When You Use A Smartphone In China, You Agree Not To...
When US consumers purchase a new smartphone, be it Apple or any other brand, it is safe to say that nobody ever reads the Terms and Conditions of the user agreement for one simple reason: at well over 50 pages, and without anyone having gone to prison for failing to read it, it is considered a colossal a waste of time.
For Chinese smartphone buyers, however, the situation is quite different.
As the following snapshot shows, failure to not only read but abide by the very strict demands of any given user agreement may lead to harsh penalties, prison time, or even worse for infractions such as:
- Opposing the basic principles determined in the Constitution of the People's Republic of China;
- Endangering national security, leaking state secrets, subverting the government, and undermining national unity;
- Harming national honor and interests;
- Inciting ethnic hatred or ethnic discrimination, and undermining national unity;
- Undermining national religious policy, promoting cults and superstitions;
- Spreading rumor, disturbing social orders, undermining social stability;
- Spreading obscenity, pornography, gambling, violence, murder, terrorism or instigating others to commit crimes;
- Insulting or slandering others, infringing upon the legal rights and interest of others;

No, the Chinese terms are honest if suppressive. The terms and conditions you'll find for Apple etal are basically your signing away your rights in the most destructive way possible with lawyer speak of the most opaque kind. But not to worry, TTP will make it MUCH worse....

I never wanted my cell phone, but my wife insisted for my and our kids' safety when I'm driving, and as a leash (my assessment). If terms ever came into existence like these, I'd cancel my plan and smash the phone.

Speaking of cell phones in China, I was on the train to Dandong (across the river from the DPRK, and a super, fun fascinating place to visit), and I had three cell phones stashed in my hoodie, which was on the shelf above the head of a hapless passenger. I reached above him to grab it, and TWO of the cell phones fell out of the pocket, and hit the poor fellow right on the noggin'! Aghast, I covered my mouth and exclaimed, "Dui bu qi! Dui bu qi!" ("I'm sorry!"). He looked at me, noticed I was a foreigner, got a big old grin on his face, looked over at my traveling companion / translator, and asked him, "What country is your friend from?"
