishment that cuts women's hair, filed a complaint with the state, and following a taxpayer-funded investigation and interview period with the barbershop owners, the state levied a fine against the shop.

The shop will pay the fine, of course, because to refuse to pay would likely bring armed government agents to the establishment to serve further warrants and additional methods of state coercion including fines, lawsuits, and possible imprisonment and/or impoverishment for the owner.

An alternative to this, of course, would be to allow shop owners to dispose of their own private property as they see fit. In the United States however, a business agreement (i.e., a verbal or written contract) does not require the consent of both parties. Instead, state and federal governments employ armies of government agents to force private individuals to enter into contracts where only one party has consented to participate.

Thus, in this manner, the government carries out its essential role in mandating hair cuts (or cake baking, or wedding photography) under threat of fines and other penalties.

If I was a barber that did not want to cut a woman’s hair, I would comply with the law…

But it would be the last time she would come to me for a doo unless she likes a little of the Goth look and my special hair gel which is a secret blend of STP and organic excretions…

in which case it would be recreation for me.

Agreed, though I think the shop owner did the right thing.

By playing the victim, he has probably doubled the number of men coming to the shop.

You simply can not buy advertising this good.

He spends $750 and gets sustained national media attention.

How did you come to the conclusion that the shop owner is playing the victim? He cuts men's hair for a living. Nothing about his operation suggests that he is also trained to style women's hair.
He is being ripped off for $750. And the woman who complained is an ass.

Hold uo Mr Divine. "Playiing" the victim. I believe he truly was the victim. I can do quite a bit c $750. If that is playing then I do not want to see serious.

I would be angry for a very long time based solely on the principle of the matter, or the lack thereof.

I went to a barber's shop for a haircut, but the guy did not know how to cut women's hair. He tried, but It was pretty bad. A barber does not need to deliberately mess up anyone's haircut. He will, because he has no practice in long hair.

That rebound scares me Miffed. The rebound reaction for women, gays, minorities, and sometimes even idiots. The rebound could be harsh. Judging people individually could be thrown out the window.

When I was a young man in West Texas ther were not many idiots, since an idiot could not feed his family and had to learn in order to survive. I could carry on a conversation with a man who was not that bright about doing a brake job or fixing a fence or working cattle. Today idiots are just that. They have never had to learn and they do not want to learn.

Will I help them? I am not sure.

But it seems that most of the  people I meet from California know how to do everything, so you should be fine. I am sure that civil servant can do brain surgery on you next week if you ask politely.

Technically therapeutic phlebotomy. Phlebotomy is just drawing blood. Mr tends to have a high ferritin level so he donates a few times a year. A lot of guys tend to be iron overloaded which can result in lots of health problems. One theory woman have the same rate of heart disease as men after menopause stems from this. Because the body has such a critical need for iron it has mechanisms to retain it, not excrete it.

If YOUR kid needs glasses, YOU pay for it. Just because I paid for YOUR Viagra and YOU didn't use birth control and couldn't avoid a paternity suit and child support doesn't make YOUR nearsighted kid MY problem.

The obvious thing to do is to graciously procede with the hair cut.

Then tell dirty jokes, fart, scratch, spit & hack, and give a haircut that would embarass a dog.  Simple solutions can usually be found to make people not want to return.

The baker in the news not long ago who did not want to be forced to bake a cake for a gay wedding should have employed a similar tactic.  Overcharge, or say your are too busy to make the requested deadline.  Or, take the order, then just not deliver.  When they started looking for the cake, say the work order was lost, or deliver a crude facsimle of what was expected.  In other words, just smile and fight fire with fire.  Hey, I was trying!  It wasn't my fault that I sneezed cut that 4 inch gap down the middle of her head.

funny story...  when my son was around 5 or 6 I took him for a haircut.  He usually had bushier hair and wanted to try something shorter.  At the time I had forgotten the numbering sequence for the buzz clippers.  The young lady recommended something like a #2 and I said ok.  The first pass wasn't on the sides or back.  It was right down the damn middle like a reverse mo-hawk.  No turning back from there.  The "oh shit" look on my face must have been priceless.

So, when it was my turn I has no other choice but step up and go for the #2 as well.  That way when I got home I was able to say to my wife "hey look what we did!"  The alternative of "so sorry" would have definately been a suicide mission.

He picked it up pretty quick, but the taste of the kerosene made him puke!

My Barber Story....

My sister took me to my first real haircut by a barber, she was 13 or 14 and I was 2 or 3 I think. I was apparently scared shitless and fought her all the way there (we walked). In any case, they sat me up in the chair on a piece of wood that straddled the chair arms, covered me in the bib thing and then broke out the buzz clippers to start. I closed my eyes (so I'm told, I remember nothing) and as soon as the clippers hit my head I pissed all over the wood, the chair and of course, myself. My sister was mortified and I was screaming like I was being killed - the barber made my sister take me out of the chair and then clean up which she did of course. My Dad took me the next day to a new Barber - Lou who I used for the next 12 years...

The story is my father went up to the shop after he got home from work and heard the story - my sister was more upset then me at this point, I was over it. Things didn't go well at the shop, my Dad was fined and taken to the station but not locked up - we had to pick him up - that I remember, he was really pissed. The barber shop was closed for several days afterwards, yeah my old man kicked his ass, but good - he deserved it, he treated my sister like she was a criminal - she was a little girl afterwall.

Definitely O/T too but I had to respond with my barber story since I enjoyed reading yours...

I actually went a to woman stylist for years before I bought a Flowbee, 20 years ago. The reason I switched was that the barber shop was so full of cig. smoke that you could cut it with a knife! Flowbee beats them both.

My wife goes to this place occasionally for manicures that has to be in violation of some code.  The fumes are so thick from solvents that I can barely even step in the place to buy a gift certificate.  A lit cigarette in that place would probably level a city block.

The solvent is probably acetone with some fragrance added. I don't know about the fragrance but acetone, aside from explosive, is a relatively harmless solvent. Of course too much of anything like alcohol fumes or carbon dioxide and you pass out or can die.The smell is very noticeable but ppms are probably low. They would have to spill a  half quart in a good sized salon before having to air the place out.

I've probably used a hundred gallons of acetone, including cleaning my hands and furniture from paint, shellac and varnish residue over 35 years. I'm in better health than most people my age and my brain neurons still fire up, well some of them :>)

It is too bad but Berkshares have had very limited success. You can exchange them for goods with some merchants and can swap them for Fed Res. notes at some local banks or the reverse.

No politician can represent or answer to you or anyone else as they don't know who even voted for them.

Secondly, if politicians represent the will of the people, then there is no need for politicians as they are just a proxy for our will. Only other scenario is that they don't represent the people, and therefore represent an invalid and illegitimate concept.

In a time and world of the progressive's making, we are supposed to be enjoying unprecedented tolerance, yet...we seem to increasingly have tolerance for no one or anything. The funny thing is that it is the progressives, the preachers of tolerance, who are the most intolerant and most likely to sue or protest or boycott anyone who THEY think is intolerant...people who largely just want to be left alone to live their lives without conflict or confrontation. THEY can't tolerate someone simply saying ..."no, I don't want to sell you a product or service". In a world that was supposed to be free, a world that was supposed to be free markets where BOTH the seller and buyer perceived they won, we now see the progressives again showing us that freedom is not our right or choice. We MUST capitulate to their every demand, especially if our choices are based upon some principle...a principle other than theirs, as only THEIR principle matters. Acting as our MORAL ELITES, defining the rights and wrongs we are no longer capable or allowed to discern.

Sometimes different groups are like oil and water. No matter how much you shake them, they will always separate.

Now, if you add something else, say, freedom, as an emulsifier you can obtain a stable outcome.

It is government force that causes the problems. It always seems that people tend to get along when there is no mandated rules about association.

It is when someone tries to use government force to achieve their goals that things go sideways.

Mon, 09/14/2015 - 18:13 | 6548383 Oldwood

Freedom, in a world of government indoctrination, is but another word for fear. We are taught to fear freedom, to fear those who extoll freedom, and especially those who live free.

We call them domestic terrorists.

People fear anything different, and those outside the hive ARE different. People desire consensus, the knowledge that what they are doing and thinking are the same as everyone else, all while celebrating their uniqueness as defined by the same but slightly different hair, cloths, phone, house, car, and tattoo. Looking at a herd of cattle, even within a given breed they look different from one another, yet they all wear the same brand. Indoctrination and continual marketing is our "brand" or at least for those living inside of the social hive.

NO, freedom ain't for everybody, or maybe even a few. What those of us who keep railing about what we see need to understand, is that WE are the minority, the odd man out in this. We are the threat to the beloved consensus, and even if we make our case, if we actually make others understand what they are facing, even then most will reject the message as its not what they want to hear, it does not fit their programming no matter how much sense it makes...and therefor is rejected...and we are rejected.

Just sayin

We do have the freedom to DIE for our freedoms. The reason we seemingly now have so few is because the price was too high compared to the other options available. We really sold out cheap when yo look back on it. We didn't have to die or even suffer much. WE simply had to resist the "something for nothings" and the constant fear mongering, not just against terrorists (foreign and domestic) but the fear of each other, of business and welfare queens and all the other extremely divisive shit they have been selling for decades. All while selling us pacifiers with borrowed money...trinkets of momentary pleasure.

True, Oldwood.  The barber shop owner could just refuse to pay the fine, gather up some freedom-loving freinds, and then dispense some liberty at 3,000 FPS when the government goons show up, Bundy Ranch style.

I don't know if we've reached that point yet where people have had enough and would rather die than deal with this, but maybe we're getting close.

We will get there eventually, but not by all for sure. I believe this has always been their plan...to press and squeeze, parsing out those willing and compliant from those hard-asses who will not, all for easy definition and vilification for removal/elimination. If you haven't noticed, it is these hard-asses that they deem as our greatest threat (after climate change of course). As we see the heat turned up, more and more will resist violently, giving our benevolent government all the reason they need to "crack down" effectively taking us deeper into a state of tyranny, where ALL freedoms represent imminent threat. There is no real effective response to this, as they well planned it. They will have effectively indoctrinated the masses into fearing the "crazies" screaming about lost freedoms, and will have their full support in every step of our imprisonment.

To not act is capitulation and to act is to advance their agenda. I think we are trapped, between bad choices...as always, except the choices just get worse. I honestly think the ONLY real choice we have, if turning this back is the goal and not just retaliation, is passive resistance. It would be the hardest choice by far, as it would require the continual turning of the other cheek. The easiest is to respond violently, as that is our first urge. But again, I believe that is EXACTLY what they desire....no, NEED.

We cannot beat them with violence.

Of course Gilnut you are very logical and as far as I'm concerned morally correct. The problem is that most people don't understand what it means to get a license to do something. In order to get a government license you have to agree to abide by all gov. regulation (I don't mean the American Constitution) while using the license. All gov. regulations pertaining to a license can change any time the gov. decides to change it. You give up fundamental rights to acquire permission from the government.

There are numerous licenses that people mistakenly think they must have in order to do something which they already have a right to do. In this case the government construes the "Barber" as a profession engaged in commerce. The gov. has a right to regulate commerce. If he was merely doing labor for agreed compensation which this could be construed as, he might win if he is willing to not have a license and take a suit all the way to the supreme court. Defending your fundamental rights is extremely costly and could take 5-10 years. By default the government prevails because no one is willing to spend half a mil.

It is a tricky legal question which has not much to do with common sense. It is contract law IMHO.

Gilnut, where did you go? Must have deleted his post.

Stop in the middle of the cut and say its time for a coffee break and take a half hour off.
