California Mayor Forced to Hand Over Electronics and Passwords at Airport – Compares U.S. to Nazi Germany

I briefly had to remind myself that this was not North Korea or Nazi Germany. This is the land of the Free.

Just in case you’re still under the infantile illusion that you reside in a free country.

Stockton, California Mayor Anthony R. Silva attended a recent mayor’s conference in China, but his return trip took a bit longer than usual. At the San Francisco International Airport (SFO) this week, agents with the Department of Homeland Security detained Silva and confiscated his personal cell phone among other electronics. According to comments from the mayor, that may not even be the most alarming part.

 

“Unfortunately, they were not willing or able to produce a search warrant or any court documents suggesting they had a legal right to take my property,” Silva told SFGate. “In addition, they were persistent about requiring my passwords for all devices.”

 

The mayor’s attorney, Mark Reichel, told SFGate that Silva was not allowed to leave the airport without forfeiting his passwords. Reichel was not present for Silva’s interaction with the DHS agents, either. The mayor was told he had “no right for a lawyer to be present” and that being a US citizen did not “entitle me to rights that I probably thought,” according to the paper.

 

Evidently, Silva was well aware of the situation and only had his concerns heightened by first-hand experience. Talking to SFGate, he briefly compared the government battle on privacy to notorious dictatorships worldwide.

 

“I think the American people should be extremely concerned about their personal rights and privacy,” Silva told the paper. “As I was being searched at the airport, there was a Latino couple to my left, and an Asian couple to my right also being aggressively searched. I briefly had to remind myself that this was not North Korea or Nazi Germany. This is the land of the Free.”

This is not what freedom looks like.

I had to travel to the states for a funeral. Left all my electronics at home.

Still spent for effing hours in customs. They pulled and went through every items in my luggage while they played a million questions. For hours later they told me I could go, and then expected me to track all the crash they took out and pulled up haphazardly.

I can only imagine the hassle if I wasn't Caucasian.

No. Just a skeptic. It comes from having uncovered lots of fraud and embezzlements over my career, and from having hung out with some politicians years ago.   Stockton went through a bankruptcy and the place is a gangland haven.  I would never live there.  While I agree that there should have been a warrant, I don't necessarily believe this guy is telling it like it is.

There has been a lot of "smoke" surrounding this guy.  The skeptic in me finds it difficult to believe there is no fire.

Even though Silva is a Republican, he must be a Hillary fan.  He has also used his personal email to avoid public scrutiny and has not turned them over. 

According to the records the city sent News10, Silva did not send a single message from his city email account for the entire months of May and June.  It's clear that he did send messages dealing with city business, but when he did, he used his personal AOL account or texted from his cell phone.  After more than two months, the city did provide some emails from the mayor's personal email account. Most were related to the mayor's recruitment of volunteers for an advisory committee. Those emails included a few dozen people congratulating the mayor on the election or saying they were interested in serving on the committee. Also, it is not the first time Silva was intentionally stopped at the airport.  He also was detained briefly for a much more limited search while going through customs in Sacramento this summer, at the end of a trip to Monterrey, Mexico.  It is all part of an ongoing investigation and I find it unlikely that he has no clue about an investigation considering it is the second time he was stopped at an airport.  It was an agent from Homeland Security that took Silva's electronics.  http://www.recordnet.com/article/20151002/NEWS/151009924?template=printart

And the limo incident was a bit more serious than just an argument. Silva's friend, Curtis Mitchell, was arrested for "bloodying a female companion [his fiance] and causing major damage to the vehicle." ... “Call Vinnie at the FBI and he’ll get me out of these handcuffs in two minutes,” Mitchell told officers, according to the CHP report. “Vinnie will make you pay. Don’t you know who I was with tonight? I was with the Mayor. He’ll take care of me.”   According to the report, two men and two women were in the back of the limousine when officers arrived. The CHP redacted names of all witnesses before releasing the report.  As he drove south, the driver said he began to smell marijuana smoke wafting from the passenger compartment and heard loud banging on the glass. I believe in minimal government especially the centralized kind. What I do NOT support is removing things that help the poor PRIOR to removing the parasites in power who have been destroying this country and making jobs scarce. I want the power elite's socialism done away with FIRST before we get rid of things like SNAP. Liberty is the freedom to be secure in one's person and one's psyche. This is well-trodden ground. The TSA officials may have been misinformed as to rights and responsibilities, which can be addressed with remedial training. But that doesn't mean we aren't all more secure in our persons and our psyches when they do their jobs, part of which involves securing all electronic devices, scouring said devices for information useful to security and safety.

I once had to hand over my iPad and I had a 3 time wrong password app installed that erased the tablet.

Everythings in the cloud so it only takes me 2 minutes to get it all back but when they asked me my passwords I just gave them 3 veriations of the password that where wrong so it deleted itself :)

I had a reason of course because the iPad was loaded with a shitload of downloaded movies and mp3's :)

And that's how people should just do it.

You have to file a claim against the individuals that took your property. They violated their oaths to support and uphold the Constitution. Your unalienable rights are your personal property and they were seized without a warrant. That supports a claim of damage to you property simply under the laws of equity. The problem with this is that with most countries (and possibly the USA) have a completely different set of rules for the border areas.

In other words, at a border crossing there are no rights or law other than what the federal border regulations prescribe. This is common. It sucks, however it is just one more area of loss of rights for the average citizen.

The weird part when I go to America is always the borders.

In Europe, those at border control are almost sleeping and when you want to talk to them they're looking at you with eyes that say "Leave me the fuck alone please"

You just walk passed them without problems, they're friendly, and if you pass the metal detectors they help you get your stuff and they're friendly and you can chitchat with them and make a joke.

The last time I travelled through US from Europe to Canada was THE LAST TIME I TRAVEL THROUGH US.

Spent 9 miserable hours in the shit hole known as LaGuardia having suffered a shuttle bus from JFK. The shuttle experience felt like I was in a comedy show where nobody was laughing. Entering US as a Canadian was bad enough, but watching the BS the Europeans had to deal with made me glad I wasn't in that line. Miserable fuck border control dude just tried to stare me down, fucking arsehole. Got to Canada - at least the border control guy hadn't had the nerves to his smile muscles surgically severed - actually said 'welcome back to Canada'.

I've found the most pain-free way to fly into The Homeland is via Vancouver BC.

Vancouver obviously is not the USA, but the Canadian customs and border guys are reasonable, and with most onward flights to the USA, you are cleared by American customs/border guys operating within the Vancouver airport, where they seem to largely lose the bad-ass attitude that their colleagues often have in LA or NYC.
