Snowden Vindicated As Judge Slams "Unconstitutional, Orwellian" NSA Bulk Spying

On Monday, a federal judge ordered a halt to the NSA’s bulk metadata collection program in a reiteration and confirmation of a previous ruling that found the practice “unconstitutional” — and even “Orwellian.”
“This court simply cannot, and will not, allow the government to trump the Constitution merely because it suits the exigencies of the moment,” stated Washington, D.C. District Court Judge Richard Leon in his mordant 43-page ruling.
Edward Snowden immediately hailed the decision, pointing out significant passages from the court to his millions of Twitter followers. Of particular importance — and, indeed, at the heart of both known and potentially unknown domestic spy programs — remains the impossible reckoning between Fourth Amendment protections and the government’s claims of a national security imperative.
“Moved by whatever momentary evil has aroused their fears, officials — perhaps even supported by a majority of citizens — may be tempted to conduct searches that sacrifice the liberty of each citizen to assuage the perceived evil. But the Fourth Amendment rests on the principle that a true balance between the individual and society depends on the recognition of ‘the right to be let [sic] alone — the most comprehensive of rights and the right most valued by civilized men,’” the ruling stated, with emphasis added by Snowden.
In another tweet, the whistleblower summarized the ruling: “Judge rejects government claim that so long as you aren’t targeted individually, dragnet searches of your life are OK.”

Though Leon’s judgment arrives mere weeks before metadata collection would naturally end under the USA Patriot Act’s Section 215 upon implementation of the newly passed USA Freedom Act, he emphasized potential implications of any undue delay in bringing such spying to a close, stating:
“In my December 2013 Opinion, I stayed my order pending appeal in light of the national security interests at stake and the novelty of the constitutional issues raised. I did so with the optimistic hope that the appeals process would move expeditiously. However, because it has been almost two years since I first found that the NSA’s Bulk Telephony Metadata Program likely violates the Constitution and because of the loss of constitutional freedoms for even one day is a significant harm […] I will not do that today.”
In other words, the judge harshly repudiated the government’s already poorly disguised emphasis on national security to justify bulk collection as wholly secondary to the individual’s right to privacy under the Constitution. Leon’s 2013 ruling was struck down in August this year, when an appeals court found the plaintiff in Klayman v. Obama had not established the legal standing necessary to dispute the constitutionality of the NSA program. Once amended appropriately, the judge was able to make a ruling on the original case and issue an injunction to halt bulk collection.
In this ruling, Leon sharply admonished the appeals court for its reversal, saying:
“Because the loss of constitutional freedoms is an ‘irreparable injury’ of the highest order, and relief to the two named plaintiffs would not undermine national security interests, I found that a preliminary injunction was not merely warranted — it was required.” [emphasis by the judge]
Seemingly irritated at the insult of the government maintaining its position on the necessity of bulk collection while ignoring the preceding twenty-two months to find less invasive means to achieve the same goal, Leon searingly stated:
“To say the least, it is difficult to give meaningful weight to a risk of harm created, in significant part, by the Government’s own recalcitrance.”
Pointing out the painfully obvious, Leon derided fictitious claims the government needs bulk data collection at all, considering the program thwarted exactly zero terror attacks throughout its entire duration. In rebuttal to claims the contentious NSA program remains reasonably effective, the judge flatly stated:
“This is a conclusion I simply cannot reach given the continuing lack of evidence that the Program has ever actually been successful as a means of conducting time-sensitive investigations in cases involving imminent threats of terrorism.”
Pulling no punches, Leon concludes with a scathing challenge to the naïveté and blind acceptance Congress mistakenly presumed the public and court would give the contentiously invasive program:
“To be sure, the very purpose of the Fourth Amendment would be undermined were this court to defer to Congress’s determination that individual liberty should be sacrificed to better combat today’s evil.”
Employing linguistic subtlety which, at times, borders on a verbal smackdown, Judge Richard Leon brilliantly sent the NSA, Congress, and rest of the government a message that couldn’t be denied this second time around: Nobody buys your bullshit.

What a courageous Judge! He is now in my top 5 list of heroes. As an attorney, I can tell you he is rare among jurists. What an incredible man. I went to Law school in Washington. I do not agree with the speculations here that anybody in government that is no longer towing the line will get a nail gun. The society has been ripped apart socially but that doesnt mean it stays this way. People around the world reseing this should know we Americans are openly mocking ourselves with a lot of satire such as on Saturday night Live. Now that is what our 1st amendment allows us to do. If the one truly fails the second one becomes the recourse that is the gun recourse. The reason why we havent used it is we still operate to at least a limited effect to free speech.

This is a good ruling, good news. Now I do see a lot of societal problems accelerating in emergence. Once bright people that are productive are losing it, like in mentally spacing out like as in you send them emails and it as if they dont really read or understand them or ask for the samr thing in business the very next day like if the two of you had never spoken. Your comment that we can still say what we want is true but some what irrelevant. It is true that the police won't come and drag me away for stating my position as contrary to the government's position, but at the same time we individuals have no access to media and politicians or any other venue, so "say all we want" -- while indeed allowed -- doesn't get us anywhere. In fact, being left to say anything we want is a kind of distraction because it keeps people from realizing they are utterly without a voice concerning important matters. If the police came and dragged someone away for wanting a say in important matters then everyone would learn something important. But by destroying the channels for discussion via media ownership and propaganda -- and by control of the election process, this being 100% the case -- we are left to say all we want without actually being a threat to the oligarchs running the country, passing laws they want, buying politicians, etc. This whole process is extremely subtle, and most average people would have no idea it is already in full operation. Even intelligent people who should be able to see the situation remind blind to it, they keep think they'll vote their way into a better world some day. Totally not happening ever forever.
As things proceed just as they are, and without any other thing changing, I don't think we will ever see a better day, not without a very massive and highly destructive class-based civil war. We would need to at least murder the entire upper 1% of the elites, just cut them down entirely, murder their families and destroy their institutions, reverse all their policies they bought, end their perks and advantages, silence their media propaganda empires, drag their corrupt politicians out of their cozy lairs and throw them into the sea to drown. It would be a million times worse than the French Revolution "terrors". But the elites own the police and military, who do their bidding at the drop of a hat, there is no chance at all -- zero -- of changing that ever. So Americans would have to fight their own police and military forces in the streets at great and universal loss of life before they could even start to lay their hands on the 1% and their running dogs in Washington. Americans simply will not do it. No chance. Just would not. By the time Americans are in enough trouble to raise themselves off the couch, it will be too late and they will be under constant government surveillance 24/7. It is already nearly to that point.
I think I know how this will end. None of the above need transpire. It will end when it needs to and for reasons that nobody here would even start to understand. But it will end.
So I have that to look forward to. SHould I live that long. And I might.

No contract in Common law is valid unless it involves an exchange of "good & valuable consideration." Unpayable debt transfers power and control to the sovereign power structure that has no interest in money, law, equity or justice because they have so much wealth already.

In 1933, the federal United States hypothecated all of the present and future properties, assets and labor of their "subjects," the 14th Amendment U.S. citizen, to the Federal Reserve System.
In return, the Federal Reserve System agreed to extend the federal United States corporation all the credit "money substitute" it needed. Like any other debtor, the federal United States government had to assign collateral and security to their creditors as a condition of the loan. Since the federal United States didn’t have any assets, they assigned the private property of their "economic slaves", the U.S. citizens as collateral against the unpayable federal debt. They also pledged the unincorporated federal territories, national parks forests, birth certificates, and nonprofit organizations, as collateral against the federal debt. All has already been transferred as payment to the international bankers.
Unwittingly, America has returned to its pre-American Revolution, feudal roots whereby all land is held by a sovereign and the common people had no rights to hold allodial title to property. The Great Patriotic War: The most terrible war in history in which tens of millions of Soviet citizens of all nationalities perished, many of them exterminated solely for their ethnicity or religion, thousands of villages and cities were razed to the ground, and cultural wounds still felt today were created. Russia commemorates the solemn event of Victory day by totally monopolizing the Soviet struggle, making state-funded films which are insulting to veterans and actually make the Germans look better than the Red Army, dressing up little kids in soldier uniforms from a war they know nothing about, making body art, putting on a WWII-themed dog show and various other bizarre spectacles, and of course- selling shit. Russia reserves the right to lecture any other country on the topic of the Great Patriotic War, in spite of the fact that Russia is nothing like the USSR and the values of its modern government are far closer to those of Nazi Germany or Fascist Italy than the Soviet Union.

Whether the search is a 'hue and cry' search (general warrant) or simply mass surveillance of a type not possible 200 years ago, they are ripe for abuse. General Warrants, then much as TSA, NYC's 'Stop and Frisk', NSA, National Security letters, etc today, become simple objects of political power, theft, and graft.
The majority of people in these agencies who support mass surveillance, do so sincerely from pure motives. But if only 1 in 100,000 of them sees it as an opportunity to exercise power, theft, blackmail, etc, then they will have severed the indispensible bond of trust which allows a common government to exercise authority more or less by consent rather than by force.
And make no mistake, as so many often do, no government can withstand popular non-support, much less enmity. None. When they try to supress such dissent, their enforcers turn. Their revenues disappear. And calamities befall such governments from every angle...precisely because those from whom they draw sustenance have a million ways of making compliance a net loss to the government.
At the same time, the security provided by such general warrants is illusory. It provides them not with a needle in a haystack, but a needle in a stack of needles... and no realistic way to get the right needle to the right action officer in any kind of timely manner.
Yet...security...
To be alive means to be continually resisting death. There is no such thing as security in this world, only actions meant to focus confrontations with death to certain times of life, or certain situations.
We are mortal. To secure oneself against one threat, is to expose oneself to another.
