Feds Illegally Maintain Registry Of Firearm Owners; Media Fails To Report It

One of the largest fears of firearm owners is the prospect of a database of their names and personal information in the hands of the federal government. The idea of the government in possession of a list of gun owners has been one of the most opposed proposals in the gun control debate. The stiff opposition is linked to the justifiable fear of the government using such a list to confiscate firearms by force.

The idea of registering with the federal government brought such stiff opposition that when the National Instant Criminal Background Check System (NICS) was instituted, the law specifically prohibited the collection of data about legal gun owners and the implementation of any kind of registry. The law reads in relevant part:

“The NICS, including the NICS Audit Log, may not be used by any Department, agency, officer, or employee of the United States to establish any system for the registration of firearms, firearm owners, or firearm transactions or dispositions, except with respect to persons prohibited from receiving a firearm by 18 U.S.C. 922(g) or (n) or by state law. The NICS Audit Log will be monitored and reviewed on a regular basis to detect any possible misuse of NICS data.”

In plain English, unless a person is prohibited from owning a firearm, their information cannot be retained. However, a recent Washington Post article parroted the Government Accounting Office’s numbers related to firearms purchases:

“Between 2004 and 2014, suspected terrorists attempted to purchase guns from American dealers at least 2,233 times. And in 2,043 of those cases — 91 percent of the time — they succeeded.”

Upon first reading, many Americans might be glad the authorities are keeping an eye on those potential terrorists in our midst. Of course, the facts are a little different. The term “suspected terrorists” in this case means somebody on the combined terrorist watch-list. These are people that may have never been convicted or even charged with a crime. The list has expanded so much that there are around 700,000 names on the list. They include a number of journalists, former Department of Justice ethics adviser Jesselyn Radack, Nelson Mandela, and the list of non-terrorists and false positives goes on forever. Known nonviolent activists have been added to the list because there is no real justification required to be placed on it, only a “reasonable suspicion.”

Even more disturbing is that to make the matches, the government must retain records on everyone, or at least have every purchase in a supposedly confidential system scanned. That data is being shared within the government, contrary to federal law. When the FBI released its figures, it went as far as saying that 2,000 known or suspected terrorists bought a pistol, sports rifle, or assault weapon. This means they are collecting information about the types of purchases as well. Just matching a name to a list would not be enough to come up with accurate data. This means the NICS program, which was promised to be free from other agencies, is sharing personal data such as name, date of birth, address, and social security number.

To be very clear, the NICS system is retaining records of legal purchases, it is sharing that information with other agencies, it is retaining and sharing information containing enough detail to match the purchaser to a government created list, and now the US government is publicizing the fact that it is doing this even though it is a violation of federal law.

This comes at a time when the government is making another power-grab for firearms. If we can’t trust the government to obey its own laws, how can we trust them with more power? This revelation leaves those seeking sensible reform to a shoddy gun control system in the lurch. It has become clear the only way to avoid having your firearms purchases tracked and registered by the federal government is to exploit the “gun show loophole” so many want to close.

A list of news outlets parroted the government’s release of information without questioning where the data came from and the legality of it be recording. Whether you agree with the concept of gun registration or not, the failure to report the dubious origin of the data demonstrates either poor journalism or complicity in pushing a government agenda. Those outlets include: The Washington Post, Newsweek, CNN, the New York Daily News, CBS, and dozens of others.

The courts have been a significant part of the problem over the years. The 2nd amendment is either a right which cannot be infringed (limited, curtailed, legislated away etc) or it is not. There is no ambiguity about it.......

The government has given itself the right to assume you gave up your Constitution in order to become a statutory citizen of DC /the 14th amendment. You have to forcefully rebut the assumption in court. It has to do with your unlimited right to contract or not to contract. Since almost no one understands the government must have your consent to limit your rights, . gov gets away with it by intimidation. Everyone assumes the government understands their limited authority and uses it properly. That is mutual ignorance of assumptions.

If you don't go to court to claim your rights and just ignore the illegal theft of your rights it could get you murdered.

I attended the CPAC Liberty Forum at the Omni Shoreham on February 27, 2009. One of the keynote speakers was a guy by the name of Larry Pratt. He had this 'strange' idea that the NRA was involved in gun control legislation, and had decided to found the Gun Owners of America as a 'counter-revolutionary' tactic/true conservative measure.

These OTHER radicals, like Tom Woods, Bruce Fein, Andrew Napolitano, and (GASP!) RON PAUL were there as well. The Hampton Room was filled to overflowing, with people lined up in the hallway all the way to the lobby watching on T.V. sets (that couldn't get in).

That trip cost a shitload of FRN's but IT WAS WORTH IT. I stayed at the State Plaza Hotel, and got to see the Watergate, and everything.

My gun and I were having this discussion the other day, and she told me OUTRIGHT that she kills people. After I unloaded her, she told me that it wasn't 'fair', because she felt like I was a 'sexist' (and called me a rayciss). Last time I saw her, she was out on the street, hustling to score what she calls 'rounds' from Eric Holder and the Mexican Mafia Cartels, and called me names, threatening me with 'Fast And Furious' payback.

Needless to say, the divorce was finalized, and I now have a NEW gun, who has told me that she won't kill people unless I SAY SO. She's slighly jealous of my other guns, but is taking it in stride (I lied to her and told her that I was a Mormon, and Mormon males have MULTIPLE guns that they truly love).

So, why hasn't your coveted little NRA already filed charges against the .gov for breaking the law? This one should be cut and dried, right. If we can't stop them from keeping names (registry) then we can't stop them from anything.

The time to act is now. Who is a lawyer that wants to file charges. I will use my name in this suit (or others for a class action) if we feel our name has been kept in defiance of Federal Law (I have bought a few guns in this timeframe).

When I read his book, I read, over and over, this and similar passages. The above dynamic, and his equating those who never fought back, like sheep to the wolves, really shook me. Some of my smartest, closest pals, give me such a strange look when I calmly state that our own government needs a check against it via gun ownership. Yes, I know my local cops who have bought surplus tanks and weapons from the MIC will flatten me, but my ownership has to mean something, right? People in my nation may be the single most imprisoned slaves on the planet with all of the intense tracking, calls/emails/records collection, cameras etc. And, don't dare try to rattle your sheep friends from their material induced trances. Like a dog eating at a bowl, they'll snap their jaws at you for messing with their impulsive ecstasy. What a fucked state of affairs.

IF "suspected" terrorists are purchasing "assault weapons" (i.e. military weapons capable of full automatic fire; machine guns) which require an extensive background check and a substantial payment to obtain a Class 3 weapons permit, it is either due to very sloppy background checks or an effort to do a sting setup on that person.

I live in a country with only one gun store - and it is an army base. Citizens and residents must be verified to not have a crimminal past to purchase a weapon. I don't know what sort of weapon selection there is. After purchase they will give you a few day's pass to get your weapon home (for self protection) where it is supposed to stay. You CAN get a concealed weapons permit - but I don't know the specfics.

eh, this is gonna get hyped, but in reality it doesn't matter all that much.  with the number of guns out there, they are not going to be taken away anytime soon.  absolute worst case, they profile people and use "they have guns" as an excuse to send in the swat team... but they are doing that now anyways.

 

if you're worried about gun restrictions, just buy more guns.  just be responsible and keep them secure obviously.

No gun show or background check necessary.

 

Some guns get resold a dozen times by dealers as well as privately. Good luck with that.

Inasmuch as you've done no violence, try to think of the reason.

Third,

Understand that the sooner you decide to ACTIVELY say no, to organize for physical resistance, the less likely it will be to come to that.

They have nothing that can overcome 100+ million armed citizens who have organized to say no.

It takes time and resources to mobilise such a force. You will not be surprised to know that population surveillance is a very high priority in the US, and any hints of such "insurrection" will be quashed very quickly.

Whilst there may be some who ARE willing to go the whole mile, the "Ruling Elite" know from past experience that "setting an example" - show trials, deliberate slander, are very effective in "managing" popular opinion.

If things become too "uncomfortable" escalation to "State of Emergency" and / or "Martial Law" will be very likely outcomes, and those who depend on Uncle Scam for their daily bread will tend to "follow orders", since they will already have had the "consequences" of "disobedience" explained to them - in graphic detail.

If you have a concealed carry permit you're on the list.  If you buy ammo with a credit card you're on the list.  If you buy a hunting license you're on the list.  If you check out the Gander Mountain or Cabella's website you're on the list.  

All of your purchase history, browsing history, medical history, tax history, banking history, motor vehicle history, real estate history, legal history, etc. is stored on the NSA database cross referenced by your SSN.

Don't be so certain of that.  We have Spies.  95% of the people working for the government are not "officers".  They are not bosses, they don't make policy, and most of the time they don't LIKE policy or agree with it.  And when decisions are made that they don't like, they go home and TALK.  Word like that gets around, more easily now that we have internet.  Ed Snowdon and Chesea Manning weren't the only ones who spilled lots of government beans, they're just the ones who did it in huge, public data dumps.  Plenty of trial balloons and intended operations have been pulled back and disavowed because the Conspiracy Theorists started talking about them.  For instance, the little plot The Shrub had to declare a National Emergency and remain President-For-Life was a near thing -- the concentration camps had already been prepared for the inevitable "dissidents".

I worked as a design consultant for one of the largest computer technology companies, on every kind of project and system in government and business globally, so I am speaking of real experience.

This is how AGGREGATION works:

ALL of the systems, government and business, that ask for information to identify an individual for purposes of providing any kind of service, collects and stores (as in KEEPS) ALL of the data that is involved in the transaction, and I mean KEEPS ALL THE DATA, even if the service that you are requesting is denied or otherwise not provided.

Then ALL systems either sell that data to others for further AGGREGATION, or they themselves combine the data that they have collected with ALL the other data that they can gather through licensing agreements, purchases, sharing agreements (especially common with government organizations) to AGGREGATE as complete a data set on every individual as possible. This data is worth BIG $$$$.

The largest and most valuable data collections are owned by Experian, Equifax and Transunion.

One of the Laws that I live by is that I do not give my SSN to anyone other than IRS, Social Security Admin, my banks and my brokerages - *NEVER* to any other kind of business or government organization. Cops stopped me once and asked me for it and I refused, gave them my out-of-state driver's license only. If you give out your SSN, you are tracked even more closely than with military-grade GPS.

I have some bad news for you. Your SSN is in more databases than you realize.
I refused to give it to get utilities turned on when I moved to another state. The service guy got so of my other info, such as name and previous address and then told me what it was.

A insurance agent that I was friends with also did the same thing.

This stuff really pisses me off.
I would love to sue Experian and the other credit agencies to force them to purge MY data.

You are correct. However, knowing how the system works, ie designed to vacuum up, correlate and aggregate every piece of data encountered, I designed and injected transactions with invalid and corrupt data about me, including SSN, into the databases operated by the 3 core aggregators/violators. There are ramifications to this, for which I developed adequate work-arounds, but these privacy violators no longer have valid/accurate data on the real me :-))

The EU Constitution has a clause which provides the "right" to data privacy, ie you can demand that businesses reveal what data they have on you and you can demand that they destroy it. In the USA, the partnership initiated between business and government under the first Drug Tzar has been expanded to the point that there is no longer any practical difference between corporate and business databases on residents, and you not only have no "right" to privacy, but are actually prohibited by federal law from having privacy. Also, the companies that have your data actually legally own that data, eg your name, address, SSN, DOB, etc - not YOU - it is their legal property, not yours.

What the Feds have is a  record of your background check and where it was called in from. The dealer who called it in has a form with the details of what you bought. The Feds can review these records without notice. If the dealer goes out of business, the feds get the records. We are  screwed
